1. Qualifcations/Expertise of Firms on Team

The Washington Department of Transportation (WSDOT) can look to Tierra Right of Way Services, Ltd.'s (Tierra's), local team of experts as a trusted partner to deliver high-quality right of way services

ethically, professionally, and in a timely manner. We pride ourselves on creating cost-efective solutions and contributing positively to the communities we serve. We are very pleased to ofer our services to WSDOT's NW Region for necessary right of way services in the delivery of multiple fsh passage and connecting Washington projects throughout the region.

We believe that when the relocation or acquisition process begins with communication—when our Agent educates the property owner about the process and the public benefts of the project— negotiations will result in more win-win outcomes. By following this philosophy, Tierra has achieved a 95 percent success rate in completing acquisition assignments without the use of a client agency’s eminent domain powers.

Tierra has provided real estate consulting, right of way acquisition, relocation assistance, and cultural resources services throughout Washington State since 1993.

Our team maintains current knowledge of the specifc regulations and requirements of the Federal Uniform Relocation Assistance and Real Property Acquisition Policies Act (the Uniform Act), WSDOT Local Agency Guidelines (LAGs), Revised Code of Washington (RCW)Chapter 36.57A & 8.25, the WSDOT Right of Way Manual, and the Washington Administrative Code (WAC) 468-100. In fact, our Operations Manager, Leslie Findlay (Beaird), is a former WSDOT employee who assisted with writing many of the chapters in the WSDOT Right of Way and LAG Manuals, has worked on many FHWA-funded projects.

Tierra's team has a proven history of successfully completed projects performed under a variety of funding sources, including the Federal Highway Administration (FHWA), the FTA, the Federal Aviation Administration (FAA), the Transportation Improvement Board, and the Transportation Improvement Project, as well as local funds and other grant sources.

We encourage and support staf participation in professional organizations, such as the International Right of Way Association (IRWA), and ongoing education regarding industry regulations and changing laws.

Recent Related Firm Experience

From obtaining Rights of Entry to purchasing land or easements, Tierra’s work on right of way projects in Washington has earned us favorable relationships with public agencies throughout the state. Tierra’s work for many of these agencies has required strict adherence to the Uniform Act, WSDOT LAGs, and all Federal funding stipulations. In addition, Tierra has also worked productively for numerous local engineering frms and private clients in support of their projects throughout Washington. The following projects are similar in terms of complexity and magnitude to the WSDOT’s Fish Passage and Connecting Washington Projects General Real Estate Consultant contract. The individuals listed as references have submitted references on Tierra's behalf and can be found in Part B of this submittal.

Right of Way Services for CRP 5643, Pierce County, Washington, 2018–Present (pictured below)

Tierra was contracted by Pierce County to provide right of way services for 28 acquisitions,10 relocations, and appraisal services in support of the CRP 5643: Canyon Road East Northerly Extension, Pioneer Way East to 52nd Street East project. Canyon Road is a major north-south corridor, and its planned improvements from Pioneer Way East to 52nd Street East are intended to enhance safety and relieve trafc congestion. This project is Federally funded and includes the following improvements: constructing a bridge over the railroad mainline; expanding and extending Canyon Road East to two lanes in each direction with turn lanes at intersections; building concrete curbs, gutters, and sidewalks; constructing an enclosed storm drain system and stormwater treatment and storage facilities; installing a new trafc signal at Canyon Road East/Pioneer Way East; constructing a wetland mitigation site; and closing the existing 52nd Street East at-grade rail crossing. Tierra will assist with the WSDOT certifcation of this FHWA-funded project. This project is an example of the use of multiple appraisers from our proposed team due to a compressed project schedule.

West Fir Street Rehabilitation Project, City of Sequim, Washington, 2017–2018 Tierra assisted the City of Sequim in acquiring temporary and real property rights for 23 parcels consisting of residential, commercial, and government ownership. Permanent and temporary property rights were necessary in order to construct a 2,500-linear-foot section of West Fir Street, between 5th Avenue and Sequim Avenue. This project is in support of a Federal Highway Administration (FHWA)– funded transportation project with oversight administration by the WSDOT Local Programs Ofce. Upon completion, Tierra will assist in acquiring WSDOT certifcation for the project.

10th Street NE Reconstruction Project, City of East Wenatchee, Washington, 2018–Present

Tierra was contracted by RH2 Engineering to provide acquisition services using procedures specifed by the City of East Wenatchee and in accordance with the Uniform Relocation Assistance and Real Property Acquisitions Policies Act of 1970, as amended (Uniform Act), and the WSDOT Right of Way manual. This project will transform this corridor into a safer and more user-friendly pedestrian and bicycle route linking a dense residential area to the eastern side of the commercial center of East Wenatchee. There are over 500 households in the immediate neighborhood that will have improved direct access to public transit facilities and the downtown area.

Judy Reservoir to Mt. Vernon Transmission Pipeline, Skagit PUD, Washington, 2018–Present

Tierra is currently assisting the Skagit Public Utility District (PUD) in acquiring dozens of temporary and permanent easements and utility crossing permits in support of a planned transmission water main connecting Judy Reservoir, near Sedro-Wooley, to the Mt. Vernon population center. The project is on a compressed timeline and leverages a unique appraisal approach and incentive payments for owners.

On-Call Right of Way Services for the City of Sumner, Washington, 2018–Present

Tierra is contracted by the City of Sumner to provide on-call right of way services. In addition, Tierra is working on two projects for the City, the frst of which is the Stewart Road Project. As a sub to BergerABAM, Tierra is providing right of way services for nine acquisitions, one complex business relocation, and two residential relocations. Tierra is also working directly for the City of Sumner on the CIP 14-10 White River Restoration Project. This project is a three-phase levee project that includes appraisal and review appraisal services; working with the City and partners to negotiation the acquisition of 26 parcels, each with various levels of residential and/or business relocations and title issues; and documenting all discussions and actions per WSDOT and FHWA standards.

2. Qualifcations of Proposed Right of Way Manager(s)

Tierra’s management and staf are experts in the Uniform Act and its regulations. All Tierra Agents are fully trained in Uniform Act guidelines and experienced in their practical application through their

implementation on hundreds of projects. Leslie Findlay (Beaird), SR/WA, R/W-RAC Manager, Right of Way Operations, Pacifc Northwest

Our team will be led by Leslie (Beaird) Findlay, SR/WA, R/W-RAC, who is Tierra's Right of Way Operations Manager for the Pacifc Northwest. Leslie is an expert on the laws and regulations governing appraisal, negotiations, acquisitions, relocations, and dispositions in Washington state. Ms. Findlay has over 20 years of project management experience and a proven track record of completing projects on time and within budget. Leslie has vast experience working and overseeing Federally funded projects, including over 15 years at WSDOT in Real Estate Services overseeing and mentoring consultants and staf. In the last 7 years of her WSDOT tenure, she successfully managed over 30 diferent Federal projects as a Project Manager (consultant). She is an instructor for the IRWA and a former instructor for the WSDOT, where she provided detailed instruction to local agency staf on how to interpret and implement the Uniform Act and the rules and regulations governing right of way appraisal, negotiations, and relocations. Prior to joining Tierra, Ms. Findlay served as a Project Manager and Acquisition and Relocation Manager for Sound Transit projects. She also served as a Senior Real Estate Specialist on the California High Speed Rail Project, specializing in politically challenging and complex business relocations. At Tierra, Ms. Findlay personally oversees all right of way projects in our Washington ofce. She is a hands-on, personable leader and mentor with excellent communication skills that make her efective both with the teams she leads and with the clients she serves. Her expertise and skillset are ideal for this critical project for WSDOT. Ms. Findlay will be the point of contact for all contracting matters.

Kelly McGill, SR/WA Project Manager

Kelly McGill, SR/WA, Project Manager, has over 15 years of right of way experience working for various public and private agencies, as well as substantial experience on legally complex acquisitions and acquisitions of environmentally sensitive properties. Mr. McGill also has experience with air space leases and commercial real estate. While at Puget Sound Energy (PSE), Mr. McGill managed the Pierce, Thurston, and Kitsap County Right of Way Divisions. He has extensive experience working within the project area, including with local government agencies and utilities. Mr. McGill won Puget Sound Energy's (PSE’s) Power Award (its highest award) for creating and executing an acquisition plan that delivered 34 executed easements in the space of a month using an incentive plan model. While managing Snohomish County PUD’s Real Estate Department, Mr. McGill worked collaboratively with Community Transit in Everett to sell a surplus, undeveloped portion of the PUD’s property for use as a regional Bus Rapid Transit station. Mr. McGill has strong leadership and project management skills and a high aptitude for interpreting engineering plans and researching public records, and he is an expert at resolving utility conficts on transportation projects.

Melinda Burkhart Project Manager

Melinda Burkhart, Project Manager, has over 12 years of experience as a skilled negotiator and relocation specialist. She has a deep understanding of the rules and regulations governing negotiations, acquisitions, and relocations in Washington. A former WSDOT Right of Way Agent, Ms. Burkhart is also experienced in title review and survey. As a Project Manager, she believes in keeping clients informed on project challenges and successes on a regular basis. Karen Wright, SR/WA Project Manager

Karen Wright, Project Manager, has over 20 years of experience in the title and right of way profession. She earned her Senior Right of Way Professional (SR/WA) designation from the IRWA in 2014. Ms. Wright has managed a wide variety of right of way projects, from transportation and road improvements to wastewater. She provides project coordination and management and oversees subconsultants for appraisal and appraisal review. She is organized, dependable, and experienced in title /appraisal review, research, landowner negotiations, and QA/QC. Ms. Wright holds a Washington State broker's license and is a Washington notary.

Project Manager, On-Call Real Estate Services, Redmond, Washington Client: City of Redmond—Working with the City of Redmond on CLS's second 3-year on-call contract, Ms. Wright has provided title analysis/ clearing encumbrances, appraisal coordination, document drafting, ofer presentations, and negotiations for multiple transportation projects. Teaming with KPG, CLS provided right of way services for the 46-parcel project. Ms. Wright was charged with drafting documents for fee acquisitions, utilities, slope, and TCEs. Key to the project was managing the parcel exhibits, during multiple design changes. Our team will be supported by Tierra’s Director of Right of Way Operations, Mack Dickerson, SR/WA, R/W-RAC, GRI. Mr. Dickerson has 35 years of experience in the real estate and right of way industries. His experience includes property sales and purchases for public and private sellers, complex right of way acquisitions, as well as providing relocation assistance, title research, simple valuation assignments, and property management services. He has managed and provided project oversight for transportation, transit, and electric transmission and distribution projects throughout the western United States.

Project Director, Warrenton POP to Astoria, 2017–2019 Client: Northwest Open Access Networks (NoaNet)—NoaNet will construct a high-speed fber-optic network in Astoria, Oregon, to provide capacity and redundancy to one of three fber-optic lines that serve the State of Alaska. As part of this project, Tierra is securing consent documents from 17 landowners for the placement of the fber-optic line on existing pole structures owned by PacifCorp. To date, nine of the owners have signed consent documents allowing for the placement of the fber-optic line without compensation. Acquisition activities were completed in early 2018.

Jesse Ray, SR/WA, Senior Right of Way Agent, joined the right of way profession upon graduation from the University of Washington in Business Administration/Finance. Our staf is highly knowledgeable of Federal, State, County, and municipal laws, regulations, and policies relevant to the completion of acquisitions for public infrastructure, transportation, and safety improvement projects.

Our team members have vast experience successfully completing projects under a variety of funding sources, including the FHWA, FTA, FAA, Transportation Improvement Board, Transportation Improvement Project, and other grant sources.

• 85% of the acquisition assignments Tierra completes company-wide are required to and do conform with Uniform Act regulations.

• In 2018, Tierra completed more than 300 acquisitions with Federal funding requiring Uniform Act compliance.

4. Firm's Project Management System

Tierra uses an established internal system to manage all projects we execute, regardless of size or technical content. Our process has been proven to enhance our responsiveness, technical quality, and service by following these simple principles.

• The Project Manager will work closely with WSDOT on each project assigned under this contract to defne the Scope of Work in detail. The Scope of Work will provide a clear understanding of objectives, a communication plan to determine lines of communication, accounting procedures, and budgets and schedules for each interdependent task. The roles and responsibilities of each team member will also be defned at this time.

• The Project Manager is responsible for technical execution and adherence to budget and schedule for the project. At Tierra, all of our project costs are accounted for electronically through the use of Deltek, our customized project management system. Our system provides real-time budget analysis functions enabling the Project Manager and our clients to track project expenditures. We account for all weekly work electronically through timesheets and the periodic electronic submittal of expense sheets. We monitor project status and budget on a weekly basis throughout the life of project.

• Our Right of Way Operations Manager for the Pacifc Northwest, Leslie Findlay (Beaird), is responsible for independent verifcation of workmanship and conformance to right of way acquisition record quality control requirements. Ms. Findlay has over 20 years of right of way experience. Prior to joining Tierra, she not only provided training to agencies and staf regarding acquisition and relocation planning, but also prepared, reviewed, and approved Relocation Plans for local agencies in the State of Washington. Ms. Findlay leads Tierra's Pacifc Northwest-based staf, provides oversight of all staf, and is responsible for contract oversight and budgeting. She will also be responsible for reviewing fnal deliverables prior to their delivery to WSDOT.

Communication Plan

In today's technology-focused world, it's vital to project success to determine how to best communicate with the project team. This is one of the frst topics of discussion when assigned a task. Tierra employs multiple streams of communication, including Microsoft Teams, email, text messages, and even good, old-fashioned phone calls. We will determine team points of contact, communication preferences, and frequency of project updates to WSDOT to ensure the successful delivery of projects from inception to close-out.
