11.Yourbookingisacceptedbyusontheunderstandingthatyourealisethattheservicesprovidedonaridingholidayorsafariaredifferenttomanyotherholidayservices.Ridingandhorsesarenotalwayspredictable,elementsoutsideourcontrolsuchasweather,game,groundandotherlocalconditions,mayinfluencethepaceandmannerinwhichyoucanrideatanytimeandhorsesmayperformbetterforsomeridersorinsomeconditionsthanothers.Youacceptthatdescriptionsoftheridingprovidedtoyouareanindicationofwhatisplannedbutarenotcontractuallybinding.Flexibilityisalwaysrequired.Finaldecisionsastotheconductofatripmaybeaffectedbyvariousfactors,includingthosementionedaboveandwillbemadeintheinterestsofthegroup/ridersasawhole.Youalsorealisethattheinfrastructureandstandardsrelatingtotravel,accommodationandsafetyintheplacetowhichyouaretravellingmaybelowerthanintheUK.Bothweandourlocalsuppliersandoperatorswilldoourbesttomakesurearrangements,includingtravelservices,transportandconnectionsrunsmoothlybutthismaynotalwaysbepossibleduetoflightcancellation,weather,mechanicalbreakdownorotherunforeseencircumstancesandtherewillbenorefundorcompensationforanyunusedservices.Wearealsounabletomakespecialarrangementsforyouintheeventofdelaysorcancellationsatyouroutwardorhomewardpointofdepartureoronyouroutwardorhomewardjourney(or,whereyouaremakingyourowntravelarrangements,intheeventofdelaysorchangestoanyofthosearrangements)ortorefundorcompensateyouintheeventofanysuchdelays.

FORCE MAJEURE12. Intheseconditions‘forcemajeure’meansi)unusualorunforeseeablecircumstancesbeyondthecontrolofRideWorldWideanditssuppliersandtheconsequencesofwhichneitherRideWorldWidenoritssupplierscouldavoidevenifexercisingallduecare,andii)eventswhichneitherRideWorldWidenoritssuppliers,evenwithallduecare,couldforeseeorforestall.Itincludes(butisnotlimitedto)riot,civilunrest,war,terroristactivityandthethreatofanyoftheforegoing,industrialdispute,decisionsbygovernmentorgoverningauthority,naturaldisaster,adverseweatherconditions,fire,technicalormaintenanceproblemswithtransport,changesofschedulesoroperationaldecisionsofaircarriersandallsimilareventsoutsideourcontrol.ItalsoincludesanyothereventorcircumstancewhichtheForeignOfficeinLondonconsidershazardousorthreateningtotouristsandasaresultofwhichitisadvisingagainstnonessentialtraveltothecountry(ortherelevantpartofthecountry)concerned.13. Onextremelyrareoccasions,circumstancesoreventswhichamountto‘forcemajeure’mayeffecttheareatowhichyouplantotravelandasaresultRideWorldWideanditssuppliersmaybeunabletoprovide,performorcompletethearrangementsbookedinthemanneroriginallyintendedandmaybeobligedtochange,cancelorcurtailsucharrangementsatshortnotice.Intheseveryunusualcircumstanceswewilldoourutmosttomakesuitablealternativearrangementsforyoubutwewillnotbeliabletoyouforafailuretodoso,norforanyfailuretoprovidethearrangementsasoriginallybooked.Weregretthatweareunabletocompensateyouforanylossesorexpensesyoumayincurasaresultofchanges,cancellationsorcurtailmentsdueto‘forcemajeure’,andweareonlyabletorefundyoupaymentsmadeforarrangementsthatarecancelledorcurtailedasaresultifandtotheextentthatweobtainrefundsfromoursuppliersinrespectofthesame,whichwewillendeavourtodo.Whereweareabletomakesuitablealternativearrangementsforyouthecostofthesewillbedeductedfromanysuchrefundsweobtainandyouwillpayanyadditionalcosts.Ifcircumstanceswhichamountto‘forcemajeure’existbeforeyoucommenceyourholidaybutyouarestillableandwishtotraveltoyourholidaydestinationandtobegin/continuewiththearrangementsasbookedoralteredinsomeway,wemayrequireyoutosignanacknowledgementacceptinganyrisksinvolvedbeforeyoustartorcontinuewiththearrangements.

LOW BOOKINGS14. Occasionallypricesquotedforholidayarrangementsassumeaminimumnumberofparticipants.Ifthisisthecasewewillnotifyyoubeforeyourbookingisconfirmed.Iftheminimumnumberisnotreachedbytheduedateforpaymentofyourbalance(8weeksbeforetheholidaystartdate),wereservetherighttoa)cancelthetrip;orb)postponetheduedateforpaymentofthebalanceuntil4weeksbeforethestartdate;orc)withyouragreement,continuewiththearrangementsforfewerparticipantsatthenecessarysupplement.Ifwecancelasina)wewillnotifyyouinwritingandwillrefundinfullanydepositorotherpaymentmadetousbyyouforthearrangements.Ifwepostponethepaymentdateasinb)wewillnotifyyouand,beforethenewpaymentdate,wewilleitherconfirmthedepartureornotifyyouinwritingthatthetripiscancelled.Inthelattercasewewillalsorefundinfullanypaymentmadetousbyyouforthetrip.Unlessyouagree,cancellationswillnotbemadelessthan30daysbeforetheholidaystartdate.



CONSUMER PROTECTION AND FINANCIAL SECURITY15. a)WhenyoubuyanATOLprotectedflightorflightinclusiveholidayfromusyouwillreceiveanATOLCertificate.Thislistswhatisfinanciallyprotected,whereyoucangetinformationonwhatthismeansforyouandwhotocontactifthingsgowrong.We,orthesuppliersidentifiedonyourATOLCertificate,willprovideyouwiththeserviceslistedontheATOLCertificate(orasuitablealternative).Insomecases,whereneitherwenorthesupplierareabletodosoforreasonsofinsolvency,analternativeATOLholdermayprovideyouwiththeservicesyouhaveboughtorasuitablealternative(atnoextracosttoyou).YouagreetoacceptthatinthosecircumstancesthealternativeATOLholderwillperformthoseobligationsandyouagreetopayanymoneyoutstandingtobepaidbyyouunderyourcontracttothatalternativeATOLholder.However,youalsoagreethatinsomecasesitwillnotbepossibletoappointanalternativeATOLholder,inwhichcaseyouwillbeentitledtomakeaclaimundertheATOLscheme(oryourcreditcardissuerwhereapplicable).b)Ifwe,orthesuppliersidentifiedonyourATOLcertificate,areunabletoprovidetheserviceslisted(orasuitablealternative,throughanalternativeATOLholderorotherwise)forreasonsofinsolvency,theTrusteesoftheAirTravelTrustmaymakeapaymentto(orconferabenefiton)youundertheATOLscheme.YouagreethatinreturnforsuchapaymentorbenefityouassignabsolutelytothoseTrusteesanyclaimswhichyouhaveormayhavearisingoutoforrelatingtothenon-provisionoftheservices,includinganyclaimagainstus,thetravelagent(oryourcreditcardissuerwhereapplicable).Youalsoagreethatanysuchclaimsmaybere-assignedtoanotherbody,ifthatotherbodyhaspaidsumsyouhaveclaimedundertheATOLscheme.16.TheAssociationofBondedTravelOrganisersTrustLimited(ABTOT)providesfinancialprotectionunderthePackageTravel,PackageHolidaysandPackageToursRegulations1992forRideWorldWideandintheeventofitsinsolvency,protectionisprovidedforthefollowingi)non-flightpackagescommencinginandreturningtotheUK;ii)non-flightpackagescommencingandreturningtoacountryotherthantheUK;andiii)flightinclusivepackagesthatcommenceoutsidetheUKwhicharesoldtocustomersoutsidetheUK.i),ii)andiii)provideforarefundintheeventyouhavenotyettravelled.i)andiii)provideforrepatriation.PleasenotethatbookingsmadeoutsidetheUKareonlyprotectedbyABTOTwhenpurchaseddirectlyfromRideWorldWide.

PRICES17a). Wereservetherighttorevisepricespreviouslyquotedforholidayarrangementsbeforeabookingisconfirmed.Onceyourbookingisconfirmedandaconfirmationinvoiceisissued,(subjecttocorrectionoferrors)therewillbenopriceincreaseslessthan30dayspriortotheholiday(althoughthisissubjectalwaystoourright,ifyouhavenotpaidanymoneydueunderyourconfirmationinvoice,totreattheoriginalarrangementsascancelledbyyouandtoreviseprices).Otherwisepriceincreaseswillonlybemade(otherthantocorrectobviouserrors)inverylimitedcircumstancesandinsuchcaseswewillissueaninvoiceforasurcharge.Asurchargeinvoicemaybeissuedbecauseofadeteriorationinthesterlingexchangerateusedtocalculatethecostofyourholiday,tocoverincreasesintransportationcharges(includingfuel),tocoverincreasedtaxes(e.gVAT)orfeessuchaslandingordisembarkationfees.Eventhen,wewillabsorbamountsupto2%ofthecostquotedtoyouforthearrangementsinyourconfirmationinvoice(excludinganyamendmentcharges).Youwillnotbeentitledtocancellationcompensation.17 b).Whereyouhavemadeapaymenttousthathasbeenpassedontotherelevantcarrierorsupplier,toguaranteeacertainfareforaflightorothertravelserviceanditwasaconditionofobtainingthatfareorservicethatrefundrightswerenilorlimited,anyrefundbyuswillbesubjecttodeductionofcancellationchargesimposedtobythecarrierorserviceprovider.18.Pricesinthisbrochurearebasedonexchangeratesof£1=$1.5US;£1=1.2eurosand£1=16.5SouthAfricanRand.

LIABILITY19. Subjecttoparagraph20below,weacceptliabilityforensuringthatourcontractwithyouisproperlyperformedandthattheserviceswehaveagreedtoprovideunderitareprovidedtoareasonablestandard.Wearenotresponsiblehoweverforanyserviceswhichdonotformpartofourcontractwithyou,forexampleanyadditionalservicesorfacilitiesyoupurchasefromyourhotel,guideoranothersupplier,whichwehavenotagreedtoprovide.20.Wewillnotbeliableforanyloss,damage,expenseorinconveniencesufferedorincurred(includingdeathorpersonalinjury)whichisattributabletoi)yourownactoromissionorthatofoneofyourparty,orii)anactofomissionofathirdpartynotconnectedwiththeprovisionoftheservicesorarrangementsandwhichwasunforeseeableorunavoidable,oriii)forcemajeure.RideWorldWide’sliabilityisalsoconditionalonyouassigningtoitanyrightsyoumayhaveagainstthepersonwhoseactoromissiongaverisetothatliability.Inaddition,welimitourliabilityasfollows:i)liabilityotherthanfordeathorpersonalinjuryislimitedtosuchamountasisreasonabletakingintoaccountthecostofthearrangementsbookedwithusandtheextenttowhichyourenjoymentofthemhasbeenaffectedbut(withoutprejudicetothat)willnotexceedthecostofthearrangementsbookedforthepersonaffected;ii)liabilityforloss/damagetobaggageandpersonalpossessionsislimitedto£50perpersonasyouareexpectedtohavetakenoutadequateinsurance;iii)liabilityfordeath,personalinjuryoranyotherlosssufferedinthecourseofanyoftheservicesprovidedunderourcontractwithyou(includinganyair,rail,roadorseatravel(andthegettingonandoffsuchtransport)orfromastayinahotelorsimilaraccommodation)islimitedinaccordancewiththeprovisionsofallrelevantinternationalconventionsrelatingtotheprovisionofsuchservicesasifRideWorldWidewasasupplieroftheservicesinquestionforthepurposesoftherelevantconvention.

SAFETY AND BEHAVIOUR WHEN RIDING21. Whilstridingorinthevicinityofhorsesinthecareoftheguideoroperatorofyourtripyoumustcomplywiththeinstructionsofthatperson.Itisaconditionofyourbookingthatyouacceptthatthatpersonisentitledtorequireyoutodismountortorefusetoallowyoutorideifforanyreason,includingyourinability,behaviourorhealth,theyconsiderthatyoumayendangerthesafetyorwelfareofthehorsesorofanyperson,andifsorequired,youhavenoclaimandwillnotbeentitledtoanyrefundorcompensation.22.Theguide,tourleaderorpersoninauthorityonyourtripmayalsoterminateyourparticipationinthattripimmediatelyifheorsheconsidersitreasonablynecessaryforthehealthorsafetyofanyotherperson.Ifyourparticipationissoterminatedyouwillhavenoclaimandwillnotbeentitledtoanyrefundorcompensation.23. Youarestronglyadvisedforyourownsafetytowearawellfittinghardhatwhilstriding.Childrenunder18willberequiredtowearahardhat.Somerideoperatorswillhavehatsavailablebutyoushouldnotrelyontheseandareadvisedtotakeyourown.Youacknowledgethattherearerisksinhorseridingandindealingwithhorsesandunderstandthathorses,asindependentcreatures,canbeunpredictableoractunexpectedly.Youalsoacknowledgethatmanyofthetripswearrangeincluderidingandotheractivitiesinareasthatareremoteand/orareaswherethereispotentiallydangerousgame,difficultterrainorotherconditionsthatcanbehazardous.Safetyservicesandback-upinfrastructuremayalsobemorelimitedthanusual.Bybookingtotakepartinoneofthesetrips,youconfirmthatyouunderstandandfullyaccepttheserisks.Youunderstandthatyoumayalsoberequiredtosignaseparateacknowledgementandacceptanceofpersonalliabilitybythelocalsupplierbeforebeingallowedtorideortakepartinatrip,andifyouarenotallowedtorideortakepartbecauseyourefusetosign,ortowearahardhatifrequired,youwillhavenoclaimagainstRideWorldWideorthesupplierandwillnotbeentitledtoanyrefundorcompensation.
