RESUMEN El artículo aborda el alc ance de la presunción de inocencia en el ordenamiento jurídico nacional, teniendo en consideración el derecho convencional internacional de los derechos humanos, el código procesal constitucional y la jurisprudencia emanada de nuestros tribunales superiores como de la Corte interamericana de Derechos Humanos. ABSTRACT The present article analyzes the scope of the presumption of innocence in Chilean law, considering the law of the international treatises on human rights, the constitutional procedural code, and the case material from both Chilean higher courts and the Inter-American Human Rights Court. El derecho a la presunción de inocencia forma parte del bloque constitucional de derechos, porque es tá asegurado y garantizado tanto en la Convención Americana de Derechos Humanos como en el Pacto Internacional de Dere chos Civiles y Políticos. Tales derechos, de acuerdo al artículo 5° inciso 2° de l a Constitución, constituyen límites a la soberanía, debiendo ser asegurados y promovidos por todos los órganos del Estado. Asimismo, el Código Procesal Penal, en su artículo 10, inciso 1°, dispone que "en cualquier etapa del procedimiento en que el juez de garantía estimare q ue el imputado no está en condiciones de eje rcer los
