- INSTRUCTIONS TO BIDDERS -

The following information covers details concerning the proposed lump sum sale of an estimated 1,125,270 board feet of sawlogs and 4,058 tons of pulpwood to be cut from 285 acres of State Game Lands No. 184, Dean Township, Cambria County.

See attached sheets for additional volume information. The volume and percentages are not guaranteed, and each prospective bidder is urged to examine the sale area and bid based on their own estimate. - SHOW DATE -

Timber will be shown to prospective bidders on April 14, 2020. Viewers will be met at the PGC parking area along Blacksnake Road, Dean Twp., Cambria County, PA. GPS coordinates N40.5744 W78.5067 at 10:00 a.m. and conducted to the sale area.

The timber to be sold will be clearly designated by Andrew Hetrick, 4820 Route 711, Bolivar, PA 15923, telephone: 1-724-238-9523, the Regional Forester. - BIDS -

BIDS SHOULD BE MAILED AT LEAST FOUR (4) WORKING DAYS PRIOR TO BID OPENING TO PERMIT U.S. POSTAL SERVICE DELIVERY. USE SPECIAL MAIL SERVICE IF MAILED LATER THAN FOUR DAYS PRIOR TO BID OPENING. Bids must be submitted in an envelope that clearly states on the outside: BID PROPOSAL FOR TIMBER. SGL #184. Bids received in envelopes not containing this information will be rejected.

In order to be considered, the bid shall be accompanied by a CERTIFIED, CASHIER'S OR TREASURER'S CHECK, OR A BANK, POSTAL OR EXPRESS MONEY ORDER, payable to the Pennsylvania Game Commission in the amount of $1,000.00, as evidence of good faith in bidding, to be forfeited as fully liquidated damages upon the bidders failure to accept the award, execute the contract and give bond as required. Bid deposits will be returned to the unsuccessful bidder when the contract has been executed and a satisfactory performance deposit has been furnished.

In lieu of bid deposit, bidders may submit an open bid bond to cover the deposit requirement. Any bid bond must be filed for an annual period and both the amount of bond and the surety shall receive prior approval of the Pennsylvania Game Commission.

The Commission reserves the right to reject any and all bids and to award the contract as deemed to its best interests.

Rev (7-13) - PERFORMANCE DEPOSIT -

A performance bond in the amount of $25,000.00 will be required in the form of a Certified Check or a Postal Money Order drawn to the order of the Pennsylvania Game Commission. Negotiable securities, including assignment of a bank savings account may be furnished in lieu of above. A bond with corporate surety approved by the Attorney General, or a bank Irrevocable Letter of Credit, may be posted provided the bond has an expiration date a minimum of 1 year beyond the expiration date of the timber contract. - EXPIRATION OF CONTRACT -

Contract will expire June 30, 2023. - PAYMENTS - The sale is divided into 8 cutting blocks. Payment may be made by:

1. Total payment when agreement is signed. or 2. Payment prior to logging operations.

1 – 13% - 67 acres 2 – 12% - 54 acres 3 – 14% - 25 acres 4 – 18% - 26 acres 5 – 12% - 43 acres 6 – 14% - 39 acres 7 – 01% - 04 acres 8 – 16% - 27 acres Payment for Block 1 (13% of the bid price) is due at contract execution. Final payment is due no later than 120 days before the expiration of the Agreement.

- ANTI DISCRIMINATION -

The contractor awarded the Timber Sale Agreement agrees he will not discriminate against any employee or other persons on account of race, sex, creed, age, ancestry or national origin.

- SAFETY and ENVIRONMENTAL PROTECTION –

The Buyer, his employees and sub-contractors are expected to perform all logging operations in a safe manner as required by applicable laws and regulations. The Commission expects the Buyer to ensure that logging crewmembers dress in protective attire and perform their duties with equipment in accordance with standards established by the logging industry and the Occupational Safety and Health Administration (OSHA).

The PGC recommends that logging crews working on Sta te Game Lands be trained in safe logging

techniques and sound environmental logging practices though a formal training program such as the one provided by the Pennsylvania Sustainable Forestry Initiative (PA SFI) or another similar program.

Contractor must comply with the erosion and sediment control plan for disturbed areas that is included as a part of the timber contract. - SPECIAL PROVISIONS -

SPECIAL PROVISIONS FOR THE “KNOTACLUE TIMBER SALE”

S.G.L. # 184 T.S. # 184-2019-01 1) ADMINISTRATIVE ITEMS

a) This 285-acre timber sale consists of 121 acres of shelterwood (Blocks 1 & 2), 51 acres

of overstory removal (Blocks 3 & 4), 86 acres of clear cut with residuals (Blocks 5, 6, & 7) and 27 acres of clear cut (Block 8).

b) Saw timber volumes were determined by a 100% tally and pulp wood was determined by

a 10 BAF prism plot cruise. All trees are tallied in 2-inch diameter classes.

c) Operator is responsible for contacting PA One Call (8-1-1) at least three business days prior to any earth moving activities, skidding, or hauling to insure all utility lines are clearly identified. PA One Call will alert the appropriate facility owners of the intent to conduct earth moving activities or cross underground lines for more information, visit www.paonecall.org

d) The contractor shall provide the Regional Forester or his designee with at least 3 days

notice prior to moving equipment on-site in anticipation of start-up.

e) No permanent paint may be used by bidder for marking/cruising this timber sale area.

f) Whole tree harvesting is not permitted.

g) Payment for Block 1 (13% of the bid price) is due on the execution of the contract. Final payment is due no later than 120 days before the expiration of the Agreement.

2) BOUNDARIES, BLOCKS, AND CUTTING INSTRUCTIONS

a) The sale consists of eight (8) cutting blocks. The sale boundary is delineated with

BLUE-marked trees with 2 slashes. Corners are marked with 3 slashes. All RED slashed and all BLUE slashed trees shall remain standing.

b) Reserve trees are marked with a single RED slash in Blocks 1, 2, 5, 6, & 7. Reserve

trees are marked with a single Blue slash in Blocks 3 & 4. There are no reserve trees in Block 8. The operator will determine if a reserve tree is a safety hazard and will notify the Regional Forester of any reserve trees that were felled for safety reasons. Any reserved trees that are felled for safety reasons must be left at the stump. Snags may be left standing unless they present a safety hazard.

c) The Blue numbered block line trees separating Blocks 3 & 4 are tallied and may be felled unless marked with Blue slashes. The Blue numbered block line trees separating Blocks 3 & 5, 4 & 5, & Blocks 5, 6, & 7 are tallied and may be felled unless marked with Red slashes.

d) All live trees 1-inch dbh and larger must be felled within cutting blocks 1, 2, 5, 6, 7, & 8. with the exception of designated reserve trees.

e) All live trees 6-inch dbh and larger must be felled within cutting blocks 3 & 4 with the exception of designated reserve trees. Hawthorn and apple trees are to be reserved when possible.

f) All top wood up to 3 inches is reserved and must be cut off in the woods prior to skidding

tree to the landing.

g) All woods operations are to proceed at the same time. Pulpwood and culls must be cut during the same operation as sawlogs are being cut and skid.

h) Cull portions of the tree are to be left at the stump. All logs and pulpwood are to be

marked to length in the woods to eliminate short ends at the landings.

i) Tops and slash will be cleared within 10 feet of the gameland boundary, roads and ditch lines, culverts, utility right-of-ways, herbaceous openings, spring runs, and defined stream channels.

j) All stumps must be cut lower than 12” from the ground. Exceptions will be granted for multiple bole sawtimber trees.

k) Extra caution should be taken to avoid felling damage or skidding damage to reserved trees.

l) No fuel wood cutting by individuals other than the operator and employees will be

permitted. 3) US / STATE / LOCAL ROADS

a) Operator may contact Penn DOT District 9-0, Cambria County at 814-419-1157 for permitting and/or bonding information for any State Roads to be used. For additional information go to http://www.papostedroads.pa.gov/

b) Timber from All blocks will be hauled via PGC administrative roads to SR 1014 Black Snake Road then to SR 53 Clearfield Valley Boulevard.

4) GAME LAND ROADS TO BUILD / IMPROVE

Cutting Blocks 1, 2, 3 & 4

a) The existing gameland road, approximately 2,200 ft, used for hauling, must be kept open and passable for vehicles at all times. The operator is responsible for any haul road upgrades prior to, and during, hauling.

b) Upon conclusion of use, the PGC Administrative road will be graded to a 12-foot running

surface, ditch lines established leading into cutouts or culverts, positively drained with broad-based dips and cutouts, and crowned to drain all water into the ditches, rolled with a vibratory road roller to further compact and shape the road, and tailgated with 158 tons of 2A quarry stone 2 inches thick (from Black Snake Road to the second gameland gate at the end of Block 2).

Cutting Blocks 5

a) Prior to hauling, the existing PGC administrative road, approximately 400 feet from Black Snake Road to the Block line of Blocks 3 & 4, will be graded to a 12-foot running surface, ditch lines established leading into cutouts or culverts, positively drained with broad-based dips and cutouts, crowned to drain all water into the ditches and tailgated with 45 tons of 3A quarry stone 4 inches thick. The operator is responsible for any haul road upgrades prior to, and during, hauling.

b) Upon conclusion of use, the road will be graded to a 12-foot running surface, ditch lines established leading into cutouts or culverts, positively drained with broad-based dips and cutouts, and crowned to drain all water into the ditches.

Cutting Block 6, 7, & 8

a) Prior to hauling, the existing PGC administrative road, approximately 2,800 feet from Black Snake Road to the beginning of Block 6, will be graded to a 12-foot running surface, ditch lines established leading into cutouts or culverts, positively drained with broad-based dips and cutouts, crowned to drain all water into the ditches and tailgated with 360 tons of 3A quarry stone to create the road base 4 inches thick. The operator must then use a vibratory road roller to further compact and shape the stone after application. Once the base is compacted, it will be tailgated with 250 tons of 2A quarry stone approximately 3 inches thick. The operator will again use a vibratory road roller to further compact and shape the stone after application. The operator is responsible for any haul road upgrades prior to, and during, hauling.

b) Upon conclusion of use, the road will be graded to a 12-foot running surface, ditch lines established leading into cutouts or culverts, positively drained with broad-based dips and cutouts, and crowned to drain all water into the ditches, rolled with a vibratory road roller to further compact and shape the road. Immediately following road improvement work, any disturbed areas outside of the road surface must be treated according to specifications outlined in Section 7, Seeding of Roadways and Landings while the soil is freshly disturbed.

5) LANDINGS

a) All landings are to be approved by the Regional Forester or designee.

b) At the discretion of Regional Forester, landing sites constructed in wooded areas, must

have all stumps removed and scattered about the cleared edge.

c) Logging debris is to be kept to a minimum. All logs and pulpwood are to be marked to length in the woods to eliminate short ends at the landings.

d) At the conclusion of the sale, all stumps and debris must be removed and scattered singly into the surrounding woods, landing sites are to be leveled and positively drained, cleared of debris, and treated according to specifications outlined in Section 7, Seeding of Roadways and Landings.

e) All excessive logging debris on the landings is to be removed from the game lands by the operator at the conclusion of the sale.

6) SKIDDING

a) Skid trails will be coordinated with the Regional Forester or designee.

b) No skidding will be allowed through streams or across unprotected utility lines.

c) No skidding will be permitted across small drainages without the use of temporary bridges.

d) Wet areas should be avoided when skidding. e) If skid trails are to sit idle for one month or longer, they will be leveled and have water

bars added. f) Though coordination with the Regional Forester or designee, skid roads and trails within

the cutting blocks may be graded rut free, water-bared, and brushed closed as harvesting progresses.

g) Upon conclusion of use, skid roads not graded and brushed closed will be cleared of all debris, graded rut free, and positively drained with water-bars and cut-outs. Sections of skid roads that are considered erodible will be treated according to specifications outlined in Section 7, Seeding of Roadways and Landings.

7) SEEDING OF ROADWAYS AND LANDINGS

a) At the conclusion of logging operations in each block or group of adjoining blocks, and suitable weather permits, all disturbed areas designated for seeding will be graded according to specifications outlined above and treated according to the following:

5 lbs. per acre of Inoculated Alsike Clover 5 lbs. per acre of Inoculated Ladino Clover 5 lbs. per acre of Inoculated Crimson Clover 5 lbs. per acre of Inoculated Red Clover 2 bu. per acre of oats (spring), wheat or barley (fall) 200 lbs. per acre of Pelletized Lime

150 lbs. per acre of Triple 19 Fertilizer (19-19-19) 40 bales per acre of straw

Approximately 4.0 acres are anticipated, but total acreage requiring seeding will be determined on-site as operations progress. All areas, if treated between June 15 and August 15, will be mulched. Landings will be mulched regardless of time of year. Guaranteed catch of cover must be obtained to the satisfaction of the Regional Forester before the bond will be released and seeding completed after October 10 will require inspection for successful germination the following spring.

b) The operator will notify the Regional Forester or designee three business days prior to seeding. The work will occur during normal working days of the forester and will not occur on weekends or holidays.

8) OPERATIONS AND NON-WORK DAYS

a) No woods operation will be permitted on the following days: 1. All Saturdays in the months of October, November, December, and January. 2. The opening day and all Saturdays during spring turkey season, including the

youth spring gobbler hunt. 3. All the days of the general statewide bear season 4. The entire 2 weeks of the general firearms deer season 5. The opening day of the flintlock muzzleloader season

No woods operation will be permitted from March1 through April 15 (spring break-up) without the permission of the Regional Forester.

b) The contractor, employees, and sub-contractors may not hunt to, from, or at the job site

when the work location is beyond a gated road that is closed to public traffic. The contractor may travel to and from the work location on no-work days to check on the condition of equipment.

c) Except on Sundays, it is unlawful to be present on State Game Lands from November 15 through December 15 inclusive when not engaged in lawful hunting or trapping and fail to wear a minimum of 250 square inches of daylight fluorescent-orange material on the head, chest, and back combined, or in lieu thereof, a hat of the same colored material. The material shall be worn so it is visible in a 360-degree arc.

9) MISCELLANEOUS

a) Operator must comply with the erosion and sedimentation control plan for the area,

update the plan with control measures implemented as logging progress, and maintain an updated copy on-site at all times.

b) The operator is responsible for any additional haul road upgrades prior to and during hauling.

c) A copy of weigh slips will be provided to the Regional Forester for all specified quarry

stone.

d) Gates are to be kept closed and locked at all times except when the contractor is present on the site.

e) Violation of contract provisions by the operator may subject the operator or their employees or contractors to fines based on Title 58 regulations.

f) Operator will supply all employees working on this site with a map and copy of the sale provisions.

10) PA RIGHT TO KNOW PROVISIONS a. The Pennsylvania Right-to-Know Law, 65 P.S. §§ 67.101-3104, applies to this contract. b. Unless the Contractor provides the Commonwealth, in writing, with the name and contact information of another person, the agency shall notify the Contractor using the Contractor information provided by the Contractor in SRM [or “the legal contact information provided in this contract’] if the agency needs the Contractor’s assistance in any matter arising out of the Right to Know Law (“RTKL”). The Contractor shall notify the agency in writing of any change in the name or the contact information within a reasonable time prior to the change. c. Upon notification from the Commonwealth that the Commonwealth requires the Contractor’s assistance in responding to a RTKL request for records in the Contractor’s possession, the Contractor shall provide the Commonwealth, within fourteen (14) calendar days after receipt of such notification, access to, and copies of, any document or information in the Contractor’s possession which arises out of the contract that the Commonwealth requests (“Requested Information”) and provided such other assistance as the Commonwealth may request in order to comply with the RTKL. If the Contractor fails to provide the Requested Information within fourteen (14) calendar days after receipt of such request, the Contractor shall indemnify and hold the Commonwealth harmless for any damages, penalties, detriment or harm that the Commonwealth may incur as a result of the Contractor’s failure, including any statutory damages assessed against the Commonwealth. d. The Commonwealth’s determination as to whether the Requested Information is a public record is dispositive of the question as between the parties. Contractor agrees not to challenge the Commonwealth’s decision to deem the Requested Information a Public Record. If the Contractor considers the Requested Information to include a request for a Trade Secret or Confidential Proprietary Information, as those terms are defined by the RTKL, the Contractor will immediately notify the Commonwealth, and will provide a written statement signed by a representative of the Contractor explaining why the requested material is exempt from public disclosure under the RTKL within seven (7) calendar days of receiving the request. If, upon review of the Contractor’s written statement, the Commonwealth still decides to provide the Requested Information, Contractor will not challenge or in any way hold the Commonwealth liable for such a decision. e. The Commonwealth will reimburse the Contractor for any costs associated with complying with this provision only to the extent allowed under the fee schedule established by the Office of Open Records or as otherwise provided by the RTKL if the fee schedule is inapplicable. f. Contractor agrees to abide by any decision to release a record to the public made by the Office of Open Records, or by the Pennsylvania Courts. The Contractor agrees to waive all rights or remedies that may be available to it as a result of the Commonwealth’s disclosure of Requested Information pursuant to the RTKL. Contractor’s duties relating to the RTKL are continuing duties that survive the expiration of this contract and shall continue as long as the Contractor has Requested Information in it possession.
