:VIEMORANDUM IN OPPOSITION

This appeal arose as a result of the appellate court granting Relator's Complaint 1or a

Writ of Procedendo. Respondent, The Ilonorable Tracie M. Hnter, was not defended in the

proceedizlgs below. As a result, no defense was raised to Relator's Complaint. Respondent took

it upon herself to filepro se a notice of appeal in the case. Respondent is representing herself

pro se in her official capacity.

Under Ohio Revised Code § 309.09, the Flamilton County Prosecutor's Office (the

"Prosecutor") was initially responsible to provide Respondent a legal defense. Due to conflicts,

the Prosecutor withdrew as counsel from the instant case. Revised Code § 305.14 provides for

additional or substitute counsel to be appointed by a county court of common pleas. Two private

attorneys were appointed by the Ham.ilton County Court of C;ommon Pleas to represent

Respondent in various procedendo cases including the instant case. Flowever, these appointed

counsel did not file an answer or other responsive pleading in this case. Thus, the Court of

Appeals i-uled without benefit of knowiiig Respondent's defense and legal arguments.

Respondent appealed because the writ was issued in error.

Relator has now moved to dismiss the instant appeal on the grounds that Respondent has

already issued a decision in accordance Nvith the First District's order grailting procedendo.

Respondent complied with the court of appeal's order despite Respondent's belief the decisions

were in error because Respondent believed that not complying could lead to a charge of

contempt. Respondent's compliance does not moot the appeal because this Court can still issue

effective relief by guiding the parties and the 1-lamilton County Juvenile Court in applying this

Court's time giudelines in this case and similar cases. More importantly, this Couzfi's ruling in

this appeal would clarify that the extraordinary remedy of a writ of procedendo is inappropriate

when a court is overburdened by its caseload. As of the date of this filing, 18 complaints for writ

of procedendo have been filed against Relator Judge Tracie 1Iuriter.

A. The Hamilton County Juvenile Court is So Overburdened That a Writ ofProcedendo is Not Appropriate.

It is public knowledge that the llamilton County Juvenile Court has the heaviest caseload

of any juvenile court in Ohio. According to the Ohio Suprenie Court's 2012 Qhio Cour-ts

Statistical Report, the Hamilton County Juvenile Court has the second highest population per

juvenile court judge: 401,000 people per judge. &e Exhibit A at pp. 126-27. More concerni_ng

is that the number of case terrninations per judge in 1:1ainilton County is 14,382 each, Id. That is

more than twice as high a number of cases terminated per judge for any judge in any county in

Ohio. .Id. 7'his caseload causes the Hamilton County Juvenile Court to delegate more than

double the number of cases to magistrates of any other Ohio county. Id. at 128-29. Litigants

before a magistrate have the right to move to set aside any order by a magistrate, or object to any

decision by a magistrate. See Ohio R. Juv. P. 40(D). From :May 25, 2012, to August 31, 2013,

the Haznilton County Juvenile Court recorded 499 objection motions filed. Of these, 296 were in

cases assianed to Respondent Judge I-lunter, while only 203 were assigned to the other judge in

the court, Judge John Williains. ,S'ee t?xhibit B. Respondent is the most overb-Lirdened juvenile

courtjudges in Ohio: she presides in a court that has twice as many cases per judge than any

other court; that has twice as many cases pending before magistrates and who has pending before

her 60% of all objections filed in the court since she has been on the bench.

Procedendo exists to prevent "undue delay" by a judge. A judge overburdened by an

enorn-ious caseload cannot be said to be und.uly delaying the resolution of cases. Over afifteen

Ynonth period, objections were filed 296 times in cases assigned to Respondent. Despite this

burden, Re.spondent was able to issue decisions in seven of the cases for which petitions for

procedendo were sought, causing the cases to be voluntarily dismissed by the Hamilton County

Public Defenders' Office.' This method of piecemeal resolution prejudices litigants who are the

victiznsof systemic court delays but whose cases are passed over for decision in order to rule on

a case where a coiriplaint for a writ of procedendo has been filed. kespondent has been forced to

deprioritize cases which have been pending fbr longer periods or which have more pressing

issues in order to focus on cases in which the I-lam.ilton County Public Defender has filed

procedendo petitions.

Additionally, the Hanlilton County Juvenile Court records on the Supreme Court's "1iorm

D" data on cases which are pending beyond a specified time guideline after assignmeiit to a

judge. This Court's Instructions for Preparation All Report Fornls state that these time

guidelines are "mandatory" and that the clock begins to run when a case is origizlally assigned to

the i:eportiilg judge. Notably, Juvenile Court Judge John Williams has more cases pending

beyond time guidelines than Respondent, and yet no procedendo petitions have been filed against

him, which allows him to decide his cases in. an orderly fashion.

Therefore, issuing the extraordinary writ of Procedendo is not appropriate in this case. A

writ of Procedendo is, "issued by a court of superior jurisdiction ordering a lower court to

proceed to judgment in a case." See Sherrills v. Cornfnan Pleas; 72 Ohio St.3d 461, 462, 650

N.E.2d. 899 (1995). Procedendo is warranted where the petitioner can demonstrate "a clear legal

right to require the court to proceed, a clear legal duty on the part of the court to proceed, and the

lack of an adequate remedy in the ordinary course of the law." Culgan v. Collier•, 135 Ohio St.

3d 436, 437, 2013-Ohio-1762, 9$8 N.E.2d 564 (citing Sherrills, 72 Ohio St.3d at 462). Such

relief as appropriate where "a court has refused to enter judgment or has unnzcessarily delayed

proceeding to judgment." Id. (citing Crandall, Pheils & Wisnietivs•ki v. DeCessna, 73 Ohio St.M

180, 184, 652 IV.E.2d 742 (1995)). Since the Hamilton County Juvenile Court has such a heavy

caseload, and Respondent Judge Hunter has the largest caseload of the two sitting judges, these

facts alone explain any delay in ruling in this case, yet the Court of Appeals did not consider this

evidence when it issued its decision.

In total, eighteen writ cases have been filed against Respondent ;ludge Hunter. Seven of

the writ cases filed against Respondent were voluntarily d.ismissed by the petitioner because

Respondezlt issued an order before the court of appeals granted the writ. The backlog of cases

Judge Hunter inherited and now presides over reflects a systemic problezn at the Hamilton

County Juvenile Court. The Hamilton County Juvenile Court is among the most overburdened

in the state, and Respondent the most overburdened in that court. This problem. is properly

addressed by the Ohio Supreme Court Case Maziageznent Section not by the Court of Appeals

issuing extraordinary writs on an ad hoe basis. As a result, this Court's Case Management

Section has taken steps to address the systemic problem and has appointed retired Hamilton

County Juvenile Court Judge Thomas Lipps to preside over "all cases in which Objections to

Magistrates' Decision are pending past the 120-day time guideline as of October 15, 2013 ...."

S'ee Exhibit C. This Court's order applies to cases pending before both Judge Williams and

Judge Hunter. Case Management is the proper remedy, not a writ of procedendo. Respondent

requests that the motion to dismiss be denied so Respondent can bring these facts to this Court's

atterition.

B. The Court of Appeals Misapplied Ohio Rule of Superintendence 40(A)

Because Respondent was notrepresented by counsel, as required by statute, Relator's

allegations were unanswered. The court of appeals issued a decision that merely restated

Relators' unrebutted petition. This was essentially a default judgment issued through no fault of

Resporident's. The Court of Appeals did not conduct a thorough review of the legal issues in this

case because Respondent was not permitted a defense to explain what mitigating factors existed.

As a result, the cou.rtissued an unprecedented decision applied Ohio Rules of Superintendence

40(A)(2-3) to create deadlines for ruling on objections to magistrate's decisions - a decision that

is not based in this Court's Rules or case law.

1. Rules 40 (A)(2) and (A)(3) Do Not Apply to Rulings on Objections.

Very few decisions have used Rules 40(A)(2-3) as guidance in determining when a writ

of procedendo should issue. Rules 40(A)(2-3) state that:

(2) All cases submitted for determination after a court trial shall be decidedwithin ninety days from the date the case was submitted.

(3) All motions shall be ruled upon within one hundred twenty days from thedate the motion was filed, except as otherwise noted on the report fornis.

(emphasis added). For example, in Czzlgan, the petitioner moved for relief in the trial court,

claizning that an error related to his 2009 sentencing justified his release from post-release

control. 135 Ohio St. 3d at 436. The trial court judge did not rule on the Inotion within 120

days. I'he petitioner sought writs of znandamus and procedendo in the court of appeals, which

dismissed, stating that the petitioner had an adequate remedy by appeal. Id. The petitioner

appealed to the Ohio Supreme Court, which held that Superintendence Rule 40(A)(3), which the

petitioner relied on for the 120-day standard, did not create a cause of action, but that

"procedendo and mandamus will lie when a trial court has refiised to render, or unduly delayed

rendering, a judgrrzent." Id. at 437-38 (quoting .Reynolcls v. Basinger, 99 Ohio St.3d 303, 2003-

Ohio-3631, 791 NE2d 459).

This Court used Rule 40(A)(3) to "guide" it in determining whether decision on a motion

was ui-iduly delayed. Id. at 438. Instead of endorsing a flat 120-day rule, this Corirt nained

several other factors that would inform its determination of undue delay:

For exainple, a judge may require longer than 120 days to rule on a motion forsummary judgment in a complex case. Other .factors that might delay a ruling arethe need for further discovery, the possibility of settlement, and other motionspending in the case.:S'ee ^5tcrfe ex rel. Duncan v. DeWeese, 5th Dist. No. 2011-CA-67, 2011-Ohio-5194, 2011 WL 4625370, Ti 4. This is not an exhaustive list;we cannot anticipate all the factors that might allow a court, acting withiil itsproper discretion, to delay ruling on a motion past the 120 days conzmanded bythe rule.

Three other cases discuss Rule 40(A)(3) in conjunction with a petition for procedendo.

In Duncan, which preceded Culgczn, the petitioner requested the writ to compel a trial court to

rule on his motion for resentencing. 2011 WL 4625370 at * 1. Like Culgan, Duncczn held that

Rule 40(A)(3)'s 120-day deadline did not create an enforceable right, and that the presum.ption

ofundue delay after 120 days was subject to factors such as "[t]he need for discovery, the issues

presented, the possibility of settlement, other motions pending in the case, and even other matters

pending before the court...." Id. Further, "allowing litigants to enforce such a rigid rule risks

depriving other litigants of due process, invites gamesmanship in litigation, and could frustrate

the policy of deciding cases on their m.erits and not on procedural technicalities." Id.

In .Iamison v. Aluskingum, the petitioner sought a writ of mandamus or procedendo

campelling a ruling on his motion for a new trial in the trial. court. Jainison v. ^1fluskinguin, 5th

Dist. Muskingum No. CT2009-0001, 2009-Qhio-1482, 2009 WL 818957 at * 1(Ntarch 25,

2009). The court of appeals found that although more than 120 days had elapsed since the date

of the motion, a prior appeal filed by the petitioner had divested the trial court of jurisdiction for

several months. See id. When the appeal was dismissed the trial court asstuned jurisdiction over

the motion, but less than 120 days elapsed before l'etitioner sought relief via procedendo. Id. at

*^. This caused the court to dismiss the petition as premature. .td.

Although only acting as guidance, Rule 40(A)(3) has on1yr been applied to m.otions that

were pending more thait 120 days. There is no precedent for applying this framework in the

context of objections to magistrates' decisions. Rule 40(A)(3) oiiIy applies to "motions," and

Rule 40(A)(2) to "court trials." No Ohio cotu-t has applied Rule 40(A)(3) as gctidance in a

procedendo action involving objections to a magistrate's decision until the court of appeals did

so in this and other procedendo cases against Respondent Judge Hunter, Additionally, no couz:t

has applied Rule 40(A)(2) to create a presuniptive ninety-day deadline for decisions after oral

arguments are heard on objections.

2. The Court of Appeals Did Not Properly Apply Rule 40(A)

I;ven if Rule 40(A) applied in this case, the rule states that the guideline is 120 days,

``except as otherwise noted on the report forms." Report Fonn F applies to motions, however the

Hamilton County Juvenile Court does not complete Form Fs. Hamilton County Juvenile Court

does complete Form Ds vvhich states the guidelille in a custody case, like this, is nine months. At

the time the complaint for a writ was filed, the time guideline of nine months had not yet expired

from the date of the final objections were filed on March 11, 2013. In fact, as of the date

Respondent rtiled on October 2, 2013, only less tlaan seven months had passed from the date of

the supplemental objections were filed.

3. The Court of Appeals Did Not Consider Nlitigatfng Factors

Respondent Nvas unable to present the mitigating factors that weiahed against issuing a

writ to rule on objections from a magistrate. The facts available to the Court of Appeals include

court records, wllieh the court had access to, but did not take judicial notice of. Oue such record

is the docket sheet, called a"Journal Query" in the Hamilton County Juvenile Court. The

docket sheet for this case shows that:

This case involves a custody dispute that was filed July 15, 2005. On January 18, 201 3,

the magistrate decided Hamilton County Jobs and Family Service ("JFS") shall have permanent

custody of the children that had been in their temporary custody for years. The children remained

in JFS's custody in foster care throughout the relevant time period. Objections were filed January

22, 2013, January 23, 2013, and March 11, 2013. Oral argument was held before Judge Hunter

on March 12, 2013. Before the court ruled, the children's father filed a petition for custody, thus

delaying the ruling on the objections to the decision to grant permane:nt custody to JF^ S.

A trial was held on August 26, 2013 on the father's custody petition. Evidence was

taken. A home study was ordered. JFS's requested a continuance, whiclz was granted. The trial

was continued to October 2, 2013. The October 2, 2013 trial was continued at the request of the

Relator, the guardian ad litem. A new trial date of November 20, 2013 was scheduled.

All of these delays in ruling arereasonable given the father's right to seek custody, and

the various parties requests for continuances of the trial on the father's custody petition. What

the court of appeals did not know when it issued its writ, because Respondent was not

represented and because Relator did not inform the court of appeals, is that JFS, the party to

whom permanent custody was awarded and objected to, requested a continuance at the August

26, 2013 hearing. After thecourt of appeals issued its writ, but before the deadline for

compliance, Relator requested a continuance of the father's custody trial on October 2, 2013.

Relator did not inforzn the Court of Appeals of its request for a delay. The continuance was

granted.

Had the Court of Appeals had all the facts before it, including the mitigating factors of

the intervening custody petition filed by the father, supplemental objections being filed two

months after the first set, two continuances being granted, one to JFS an.d one to Respondent, and

the press of other business before the court, the Court would have been able to apply the

mitigating factors and been able to find that there was no undue delay in Judge Hunter's ruling in

this case. In fact, a decision to the contrary would not serve justice in a future similar case. A

judge should be free to grant reasonable continttances to a prosecutor; to allow pal-ties time to

read a transcript before argument; and to have the parties brief issues before argument. This

flexibility allows the parties to be treated fairly and believe justice was served.

In the Hamilton County Juvez iile Court many actions take place after the filing of an

ol^jection to a magistrate's decision and before the Judge is able to rtrle on an objection: hearing

oral arguments on objections, allowing time for litigants to file supplemental objections and

present additional oral arguments, waiting during interlocutory appeals which divest the court of

jurisdiction, waiting 1or transcripts to be prepared from each hearing in the case (due to the lack

of court reporters), readiilg each transcript, and most importantly conscientiously perfozrning the

duty of the juvenile court judges to "undertake an independent review as to [any] objected

matters," see Juv. R. 40(D)(4)(d). The court of appeals did not have occasion to consider any

mitigating factors jusl.ifying a delay in the instant decision, whether systemie or specific to this

case. For this reason, the motion should be denied and the appeal be allowed to proceed.

C. The Appealis Not Moot

The standard for mootness is "when, during the pendency of an appeal, an event occurs

which precludes the granting of any effective relief even if error be found ...." IViller v. Ohio

Dep't of Con2merce, l Oth Dist. Franklin No. 86AP-825, 1987 WL 14395 (July 23, 1987)(citing

illiner v. Wilt, 82 Ohio St. 237, 92 N.E. 21 (191(1)). Effective relief is notprecluded here

because vacating the court of appeal's order granting procedendo will avoid damage to

Respondent's reputation, provide guidance to the parties including the Hainilton County Juvenile

Court on the time guidelines that apply when objections are pending in this and similar cases,

and prevent future deprioritization of cases ia:n.der the piecemeal approach pursued by Relator.

D. Conclusion

The court of appeals did not consider the systemic problems at the I-lamilton County

Juvenile Court, along with the specific issues relevant to the underlying case. Respondent was

precluded from putting on a defense due to the refusal of her statutorily mandated counsel to file

arl answer or other defensive docuntents. Respondent issued a decision in the underlying case to

avoid being held in contempt by the court of appeals. This should not preclude an appeal on the

merits. For these reasol7s, Respondent respectfully requests that Relator's motion to dismzss be

denied.
