INTRODUCTORY NOTE

1. The twenty-four resolutions adopted and the seventeen other decisions taken by the General

Conference at its thirty-ninth (1995) regular session are reproduced in this booklet.

2. The resolutions are, for ease of reference, preceded by the agenda for the session. Before

the title of each resolution a serial number is given by which it may be cited. Any footnotes to a

resolution appear immediately after the text on the left side of the page; on the right side are given

the date of the adoption of the resolution, the relevant agenda item and a reference to the record

of the meeting at which the resolution was adopted. The other decisions taken by the Conference

are presented similarly.

3. This booklet should be read in conjunction with the summary records of the General

Conference, where details of the proceedings - including voting results, where applicable - are

GC(39)/RES/1 APPLICATION BY THE REPUBLIC OF GEORGIAFOR MEMBERSHIP OF THE AGENCY

The General Conference.

(a) Having received the recommendation of the Board of Governors that the Republicof Georgia should be approved for membership of the Agency,1' and

(b) Having considered the application of the Republic of Georgia for membership in thelight of Article IV.B of the Statute,

1- Approves the Republic of Georgia for membership of the Agency; and

2. Determines, pursuant to Financial Regulation 5.09^ , that in the event of the Republic ofGeorgia becoming a Member of the Agency during the remainder of 1995 or in 1996, it shall beassessed as appropriate:

(a) For an advance or advances to the Working Capital Fund, in accordance withFinancial Regulation 7.04^; and

(b) For a contribution or contributions towards the Agency's Regular Budget, inaccordance with the principles the Conference has established for that purpose-.

GC(39)/RES/2 APPLICATION BY THE REPUBLIC OF BOSNIA ANDHERZEGOVINA FOR MEMBERSHIP OF THEAGENCY

The General Conference.

(a) Having received the recommendation of the Board of Governors that the Republicof Bosnia and Herzegovina should be approved for membership of the Agency,- and

(b) Having considered the application of the Republic of Bosnia and Herzegovina formembership in the light of Article IV.B of the Statute,

1. Approves the Republic of Bosnia and Herzegovina for membership of the Agency; and

GC(39)/RES/3 IMPLEMENTATION OF THE AGREEMENTBETWEEN THE AGENCY AND THE DEMOCRATICPEOPLE'S REPUBLIC OF KOREA FOR THEAPPLICATION OF SAFEGUARDS IN CONNECTIONWITH THE TREATY ON THE NON-PROLIFERATION OF NUCLEAR WEAPONS

The General Conference.

(a) Recalling the Board of Governors' resolutions GOV/2436 of 25 February 1993,GOV/2639 of 18 March 1993, GOV/2645 of 1 April 1993, GOV/2692 of 23 September 1993,GOV/2711 of 21 March 1994 and GOV/2742 of 10 June 1994 and General Conferenceresolutions GC(XXXVII)/RES/624 of 1 October 1993 and GC(XXXVIII)/RES/16 of 23September 1994,

(b) Noting the Director General's report contained in document GC(39)/18,

(c) Recalling further resolution 825 (1993) adopted by the Security Council of the UnitedNations on 11 May 1993 and the 31 March 1994, 30 May 1994 and 4 November 1994statements by the President of the United Nations Security Council, particularly the request totake all steps the Agency may deem necessary to verify full compliance by the DemocraticPeople's Republic of Korea (DPRK) with its safeguards agreement with the Agency,

(d) Noting that the DPRK has decided to remain a party to the Treaty on the Non-Proliferation of Nuclear Weapons and reaffirming that the IAEA-DPRK safeguards agreement(INFCIRC/403) under the Treaty remains binding and in force,

(e) Noting also the stated intention of the DPRK to come into full compliance with thesafeguards agreement and the continuing IAEA-DPRK discussions on outstanding safeguardsissues, and

(f) Regretting the withdrawal of the DPRK from the Agency and expressing the hopethat the DPRK will rejoin,

1. Strongly endorses the actions taken by the Board of Governors and commends the DirectorGeneral and the Secretariat for their impartial efforts to implement the IAEA-DPRK safeguardsagreement;

2. Commends the Secretariat for its efforts to monitor the freeze of specified facilities in theDPRK as requested by the United Nations Security Council;

3. Expresses concern over the continuing non-compliance of the DPRK with the safeguardsagreement and calls upon the DPRK to comply fully with the IAEA-DPRK safeguards agreement;

Urges the DPRK to co-operate fully with the Agency in the implementation of the safeguardsagreement and to take all steps the Agency may deem necessary to preserve, intact, all informationrelevant to verifying the accuracy and completeness of the DPRK's initial report on the inventoryof nuclear material subject to safeguards until the DPRK comes into full compliance with itssafeguards agreement; and

5. Decides to include in the agenda for its fortieth regular session an item entitled"Implementation of the agreement between the Agency and the Democratic People's Republic ofKorea for the application of safeguards in connection with the Treaty on the Non-Proliferation ofNuclear Weapons".

GC(39)/RES/4 AN AFRICAN NUCLEAR-WEAPON-FREE ZONE

The General Conference.

(a) Recalling resolution GC(XXXVIII)/RES/17 of 1994 and all other relevant resolutionsand decisions of the General Conference and the Board of Governors,

(b) Welcoming the progress made towards the conclusions of a treaty on an AfricanNuclear-Weapon-Free Zone, on the basis of the Declaration on the Denuclearization of Africaadopted by the Summit of the Organization of African Unity (OAU) at its first ordinarysession, held in Cairo from 17 to 21 July 1964, and of resolution 49/138 adopted on 19December 1994 by the General Assembly of the United Nations,

(c) Noting resolution CM/Res.1592 (LXII)/Rev.l adopted at the sixty-second meetingof the Council of Ministers of the OAU, which adopted the Pelindaba Text of the Treaty onan African Nuclear-Weapon-Free Zone on 23 June 1995, and

(d) Welcoming the offer of the Egyptian Government to host the Treaty signingceremony and the offer of the South African Government to host the Headquarters of theAfrican Nuclear Energy Commission,

1. Takes note of the report of the Director General on the establishment of an African Nuclear-Weapon-Free Zone contained in document GC(39)/14;

2. Commends the African States for their united efforts directed towards the establishment of anAfrican Nuclear-Weapon-Free Zone and requests the Director General to continue to assist themin this regard and report on the implementation of this resolution to the General Conference at itsfortieth regular session under an agenda item entitled "An African Nuclear-Weapon-Free Zone";

(b) Recalling further the resolutions of the thirty-fifth (1991), thirty-sixth (1992) andthirty-seventh (1993) General Conferences (GC(XXXV)/RES/568, GC(XXXVI)/RES/579 andGC(XXXVII)/RES/626), and the resolution of the thirty-eighth (1994) General Conference(GC(XXXVIII)/RES/19), which stressed the need for Iraq to co-operate fully with the Agencyin achieving the complete and long-term implementation of the relevant Security Councilresolutions,

(c) Reaffirming the need for full implementation by Iraq of Security Council resolutions687, 707 and 715,

(d) Taking note of the Director General's report contained in document GC(39)/10 andof his oral statement to the thirty-ninth General Conference, and

(e) Deeply concerned by the evidence, outlined in document GC(39)/10/Add. 1, that Iraqin 1990 initiated a crash programme to build a nuclear weapon,

1. Commends the Director General and the Agency's Action Team for their strenuous efforts toimplement Security Council resolutions 687, 707 and 715, and in particular their detection anddestruction or otherwise rendering harmless of equipment and materials which could have been usedfor nuclear weapons, and requests them to continue their efforts;

2. Welcomes the work done by the Agency towards establishing a mechanism for monitoringfuture sales and supplies of designated items to Iraq;

6. Demands that Iraq hand over to the Agency without further delay any currently undisclosednuclear-weapon-related equipment, material or information, as called for in Security Councilresolutions 687, 707 and 715;

Stresses that the Agency will continue to exercise its right to investigate further any aspectsof Iraq's past nuclear weapons capability, in particular as regards the new information obtained bythe Agency in August 1995 and any further relevant information that Iraq may still be withholdingfrom the Agency; and

Requests the Director General to report the views of the General Conference to the Secretary-General of the United Nations and to report to the Board of Governors and to the fortieth regularsession of the General Conference on his efforts to implement Security Council resolutions 687,707 and 715 and decides to remain seized of this issue.

(a) Recalling its resolutions embodying principles for the assessment of Members'contributions towards the safeguards component of the Agency's Regular Budget - andoperative paragraph 2 of resolution GC(XXXVI)/RES/589,

(b) Having considered the Board's recommendation in document GC(39)/23 concerningthe arrangements for the assessment of Members' contributions towards the safeguardscomponent of the Agency's Regular Budget for each of the years 1996 through 2000,

(c) Believing that the arrangements now being approved for the period 1996 through2000 should not prejudge whatever may be decided during that period, and

(d) Taking note of the Board's intention to continue its efforts to arrive at long-termarrangements for the financing of safeguards,

1- Establishes the following revised arrangements for the assessment of Members' contributionstowards the Agency's Regular Budget, to be applicable for each of the years 1996 through 2000,to supplement those contained in resolutions GC(III)/RES/50 and GC(XXI)/RES/351 and to replacethose which it approved by resolution GC(XXXVI)/RES/589:

(a) Each Member's contribution towards the Agency's Regular Budget shall comprisea non-safeguards component and a safeguards component, corresponding respectivelyto that Member's assessment in respect of:

(i) non-safeguards expenses, which shall include all expenses required to beapportioned among Members in accordance with Article XIV. D of the Statuteexcept safeguards expenses; and

(ii) safeguards expenses, which shall include all expenses relating to theAgency's safeguards activities.

(b) Non-safeguards expenses shall be borne by Members in proportion to theirrespective base rates of assessment calculated by application of the principles setforth in resolution GC(III)/RES/50, as amended by resolution GC(XXI)/RES/351.

(c) Safeguards expenses, after deduction of such amounts as are recoverable underagreements relating to safeguards between the Agency and parties to suchagreements that are not Members of the Agency, shall be borne by Members asfollows:

(i) each Member included in the list referred to in sub-paragraph (ii) below shallcontribute an amount corresponding to one half of its base rate of assessmentin respect of the safeguards component of the Regular Budget with theproviso that no such Member shall be obliged to contribute to any increasein the safeguards budget beyond zero real growth;

(ii) the list (hereinafter referred to as the "shielded" list), which shall be drawnup by the Director General (and be kept under review by the Board ofGovernors), shall comprise the Members - except the ten Members with thehighest base rates of assessment and those Members which have notified theDirector General that they do not wish to be included - having per capita netnational products of less than one third of the average per capita net nationalproduct of the fifteen Members with the highest per capita net nationalproducts, the per capita net national products being identified by examinationof the documents used by the Committee on Contributions of the GeneralAssembly of the United Nations and the "shielded" list being reviewed andadjusted, if necessary, each time new documents on per capita net nationalproducts are made available by that Committee;

(iii) any Member not included in the "shielded" list shall contribute on the basisof a scale to be determined for the year in question by proportionatelyincreasing its base rate of assessment in such a way that the totalcontributions of such Members make up the balance of the safeguardsexpenses; and

(iv) in the case of admission of a new Member of the Agency which is to beincluded in the "shielded" list referred to in sub-paragraph (ii) above, thatMember shall contribute in the year its membership becomes effective inaccordance with the provisions set out in sub-paragraph (i) above.

(d) Notwithstanding the provisions of sub-paragraph l(c)(i) above, the followingtransitional arrangements shall apply in order to mitigate the burden of significantincreases for Members having received partial relief under the existing arrangementsin respect of their assessments for the safeguards component of the Regular Budget:-'

(i) for those Members which remain in the "shielded" list referred to in sub-paragraph l(c)(ii) above, the contributions shall be determined as follows:

In each of the years 1996 through 1999 the contribution of each Member willbe calculated at half of its base rate and then compared with its contributionfor 1995. A portion of the resulting difference will be incrementally addedto the contribution for 1995, as follows:

in the first year (1996) - one fifth of the difference,in the second year (1997) - two fifths of the difference,in the third year (1998) - three fifths of the difference andin the fourth year (1999) - four fifths of the difference.

In the fifth year (2000), each Member included in the "shielded" list willcontribute its full share, i.e. in accordance with half of its base rate.

(ii) for those Members which no longer qualify for inclusion in the "shielded"list, the contributions shall be determined as follows:

In each of the years 1996 through 2004 the contribution of each Member willbe calculated in accordance with sub-paragraph l(c)(iii) and then comparedwith its contribution for 1995. A portion of the resulting difference will beincrementally added to the contribution for 1995, as follows:

in the first year (1996) - one tenth of the difference,in the second year (1997) - two tenths of the difference,in the third year (1998) - three tenths of the difference,in the fourth year (1999) - four tenths of the difference,in the fifth year (2000) - five tenths of the difference,in the sixth year (2001) - six tenths of the difference,

(e) These arrangements, applicable for each of the years 1996 through 2000, shall bereviewed by the Board in 2000 at the latest.

2. Requests the Board, in conducting the review referred to in sub-paragraph l(e), to includeconsideration of changes in the contributions of "shielded" countries, the criteria for determiningcontributions, and other relevant issues.

(d) Recognizing that decisions on implementation of the Convention are theresponsibility of States Parties,

(a) Recalling resolution GC(XXXVIII)/RES/8 on "Strengthening of the Agency'stechnical co-operation activities",

(b) Noting that the objectives of the Agency as stated in Article II of the Statute are "toaccelerate and enlarge the contribution of atomic energy to peace, health and prosperitythroughout the world" and to ensure that the assistance provided is not used to further anymilitary purpose,

(c) Noting also that one of the statutory functions of the Agency is to "encourage andassist research on, and development and practical application of, atomic energy for peacefuluses throughout the world",

(f) Conscious of the great potential of nuclear power for meeting energy requirementsin many countries and the need to protect the environment,

(g) Desiring that the Agency's resources for technical co-operation activities be assuredand sufficient,

(h) Taking note of the report by the Director General contained in document GO V/2821 -GC(39)/13, and

(i) Welcoming the decision to establish the Standing Advisory Group on TechnicalAssistance and Co-operation (SAGTAC),

1. Stresses the need, in conformity with the Statute, to strengthen technical co-operation activitiesand also their effectiveness and efficiency;

2. Requests the Director General to pursue, in consultation with Member States, efforts tostrengthen the technical co-operation activities of the Agency through the development of effectiveprogrammes aimed at improving the scientific and technological capabilities of developingcountries, account being taken of the infrastructure and the level of technology of the countriesconcerned, in the fields of peaceful applications of nuclear energy, including both the applicationsof nuclear methods and techniques and the production of electricity, and achieving sustainabledevelopment;

3. Further requests the Director General to follow-up actions on initiatives mentioned in hisreport;

4. Requests the Director General to continue to take account of the view of the GeneralConference on this question when requesting Member States to pledge their respective shares ofthe Technical Co-operation Fund targets and to make timely payments to the Fund; and

5. Requests the Director General and the Board of Governors to remain seized of this matter andfurther requests the Director General to report to the Board of Governors periodically and to theGeneral Conference at its fortieth regular session on the implementation of this resolution Underan agenda item entitled "Strengthening of the Agency's technical co-operation activities".

(a) Recalling resolutions GC(XXXIII)/RES/515, GC(XXXIV)/RES/540,GC(XXXV)/RES/563, GC(XXXVI)/RES/592, GC(XXXVII)/RES/617 andGC(XXXVIII)/RES/7,

(b) Noting the study on the "Technical and economic evaluation of potable waterproduction through the desalination of sea water by using nuclear energy or other means"attached to document GC(XXXVI)/1013, which concludes that the use of nuclear energy asan alternative option to the use of fossil fuelled plants for supplying energy for sea waterdesalination is technically feasible and in general economically competitive, and documentGOV/INF/708,

(c) Noting the main conclusion of the Advisory Group on Demonstration Facilities,attached to document GC(XXXVIII)/8, which includes the conclusion that there is a need toestablish a programme for identifying a practical set of options from which one or moredemonstration facilities with well-defined objectives might be chosen,

(d) Noting also the interest of a number of Member States in activities relating to seawater desalination using nuclear energy as reflected in document GC(XXXVII)/INF/323,

(e) Aware that the acute shortage of potable water in some Member States remains amajor problem, and

(f) Underlining the vital importance of sufficient potable water supplies for mankind andof regional and international co-operation in solving the problem of potable water shortagesin Member States and the interest of potential beneficiaries and technology holders in theprovision of low-cost potable water,

1 • Welcomes the progress made in this regard, and especially the initiation of a two-phase OptionsIdentification Programme (described in document GC(39)/12) which aims at evaluating data relevantto a demonstration programme and analysing the most practical options for demonstration;

2. Urges the Secretariat to secure sufficient funding, through appeals to international organizationsand prospective donor countries, so that the second phase of the Options Identification Programmewill be completed in 1996 and a final report presented to the General Conference for considerationat its fortieth session;

3. Requests the Director General to continue consultations with interested States, the competentorganizations of the United Nations system and other relevant intergovernmental organizationsconcerning the main conclusions of the "Technical and economic evaluation of potable waterproduction through the desalination of sea water by using nuclear energy or other means";

7. Requests the Director General to report on the progress made in the implementation of thisresolution to the Board of Governors and to the General Conference at its fortieth session underan appropriate agenda item.

GC(39)/RES/16 EXTENSIVE USE OF ISOTOPE HYDROLOGY FORWATER RESOURCES MANAGEMENT

The General Conference,

(a) Appreciating the work done by the Agency in the area of isotope hydrology inresponse to resolution GC(XXXVIII)/RES/9,

(b) Recognizing that the quality and quantity of available water resources, particularlyin arid and semi-arid zones, are inadequate and that the availability of clean water at aminimum level is essential for sustaining development,

(c) Underlining that the availability of clean drinking water directly improves humanhealth and hence contributes to the optimum utilization of economic resources,

(d) Conscious of the proven techno-economic benefits of using isotope hydrologytechniques in water resources management,

(e) Aware that these techniques can be very valuable in studying processes likeground water recharge, surface and sub-surface water interaction, water salination, seepage andthe pollution of water bodies and that their use should be integrated with conventionaltechniques, and

1 • Requests the Director General to continue to integrate the available expertise and resources ofthe Agency and Member States and to direct them towards concrete programmes for producing avisible impact by improving the quality and availability of water;

2. Requests further that the Agency continue to explore the possibility of working in conjunctionwith other concerned international organizations and to solicit their technical and financial co-operation; and

3. Also requests the Director General to report on the progress achieved in the implementationof this resolution to the Board of Governors and to the General Conference at its fortieth regularsession under an appropriate agenda item.

(b) Convinced that the Agency's safeguards can promote greater confidence amongStates and thus contribute to strengthening collective security,

(c) Considering the Treaty on the Non-Proliferation of Nuclear Weapons, the Treaty forthe Prohibition of Nuclear Weapons in Latin America and the Caribbean and the South PacificNuclear Free Zone Treaty and the Agency's essential role in applying safeguards in accordancewith the relevant articles of these treaties and noting the outcome of the 1995 Review andExtension Conference on the Treaty on the Non-Proliferation of Nuclear Weapons,

(d) Noting that decisions adopted by the Board of Governors aimed at furtherstrengthening the effectiveness of IAEA safeguards should be supported and implemented andthat the IAEA's capability to detect undeclared nuclear activities should be increased, and

1 • Stresses the need for effective safeguards in order to prevent the use of nuclear energy forprohibited purposes in contravention of safeguards agreements entered into by States andunderlining the vital importance of effective safeguards for facilitating co-operation in the field ofpeaceful uses of nuclear energy;

2. Affirms that increasing the Agency's capability to detect undeclared nuclear activities incontravention of safeguards agreements will contribute to strengthening the effectiveness ofsafeguards;

3 • Endorses the decision of the Board of Governors to authorize the Secretariat to implement atan early date, after consultations between the Secretariat and individual Member States, the firstpart of the measures it has proposed;

4. Confirms its resolve to maintain and strengthen the effectiveness and cost-efficiency of thesafeguards system in conformity with the Agency's Statute and calls upon all States to co-operatewith the Agency in implementing the decisions taken by the Board of Governors to that end;

5 • Requests the Director General to continue to develop the measures proposed under Programme93+2, in order to bring about a more effective and efficient system covering all nuclear materialin all peaceful nuclear activities within the territory of a State which has concluded a comprehensivesafeguards agreement, and to make arrangements to implement at an early date the measuresoutlined in Part 1 of document GOV/2807 after consulting individual States;

6. Also requests the Director General, taking account of the views on Part 2 of Programme 93+2expressed in the Board of Governors and at the General Conference's thirty-ninth regular sessionand the outcome of the consultations with Member States individually or collectively, to put beforethe Board of Governors as soon as possible clear proposals for the measures proposed in Part 2;and

7. Further requests the Director General to report on the implementation of this resolution to theGeneral Conference at its fortieth regular session.

(d) Noting that in application of the fourth paragraph of resolutionGC(XXXVII)/RES/622 the Director General continues to benefit from some supplementaryresources to implement the action plan, with a view to improving the status and representationof women in the Secretariat,

(e) Convinced that further efforts should be made in order to rectify the existingimbalance in the representation of women in the Professional and higher categories,particularly at the senior and policy-making levels of the Secretariat, and

(f) Noting that the United Nations has set a target of 35% representation on this issue,

Requests the Director General to continue his efforts, in keeping with the provisions of ArticleVII of the Statute, to increase substantially, particularly at the senior and policy-making levels, aswell as for scientific and technical posts, the number of female staff members, particularly fromdeveloping countries and from those other Member States which are under-represented;

3. Calls on the Director General to examine the Platform for Action developed at the UnitedNations Fourth World Conference on Women and to integrate, where applicable, the elements ofthis platform into the Agency's relevant policies and programmes;

4. Invites the Director General to establish a focal point for gender concerns in the Secretariatand for the implementation of the Platform for Action;

5. Stresses that the work should primarily be financed from the Regular Budget of the Agencybut also calls on Member States to provide voluntary contributions in order to assist with theimplementation of the Platform for Action and of the Secretariat's action plan;

6. Also calls on Member States to actively support the Agency's efforts to respond to thisresolution by ensuring that (i) vacancy notices and expert and fellowship announcements arebrought to the attention of suitably qualified women, especially for high-level posts and in scientificcareers, (ii) such women are strongly encouraged to apply and (iii) any obstacles that might impedetheir accepting employment in the Secretariat - if offered - are eliminated; and

7. Further requests the Director General to report on the implementation of this resolution to theBoard of Governors and to the General Conference at its fortieth regular session.

1. Requests the Director General to study all the implications of the proposal contained indocument GC(39)/COM.5/10 and submit a report to the Board of Governors. This report shouldtake into account the general debate undertaken in this regard, especially the view that the primaryresponsibility for deciding upon the composition of regional groups lies with the respective groupsthemselves and the view that every State has the right to participate in a regional group; and

2. Requests the Board of Governors to consider this matter and report to the General Conferenceat its fortieth session.

GC(39)/RES/23 NUCLEAR TESTING

The General Conference,

(a) Recalling United Nations General Assembly resolution 48/70 of 16 December 1993,in which the entire international community, for the first time, supported the commencementof multilateral negotiations on a Comprehensive Nuclear Test Ban Treaty,

(b) Reaffirming that a Comprehensive Nuclear Test Ban Treaty is one of the highestpriority objectives of the international community in the field of disarmament and non-proliferation,

(c) Reaffirming that a universal and internationally and effectively verifiableComprehensive Nuclear Test Ban Treaty should contribute to the prevention of theproliferation of nuclear weapons in all its aspects, to the ultimate goals of the completeelimination of nuclear weapons and a treaty on general and complete disarmament under strictand effective international control, and therefore to the enhancement of international peace andsecurity,

(d) Reaffirming the conviction that the exercise of utmost restraint in respect of nucleartesting would be consistent with the negotiation of a Comprehensive Nuclear Test Ban Treaty,as reaffirmed in United Nations General Assembly resolution 49/70 of 5 December 1994, andrecalling the undertaking of the nuclear-weapon States in this regard as well as all thePrinciples and Objectives for Nuclear Non-Proliferation and Disarmament adopted by the 1995NPT Review and Extension Conference,

(e) Recalling the important mandate and role of the International Atomic Energy Agencyin promoting non-proliferation and also nuclear safety,

(f) Recalling Article III.B.I of the Agency's Statute, which states that in carrying outits functions the Agency shall "Conduct its activities in accordance with the purposes andprinciples of the United Nations to promote peace and international co-operation, and inconformity with policies of the United Nations furthering the establishment of safeguardedworldwide disarmament and in conformity with any international agreements entered intopursuant to such policies", and

(g) Recalling United Nations General Assembly resolution 49/65 of 15 December 1994on the report of the International Atomic Energy Agency, in which the General Assembly interalia urged all States to strive for effective and harmonious co-operation in promoting the useof nuclear energy and the application of necessary measures to strengthen further the safetyof nuclear installations and to minimize the risks to life, health and the environment,

1 • Expresses grave concern at the resumption and the continuation of nuclear testing and callsupon those States which have active nuclear testing programmes in place to desist from testinguntil a Comprehensive Nuclear Test Ban Treaty enters into force;

2. Calls upon all States, particularly those with nuclear weapons programmes, to take furthereffective steps toward fulfilling their obligations as regards nuclear disarmament and the non-proliferation of nuclear weapons;

3. Expects that the negotiations for a Comprehensive Nuclear Test Ban Treaty will be completedand the Treaty signed in 1996 as may be further specified by the Fiftieth Session of the UnitedNations General Assembly, and urges all participants in the negotiations to further intensify theirefforts to this end;

4. Affirms that cessation of nuclear testing would contribute to the successful conclusion of aComprehensive Nuclear Test Ban Treaty and to the promotion of nuclear non-proliferation anddisarmament;

5- Recognizes that nuclear testing raises serious concerns about the risks to life, health and theenvironment;

6. Calls on all States concerned to fulfil their responsibilities to ensure that sites where nucleartests have been conducted are monitored scrupulously and to take appropriate steps to avoid adverseimpacts on health, safety and the environment as a consequence of such nuclear testing;

7. Requests all States concerned to inform the International Atomic Energy Agency of anyadverse impact on health, safety and the environment as a consequence of such nuclear testing asnecessary to assist the Agency to discharge its functions under the Statute; and

8. Calls for co-operation between the States concerned and the International Atomic EnergyAgency in accordance with its Statute in the implementation of the two preceding paragraphs.

GC(39)/RES/24 APPLICATION OF IAEA SAFEGUARDS IN THEMIDDLE EAST

The General Conference.

(a) Recognizing the importance of the non-proliferation of nuclear weapons - bothglobally and regionally - in enhancing international peace and security,

(b) Mindful of the usefulness of the Agency's safeguards system as a reliable means ofverification of the peaceful uses of nuclear energy,

(c) Concerned by the grave consequences, endangering peace and security, of thepresence in the Middle East region of nuclear activities not wholly devoted to peacefulpurposes,

(d) Welcoming the initiatives regarding the establishment of a zone free of all weaponsof mass destruction, including nuclear weapons, in the Middle East and recent initiativesregarding arms control in the region,

(e) Recognizing that full realization of these objectives would be promoted byparticipation of all States of the region,

(f) Commending the efforts of the Agency concerning the application of safeguards inthe Middle East and the positive response of some States in concluding a full-scope safeguardsagreement, and

(g) Recalling its resolution GC(XXXVIII)/RES/21,

1. Takes note of the Director General's report in document GOV/2825-GC(39)/20;

2. Affirms the urgent need for all States in the Middle East to forthwith accept the applicationof full-scope Agency safeguards to all their nuclear activities as an important confidence-buildingmeasure among all States in the region and as a step in enhancing peace and security in the contextof the establishment of a nuclear-weapon-free zone (NWFZ);

3. Calls upon all parties directly concerned to consider seriously taking the practical andappropriate steps required for the implementation of the proposal to establish a mutually andeffectively verifiable NWFZ in the region, and invites the countries concerned to adhere tointernational non-proliferation regimes, including the Treaty on the Non-Proliferation of NuclearWeapons, as a means of complementing participation in a zone free of all weapons of massdestruction in the Middle East and of strengthening peace and security in the region;

4. Takes note of the importance of the ongoing bilateral Middle East peace negotiations and theactivities of the multilateral working group on Arms Control and Regional Security in promotingmutual confidence and security in the Middle East, including establishment of a NWFZ, and callson the Director General, as requested by the participants, to render all necessary assistance to theworking group in promoting that objective;

5 • Requests the Director General to continue consultations with the States of the Middle East tofacilitate the early application of full-scope Agency safeguards to all nuclear activities in the regionas relevant to the preparation of model agreements, as a necessary step towards the establishmentof a NWFZ in the region, referred to in resolution GC(XXXVII)/RES/627;

6. Calls upon all States in the region to extend their fullest co-operation to the Director Generalin the fulfilment of the tasks entrusted to him in the preceding paragraph;

7. Further calls upon all States in the region to take measures, including confidence-building andverification measures, aimed at establishing a NWFZ in the Middle East;

8. Calls upon all other States, especially those with a special responsibility for the maintenanceof international peace and security, to render all assistance to the Director General by facilitatingthe implementation of this resolution; and

9. Requests the Director General to submit to the Board of Governors and to the GeneralConference at its fortieth regular session a report on the implementation of this resolution and toinclude in the provisional agenda for that session an item entitled "Application of IAEA safeguardsin the Middle East".
