    Russian Federation and United States of America: draft resolution

    The Security Council ,

     Recalling  its resolutions 1267 (1999), 1333 (2000), 1363 (2001), 1373 (2001),

    1390 (2002), 1452 (2002), 1455 (2003), 1526 (2004), 1566 (2004), 1617 (2005),1624 (2005), 1699 (2006), 1730 (2006), 1735 (2006), 1822 (2008), 1904 (2009),

    1988 (2011), 1989 (2011), 2083 (2012), 2133 (2014), 2170 (2014), 2178 (2014),

    2195 (2014), 2199 (2015), 2214 (2015), and 2249 (2015),

     Reaffirming  that terrorism in all forms and manifestations constitutes one of 

    the most serious threats to peace and security and that any acts of terrorism are

    criminal and unustifia!le re"ardless of their moti#ations, $hene#er, $here#er, and

     !y $homsoe#er committed, and reiteratin" its une%ui#ocal condemnation of the

    &slamic 'tate in &ra% and the e#ant (&'&, also no$n as *a+esh), l-.aida, and

    associated indi#iduals, "roups, undertain"s, and entities for on"oin" and multiple

    criminal terrorist acts aimed at causin" the deaths of innocent ci#ilians and other 

    #ictims, destruction of property, and "reatly underminin" sta!ility,

     Recognizing   that terrorism poses a threat to international peace and securityand that counterin" this threat re%uires collecti#e efforts on national, re"ional and

    international le#els on the !asis of respect for international la$ and the /harter of 

    the nited ations,

     Reaffirming   that terrorism cannot and should not !e associated $ith any

    reli"ion, nationality, or ci#iliation,

     Expressing   its "ra#est concern a!out the presence, #iolent etremist ideolo"y

    and actions of &'&, l-.aida, and their affiliates in the iddle ast and orth

    frica and !eyond,

     Reaffirming   its commitment to so#erei"nty, territorial inte"rity and political

    independence of all 'tates in accordance $ith the /harter of the nited ations,

     Recalling   the residential 'tatements of the 'ecurity /ouncil on threats tointernational peace and security caused !y terrorist acts of 15 anuary 2013

    ('':20131), of 28 uly 2014 ('':201414), of 19 o#em!er 2014

    ('':201423), of 29 ay 2015 ('':201511), and of 28 uly 2015

    ('':201514),

     Reaffirming  the need to com!at !y all means, in accordance $ith the /harter 

    of the nited ations and international la$, includin" applica!le international

    human ri"hts la$, international refu"ee la$, and international humanitarian la$,

    threats to international peace and security caused !y terrorist acts,  stressing  in this

    re"ard the important role the nited ations plays in leadin" and coordinatin" this

    effort,

     Recognizing   that de#elopment, security, and human ri"hts are mutually

    reinforcin" and are #ital to an effecti#e and comprehensi#e approach to counterin"

    terrorism, and underlining   that a particular "oal of counter-terrorism strate"ies

    should !e to ensure sustaina!le peace and security,

     Reaffirming  its resolution 1373 (2001) and in particular its decisions that all

    'tates shall pre#ent and suppress the financin" of terrorist acts and refrain from

     pro#idin" any form of support, acti#e or passi#e, to entities or persons in#ol#ed in

    terrorist acts, includin" !y suppressin" recruitment of mem!ers of terrorist "roups

    and eliminatin" the supply of $eapons to terrorists,

    Stressing   that terrorism can only !e defeated !y a sustained and

    comprehensi#e approach in#ol#in" the acti#e participation and colla!oration of all

    'tates and international and re"ional or"aniations to impede, impair, isolate, andincapacitate the terrorist threat,

     Emphasizing   that sanctions are an important tool under the /harter of the

    nited ations in the maintenance and restoration of international peace and

    security, includin" in support of counterin" terrorism, and  stressing   in this re"ard

    the need for ro!ust implementation of the measures in para"raph 2 of this

    resolution,

     Recalling  that &'& is a splinter "roup of l-.aida, and recalling   further that

    any indi#idual, "roup, undertain", or entity supportin" &'& or l-.aida is eli"i!le

    for listin",

    Condemning  the fre%uent, recent terrorist attacs perpetrated !y &'& around

    the $orld resultin" in numerous casualties, recognizing   the need for sanctions to

    reflect current threats and, in this re"ard, recalling  para"raph 7 of resolution 2249,

     Reminding   all 'tates that they ha#e an o!li"ation to tae the measures

    descri!ed in para"raph 2 $ith respect to all indi#iduals, "roups, undertain"s, and

    entities included on the list created pursuant to resolutions 1267 (1999), 1333

    (2000), 1989 (2011), 2083 (2012), and 2161 (2014) (no$ and hereunder referred to

    as the ;&'& (*a+esh) < l-.aida 'anctions ist=), re"ardless of the nationality or 

    residence of such indi#iduals, "roups, undertain"s, or entities,

    Urging  all em!er 'tates to participate acti#ely in maintainin" and updatin"

    the &'& (*a+esh) < l-.aida 'anctions ist !y contri!utin" additional information

     pertinent to current listin"s, su!mittin" delistin" re%uests $hen appropriate, and !y

    identifyin" and nominatin" for listin" additional indi#iduals, "roups, undertain"s,

    and entities $hich should !e su!ect to the measures referred to in para"raph 2 of this resolution,

     Reminding  the /ommittee esta!lished pursuant to resolutions 1267 (1999) and

    1989 (2011) (;the /ommittee=) to remo#e epeditiously and on a case-!y-case !asis

    indi#iduals, "roups, undertain"s, and entities that no lon"er meet the criteria for 

    listin" outlined in this resolution, welcoming   impro#ements to the /ommittee+s

     procedures and the format of the &'& (*a+esh) < l-.aida 'anctions ist,

    expressing  its intent to continue efforts to ensure that procedures are fair and clear,

    and recognizing   the challen"es, !oth le"al and other$ise, to the measures

    implemented !y em!er 'tates under para"raph 2 of this resolution,

     Recognizing  the importance of !uildin" capacities of em!er 'tates to counter 

    terrorism and terrorist financin",

    Welcoming   a"ain the esta!lishment of the >ffice of the >m!udsperson

     pursuant to resolution 1904 (2009) and the enhancement of the >m!udsperson+s

    mandate in resolutions 1989 (2011), 2083 (2012), and 2161 (2015), noting   the

    >ffice of the >m!udsperson+s si"nificant contri!ution in pro#idin" additional

    fairness and transparency, and recalling  the 'ecurity /ouncil+s firm commitment to

    ensurin" that the >ffice of the >m!udsperson is a!le to continue to carry out its role

    effecti#ely and independently, in accordance $ith its mandate,

    Welcoming   the >m!udsperson+s !iannual reports to the 'ecurity /ouncil,

    includin" the reports su!mitted on 21 anuary 2011, 22 uly 2011, 20 anuary 2012,

    30 uly 2012, 31 anuary 2013, 31 uly 2013, 31 anuary 2014, 31 uly 2014, and

    2 ?e!ruary 2015,

    Welcoming   the continuin" cooperation !et$een the /ommittee and&:>, the nited ations >ffice on *ru"s and /rime, in particular on

    technical assistance and capacity-!uildin", and all other nited ations !odies, and

     strongly encouraging   further en"a"ement $ith the /ounter :errorism

    &mplementation :as ?orce (/:&:?) to ensure o#erall coordination and coherence in

    the counter-terrorism efforts of the nited ations system,

     Recalling   its resolutions 2199 (2015) and 2133 (2014) stron"ly condemnin"

    idnappin" and hosta"e-tain" committed !y terrorist "roups for any purpose,

    includin" $ith the aim of raisin" funds or "ainin" political concessions, epressin"

    its determination to pre#ent idnappin" and hosta"e-tain" committed !y terrorist

    "roups and to secure the safe release of hosta"es $ithout ransom payments or 

     political concessions in accordance $ith applica!le international la$, reiterating its

    call upon  all em!er 'tates to pre#ent terrorists from !enefitin" directly or 

    indirectly from ransom payments or from political concessions and to secure the

    safe release of hosta"es, and $elcomin" the endorsement !y the @lo!al

    /ounterterrorism ?orum (@/:?) in 'eptem!er 2015 of the ;ddendum to the

    l"iers emorandum on @ood ractices on re#entin" and *enyin" the Aenefits of 

    Bidnappin" for ansom !y :errorists=,

    Gravely concerned   that in some cases &'&, l-.aida, and associated

    indi#iduals, "roups, undertain"s, and entities continue to profit from in#ol#ement

    in transnational or"anied crime, and expressing concern that terrorists !enefit from

    transnational or"anied crime in some re"ions, includin" from the trafficin" of 

    arms, persons, dru"s, and artefacts, and from the illicit trade in natural resources

    includin" "old and other precious metals and stones, minerals, $ildlife, charcoal

    and oil, as $ell as from idnappin" for ransom and other crimes includin" etortion

    and !an ro!!ery,

     Recognizing  the need to tae measures to pre#ent and suppress the financin"

    of terrorism, terrorist or"aniations, and indi#idual terrorists e#en in the a!sence of 

    a lin to a specific terrorist act, includin" from the proceeds of or"anied crime,

    inter alia, the illicit production and trafficin" of dru"s and their chemical

     precursors, and recallin" para"raph 5 of resolution 1452,

     Recognizing   the need for em!er 'tates to pre#ent the a!use of  

    non-"o#ernmental, non-profit and charita!le or"aniations !y and for terrorists, and

    calling upon  non-"o#ernmental, non-profit, and charita!le or"aniations to pre#ent

    and oppose, as appropriate, attempts !y terrorists to a!use their status, $hile

    recallin" the importance of fully respectin" the ri"hts to freedom of epression and

    association of indi#iduals in ci#il society and freedom of reli"ion or !elief, and

    welcoming  the rele#ant updated Aest ractices aper issued !y the ?inancial ction

    :as ?orce for the appropriate, ris-!ased implementation of the international

    standard related to pre#entin" terrorist a!use of the non-profit sector,

     Recalling   its decision that em!er 'tates shall eliminate the supply of 

    $eapons, includin" small arms and li"ht $eapons, to terrorists, as $ell as its calls

    on 'tates to find $ays of intensifyin" and acceleratin" the echan"e of operational

    information re"ardin" traffic in arms, and to enhance coordination of efforts on

    national, su!re"ional, re"ional, and international le#els,

     Expressing concern at the increased use, in a "lo!alied society, !y terrorists

    and their supporters, of ne$ information and communications technolo"ies, in

     particular the &nternet, to facilitate terrorist acts, and condemning  their use to incite,recruit, fund, or plan terrorist acts,

     Expressing concern at the flo$ of international recruits to &'&, l-.aida, and

    associated "roups and the scale of this phenomenon, and recalling   its resolution

    2178 (2014) decidin" that em!er 'tates shall, consistent $ith international human

    ri"hts la$, international refu"ee la$, and international humanitarian la$, pre#ent

    and suppress the recruitin", or"aniin", transportin", or e%uippin" of forei"n

    terrorist fi"hters and the financin" of their tra#el and of their acti#ities,

     Reiterating  the o!li"ation of em!er 'tates to pre#ent the entry into or transit

    throu"h their territories of any indi#idual a!out $hom that 'tate has credi!le

    information that pro#ides reasona!le "rounds to !elie#e that he or she is seein"

    entry into or transit throu"h their territory for the purpose of participatin" in the

    forei"n terrorist fi"hter-related acti#ities descri!ed in para"raph 6 of resolution2178 (2014), and reiterating  further the o!li"ation of em!er 'tates to pre#ent the

    mo#ement of terrorist "roups, in accordance $ith applica!le international la$, !y,

    inter alia, effecti#e !order controls, and, in this contet, to echan"e information

    epeditiously, impro#e cooperation amon" competent authorities to pre#ent the

    mo#ement of terrorists and terrorist "roups to and from their territories, the supply

    of $eapons for terrorists, and financin" that $ould support terrorists,

    Condemning  any en"a"ement in direct or indirect trade, in particular of oil and

    oil products, modular refineries, and related materiel includin" chemicals and

    lu!ricants, $ith &'&, ?, and associated indi#iduals, "roups, undertain"s, and

    entities desi"nated !y the /ommittee pursuant to resolutions 1267 (1999) and 1989

    (2011), and reiterating   that such en"a"ement $ould constitute support for such

    indi#iduals, "roups, undertain"s, and entities and may lead to further listin"s !ythe /ommittee,

    Condemning  the destruction of cultural herita"e in &ra% and 'yria particularly

     !y &'& and ?, includin" tar"eted destruction of reli"ious sites and o!ectsC and

    recalling its decision that all em!er 'tates shall tae appropriate steps to pre#ent

    the trade in &ra%i and 'yrian cultural property and other items of archaeolo"ical,

    historical, cultural, rare scientific, and reli"ious importance ille"ally remo#ed from

    &ra% since 6 u"ust 1990 and from 'yria since 15 arch 2011, includin" !y

     prohi!itin" cross-!order trade in such items, there!y allo$in" for their e#entual safe

    return to the &ra%i and 'yrian people,

     Recalling   its resolution 2178 (2015) epressin" concern $ith the continued

    threat posed to international peace and security !y &'&, l-.aida, and associated

    indi#iduals, "roups, undertain"s, and entities, and reaffirming  its resol#e to addressall aspects of that threat, includin" terrorist acts perpetrated !y forei"n terrorist

    fi"hters,

    Condemning  in the stron"est terms a!ductions of $omen and children !y &'&,

    ?, and associated indi#iduals, "roups, undertain"s, and entities and recallin"

    resolution 2242 (2015), expressing  outra"e at their eploitation and a!use, includin"

    rape, seual #iolence, forced marria"e, and ensla#ement !y these entities,

    encouraging  all 'tate and non-state actors $ith e#idence to !rin" it to the attention

    of the /ouncil, alon" $ith any information that such human trafficin" may support

    the perpetrators financially, emphasizing   that this resolution re%uires 'tates to

    ensure that their nationals and persons $ithin their territory do not mae a#aila!le

    any funds, financial assets or economic resources for &'&+s !enefit, and noting  that

    any person or entity $ho transfers funds to &'& directly or indirectly in connection$ith such eploitation and a!use $ould !e eli"i!le for listin" !y the /ommittee,

    Welcoming  the efforts of the 'ecretariat to standardie the format of all nited

     ations sanctions lists to facilitate implementation !y national authorities, further 

    welcoming   the 'ecretariat+s efforts to translate all list entries and narrati#e

    summaries of reasons for listin" a#aila!le in all official lan"ua"es of the nited

     ations, and encouraging   the 'ecretariat, $ith the assistance of the onitorin"

    :eam, as appropriate, to continue its $or to implement the data model appro#ed !y

    the /ommittee,

     cting  under /hapter D&& of the /harter of the nited ations,

     !easures

    1E   "ecides that, from the date of adoption of this resolution, the 12671989

    l-.aida 'anctions /ommittee shall henceforth !e no$n as the ;12671989225F

    &'& (*a+esh) and l-.aida 'anctions /ommittee= and the l-.aida 'anctions ist

    shall henceforth !e no$n as the ;&'& (*a+esh) and l-.aida 'anctions ist=C

    2E   "ecides  that all 'tates shall tae the follo$in" measures as pre#iously

    imposed !y para"raph 8 (c) of resolution 1333 (2000), para"raphs 1 and 2 of 

    resolution 1390 (2002), and para"raphs 1 and 4 of resolution 1989 (2011), $ith

    respect to &'& (also no$n as *a+esh), l-.aida, and associated indi#iduals,

    "roups, undertain"s and entitiesG

     sset #reeze

    (a) ?reee $ithout delay the funds and other financial assets or economicresources of these indi#iduals, "roups, undertain"s and entities, includin" funds

    deri#ed from property o$ned or controlled directly or indirectly, !y them or !y

     persons actin" on their !ehalf or at their direction, and ensure that neither these nor 

    any other funds, financial assets or economic resources are made a#aila!le, directly

    or indirectly for such persons+ !enefit, !y their nationals or !y persons $ithin their 

    territoryC

    Travel $an

    (!) re#ent the entry into or transit throu"h their territories of these

    indi#iduals, pro#ided that nothin" in this para"raph shall o!li"e any 'tate to deny

    entry or re%uire the departure from its territories of its o$n nationals and this

     para"raph shall not apply $here entry or transit is necessary for the fulfilment of a udicial process or the /ommittee determines on a case-!y-case !asis only that entry

    or transit is ustifiedC

    (c) re#ent the direct or indirect supply, sale, or transfer to these indi#iduals,

    "roups, undertain"s and entities from their territories or !y their nationals outside

    their territories, or usin" their fla" #essels or aircraft, of arms and related materiel of 

    all types includin" $eapons and ammunition, military #ehicles and e%uipment,

     paramilitary e%uipment, and spare parts for the aforementioned, and technical

    ad#ice, assistance or trainin" related to military acti#itiesC

     &isting Criteria

    3E   "ecides  that acts or acti#ities indicatin" that an indi#idual, "roup,

    undertain" or entity is associated $ith &'& or l-.aida and therefore eli"i!le for 

    inclusion in the &'& (*a+esh) < l-.aida 'anctions ist includeG

    (a) articipatin" in the financin", plannin", facilitatin", preparin", or 

     perpetratin" of acts or acti#ities !y, in conunction $ith, under the name of, on

     !ehalf of, or in support ofC

    (!) 'upplyin", sellin" or transferrin" arms and related materiel toC

    (c) ecruitin" forC or other$ise supportin" acts or acti#ities of l-.aida,

    &'&, or any cell, affiliate, splinter "roup or deri#ati#e thereofC

    4E   'otes that such means of financin" or support include !ut are not limitedto the use of proceeds deri#ed from crime, includin" the illicit culti#ation,

     production and trafficin" of narcotic dru"s and their precursorsC

    5E   Confirms that any indi#idual, "roup, undertain" or entity either o$ned

    or controlled, directly or indirectly, !y, or other$ise supportin", any indi#idual,

    "roup, undertain" or entity associated $ith l-.aida or &'&, includin" on the &'&

    (*a+esh) < l-.aida 'anctions ist, shall !e eli"i!le for listin"C

    6E   Confirms  that the re%uirements in para"raph 2 (a) a!o#e apply to

    financial and economic resources of e#ery ind, includin" !ut not limited to those

    used for the pro#ision of &nternet hostin" and related ser#ices, used for the support

    of l-.aida, &'&, and other indi#iduals, "roups, undertain"s or entities included

    on the &'& (*a+esh) < l-.aida 'anctions istC

    7E   Confirms that the re%uirements in para"raph 2 (a) a!o#e apply to funds,

    financial assets or economic resources that may !e made a#aila!le, directly or 

    indirectly, to or for the !enefit of listed indi#iduals in connection $ith their t ra#el,

    includin" costs incurred $ith respect to transportation and lod"in", and that such

    tra#el-related funds, other financial assets or economic resources may only !e

     pro#ided in accordance $ith the eemption procedures set out in para"raphs 1 and 2

    of resolution 1452 (2002), as amended !y resolution 1735 (2006), and in

     para"raphs 10, 74 and 75 !elo$C

    8E   Confirms further   that the re%uirements in para"raph 2 (a) a!o#e shall

    also apply to the payment of ransoms to indi#iduals, "roups, undertain"s or entities

    on the &'& (*a+esh) < l-.aida 'anctions ist, re"ardless of ho$ or !y $hom the

    ransom is paidC

    9E   Reaffirms that em!er 'tates may permit the addition to accounts froen

     pursuant to the pro#isions of para"raph 2 a!o#e of any payment in fa#our of listed

    indi#iduals, "roups, undertain"s or entities, pro#ided that any such payments

    continue to !e su!ect to the pro#isions in para"raph 2 a!o#e and are froenC

    10E   Encourages  em!er 'tates to mae use of the pro#isions re"ardin"

    a#aila!le eemptions to the measures in para"raph 2 (a) a!o#e, set out in para"raphs

    1 and 2 of resolution 1452 (2002), as amended !y resolution 1735 (2006), confirms

    that eemptions to the tra#el !an must !e su!mitted !y em!er 'tates, indi#iduals

    or the >m!udsperson, as appropriate, includin" $hen listed indi#iduals tra#el for 

    the purpose of fulfillin" reli"ious o!li"ations, and notes  that the ?ocal oint

    mechanism esta!lished in resolution 1730 (2006) may recei#e eemption re%uests

    su!mitted !y, or on !ehalf of, an indi#idual, "roup, undertain" or entity on the &'&(*a+esh) < l-.aida 'anctions ist, or !y the le"al representati#e or estate of such

    indi#idual, "roup, undertain" or entity, for /ommittee consideration, as descri!ed

    in para"raph 76 !elo$C

     !easures implementation

    11E   Reiterates  the importance of all 'tates identifyin", and if necessary

    introducin", ade%uate procedures to implement fully all aspects of the measures

    descri!ed in para"raph 2 a!o#eC

    12E   Reaffirms  that those responsi!le for committin", or"aniin", or 

    supportin" terrorist acts must !e held accounta!le, recalls its decision in resolution

    1373 (2001) that em!er 'tates shall afford one another the "reatest measure of 

    assistance in connection $ith criminal in#esti"ations or criminal proceedin"s

    relatin" to the financin" or support of terrorist acts, includin" assistance in

    o!tainin" e#idence in their possession necessary for the proceedin"s, underlines the

    importance of fulfillin" this o!li"ation $ith respect to such in#esti"ations or 

     proceedin"s in#ol#in" &'&, l-.aida and associated indi#iduals, "roups,

    undertain"s and entities, and urges em!er 'tates to pro#ide full coordination in

    such in#esti"ations or proceedin"s, especially $ith those 'tates $here, or a"ainst

    $hose citiens, terrorist acts are committed, in accordance $ith their o!li"ations

    under international la$, in order to find and !rin" to ustice, etradite, or prosecute

    any person $ho supports, facilitates, participates or attempts to participate in the

    direct or indirect financin" of acti#ities conducted !y &'&, l-.aida and associated

    indi#iduals, "roups, undertain"s and entitiesC

    13E   Reiterates em!er 'tates+ o!li"ation to ensure that their nationals and persons in their territory not mae a#aila!le economic resources to &'&, l-.aida,

    and associated indi#iduals, "roups, undertain"s, and entities, recalls also that this

    o!li"ation applies to the direct and indirect trade in oil and refined oil products,

    modular refineries, and related material includin" chemicals and lu!ricants, and

    other natural resources, and recalls further   the importance of all em!er 'tates

    complyin" $ith their o!li"ation to ensure that their nationals and persons $ithin

    their territory do not mae donations to indi#iduals and entities desi"nated !y the

    /ommittee or those actin" on !ehalf of or at the direction of desi"nated indi#iduals

    or entitiesC

    14E   Encourages all em!er 'tates to more acti#ely su!mit to the /ommittee

    esta!lished pursuant to resolutions 1267 (1999) and 1989 (2011) listin" re%uests of 

    indi#iduals and entities supportin" &'&, l-.aida, and associated indi#iduals,"roups, undertain"s and entities, and directs the /ommittee to immediately

    consider, in accordance $ith its resolution 2199 (2015), desi"nations of indi#iduals

    and entities en"a"ed in financin", supportin", facilitatin" acts or acti#ities,

    includin" in oil and anti%uities trade-related acti#ities $ith &'&, l-.aida, and

    associated indi#iduals, "roups, undertain"s and entitiesC

    15E   Expresses  increasin" concern a!out the lac of implementation of 

    resolutions 1267 (1999), 1989 (2011), and 2199 (2015), includin" the insufficient

    le#el of reportin" !y em!er 'tates to the /ommittee on the measures they ha#e

    on the criminaliation of terrorist financin" to incorporate the rele#ant element of '/ 2178, specifically clarifyin" that terrorist financin" includes the financin"

    of the tra#el of indi#iduals $ho tra#el or attempt to tra#el to a 'tate other than their 

    'tates of residence or nationality for the purpose of the perpetration, plannin", or 

     preparation of, or participation in, terrorist acts or the pro#idin" or recei#in" of 

    terrorist trainin", and highlights  that ?:? ecommendation 5 applies to the

    financin" of terrorist or"aniations or indi#idual terrorists for any purpose,

    70E   Reaffirms that, prior to the unfreein" of any assets that ha#e !een froen

    entity on the &'& (*a+esh) < l-.aida 'anctions ist or !y the le"al representati#e

    or estate of such indi#idual, "roup, undertain" or entity (;the petitioner=)E

    :he /ouncil recalls that em!er 'tates are not permitted to su!mit delistin"

     petitions on !ehalf of an indi#idual, "roup, undertain" or entity to the >ffice of the

    2E ?or delistin" petitions not returned to the petitioner, the >m!udsperson shall

    immediately for$ard the delistin" re%uest to the mem!ers of the /ommittee,

    nited ations !odies, and any other 'tates deemed rele#ant !y the >m!udspersonE
