RESOLUTION NO. 798Series of 2006

APPROVING THE COMPREHENSIVE LAND USE PLANAND ZONING ORDINANCE OF CAGAYAN DE ORO CITY

WHEREAS, the Board is empowered under Letter of InstructionNo. 729, Executive Order (EO) No. 648 s. 1981 as amended by EONo. 90 s. 1986, Republic Act (RA) No. 7279. and RA No. 7160, theLocal Government Code, as implemented by EO No. 72 s. 1991, toreview and ratify land use plans of Highly Urbanized Cities to ensuretheir compliance with national standards;

WHEREAS, CAGAYAN DE ORO CITY has completed theformulation of its Comprehensive Land Use Plan and ZoningOrdinance (CLUP and ZO), 2000-2010, through the City DevelopmentCouncil and the City Planning and Development Office;

WHEREAS, the CLUP has been adopted by the SangguniangPanlungsod under SP Resolution No. 7959-2001, S. 2001 dated 10December 2001; City Ordinance No. 10384-2006, dated 20 November2006, enacting the zoning ordinance of the city;

WHEREAS, the Regional Land Use Committee approved andhas favorably endorsed to the Board the approval of said CLUP andZO through RLUC Resolution No.1, S. 2003 dated 25 March 2003;

WHEREAS, the city has complied with the prescribeddocumentary and procedural requirements in the plan formulationprocess;

WHEREAS. after a review of the above plan pursuant to theCLUPIZO review and approval process under HLURB AdministrativeNo. 01. Series of 1996, the Board finds that the Comprehensive Land ,­Use Plan and Zoning Ordinance of CAGAYAN DE ORO CITY. 2000­2010, substantially complies with national standards and guidelines oncomprehensive land use plan fonnulation;
