PERMISSION FOR DEVELOPMENT

TOWN AND COUNTRY PLANNING

(DEVELOPMENT MANAGEMENT PROCEDURE) (ENGLAND) ORDER 2010 In pursuance of its powers under the above mentioned Act and Order Cheltenham Borough Council, as the Local Planning Authority, hereby PERMITS the following development:- Erection of a building comprising shop unit and 2 bed flat at ground floor level, 2no x 2bed apartments on first and second floors, 2no x1 bed apartments on third floor. Provision of car parking facilities and a single storey building for storage of waste and bicycles AT : 385 - 387 High Street Cheltenham Gloucestershire in accordance with the conditions specified hereunder:- 1 The development hereby permitted shall be begun before the expiration of five years from

the date of this permission. Reason: To accord with the provisions of Section 91 of the Town and Country Planning Act

1990, as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. 2 The development hereby permitted shall be carried out in accordance with drawing

numbers A-100-01 B; A-100-03 A; A-100-04 A; A-100-05 A; A-200-01 A; A-200-02 A; A-200-03 A; A-200-04 A; A-200-05; A-200-06 A; A-200-07 A; A-200-08 A; A-200-09 A and A-200-10 A received 29.05.12 and 19.06.12.

Reason: To ensure the development is carried out in strict accordance with the approved drawings.

3 Prior to the commencement of development, the design and details including materials and

finishes of the following shall be submitted to and approved in writing by the Local Planning Authority:

a) Typical window section including reveal, heads and cills; b) Typical door details; c) Bay window; d) Projecting eaves; e) Parapet; f) Balustrade detail

The design and details shall be accompanied by elevations and section drawings to a minimum scale of 1:5 together with full size cross section profiles. The works shall thereafter be implemented strictly in accordance with the agreed details.

Reason: To ensure a satisfactory form of development in accordance with Local Plan Policies CP3 and CP7 relating to sustainable environment and design. These are important details which need to be constructed in the traditional local manner to ensure that the development is compatible with its surroundings.

4 Prior to the commencement of development, samples of the following items shall be

submitted to and approved in writing by the Local Planning Authority: a) red brick; b) grey aluminimum cladding panel; c) grey spandrel panel The facing materials used in the development shall thereafter be in accordance with the

samples so approved. Reason: To ensure a satisfactory form of development in accordance with Local Plan

Policy CP7 relating to design. 5 Notwithstanding the submitted details, prior to the occupation of the residential units, a

lighting scheme to improve the lighting levels of the footpath to west of the site shall be submitted to and approved in writing by the Local Planning Authority. The lighting shall thereafter be implemented and maintained as per the approved details. The scheme shall include the type of lighting proposed, the level of lux omitted and a management programme demonstrating the hours of use.

Reason: To ensure that the footpath is well lit and accessible to future occupants in accordance with policy CP4 of the Local Plan.

6 The proposed dwellings shall not be occupied until car parking has been provided in

accordance with the submitted plan and that area shall not thereafter be used for any purpose other than the parking of vehicles.

Reason: To ensure that adequate off-road parking is provided. 7 The proposed dwellings shall not be occupied until secured and covered cycle storage

facilities have been provided in accordance with the submitted plans and those facilities shall be maintained available for use at all times thereafter.

Reason: To ensure that adequate cycle storage facilities are provided in line with the Governments declared aims towards sustainable modes of travel.

8 The proposed dwellings shall not be occupied until the bin and recycling stores have been

provided in accordance with the submitted plans and those facilities shall be maintained available for use at all times thereafter.

Reason: To ensure that adequate provision for the storey of bikes and recycling is provided within the site, in accordance with policy CP7 which relates to good design.

9 Prior to the commencement of development, the surface water drainage system shall be

designed in accordance with the principles of Sustainable Drainage Systems (SUDS). This shall include a maintenance strategy and full details (including calculations) shall be submitted to and approved by the Local Planning Authority. Prior to the first occupation of any part of the development, the surface water drainage system shall be completed in all respects in accordance with the details approved and shall be retained as such thereafter.

Reason: To ensure the surface water drainage system does not contribute to flooding or pollution of the watercourse in accordance with Local Plan Policy UI3 relating to sustainable drainage systems.

10 Prior to the commencement of development, a detailed scheme for boundary walls, fences or other means of enclosure shall be submitted to and approved in writing by the Local Planning Authority and the boundary walls, fences or other means of enclosure shall be erected before the development hereby permitted is first occupied.

Reason: To ensure that the development is completed in a manner that is sympathetic to the site and its surroundings in accordance with Local Plan Policy CP7 relating to design.

11 Notwithstanding the provisions of the Town and Country Planning (General Permitted

Development) Order 1995 (or any order revoking and/or re-enacting that order) the lower panes of glass to the bedroom and kitchen windows to the ground floor apartment shall be non-opening and glazed with obscure glass and shall be maintained as such thereafter.

Reason: To safeguard the amenities of future occupants in accordance with Local Plan Policy CP4 relating to safe and sustainable living.

12 Prior to the commencement of works, a schedule of measures to be taken to deter seagulls

from nesting on the property shall be submitted to and approved in writing by the Local Planning Authority. The measures so approved shall be implemented and maintained on site to the satisfaction of the Local Planning Authority.

Reason: In order to protect the amenities of residents in accordance with Local Plan Policy CP4 relating to safe and sustainable living.

13 Prior to the commencement of development, a scheme for the provision or improvement of

recreational facilities to serve the proposed dwelling(s) shall be submitted to and approved in writing by the Local Planning Authority. The dwelling(s) shall not be occupied until the approved scheme has been implemented.

Reason: To avoid any increase in the Borough's imbalance between population and the provision of outdoor play space and related facilities in accordance with Local Plan Policy RC6 relating to play space in residential development.

INFORMATIVES :- 1 Town and Country Planning (General Development Procedure) (Amendment) Order 2003 The proposed development has been considered against the following Development Plan

Policies and, in the opinion of the Local Planning Authority, does not conflict with those policies:

a) The general design approach of the proposed in terms of scale, form, siting, design and

materials is considered acceptable to the site and its surroundings (Local Plan Policy CP7) b) The proposed development has taken full account of neighbouring residential amenities

and would not materially harm the amenities of occupiers of neighbouring properties by reason of loss of light or privacy (Local Plan Policy CP4)

c) The proposed development would not be detrimental to highway safety (Local Plan Policy TP1).

The development is considered to be in accordance with the above policies and no other

material consideration suggests outweighing these policies with a decision other than to permit.

If you are aggrieved by the decision of your local planning authority to refuse permission for the proposed development or to grant it subject to conditions, then you can appeal to the Secretary of State under section 78 of the Town and Country Planning Act 1990.

If you want to appeal against your local planning authority’s decision then you must do so within 6 months of the date of this notice.

The Secretary of State need not consider an appeal if it seems to him that the local planning authority could not have granted planning permission for the proposed development or could not have granted it without the conditions they imposed, having regard to the statutory requirements, to the provisions of any development order and to any directions given under a development order.

In practice, the Secretary of State does not refuse to consider appeals solely because the local planning authority based their decision on a direction given by him.
