Each binder and any container for the binder(s) must be labeled on the outside with the Proposer’s name, address, the RFP number and the RFP name. Each USB drive must be labeled with the RFP number and the vendor name. Proposals will be received at the above address until April 11, 2018, 10:00 a.m., Central Standard Time. A Pre-Proposal Conference will be held in conjunction with the RFP on February 28, 2018, 10:00 a.m., Conference Room 2NE32, 4400 West 18th Street, Houston, Texas 77092. Submitting proposals prior to the pre-proposal conference is not recommended, and such Submitting proposals prior to the pre-proposal conference is not recommended, and such proposals may be rejected by HISD. A more detailed timeline is set out in the Instructions, Submission Requirements and Procedures section of the RFP. Proposals will be reviewed as received in a manner that avoids disclosure to competing proposals. Contents of proposals will remain confidential during the negotiations period. Only the project [RFP] number and the identity of the Proposer(s) submitting the proposal will be made available to the public before award of the RFP. Faxed or emailed proposals will not be accepted. Proposals must be submitted in sufficient time to be received and time-stamped at the above location on or before the proposal due date and time. HISD will not be responsible for proposals delivered late by the United States Postal Service, or any other delivery or courier services. Proposals received after the Proposal due date and time will not be considered. The designated Sourcing Specialist during the proposal process shall be Demetria Thomas, Procurement Services, 4400 West 18th Street, Houston, Texas 77092, [email protected] . All communications pertaining to the RFP shall be addressed in writing to the Sourcing Specialist, as indicated in the next paragraph. Questions concerning the RFP will be answered only if sent to the Procurement Services Department, in writing via email to [email protected] not later than 5:00 p.m. Central Standard Time March 28, 2018. All questions submitted in writing to the Sourcing Specialist prior to the deadline will be answered in the form of addenda. All addenda will be posted on the HISD Procurement website. The General Terms and Conditions for Requests for Proposals governs this RFP and any contract(s) awarded under this RFP. SECTION II: SCOPE OF WORK

2.1 SCOPE OF WORK: At a minimum, the scope of services required by the successful firm shall consist of the following: Third-Party Claims Administration Services for Automobile, General, & Professional Liability Claims. A standard agreement which results from this RFP shall be for a period of three (3) years from the effective date of the Agreement with an exclusive option by the District to renew on an annual basis thereafter for two (2) additional one-year terms. This project will be awarded via a Master Services Contract. The Master Services Contract is included with this and cannot be modified and must be signed and returned with your company’s Proposal. The District intends to award this bid to a single or multiple firm(s) selected to provide the “best value“ to HISD per section 2.5 Evaluation Factors. The Houston Independent School District (HISD), with more than 216,106 students and encompassing 333 square miles within greater Houston, is the seventh-largest public school system in the nation and the largest in Texas. HISD has approximately 350 locations including 8 early childhood centers, 160 elementary schools, 38 middle schools, 39 high schools, and 42 combined/other schools. Annually, for the past three fiscal years the District has spent an average of $153,343 for Third-Party Claims Administration Services for Automobile, General, & Professional Liability Claims. The dollar value provided is no guarantee of what HISD intends to spend in the future. This amount can increase or decrease depending on the demand for these goods and services. This amount is not a guarantee of future business. It is HISD’s intent to obtain a three-year agreement with the selected supplier(s) with two one-year extensions. The inception dates of the agreements are to pick up the day after the policies from the previous provider(s) end in June 2018 for the following:

Automobile Liability General Liability Professional Liability

A. HISD Automobile Liability Claims

1. The TPA will investigate, evaluate and adjust each automobile claim reported. The established settlement authority is $5,000 for bodily injury and $20,000 for property damage. Settlement offers in excess of this amount require prior HISD approval. Recorded statements are to be taken on all Automobile Liability claims.

2. The TPA will provide HISD with monthly risk management information reports, including a loss run, check register, bank statement and account reconciliation. Claim payments are made daily or as needed by the TPA using a positive pay system. The TPA will provide a notice of payments to be issued, and HISD Risk Management will approve them prior to issuance.

3. HISD would prefer that Automobile Liability adjusters have a minimum of three years claim

handling experience (resumes required). Adjusters must be licensed by the Texas Department of Insurance. Should the adjuster prove unsatisfactory in performing their assigned duties, immediate replacement of the adjuster is required.

4. All open files must be kept on a current diary system, which provides for periodic reviews by the

handling adjuster. Each file shall be reviewed and updated as necessary. Such reviews will occur at least once every 30 days.

5. HISD has the authority to audit any and/or all files maintained by the Vendor and requires

adequate internal controls. Vendors are required to provide these procedures to protect the District from any type of financial loss. Any files of choice may be audited by HISD on a quarterly basis. Appropriate Vendor adjusters and their supervisor will be required to attend audit sessions to be held on site.

6. As of December 1, 2005, HISD has self-insured its Automobile Liability exposures. HISD Transportation Services is the largest provider of school bus service in the state. The Transportation Services Department employs over 1400 employees and operates approximately 850 buses, transporting more than 31,000 students daily to and from school and other activities. The HISD bus fleet travels more than 86,000 miles per day and approximately 15 million miles annually.

7. Under Texas Civil Practices and Remedies Code Section 101.023 (b) and Section 101.051, the

school district’s liability arising out of operation and use of a motor vehicle is limited to the following:

“money damages in a maximum amount of $100,000 for each person and $300,000 for each single occurrence for bodily injury or death and $100,000 for each single occurrence for injury to or destruction of property.”

8. Within 24 hours of receiving a report of an automobile liability claim or incident from HISD’s Risk Management Department, the TPA will:

a. Confirm receipt of claim and advise claim number and adjuster assigned

b. Initiate contact with all parties involved in the accident

9. At a minimum, the file will include the following information: a. Date of Loss b. HISD Claim Number c. TPA Reference Number (if any) d. HISD Driver’s Name and Contact Information e. HISD Driver’s Employee ID Number f. Names and Contact Details for All Other Parties Involved in the Accident g. Brief Narrative describing the Event h. Details from Police Report (if any)

i. Determination of Liability and Estimated Extent of the Loss j. Payments k. Releases l. Statements and regular documentation of current findings, negotiations and status

10. In cases where it is determined HISD is not at fault, the TPA will provide HISD Risk Management

with the results of their investigation as requested by HISD Risk Management.

11. The TPA will also be expected to provide the following services: Provide on-line access to claim files, including adjusters’ notes, to HISD Risk Management staff and designated legal counsel a. Provide appraisals of damaged vehicles b. Establish reserves c. Code cases to reflect type of claim or incident only status d. Investigate claims e. Take recorded statements and provide written transcriptions as necessary f. Index claimants with Index Bureau as requested by HISD g. Arrange rental vehicles as needed h. Review bills and process checks using established positive pay process i. Interface with attorneys designated by HISD j. Arrange surveillance as requested by HISD k. Provide medical bill review services as needed or requested by HISD l. Settle claims within clearly defined limits of authority m. Provide concise justification when seeking authorization to settle claims in excess of

designated authority n. Assume the handling of all claims open at the inception of this agreement and any claims

re-opened during the tenure of this agreement o. Act as designated agent for the district’s Responsible Reporting Entity duties: filing

electronic submissions and reporting data in conjunction with MMSEA Section 11 – Medicare Secondary Payer Mandatory Reporting

12. Separate charges may be made for each of the above services, or they may be included in a single overall price. In the event a single price is quoted, it will be understood and agreed the single price includes all the items listed above.

13. If the TPA is required to establish a service agreement for any associated services on behalf of the

District, it will be the responsibility of the TPA to coordinate all the associated services and verify the District is being charged at accepted rates. Each associated service will have performance standards to include steps for corrective actions and termination for continued non-compliance of contracted services. Preference may be given for TPA’s with offices in the greater Houston area.

14. Assignment of legal matters will be made to outside counsel by HISD Legal Department on

Automobile Liability cases.

B. HISD General and Professional Liability Claims

1. The TPA staff dedicated to the District’s account includes a supervisor and two claims representatives, with assistance from various support personnel. HISD has the ability to monitor

claims data input by the TPA via access to an on-line Risk Management Information System (RMIS).

6. The District’s current coverage for General and Professional Liability is subject to a $250,000 self-insured retention. School districts are political subdivisions of the state and are not answerable for the negligence of their trustees, agents, or employees under the doctrine of governmental immunity. In addition, the Texas Supreme Court has applied this same immunity to professional employees of school districts per the Texas Education Code. However, the district is subject to claims involving labor, employment and civil rights matters including student discipline, employment discrimination, and special education. The TPA’s function on General Liability and Professional Liability claims would be to issue immunity letters and monitor the progress of litigation with assigned defense counsel.

7. Within 24 hours of receiving a report of a General or Professional Liability claim or incident from HISD’s Risk Management Department, the TPA shall:

a. Confirm receipt of claim and advise claim number and adjuster assigned.

b. At a minimum, the file will include the following information:

11. Statements and regular documentation of current findings, negotiations and status

8. In cases where it is determined HISD has no liability, the TPA will provide HISD Risk Management with the results of their investigation and issue the appropriate immunity letter.

9. The TPA will also be expected to provide the following services:

a. Provide on-line access to claims files, including adjusters’ notes to HISD Risk Management staff and designated legal counsel

b. Establish reserves c. Code cases to reflect type of claim or incident only status d. Investigate claims e. Take recorded statements and provide written transcriptions as necessary f. Index claimants with Index Bureau as requested by HISD g. Review bills and process checks using established positive pay process h. Interface with attorneys designated by HISD i. Attend mediations as requested by HISD and/or their legal counsel j. Provide Spanish translations and other languages as needed k. Arrange surveillance as requested by HISD l. Provide medical bill review services as needed or requested by HISD m. Settle claims within clearly defined limits of authority n. Provide concise justification when seeking authorization to settle claims in excess of

designated authority o. Secure reimbursement for HISD from the insurance company for all costs in excess of the

self-insured retention p. Assume the handling of all claims open at the inception of this agreement and any claims re-

opened during the tenure of this agreement q. Act as designated agent for the district’s Responsible Reporting Entity duties: filing

electronic submissions and reporting data in conjunction with MMSEA Section 11 – Medicare Secondary Payer Mandatory Reporting

2.2 SPECIFIC CONDITIONS:

The awarded firm(s) shall provide the following goods and/or services:

A. Risk Management Information Systems (RMIS)

(Enter your response to the following on Form P: Questionnaire)

1. The current awarded TPA inputs and maintains the data on HISD’s behalf. HISD uses the data to review cases, approve payments, generate reports, etc. All participants in this RFP are expected to include RMIS plans as part of their proposal. This service may be priced separately or made part of a single overall price included with the other TPA services.

2. If a system other than the current TPA’s system is proposed, the proposal should detail:

a. How the existing data would be converted from the current system to the proposed system;

b. When the conversion process would be implemented;

c. The anticipated duration of the conversion process and any resulting service disruption to

HISD’s access to online data;

d. Pricing information (if any) for data conversion;

e. The signature of an executive level employee of the supplier is required to indicate that all responses are true and accurate. Any information found to be false prior to engagement or during the contract period may result in termination of the agreement.

B. The following information should be included with all proposals submitted:

1. Information on location of dedicated claims office.

2. The size and experience of professional staff, specifically those servicing the district account, should be defined. Include resumes of anticipated claims personnel to be dedicated to the HISD Risk Management account. Information on bilingual claims handling capabilities should be included.

3. Details on your claims management services regarding claims investigation, reserve

analysis/maintenance, claims payments, reporting, supervisory reviews, claim closure, and recovery of claims payments excess of self-insured retention.

4. Information on your risk management information system (RMIS), which should include on-line

claims access and reporting. Include your plan for converting data from current Risk Sciences Group system to your system, and the anticipated time-line for the conversion process if necessary.

5. Information on your automobile appraisal capabilities. Please advise if the appraisals will need

to be contracted to an outside third-party company.

C. STATISTICS

2.5 EVALUATION FACTORS: The evaluations committee will conduct a comprehensive, fair and impartial evaluation of all proposals received in response to this RFP. Each proposal received will be analyzed to determine overall responsiveness and completeness as defined in the scope section and in the instructions on submitting a proposal. Failure to comply with the instructions or to submit a complete proposal may deem a proposal non-responsive and may at the discretion of the Evaluation Committee be eliminated from further evaluation. If the evaluation committee has reasonable grounds to believe that the Proposer with the highest ranking score is unable to perform the required services to the satisfaction of HISD, HISD reserves the right to make an award to another proposer who in the opinion of the evaluation committee would offer HISD the best value. Some indicators (but not a complete list) of probable supplier/proposer performance concerns are: past supplier performance; the proposer’s financial resources and ability to perform; the proposer’s experience or demonstrated capability and responsibility; and the supplier’s ability to provide a reliable on-going business relationship and the maintenance of on-going agreements and support.
