AMENDMENT OF THE SECOND SCHEDULE TO THE WORKMEN'S COMPENSATION ACT, 1941 (ACf 30 OF 1941)

Under the powers vested in me by section 94 (2) of the Workmen's Compensation Act. 1941 (Act 30 of 1941), I hereby amend, with effect from 1 January 1979, the Second Schedule to the said Act as follows:

(a) By the addition of the folloWing disease in the first column of the Schedule:

"MESOTHELIOMA;'; (b) by the addition of the following description of

occupation in respect of "Mesothelioma" in the second column of the Schedule:

"Any work which involves the handling or use of asbestos or exposing the workman to asbestos dust caused by the use of asbestos in connection with the employer's business.".

ZEEKOEHOEK IRRIGATION DISTRICT. DISTRICT OF KRUGERSOORP, TRANSVAAL.EXTENSION OF BOUNDARIES

Whereas the boundaries of the Zeekoehoek Irrigation District, District of. Krugersdorp, Transvaal, were defined by Proclamation 64 of 1975;

And whereas the boundaries of the said district were altered by Proclamation 8 of 1978;

And whereas section 73, read together with. section 76 (1) of the Water Act, 1956 (Act 54 of 1956). provides that the State President may. upon the recommendation of the Minister of Water Affairs. include any additional area in an existing irrigation district;

And whereas the Minister of Water Affairs deems it expedient to alter the boundaries of the Zoekoehoek Irrigadon District to include an additional area therein;

And whereas all the provisions of the said Act in connection with such inclusion of additional land have been complied with;

Now, therefore, under and by virtue of the powers vested in me by section 73, read together with section 76 (1) of the said Act, I hereby declare that the boundaries of the Zeekoehoek Irrigation District. District of Krugersdorp, Transvaal, as e9tablished by Proclamation 64 of 1975 and as amended by Proclamation 8 of 1978. shall be extended by the inclusion of the properties described in the Annexure to this Proclamation and that the area so extended shall· continue to be styled the Zeekoehoek Irrigation District.

Nademaal die grense van die Zeekoehoek-besproeiingsdistrik, distrik Krugersdorp, Transvaal, by Proklamasie 64 van 1975 omskryf is;

En . nademaal die grense van genoemde distrik by Proklamasie 8 van 1978 gewysig is;

En nademaal artikel 73 saamgeleesmet artikel 76 (1) van die Waterwet, 1956 (Wet S4 van 1956), bepaal dat die Staatspresident op aanbeveling van die Minister van Waterwese enige addisionele gebied by 'n bestaande besproeiingsdistrik kan insluit;

En nademaal die Minister van Waterwese dit wenslik ag om die grense van die Zeekoehoek-besproeiingsdistrik te wysig ten einde 'n addisionele gebied daarby in te sluit;

En nademaal al die bepalings van genoemde Wet met betrekking tot sodanige insJuiting van addisionele grond nagekom is;

So is dit dat ek kragtens die bevoegdheid my verleen by artikel 73 saamgelees met artikel 76 (1) van genoemde Wet, hierby verklaar dat die grense van die Zeekoehoek-besproeiingsdistrik, distrik Krugersdorp, Transvaal, soos ingeitel by Proklamasie 64 van 1975 en gewysig by PrOklamasie 8 van 1978. uitgebrei word deur die insluiting van die eiendomme wat in di.e Bylae Van hierdie Proklamasie beskryf word en dat die aldus uitgebreide gebied voortaan nos as die Zeekoehoek-besproeiingsdistrik bekend staan.

Ingevolge artikel 62 (2) (a) van die Waterwet, 1956 (Wet 54 van 1956), maak ek, Abraham Jacobus Raubenheimer, in my hoedanigheid van Minister van Waterwese, hierby die volgende bepaling bekend ten opsigte van die MhIatuzerivier-staatswaterbeheergebied soos geproklameer ingevolge artikel 59 (1) (a) en (b) van die Waterwet, 1956 (Wet 54 van 1956), by Proklamasie 125 van 24 Junie 1977 wat betref die maksimum oppervlaktes wat met openbare water in die gebied besproei mag word, die maksimum hoeveelheid water



of water that may be abstracted per hectare per annum as well as the maximum rate at which water may be abstracted at any time:

(a) Each owner of riparian land may. ,in terms of section 62 (1) (b) of the said Water Act continue to abstract by means of water work as· it existed at the date of proclamation of the Government Water Control Area. namely 24 June 1977. not more than the quantity of public water abstracted lawfully and used beneficially by him for agricultural purposes on the said date. .

(b) Each owner of riparian land who had not so used water or who had not irrigated the full irrigable potential of his property. or properties on the said date may. in terms of section 62 (2) (a) (i) of the said Water Act irrigate a maximum area equal to 80 per cent of the irrigable area of his property or properties within the limits of a distance not exceeding two kilometres from the river and height not exceeding 60 metres above the river bed.

(c). 1.'he maximum annual water quota (application) per IrrIgated· hectare of land in the vaHous zones is limited to the following quantities:

(i) Nkwaleni Irrigation District: 10 000 mSIhal annum.

(ii) Umfuli Irrigation District: 9500 m3Jhalannum. (iii) Heatonville Irrigation District: 9 500 mS/hal

annum. (iv) KwaZulu: 9000 ma/ha/annum. (d) The maximum rate at which public water may at

any time be abstracted, is limited to 1,37 Htres persecond per hectare.

(e) In terms of section 62 (2) (a) (ii) of the Water Act. 1956, nobody may construct a water work for the abstraction. diversion, impounding or storage of public water or replace. alter or enlarge an existing water work unless such a person obtains a works permit beforehand authorising him/her to do so. The necessary application forms in this regard are obtainable from the Circle. Engineer. Natal Circle. Department of Water Affairs. P.O. Box 1018. Durban. 4000 (telephone 325-6369) and must be posted to the said Circle Engineer after completion.
