THAT all items be sorted and transported in accordance with PRRD Solid Waste Bylaw No. 2065, 2013; and THAT the Chetwynd Landfill staff be directed to record the make, model and license plate of the vehicle, and the driver name, vehicles when presented with the required letter of authorization from the PRRD for waiver of tipping fees for waste accumulated on the land legally described as District Lot 2083, PRD, Except Plan 17885 ; and, THAT the green modular home be moved into the Chetwynd landfill, in one piece, to be demolished and sorted on site and that the labour and equipment rate be billed back to the landowner using rates established in Tender 07-2015 by S.S.G Environmental in the Schedule of Prices – Force Account Work. - The following items not listed in the PRRD Solid Waste Bylaw No. 2965, 2013 but still accepted at the Chetwynd Landfill:

Light, medium and heavy duty equipment and truck tires on rims (at the discretion of the Landfill operator).

THAT all items be sorted and transported in accordance with PRRD Solid Waste Bylaw No. 2065, 2013; and

THAT the Chetwynd Landfill staff be directed to record the make, model and license plate of the vehicle, and the driver name, vehicles when presented with the required letter of authorization from the PRRD for waiver of tipping fees for waste accumulated on the land legally described as District Lot 2083, PRD, Except Plan 17885 ; and, THAT the green modular home be moved into the Chetwynd landfill, in one piece, to be demolished and sorted on site and that the labour and equipment rate be billed back to the landowner using rates established in Tender 07-2015 by S.S.G Environmental in the Schedule of Prices – Force Account Work.

BACKGROUND/RATIONALE: At the March 8, 2018 Regular Board Meeting, the Regional Board approved the following resolution: RD/18/03/27 MOVED Director Rose, SECONDED Director Nichols,

1. That the Regional Board approve relief from tipping fees at the Chetwynd Landfill from March 15 – May 31, 2018 for waste accumulated on the land legally described as District Lot 2083, PRD, Except Plan 17885 as this waste is a result of illegal dumping by the general public and is not the result of actions of the property owner; and 2. That the following items be relieved from tipping fees:

- REGULAR WASTE as defined in PRRD Solid Waste Bylaw No. 2065, 2013 - BULKY WASTE as defined in PRRD Solid Waste Bylaw No. 2065, 2013

- The following items from the list of CONTROLLED WASTE as defined in PRRD Solid Waste Bylaw No. 2065, 2013:

a) Bulky waste b) Household furniture and large appliances containing Ozone Depleting Substances c) Nuisance agricultural waste including, but not limited to, wire, twine and plastic materials

d) Demolition, land clearing and construction waste, excluding materials designated as restricted waste in Bylaw No. 2065, 2013; and

3. That all items be sorted and transported in accordance with PRRD Solid Waste Bylaw No. 2065, 2013; and 4. CARRIED. Additional background information relating to this application can be found on the March 8, 2018 Regional Board agenda, Item R-12 (http://prrd.bc.ca/board/agendas/2018/2018-08-178908173/AGENDA.html) which includes previous reports considered by the Board on November 2, 2017 and July 20, 2017. The PRRD Finance Department has provided the attached spreadsheet showing that 125,140 KG of waste has been deposited in the Chetwynd Landfill from the Property between March 26, 2018 and April 27, 2018. A site inspection conducted by the Bylaw Enforcement Officer on May 7, 2018 revealed a substantial amount of waste has been removed from the property. The agent has submitted a new written timeline for clean-up dated May 7, 2018, (attached). The agent reports that in addition to the waste deposited in the Chetwynd Landfill, he has hauled 4 x 22’ dump trailer loads of tires off The Property. He respectfully requests more time to complete the clean-up as it must not interfere with his personal employment and the approaching farming season. An extension until December 31, 2018 would permit the clean-up to continue through the Summer, Fall and Winter, weather permitting.

The following are new materials that the agent has proposed to be included in the relief from tipping fees (shown in BOLD in the recommendation): The agent has requested to bring medium and heavy duty equipment and truck tires without rims, stripped or unstripped vehicle hulks, empty propane tanks, light, medium and heavy duty equipment and truck tires on rims. Further, the agent has requested permission to haul the green mobile home into the Chetwynd Landfill in one piece to be demolished and sorted on site. Alternative Option 1, below, represents the relief from tipping fees as previously granted in Resolution No. RD/18/03/27 and does not include the additional materials requested by the agent. The only change is extending the timeline for relief.

ALTERNATIVE OPTIONS: OPTION 1 THAT the Regional Board approve relief from tipping fees at the Chetwynd Landfill from June 1,

2018 to December 31, 2018 for waste accumulated on the land legally described as District Lot 2083, PRD, Except Plan 17885 (The Property) as this waste is a result of illegal dumping by the general public and is not the result of actions of the property owner; and

THAT the following items be relieved from tipping fees:

OPTION 2 That the Regional Board refuse the request for extension to relief from tipping fees for waste

originating from the BLAIR property at the Chetwynd Landfill. OPTION 3 That the Regional Board direct staff to publicly solicit bids from qualified consultants to provide

professional assistance with the characterization and quantification of waste and salvage materials from land legally described as District Lot 2083, Peace River District, Except Plan 17885.

OPTION 4 That the Regional Board refuse the request for extension to relief from tipping fees at Chetwynd Landfill for the land legally described as District Lot 2083, Peace River District, Except Plan 17885.

STRATEGIC PLAN RELEVANCE:

FINANCIAL CONSIDERATION(S): To date, tipping fees in the amount of $10, 850.40 have been waived. The PRRD will not be able to recover these fees. It is estimated that bids from qualified consultants to provide professional assistance with the characterization and quantification of waste and salvage materials would have come in at a much higher cost to the PRRD. In addition, the contract to eventually remove the waste would have been a separate contract and an additional cost to the PRRD. The PRRD would not be able to recover costs associated with the waste characterization and quantification. However, once the PRRD or its agents completed work on the land there may be an opportunity to register costs against the title.

COMMUNICATIONS CONSIDERATION(S): Communications with the landowner and her agent will be ongoing.

OTHER CONSIDERATION(S): Some of the items on the land that are not permitted into the landfill may not be able to be removed until outside companies such as metal recyclers and tire shredders are available and the risk is that they may remain on the property. The agent has made progress in terms of the removal of 125,140 KG of material and the sorting of other materials in preparation for removal.
