1 INTRODUCTION

In line with the recommendation emerging from the Powers and Functions Committee

and the MDB decision, the capacity assessment of all district and local municipalities

was undertaken in August 2004.

The purpose of this report is as follows:

To provide an overview of the process followed by the MDB in undertaking the

capacity assessment

To provide an examination of the assessment of the capacity results and the

preparation of the recommendations

To provide the recommended adjustments per district or local municipality per

province.

2 LEGAL CONTEXT

In terms of section 85(9), MECs responsible for local government in a province must

regularly review the capacity of a relevant municipality and reallocate a function or

power to a municipality when that municipality acquires the capacity to perform its

function or exercise its power. A reallocation must be made with the concurrence of the

receiving municipality or, in the absence of such concurrence, after having consulted the

Demarcation Board. Furthermore, section 85(4) requires that the Demarcation Board

consider the capacity of a district or local municipality to perform the functions and

exercise the powers vested in the municipality in terms of section 84 (1) or (2) when

determining or re-determining the boundaries of the district and the local municipality,

or when so requested by the MEC for local government in the province concerned.

It was within this context that the 2004/2005 MDB capacity assessment was undertaken

in August 2004.

3 PROCESS FOLLOWED FOR THE 2004/2005 CAPACITY ASSESSMENT

As part of the MDB capacity assessment process, the Board has adopted the approach of

undertaking the assessment field work in the same month each year. The 2002/2003 and

2003/2004 assessments were conducted in the month of October. However, once the

analysis of the results was complete and the recommendations finalised for the MECs,

the process was well into March - April of the assessment period. Therefore, the MDB

took the decision to bring the field work forward to August which will hereafter be the

assessment month.

The process followed for the completion of the 2004/2005 capacity assessment is

similar to that undertaken in the two previous years which included the following:

Review of the questionnaire used in the 2003/2004 MDB assessment;

Questionnaire modified based on inputs received from the Provincial

Departments of Local Government;

Appointment of field consultants;

Briefing session for Provincial Departments of Local Government and

the field consultants;

Field work, data capture and verification;

Preliminary assessment of the results;

Drafting of the district capacity reports, and

Preparation of the recommended adjustments for the 2004/2005 period.

Municipalities are generally overwhelmed by the number of questionnaires they are

required to complete. Given the extent of the data collected and the usefulness of the

information generated, the Provincial Departments of Local Government undertook to,

as far as possible, participate and assist in the facilitation of the field work.

The table below indicates the extent of the provincial participation:

representative to each municipal meeting.

North West No participation. This occurred due poor communication between

the field consultant and the Department.

Gauteng The Department’s support was coordinated by Mr R

Mokgwatsane. Meetings with the municipalities were attended by

either Mr Mokgwatsane and or Mr Ralekhetho. Their assistance in

the field helped greatly with the completion of the municipal

questionnaires.

Based on the field experience, the municipal co operation in the participating provinces,

was far higher. However, valuable lessons were learnt which could be used to improve

the efficiency of the 2005/2006 MDB capacity assessment.

4 EVALUATION AND DETERMINATION OF RECOMMENDATIONS

FOR THE 2004/2005 PERIOD

The recommended adjustments for the 2004/2005 assessment period are directly linked

to those of the two previous assessment periods. However, each year the process has

required a slightly different method for determining the possible adjustments and

therefore it is necessary to briefly outline the assessment process followed in each case.

4.1 Process followed by the MDB for the 2002/2003 recommended adjustments

The preparation of the MDB’s “November 2002” recommendations to the MECs for the

adjustment of powers and functions was a phased process which included the following:

A preliminary assessment – based on broad criteria

Province wide workshops with municipalities

Review of preliminary assessment and workshop outcomes

Recommendations for Board approval and submission to MECs.

A broad approach was adopted toward assessing municipality capacity to perform

functions during the preliminary phase. Four aspects were reviewed per municipality:

Does the municipality perform the function – yes or no

Does the municipality have a budget for performing the function – yes or no

Does the municipality have staff performing the function – yes or no

Does the municipality have infrastructure to perform the function – yes or no

Sixteen options contained in a table were then applied to determine if the municipality

had some capacity to perform a function.

The schedules were scrutinized by an assessment team who in turn prepared a preliminary draft

for the MECs of the MDB recommendations.

In all instances, the legislation was applied. Any recommended adjustment was based on

capacity only to perform the function. Capacity is defined in the Municipal Structures Act as:

“The administrative and financial management capacity and infrastructure that

enables a municipality to collect revenue and to govern on its own initiative the

local government affairs of its community”

The table below indicates when an adjustment was recommended in the 2002/2003 assessment

period.

Once the workshops with the municipalities and the consultation with the Provincial

Departments of Local Government complete, with the exception of the Western Cape,

all the MDB recommendations were approved by the MECs and accordingly published

in the respective provincial gazette. All adjustments came into affect on 1 July 2003.

In the case of the Western Cape, the then MEC for local government took the decision

not to publish any adjustments. Therefore, the division of the powers and functions for

the district and local municipalities over which the MEC is responsible, reflected those

contained in section 84 of the Municipal Structures Act.

4.2 2003/2004 Capacity Assessment

The main objective of the 2003 - 2004 capacity was to advise the Provincial MECs on

any changes in capacity which has occurred within the 2002/2003 assessment year.

Based on the results, the Board then made recommendations on retaining, reversing and

any new adjustments for a district and local municipality or visa versa.

When determining whether an adjustment should be reversed, the following criteria

were used in the assessment process:

Whether the municipality, from which the function had been removed, had

acquired the capacity during the 2002/2003 assessment period

Whether the municipality, to which the adjustment was made, now no longer

had capacity.

Based on the data received, a spread sheet was then prepared per district municipality

containing the following information:

The 2003/2004 results for indicating if the municipality performed the function

had a budget, staff and equipment allocated for the function.

In all instances, the gazetted authorisations were checked and the results from

2002/2003 and 2003/2004 compared.

During December 2003/January 2004, district municipality reports were drafted and the

preliminary assessment derived in November 2003 was confirmed or modified based on

the more detailed findings in these reports.

The recommendations were then submitted to the MECs for consideration. In all

instances, MECs decided not to publish the MDB recommendations for the 2003/2004

assessment period. The most commonly cited reason for this was the need to allow

municipalities to consolidate based on the adjustments made on 1 July 2004.

4.3 Assessment for the 2004/2005 period

The process followed for this assessment period built on the capacity knowledge

accumulated by the MDB over the three assessment periods.

Again, a table was prepared which examined the capacity results in a summarised

format across the three periods. Based on this information, a set of draft

recommendations were prepared for testing during the drafting of the district reports.

Moreover, the district reports have been set up in manner for the 2004/2005 period in

which the detailed information on budgets, staffing and access to equipment is reflected

for all periods.

The recommendations then for the 2004/2005 period are now based on the following:

A consistent pattern of capacity development by a municipality that is it

reflected capacity for the function in the 2003/2004 and the 2004/2005

assessment periods but not in the 2002/2003 period;

A consistent pattern of capacity for all three assessment periods;

A consistent pattern of no capacity for all three periods, and

A consistent pattern of no capacity for two consecutive years.

Each function and the adjustments made on 1 July 2003 were carefully scrutinised and

the adjustment recommendations made accordingly.

The MDB recommendations for the 2004/2005 assessment period are contained as

Appendix A in this report.

5 USING THE INFORMATION PROVIDED IN APPENDIX A

It is easy to misinterpret the information contained in the tables containing the MDB

information.
