V. APPROVAL OF THE MINUTES OF THE FEBRUARY 3, 2005 WORKSHOP

MEETING AND REGULAR MEETING: upon a motion by Mr. Campbell, and a second to the motion by Ms. Marquard, the Board approved the minutes of the February 3, 2005 Workshop Meeting and Regular Meeting. Mr. Bates and Ms. Kelly abstained from the vote.

1. Executive Vice Chancellor and Acting Chief Operating Officer: Dr. Steve Head

reminded the Board of the date for the NHMCCD Foundation Star Gala to be held on April 16, 2005 at the Woodlands Marriott Waterway Hotel.

2. College Presidents: no reports. The college presidents distributed current event

information from their respective colleges.

3. Vice Chancellors: none

4. Faculty Senate: Professor Jean Whileyman, faculty senate president at Kingwood College, reported that the Texas Community College Teachers Association (TCCTA), the Texas Association of Community Colleges and the Texas Junior College Student Government Association, participated jointly in Community College Day at the Capitol in Austin. Over 1,000 students, teachers, chancellors and college presidents attended and participated in the event as well as visited the offices of senators and representatives.

VIII. STRATEGIC PLANNING REPORT:

Action Plans for the Strategic Initiatives Related to Success of our Students: In spring 2004, the Board reviewed and accepted NHMCCD’s strategic plan for 2004 – 2007. The plan identified three target areas: Success of our Students; Success of our Communities; and Success of our Employees. The plan also includes 26 strategic initiatives related to the three target areas. During fall 2004, committees were convened to develop action plans for each of the 26 strategic initiatives in the strategic plan. The co-chairs of each of the 26 committees presented these action plans to the Executive Council in December 2004. The co-chairs of the groups assigned to the nine strategic initiatives related to Success of Our Communities presented to the Board the proposed action plans for each of the initiatives. A copy is attached as Exhibit “B.”

IX. INSTITUTIONAL EFFECTIVENESS REPORT

1. Student Profile Comparing Spring 2004 and Spring 2005: Dr. Steve Head, executive vice chancellor and acting chief operating officer, presented the report and noted that overall the District continues to grow, with students served increasing by 15.4%, or about 5,375 students between Spring 2004 and Spring 2005. A copy is attached as Exhibit “C.”

2. International Students by College, Spring 2005: Dr. Steve Head, executive vice

chancellor and acting chief operating officer, presented the report and noted that the spring 2005 enrollment of international students district-wide totals 1,396 students who are from at least 100 different countries. This represents 3% of the total enrollment, and is an increase of 24% over spring 2004. A copy is attached as Exhibit “D.”

3. Concurrent Credit Students, Spring 2005: Dr. Steve Head, executive vice chancellor

and acting chief operating officer, presented the report and noted that the district

continues to provide access to high school students by providing concurrent credit classes to 2,819 individual students during spring 2005. This represents an increase of 13% compared to spring 2004. A copy is attached as Exhibit “E.”

X. CONSIDERATION OF CONSENT AGENDA: Mr. McIver proceeded with the

Consent Agenda. Dr. Head recommended separate action on Action Items 8, 9, and 14. Ms. O’Neill made a motion to approve Action Items 1, 2, 3, 4, 5, 6, 7, 10, 11, 12, 13, 15, and 16. Mr. Bates seconded the motion and the Board unanimously passed the Consent Agenda. A copy of the Consent Agenda is attached as Exhibit “F.”

XI. POLICY REPORT AND CONSIDERATION:

1. Consideration of Approval of Proposed Board Policy CAK(Local): Investments (ACTION ITEM 1): the Board approved Board Policy CAK (Local): Investments. This item was passed in the Consent Agenda. A copy is attached as Exhibit “G.”

2. Consideration of Proposed Addition to Board Policy DECA (Local): Leaves and

Absences (FIRST READING): the Board conducted the first reading of the proposed addition to Board Policy DECA (Local): Leaves and Absences. The Board expressed no objection to adding the proposed policy to the April agenda for consideration and action. A copy is attached as Exhibit “H.”

XII. FINANCIAL REPORTS AND CONSIDERATIONS

1. Monthly Financial Statements: Ms. Cindy Gilliam, vice chancellor, business affairs and CFO, presented the monthly financial statements. A copy is attached as Exhibit “I.”

2. Consideration of Acceptance of Gifts (ACTION ITEM 2): the Board formally

accepted and acknowledged gifts donated to the North Harris Montgomery Community College District in accordance with the donor’s wishes. This item was passed in the Consent Agenda. A copy is attached as Exhibit “J”

3. Consideration of Approval of an Agreement with Carnation Enterprises for Game

Room Vending Equipment at Montgomery College (ACTION ITEM 3): the Board approved the two year agreement with Carnation Enterprises to provide game room vending equipment at Montgomery College. This item was passed in the Consent Agenda. A copy is attached as Exhibit “K.”

4. Consideration of Approval of the Cooperative Purchase of Furniture for the

Renovated Information Technology (IT) Suite at Kingwood College (ACTION ITEM 4): the Board approved the cooperative purchase of furniture for Kingwood College through the Texas Building and Procurement Commission’s Texas Multiple Award Schedule (TXMAS) Program, from The Ofis, in the amount of $39,661. This item was passed in the Consent Agenda. A copy is attached as Exhibit “L.”

5. Consideration of Approval of the Purchase of a Rapid Prototyping 3D Machine for

the Manufacturing and Engineering Programs at North Harris College (ACTION

6. Consideration of Approval of an Agreement with the Windsor Auction Company for

Auction Services for Surplus Property and Equipment (ACTION ITEM 6): the Board approved a one year agreement with an option to renew for up to two additional one year periods with the Windsor Auction Company, for surplus auctioneering services. This item was passed in the Consent Agenda. A copy is attached as Exhibit “N.”

7. Consideration of Approval of the Extension of the Contract with McConnell & Jones

for the Fiscal Year 2005 Audit (ACTION ITEM 7): the Board approved the extension of the contract with McConnell & Jones for the fiscal year 2005 audit. This item was passed in the Consent Agenda. A copy is attached as Exhibit “O.”

8. Consideration of Approval of Change Order No. 2 to Gilbane’s Guaranteed

Maximum Price (GMP) Contract for Building Renovation, New Construction and an Additional Parking Lot for the New Parkway Center (PWC) (ACTION ITEM 8): upon a motion by Mr. Vogt and a second to the motion by Mr. Fox, the Board approved the proposed Change Order No. 2 to reduce Gilbane’s GMP contract for building renovation, new construction and an additional parking lot for the new PWC by $ 21,107. Ms. O’Neill abstained from the vote. A copy is attached as Exhibit “P.”

9. Consideration of Approval of Change Order No. 2 to Gilbane’s Guaranteed

Maximum Price (GMP) Contract for the Digital Technology Center (DTC) at North Harris College (ACTION ITEM 9): upon a motion by Mr. Bates and a second to the motion by Ms. Kelly, the Board approved the proposed Change Order No. 2 to reduce Gilbane’s GMP contract for the DTC at North Harris College by $236,082. Ms. O’Neill abstained from the vote. A copy is attached as Exhibit “Q.”

10. Consideration of Approval to Enter into an Interlocal Agreement with the Texas

Parks and Wildlife Department (TPWD) to Hire Cy-Fair College Student(s) as TPWD Intern(s) (ACTION ITEM 10): the Board approved the interlocal agreement with the Texas Parks and Wildlife Department to hire Cy-Fair College student interns. This item was passed in the Consent Agenda. A copy is attached as Exhibit “R.”

11. Consideration of Approval of Contract with Texas A&M Research Foundation

(ACTION ITEM 11): the Board approved a contract with Texas A&M Research Foundation to use a 34’ x 34’ piece of unused land located at the western boundary of the North Harris College (NHC) campus for a three year period. This item was passed in the Consent Agenda. A copy is attached as Exhibit “S.”

12. Consideration of Approval for Purchases of up to $500,000 for the Third Quarter of

FY 2004-05 for Technology Related Items for the District (ACTION ITEM 12): the Board approved the purchases of up to $500,000 during the third quarter for

College (ACTION ITEM 13): the Board approved the interim lease of waste treatment capacity for Cy-Fair College: This item was passed in the Consent Agenda. A copy is attached as Exhibit “U.”

14. Consideration of Approval to Adopt Resolution Authorizing the Issuance, Sale and

Delivery of North Harris Montgomery Community College District Limited Tax Refunding Bonds, Series 2005; and Approving and Authorizing Instruments and Procedures Relating Thereto (ACTION ITEM 14): upon an amended motion by Mr. Bates and a second to the motion by Dr. Campbell, the Board of Trustees approved an order authorizing the issuance of up to $55,000,000 Limited Tax Refunding Bonds, Series 2005. A copy is attached as Exhibit “V.”

Special Report and Announcement No. 5a Board Meeting 4-7-05 Report: Public Safety Report An analysis of traffic and pedestrian field contacts by the North Harris Montgomery Community College District (NHMCCD) Police Department is presented to the Board of Trustees in compliance with the provisions of the Racial Profiling Act, codified within the Texas Code of Criminal Procedures Articles 2.131-2.138, which was enacted in 2001, with the stated goal of prohibiting the practice commonly known as “racial profiling.” The District, as required by the provisions set forth in the Act, adopted procedures enjoining the peace officers commissioned by the District from engaging in racial profiling, and stipulating that the information required by the Racial Profiling Act regarding the race and gender of persons detained by NHMCCD peace officers, and other information as specified, be collected and reported to the District Director of Public Safety. The Racial Profiling Act mandates that the information gathered during a calendar year, regarding vehicle and pedestrian stops by peace officers of a political subdivision be presented to the governing body of that political subdivision. Along with such analysis, a determination of whether peace officers of the political subdivision are engaging in racial profiling, and a statement of complaints by the public alleging such conduct must also be presented. In compliance with that provision of the Act, the attached analysis of traffic and pedestrian stops by the NHMCCD Police Department during 2004 and accompanying statements as to the meaning of the data collected are hereby presented to the NHMCCD Board of Trustees.

Texas Criminal Code of Procedures, Article 2.132 (b) (6) mandates the collection of certain information regarding any traffic stop in which a citation is issued and/or an arrest is made. The report of this information is referred to as Tier One and includes:

1. The race or ethnicity of the individual detained; and 2. Whether a search was conducted and, if so, whether the person detained consented to

the search. Tier II Traffic and Pedestrian Stops Texas Criminal Code of Procedures, Article 2.133, referred to as Tier II reporting, mandates reporting of all traffic and pedestrian stops, regardless of whether arrests were made or citations were issued. Tier II reporting includes the following data:

1. The detained person’s gender and race or ethnicity. 2. The type of law violation suspected. 3. Whether a search was conducted, and if so whether it was based on consent or

None of the 105 traffic stops resulted in searches or the seizure of contraband. Citations were issued to 46 motor vehicle operators and 59 were given verbal or written warnings. Of the 45 pedestrian stops, only one pedestrian was searched and that search was incident to the individual’s arrest for burglary of a building. The other pedestrians were not searched. They were issued citations and released A review of all data collected on all traffic and pedestrian stops throughout the District does not provide any indication of racial profiling. It appears that the officers of the NHMCCD Police Department are complying with the District policies prohibiting racial profiling. No patterns of arrest, citation or search targeting any ethnic group were revealed by the analysis of the data collected during 2004.

Strategic Planning Report Board Meeting 4-7-05 Report: Action Plans for the Strategic Initiatives Related to Success of our Employees

In spring 2004, the Board reviewed and accepted NHMCCD’s strategic plan for 2004 – 2007. The plan identified three target areas: Success of our Students; Success of our Communities; and Success of our Employees. During fall 2004, committees were convened to develop action plans for each of the 26 strategic initiatives in the strategic plan. Consideration of Approval of the Proposed Addition to Board Policy DECA (Local): Leaves and Absences (SECOND READING) (ACTION ITEM 1)

Chancellor’s Recommendation:

That the Board of Trustees approve the proposed addition to Board Policy DECA (Local): Leaves and Absences.

Rationale: Board Policy DECA: Leaves and Absences defines the categories of paid

leave available to NHMCCD employees. It does not at present contain a provision which would permit employees to contribute excess sick leave for use by employees who have exhausted sick leave (a sick leave pool) even though such a pool is permitted for public entities under the Texas Government Code. After years of considering options for such a pool, the NHMCCD Benefits Advisory Council has recommended that the District adopt the proposed policy containing the following key elements:

• The purpose of the pool is to provide additional sick leave pay to participating employees who have exhausted all paid leave due to extensive or recurrent medical problems.

• Full time employees who have been employed with the District at

least 1 year and have accrued 80 hours or more of sick time are eligible to enroll in the pool.

• Each participant can contribute up to 80 hours of leave to the pool

annually.

• Only employees who participate are eligible to request sick leave pool time for qualifiying personal illness.

• An employee may request and receive up to 240 hours of leave

each fiscal year for a severe illness or condition suffered by the employee.

• The Human Resources department will conduct enrollment

periods two times a year during which time employees may elect to contribute leave and will handle the review of requests for leave.

• If the sick leave pool is exhausted before an enrollment period, the

actually used. Because this cannot be determined in advance, a $50,000 contingency budget is proposed for the first year of operation. Subsequently, budgets can be estimated based on historical use of the pool.

NORTH HARRIS MONTGOMERY COMMUNITY COLLEGE DISTRICT COMPENSATION AND BENEFITS: DECA LEAVES AND ABSENCES (LOCAL) SICK LEAVE: ELIGIBILITY

All employees who are in positions requiring 12 months of service and who work at least 20 hours per week shall be eligible for (12) sick leave days per year. Sick leave shall be accrued on a monthly basis to a maximum of 520 hours. Employees assigned to work less than 12 months and who work at least 20 hours per week shall earn one day of sick leave per month for their period of employment, including summer school.

USE OF SICK LEAVE

Accumulated sick leave may be used for personal illness or illness of an immediate family member. For purposes of this policy, immediate family is defined as husband, wife, child (natural, foster, step, or adopted), mother, father, grandmother, grandfather, sister, brother, and in-laws in the same degree of relationship.

A doctor’s statement as proof of illness may be required. Failure or refusal to submit a statement may result in disapproval of sick leave utilization.

SICK LEAVE POOL

The Chancellor is authorized to establish an optional sick leave pool program for the benefit of full-time employees. The pool is intended to provide additional paid sick leave to participating members of the pool who have exhausted all leaves due to extensive or recurrent medical problems excluding Workers’ Compensation. Employees participating in the pool may request to use days from the sick leave pool only after exhausting all accrued and unused sick leave, vacation leave and compensatory time, if eligible. The maximum number of days available to be drawn from the sick leave pool is 30 working days (240 hours) in a fiscal year (September through August). Participation in the sick leave pool is voluntary. A full-time employee is eligible to join the pool after completing twelve (12) months of employment if he or she has accumulated at least 80 hours of unused personal sick leave. Enrollment periods shall be held in March and September of each year and at other times authorized by the Chancellor. The sick leave pool program will be administered by NHMCCD Department of Human Resources. In order to participate in the pool, each employee must contribute 3 days (24 hours), 5 days (40 hours) or 10 days (80 hours) during the enrollment period. Contributed sick leave days will not be returned to the employee contributing, except as an award of pool benefits. An employee will not be required to repay the pool unless he or she has been found by the NHMCCD Department of Human Resources to have abused the privilege of the sick leave pool.

request sick leave from the pool until the next fiscal year. An employee utilizing the sick leave pool will continue to accrue leave; once accrued, however, personal sick leave and vacation leave, must be exhausted before requesting an extention or additional days from the sick leave pool. Utilization of sick leave from the sick leave pool will at all times be contingent upon the availability of sick leave days in the pool. Any sick leave drawn from the pool must be used for the employee’s personal illness, accident, surgery, or injury and must be supported by a physician or appropriate health professional’s statement on a form approved by the Vice Chancellor for Human Resources or his or her designee.

Alleged abuse of the sick leave pool will be investigated by the Vice Chancellor of Human Resources or his or her designee. Any employee found to have submitted incorrect or false documents to support leave will be required to repay all sick leave credits drawn from the pool, will be subject to suspension or removal from the pool and may be subject to disciplinary action, up to and including termination..

An employee who wishes to terminate his or her membership in the sick leave pool must do so by submitting a written request to Human Resources office.

PERSONAL LEAVE

Employees may use a maximum of two days of sick leave per year for personal business leave. Advance approval of the immediate supervisor is required. Faculty should give sufficient notice of such leave to provide adequate class coverage. Adjunct faculty is allowed one occurrence per course taught each semester with no reduction in pay.

PROFESSIONAL LEAVE

Professional leave may be approved for employees to attend conferences and workshops. The conference or workshop must be related to the employee’s teaching or working assignment, in the best interest of the District, and approved by the employee’s supervisor.

VACATION: ELIGIBILITY

Paid vacation leave shall be available to all full-time employees who are in positions requiring twelve months of uninterrupted service. An employee is entitled to use accrued vacation leave upon approval of his or her supervisor.

Contractual employees shall earn 20 days beginning with the first month of

employment.

ACCRUAL OF VACATION LEAVE

Vacation leave is calculated and earned on the first day of each pay period.

Employees may accumulate vacation leave up to a maximum of two times their annual accrual rate. Any vacation leave accumulated in excess of this maximum shall be used during the fiscal year or be forfeited on August 31. Employees may not take more vacation time than they have accrual.

In the event that an employee’s status will change from a position that accrues

vacation leave to one that does not accrue vacation leave, the District may require the employee to use accrued but unused vacation leave prior to the effective date of the change of status. The District may, in its sole discretion, determine to pay the employee for the value of the accrued leave.

BEREAVEMENT LEAVE

All full-time employees may take up to two days of paid excused absence and use sick leave or other leave if more time is needed from work in the event of the death of an immediate family member. “Immediate family” is defined to include spouse, son, daughter, sister, brother, father, mother (either natural, foster, step or adopted).

One day of paid absence from work may be taken in the event of the death of a

related family member. “Related family member” is defined to include grandparent, grandchild, mother-in-law, father-in-law, sister-in-law or brother-in-law.

If additional time off is requested and approved, it may be charged to vacation

leave, personal leave, compensatory time or leave without pay. The supervisor may request appropriate documentation. HOLIDAYS

All offices will be closed in observance of the holidays indicated in the academic calendar.

Full-time employees required to work on a holiday shall be paid their regular

rate of pay and will accrue the holiday to be taken on an alternative date with the approval of their supervisor.

Full-time employees required to work on a holiday who are not able to use hours on an alternate day due to scheduling difficulty, will be paid for the holiday hours in accordance with the overtime provisions of the Fair Labor Standards Act.

charged as vacation time and the vacation leave will be extended accordingly. RELIGIOUS HOLY DAYS

The District shall not discriminate against or penalize in any way an employee who is absent from work for the observance of a religious holy day and gives proper notice of that absence. “Proper notice’ shall consist of providing a list of religious holy days to be observed during the semester to the supervisor and providing notice of such days in advance to all students whose class would be canceled due to the faculty member’s absence. The leave time to observe religious holiday may be charged to vacation leave, compensatory time (if applicable), or leave without pay.

JURY DUTY/LEGAL DUTY

A full-time employee required to appear for jury duty or to testify in court proceedings to which he or she is not a party shall be released from their assigned duties as necessary with no loss of salary or reduction in leave.

COMPLIANCE WITH A SUBPOENA

The District shall not discharge, discipline, or otherwise penalize an employee because the employee complies with a valid subpoena to appear in a civil, criminal, legislative, or administrative proceeding.

MILITARY LEAVE: SHORT-TERM

All employees of the District who are members of the state military forces or of the reserve components of the United States Armed Forces shall be granted a leave of absence from their duties without loss of time, vacation time, or salary on all days during which they are engaged in authorized training or duty ordered or authorized by proper authority, not to exceed 15 days in a fiscal year.

Such employees who are ordered to military duty as described in this section

shall be restored, when relieved from duty, to the position held by them when ordered to duty.

LONG-TERM

Any employee, other than a temporary employee, who leaves his or her position for the purpose of entering into active duty with the regular or reserve Armed Forces of the United States or with the Texas National Guard or Texas State Guard, if discharged, separated, or released from such active duty under honorable conditions within five years from the date of enlistment or call to action service, shall be restored to employment in the same position held at the time of entering into active service or to a position of like seniority, status, and pay if the employee is still physically and mentally qualified to perform the duties of such position.

position by reason of disability sustained during such military service, but is qualified to perform the duties of another position with the District, the veteran shall be restored to employment in the other position which he or she is qualified to hold and which will provide like seniority, status, and pay or the nearest approximation.

Any employee restored to employment shall be considered to have been on

leave of absence during military service and shall be entitled to participate in retirement and all other benefits available to other employees in like positions. Such employee shall not be dismissed from his or her position, without cause for one-year following restoration of employment. Veterans eligible for restoration to employment under the terms of this policy shall make written application for such restoration to the Chair of the Board within 90 days after discharge or release from active federal or state military service and shall attach to such application evidence of discharge, separation, or release under honorable conditions.

LEAVE OF ABSENCE WITHOUT PAY

Full-time District employees may be granted unpaid leaves of absence provided such requests are thoroughly documented, timely, meet eligible qualification requirements, are reviewed and approved in advance through regular channels. Requests will then be forwarded to the Vice Chancellor for Human Resources with appropriate recommendation for review and disposition. Approval will be based upon the operational needs of the District. Guidelines for unpaid leaves of absence shall be developed and implemented by the Chancellor.

DISABILITY: LONG TERM DISABILITY

An employee who becomes eligible for long-term disability benefits will be placed on inactive status. [See General Provisions and Long Term Disability DEBC (Local)] Inactive status will terminate upon the earlier of the following occurrences:

prior to the date of his or her disability, injury, illness, or medical condition, or transfer the employee into another position, provided that the employee is able to perform the essential functions of the job and the one-year period has not expired.

SHORT TERM DISABILITY

The District provides short-term disability benefits to eligible full-time employees who are totally incapacitated and have exhausted all paid leave. Benefits are for a specific portion of the employee’s salary (60%) up to 90 calendar days. Eligibility is dependent upon appropriate medical documentation.

WORKERS’ COMPENSATION

An employee who experiences an on-the-job injury or illness that renders him or her incapable of performing his or her regularly assigned duties is eligible for Workers’ Compensation Benefits. An employee who is receiving Workers’ Compensation benefits may use accumulated sick leave concurrently. However, an employee taking Family Medical Leave and receiving workers’ compensation wage benefits may not use any accumulated sick leave until the Family Medical Leave expires (See DECB). The District shall pay the difference between the weekly income benefit received under Workers’ Compensation and the employee’s regular compensation. Sick leave shall be charged proportionally. At such time as the amount of accrued sick leave is exhausted and the employee is still absent from work due to job injury, the employee shall be placed on leave without pay status (See Section DEBC).

DOCUMENTATION OF LEAVE

The District will maintain records of the vacation and sick leave accrual and absences of each employee, and the reasons therefore, whether from sickness, vacation, other paid leave, or leave of absence without pay.

SABBATICAL LEAVE

Sabbatical leave refers to an award of a specific period of leave during which an eligible faculty member or professional contractual staff member (administrator) will be released from his or her responsibilities for the District to engage full-time in professional development, study, research, writing, work experience related to his or her field of work, or to address the strategic needs of the District.

NORTH HARRIS MONTGOMERY COMMUNITY COLLEGE DISTRICT COMPENSATION AND BENEFITS: DECA LEAVES AND ABSENCES (LOCAL) A faculty member may be awarded sabbatical leave for either 1) one full

semester, in which case he or she would receive his or her full salary for the semester and benefits; or 2) one academic year (nine months), in which case he or she would receive one-half (50%) of his or her annual salary (nine months) and full benefits. An administrator may be awarded sabbatical leave for a period of five months, during which time he or she will receive his or her full contract salary and benefits. Full-time faculty and full-time administrators with at least seven years of continuous service to the District are eligible to be awarded a sabbatical. A faculty member or administrator who was awarded a sabbatical at any time during the previous seven years is not eligible to be awarded a sabbatical. During the time that an administrator or faculty member is on sabbatical leave, he or she may not continue to perform additional services or receive any stipend, program coordinator pay or overload pay. Any faculty member or administrator who is awarded sabbatical leave must serve one complete contract year of full-time service to the District. A faculty member or administrator who takes sabbatical leave and does not fulfill this service requirement must repay the full value of the leave on a pro-rata basis. The Chancellor will appoint a committee consisting of the Vice Chancellor for Human Resources or his or her designee, one faculty member from each college and one professional contractual staff member from each college to develop procedures regarding the application process and timelines for selecting persons to be awarded sabbatical leave. Each year, the Chancellor shall determine the number of available sabbatical leave awards to be awarded at each college and at the district office. The award process shall be conducted at each location in accordance with the District procedures.

FACULTY LEAVE BANKING

The Chancellor shall establish a Faculty Leave Banking program to permit faculty and other full-time employees who teach to convert compensation earned through extra service assignments into a future leave pool. This program shall permit an eligible employee who has earned the equivalent of a full-semester of banked leave plus three additional contact hours to take a semester’s leave with full pay. An eligible employee who has elected the leave banking option may reverse the election at any point before he or she has taken the banked leave. If an eligible employee reverses the election, the amount of salary to be paid is the same amount that he or she would have been paid if the leave banking option had not been elected and shall not reflect any interest earnings, salary adjustments or subsequent reclassifications.

Consideration of Approval of Proposed Fee Schedule for Implementation in Fall 2005

Chancellor’s Recommendation:

That the Board of Trustees approve the proposed fees submitted for Fall 2005.

Rationale: Collection of fees for student insurance fees for clinical and practicum

experiences will be added to overall tuition and fee charges. This enables students to use appropriate financial aid monies to help defer costs instead of paying separately for these fees. These fees are collected and then submitted to the appropriate agency. New & increased lab fees will help to offset the increasing costs of laboratory materials and supplies. In addition, the Board is requested to approve a proposal to expand the collection of a technology fee to Continuing Education leisure learning courses. Previously the Board approved the implementation of a technology fee schedule for certain Continuing Education and Workforce Development courses during the June 5, 2003 meeting. The approved fee schedule excludes testing (GED, etc.), contract and grant funded courses, evening high school and leisure courses, Small Business Development Center classes and certain linked courses for which tuition is not collected. The CE Council is now proposing that a technology fee be collected for leisure learning courses in order to support the technological infrastructure used for Colleague registration, certificate generation, tracking, and posting of grades for those courses. This proposal would exempt Discovery College (Youth courses) and Academy for Lifelong Learning courses (ALL).

Fiscal Impact:

Funding increase will be in effect for the 2005-06 operating budget.

The curriculum council wants to increase the fee to $18 with is the same as BIOL 1407, 2401, 2401, & 2420. The courses with the lower biology lab fees have an equal amount of equipment and material requirements as the higher lab fee courses. For exmple, the BIOL 1406 course requires expensive DNA materials and the 1409 course requires specimen similar to the 1407 biology course which has an $18 fee. All of the biology courses have molecular labs that require expensive glassware. Fee increase is needed to cover lab supplies.

HCC: $24 for all classes. San Jacinto: $15 for all labs except Microbiology which is $20.

Rationale: This project consists of installation of new sidewalk site lighting at North

Harris and Kingwood Colleges. The lights for North Harris College will replace existing in-ground lighting fixtures that are no longer working. At Kingwood College, the new light fixtures will be installed along the new concrete walkway from the parking lot to the Fine Arts building. These light fixtures will provide added security for students, faculty, and staff who are on campus after dark.

Services to Eliminate Bats at Tomball College Chancellor’s Recommendation:

That the Board of Trustees ratify the purchase of emergency services for elimination of bats at Tomball College to Newsom’s Wild Animal Control Services, P. O. Box 2027, New Caney, TX 77357, for $16,840.

Rationale: Tomball College administrators purchased professional services to re-

locate a colony of free roaming bats and eliminate any potential threat to the safety of students, faculty, staff and construction employees from within college buildings. The services were purchased immediately when the extent of the problem was discovered. Pursuant to Texas Education Code 2155.137, each agency has the sole responsibility to declare an emergency purchase of goods or services if the agency feels they will suffer financial or operational damage unless the purchase is immediately secured. Board Policy states that when an emergency purchase exceeds $10,000, approval from the Chief Financial Officer must be secured before the purchase is made and a full record of the transaction must be presented to the Board of Trustees at the next regular meeting for approval.

That the Board of Trustees approve the purchase of power door openers for the DSTC and TUC from the low bidder, Marek Brothers Systems, Inc., 3539 Oak Forest Drive, Houston, TX 77018, in the amount of $27,711.

Rationale: The project consists of the installation of power door openers on six (6)

entry doors located on the first floor of the DSTC and two (2) restroom doors located on the third floor of TUC. The powered doors will make the buildings and restrooms more accessible for everyone using the facility, particularly for those with disabilities. Marek Brothers offered an equivalent to the specified door opener. After evaluation, the equivalent was found to be an acceptable alternative. Acceptance of the alternative resulted in a savings of $3,625.

Fiscal Impact: Funds for this purchase are available from 2000 Referendum General Obligation Bonds, Series 2003 for DSTC and Repair and Replacement budget for TUC.

Rationale: The project will consist of the addition of a secondary entrance on the

south side of Willow Chase Center. The new entrance will allow for better accessibility to students, staff and faculty and provide closer proximity from the parking lot. The majority of the parking lot is full throughout the day and evening and having the secondary entrance will provide faster, more convenient and safer access to the building. The remodeling of the three computer labs are necessary in order for the addition of the entryway to be completed. Bid proposals were sent to eighteen (18) construction contractors and three (3) responses were received. See attached Bid Tabulation.

NHMCCD Monthly Project Summary

Report

Tomball College Phase IV: The new Library at Tomball College and the new Wellness Center are complete and occupied by the College. The following areas have been completed and are currently occupied by the college: Library Renovation, New Bookstore, New Multipurpose Room, New Recreational rooms and changes made to the old President’s office.

Ongoing renovation of theWomen’s Showers

Renovation of the Showers (Wellness Center) is nearing completion. The rough in plumbing, plaster ceilings, and masonry work have been completed in the restrooms. Currently we are completing the ceramic tile work in both restrooms and preparing to begin installing the final plumbing fixtures and the toilet accessories. The showers are scheduled for completion at the end of March.

Ongoing Renovation of the Men’s Showers

Work has begun on the Dining Area Addition, which will take place at the old bookstore. All existing plants and shrubs have been removed and dirt work has begun, but the recent rainy weather has slowed our progress.

Chancellor’s Recommendation:

That the Board of Trustees approves the commissioning of the following peace officers for the North Harris Montgomery Community College District.

North Harris College Anthony Louis Ruben

Alejandro Eleazar Carrizales Patrick Eugune Chisholm

Rationale:

These officers are eligible to be commissioned by this Board because they: 1. Have current licenses from the Texas Commission on

LawEnforcement Officer Standards and Education; 2. Have taken and filed the oath required of peace officers; 3. Have executed good and sufficient bonds in the sum of $1,000

in accordance with the law; and 4. Possess a sufficient number of college credit hours to meet the

minimum standard for an NHMCCD peace officer.
