    SlMichael Zeleny was determined to be carrying a concealed firearm on his person, in a public area, in violation of PC 25400(a)(2). Case to the DA for review.

    NARRATIVE:

    On 06113/12, at approximately 0902 hours, I responded to the southwest comer of the 2800 block of Sand Hill Road, to speak with SlMichael Zeleny.

    I was familiar with Zeleny from previous contacts and knew that he regularly conducted demonstrations in that area to draw attention to executives he was at odds with, that allegedly worked for a nearby company. I also knew that as part of his public demonstrations, Zeleny would often display large posters of the executives he was drawing focus towards. In addition to the posters, I knew that Zeleny would often bring a collection of various fuearms to his demonstrations-typically pistols, rifles, and shotguns.

    As I arrived on-scene, I immediately noted that Zeleny was standing on the public sidewalk, adjacent to Sand Hill Road. Further, I observed that he was wearing a tactical armored vest with two rifle magazines in the chest pockets. Of concern however, was the fact that Zeleny was wearing a tan-colored leather shoulder holster, with the holster portion along his left side. I could not readily determine if there was a fuearm concealed in the holster itself.

    As I approached Zeleny (with my MPPD-issued digital audio recorder activated), I greeted him and . asked if his holster had a pistol in it. He nodded and stated that it did. As I looked at his holster more closely, I noted what appeared to be a makeshift locking mechanism attached to the leather flap of the holster. The mechanism itself appeared to be relatively flimsy in construction. Zeleny later told me that he had fashioned the mechanism himself and attached it to the holster. The lock itself was small in size and required a key to open. Zeleny gave me the key so I could inspect the pistol concealed inside.

    Once I could see the contents inside of the holster I located a SIG SAUER, P210-6, 9mm pistol, with a serial number of: P79136. A records check of the pistol showed that it was registered to Zeleny. In addition to the pistol located in the holster, I located a fully-loaded magazine belonging to the pistol, in a side-pouch.

    Based on the evidence observed, I believed. that Zeleny was in violation of PC 2S400(a)(2), carrying a concealed firearm on his person.

    I took digital photos of the violation and later downloaded them into the MPPD secure digital media server as evidence.

    CRIME SCENE:

    The crime took place at the intersection of 2800 Sand Hill Road, in the city of Menlo Park, CA, in the County of San Mateo.
