EPA is planning to spend public funds to control and investigate these releases. This action will be taken by N EPA pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA), 42 U.S.C, §9601 et seq., unless EPA determines that such action will be done properly by a responsible party. Responsible parties under CERCLA include the current and former owners or operators of the site and persons who generated the hazardous substances or were involved in transport, treatment, or disposal of them at the site. Eased on information EPA received during its investigation cf conditions at this site, EPA believes that you and/or your firm may be responsible parties. EPA is currently completing a remedial investigation/feasibility study (RI/FS) to address contamination in the brook and will be acting en the recoiBmenclaticns of that study. Before undertaking any necessary remedial action at the sits, however, U.S. EPA will request that the responsible parties voluntarily perform the work required to abate any releases or threatened releases of hazardous substances, pollutants, and contaminants. EPA is planning to spend public funds to control andinvestigate these releases. This action will be taken byNEPApursuant to the Comprehensive Environmental Response, Compensation,and Liability Act of 1980 (CERCLA), 42 U.S.C, §9601 et seq.,unless EPA determines that such action will be done properly bya responsible party. Dear Sir or Madam:

The United States Environmental Protection Agency (U.S. ERA) has documentedthe releases or threated releases of hazardous substances, pollutants andcontaminants at the above referenced site. U.S. ERA is planning to spendpublic funds to control and investigate these releases. This action willbe taken by U.S. EPA pursuant to the Comprehensive Environmental Response,Compensation, and Liability Act of 1980 (CERCLA), 42 U.S.C. 9601 et seq.,unless U.S. ERA determines that such action will be done properly~Fy a re-sponsible party. Responsible parties under CERCLA Include the currentand fomer owners or operators of the site and persons who generated thehazardous substances or were involved 1n transport, treatment, or disposalof th**m at the site.

Rased on information U.S. EPA received during Its Investigation of conditionsat this site, U.S. EPA believes that you and/or your firm may be respon-sible parties. U.S. EPA 1s currently conpleting a Remedial Investigation/Feasibility Study (RI/FS) to address contamination in the brook and willbe acting on the recommendations of that study. Before undertaking anynecessary remedial action at the site, however, U.S. EPA will request thatthe responsible parties voluntarily perform the work required to abate anyreleases or threatened releases of hazardous substances, pollutants, and con-tr.ninants. Under Section 107(a) of CERCLA, responsible parties may be heldliable for all reasonable costs incurred by U.S. EPA when it expends publicfunds tn achieve th<^ cleanup of hazardous substances at a waste site.

In addition, U.S. ERA is seeking to obtain certain other information fromyou pursuant to its authority under Section 104 of CERCLA, 42 U.S.C. §9604,and Section 3007 of the Resource Conservation and Recovery Act (RCRA) asamended, 42 U.S.C. §6927, for the purpose of assisting in determining theneed for response to a release of hazardous substance(s) under CERCLA. TheAdministrator of the U.S. ERA has the authority to require any person whogenerates, stores, treats, transports, disposes, arranges for the disposalof, or otherwise handles hazardous wastes and hazardous substances, as thoseterms are defined in Section 1004(5) of RCRA, 42 U.S.C. 6903(5) and Section101(14) of CERCLA, 42 U.S.C. 9601(14), to furnish the U.S. EPA with informa-tion related to such activities. Pursuant to these statutory provisions, youare hereby requested to submit the information requested below.

1. Copies of all shipping documents or other business documentsrelating to the acceptance, transportation, storage and/ordisposal of waste materials or substances 1n or from theFields Brook drainage basin in Ashtabula County, Ohio.

2. A detailed description of the generic common and/or tradename and the chemical composition and character (i.e.,liquid, solid, sludge) of the waste material offered byyou for transportation to, storage and/or disposal in theFields Brook drainage basin or transported, stored, ordisposed by you in the Fields Brook basin drainage,

3. For each hazardous substance identified above, please givethe total volume, in gallons for liquids and in cubicyards for solids, for which you arranged disposal, andlist when and where disposal occurred.

4. What arrangements were made to transport hazardous sub-stances in or from the Fields Brook drainage basin inAshtabula County, Ohio? What type of transportation wasused (i.e., tankers, dump trucks, drums)?

5. Who was the transporter of the hazardous substances, whatwas his previous address, and what is his current address?

6. Copies of all records, including analytical results, andmaterial safety data sheets, which indicate the chemicalccnposition and/or chemical character of the waste mater-ial (s) transported to or from, stored or disposed of inthe Fields Brook drainage basin or offered for transporta-tion to or fron storage or disposal in the Fields Brookdrainage basin.

7. A list and description of all liability insurance coveragethat is and was carried by you including any self-insuranceprovisions, that relates to hazardous substances and/orthe Fields Brook site and copies of all of these insurancepolicies.

8. Describe any information you may have obtained regardingcontaminated fill material or debris deposited in or nearthe Fields Brook drainage basin. Such should include anyinformation regarding fill allegedly disposed by you at ornear the residence of Sandra Herl, 935 East 19th Street,

. Ashtabula, Ohio.

To assist you in answering this request, the information sought pertains toany and all information in your possession, custody or control relating tothe Fields Brook site and to the transportation, storage, and/or disposal ofhazardous substances or the generation of hazardous substances which were ul-timately disposed of or offered for disposal at the site or by persons withinthe Fields Brook drainage basin. Where documents are unavailable or incomplete,interviews of knowledgeable persons shall be used to develop the requestedinformation (each such person shall be identified).

For all purposes of this information request, "shipping documents" shall meanall contracts, agreements, purchase orders, requisitions, pick-up or deliv-ery tickets, customs forms, freight bills, shipping memoranda, order forms,weight tickets, work orders, manifests, snipping orders, packing slips, billsof lading, invoices, bills and any other similar documents that evidence dis-crete transactions involving shipment, or the arrangement for shipment, ofwaste materials to, through, OP from, the above referenced site. "Haste materi-als" shall mean hazardous substances, solid wastes and hazardous wastes, andother materials which may or may not contain pullutants or contaminants,and shall include reclaimed and off-specification materials of any kind."Person" means any natural person, proprietorship, corporation, publiccorporation, state or local government entity, governmental agency, politicalsubdivision, public or private university or other institution of higherlearning, partnership, group, association, committee or any other organization.A request for the description or identification of a person shall be deemedto include a request for the following information with respect to such person:(a) the person's full name; (b) the person's last known address and hisbusiness address; (c) the person's telephone number; (d) the person's companyor agency affiliation at the date of the transaction referred to and thecapacity in which such person was then serving said company or agency; (e) theperson's present or last known company or agency affiliation and the capacityin which such person serves such company or agency; and (f) the reason theperson has the knowledge requested and a listing of the items, in the informationrequested above, of which the person has knov/eldge. "Fields Brook" or "FieldsBrook site" consists of Fields Brook, Ashtabula County, Ohio, its tributaries,and any surrounding areas which contribute, potentially may contribute, orhave contributed to contamination of the brook or its tributaries. Exceptfor areas, if any, located outside the Fields Brook watershed which dischargeinto it, the attached figure of the watershed, also referred to as the "FieldsBrook drainage basin," delineates the area which contains the site.

Under Section 3008 of RCRA,42 U.S.C. 6928, failure to comply with this request may result in an orderrequiring compliance or in a civil action for appropriate relief.
