1 READY RECKONER On PAY, ALLOWANCES AND PENSION - 2009 The VI th Central Pay Commission (CPC) was set up by the Govt. Of India by Resolution No. 5/2/2006-E III(A) dated 05 Oct 2006 as amended by Resolution No. 5/2/2006-E III (A) dated 07 Dec 2006 and 5/2/2006-E III (A) dated 08 Aug 2007. The Commission submitted its report on 24 Mar 2008. The report covered among other things matters relating to structure of emoluments, allowances and conditions of service of Armed Forces personnel. After analysis, the Govt. of India has approved the report with some modification/amendments. The revised rate of Pay and Allowances are applicable from 01 Jan 06 and 01 Sep 08 respectively. The revised rates/scale of Pay and Allowances and Pension of Armed Forces Personnel are appended below:- 1. PBOR . 1. PBOR. The revised pay structure of PBORs of Army, Navy and Air Force will be as follows:-

(b) Group ‗X‘ Pay is a fixed amount admissible to a PBOR of ‗X‘ Group only. It

will be counted as pay for all purposes including calculation of the annual increment. (c) Rate and Date of Increment

The Annual Increment in the revised pay structure will be 3% of the sum of the pay in the Pay Band, Grade Pay corresponding to the rank and ‗X‘ Group Pay (where applicable), which will be rounded off to the next multiple of 10. The amount of increment will then be added to the pay in the Pay Band. The increment will be paid annually on 01st July each year. The personnel completing six months and above in the pay band will be eligible for grant of increment.

(d) Classification Allowance. This allowance was admissible to only PBORs of Army till the Vth CPC. However Post-VIth CPC, Classification Allowance has been extended to PBORs of Navy and IAF also on similar conditions of admissibility as applicable to PBORs of Army. The revised rates of allowance are as follows:-

(g) Pay Scales of DSC Personnel. DSC personnel will be paid on the basis of revised pay structure as applicable to PBORs.

(h) Assured Career Progression (ACP). A directly recruited PBOR as a Sea II, PO or CPO will be entitled to minimum three financial up gradations after 8,16 and 24 years of service. At the time of each financial up gradation under ACP, the PBOR would get an additional increment and next higher Grade Pay.

(j) Good Service/Conduct/Badge Pay. The GS/GCB rates, which were admissible to PBORs of the three Services, have been doubled subject to the existing terms and eligibility conditions. The revised rates are as follows:-

3 2. Officers. The revised pay structure of Commissioned Officers of Armed Forces will be as follows:-

Note 1:- The captain (TS) will draw the same Grade Pay as admissible to a Captain (Select) and will be granted one increment on promotion to Captain (TS). Note 2:- On promotion from PB-4 to HAG Scale, one increment in the Pay in the Pay Band and existing Grade Pay be added. To the figure so arrived, a sum of Rs. 2000.00 will also be added so that benefit allowed on promotion to HAG is not withdrawn. The resultant figure will become the basic pay in HAG scale, subject to a minimum of Rs. 67000.00 Note 3:- The Basic Pay in the HAG scale shall not exceed Rs. 79000.00, the maximum of the scale. The officers in receipt of NPA, the pay plus NPA shall not exceed Rs. 85000.00. Note 4:- On promotion from HAG to HAG+ scale, one increment in the Basic Pay be added. The resultant figure will become the basic pay in HAG+ scale, subject to a minimum of Rs. 75000.00 . The Basic Pay in the HAG+ scale shall not exceed Rs. 80000.00, the maximum of the scale. The officer in receipt of NPA, the pay plus NPA shall not exceed Rs.85000.00. 3. Grant of Fixed Pay during Training to Gentlemen/Lady Cadets in Service Academies. Fixed stipend of Rs. 21000.00 p.m during last year of training is admissible. On completion of training the fixed stipend of Rs 21000.00 p.m (Rs. 15600.00 as pay in Pay Band plus Grade Pay of Rs. 5400.00) would be converted to ―Pay‖ for all purposes on grant of commission and revised rates of pay viz. Pay in the Pay Band, Grade Pay, MSP and DA etc, as applicable would be paid in arrears.

4 4. Pay for Entrants to AMC, ADC and RVC. Entrants to AMC, ADC and RVC are to be paid as indicated below:-

(a) Sub Lieutenant/Equivalent - 09% higher than minimum of Pay Band 3 along with Grade Pay. (b) Lieutenant/Equivalent - 12% higher than minimum of Pay Band 3 along with Grade Pay.

5. Pay Structure - MNS Officers. Revised pay scales of MNS Officers are as under:-

Authority:- SAI/SNI/SAFI 01/08 and 02/08 6. Pay Fixation of Re-employed Officers. The officers who are re-employed on or after 01 Jan 2006 shall be allowed to draw pay only in the revised pay structure. The pay of these officers is to be fixed in the following manner.

(a) Officers who retired from Pre-revised Scales of Pay and were Re-employed in the Revised Pay Structure. The initial pay in the pay band shall be fixed in the revised scale in accordance with NI 02/S/08 with reference to the rank held at the time of retirement. Grade Pay of the rank held by the officer at the time of his retirement or Captain (TS)‘s grade pay, whichever is lower is to be granted to him during the period of re-employment. (b) Officers who retired and or Re-employed in the Revised Scales of Pay. The initial pay on re-employment shall be fixed at the same stage in the revised scale as the last pay drawn. Grade Pay of the rank held by the officer at the time of his retirement or Captain (TS)‘s grade pay, whichever is lower is to be granted to him during the period of re-employment.

Once the initial pay of a re-employed pensioner has been fixed in the manner as indicated above, annual increments will be allowed in accordance with procedure as laid down in para 9 and 11 of NI 02/S/08, i.e., 3% of the sum in the pay in the pay band and grade pay applicable, which will be rounded off to the next multiple of 10 and payable on 01 Jul of every year. The increment be calculated on the entire amount of pay as if pension had not been deducted provided that the pay plus gross pension on re-employment does not exceed Rs. 80,000.00 p.m. The ignorable part of pension has also been enhanced to Rs. 4000.00 and applicable only to officers who retired/retires before attaining the age of 55 years.

7. The rates of Flying Allowance are as follows:-

8. Special Force Allowance. Commandos of Army and Air Force are entitled to Special Force Allowance. The revised rates are as follows:-

9. Para Allowance and Para Reserve Allowance.

(a) Para Allowance and Para Reserve Allowance is admissible to officers and PBORs holding appointments of operational parachutists authorised in the war/peace establishments of their units. For continuance of grant of Para Pay, a Parachute Refresher course including a minimum of two jumps is required to be attended. The allowance ceases on shifting from operational Parachutist appointment and Para Reserve Allowance is granted thereafter subject to the condition that the individual has rendered a minimum of 03 years service in a para unit and is less than 35 years of age. The rates of the allowance are as follows:-

(b) Para Jump Instructor Allowance. The Para Jump Instructor Allowance @ Rs. 2400.00 per month to officers and Rs. 1800.00 per month to PBORs of Air Force is granted, who are Parachute Jump Instructors.

(c) Free Fall Jump Instructor Allowance. The allowance shall be admissible to Para Jump Instructors on successful completion of Free Fall Jump Instructor Course and only when they are employed as Free Fall Jump Instructors. Rates are as under:-

Note:- Personnel who are entitled to Flying Allowance shall draw either the Siachen Allowance or Flying Allowance along with the Highly Active Field Area Allowance. The Siachen and Flying Allowance shall not be admissible concurrently. In addition to the Special Force Allowance, the Special Forces personnel shall be entitled to the applicable Field Area and High Altitude Allowance when they are deployed in areas where these allowances are also admissible. However, when deployed on CI Ops they shall be entitled, in addition, only the applicable CI Ops Allowance depending on the area of CI Ops.

15. Sea Going Allowance for Officers and Sea Duty Allowance to Sailors. The admissibility condition for this Allowance is that the ship must be at sea for duration exceeding 12 hrs in a day. The Allowance would be admissible on a daily pro-rata basis as at present. The Submarine and Flying Allowance will not be admissible

concurrently with this allowance. The rates are as follows:-

16. Submarine Duty Allowance. The Submarine Duty Allowance is admissible to personnel who are not qualified submariners but embark on submarine for duty, training or passage etc. The rate of the allowance is Rs. 90.00 per day for officers and Rs. 30.00 per day for sailors. COMPENSATORY ALLOWANCES 17. Acting Allowance (JCOs and Equivalent in Navy and Air Force). The rates for Acting Allowance are as under:-

18. Extra Duty Allowance. The rates for extra duty allowance are as follows:-

20. Aeronautical Technical Allowance. The allowance will be granted to the Aircraft technicians in all the three Services at the same rate subject to the similar terms and conditions as applicable in respect of the Submarine Technical Allowance which is Rs 200.00 p.m. The allowance will be admissible to those aircraft technicians who have successfully qualified in TETTRA, TTCU, MCF or similar courses in the Air Force or the equivalent courses in the Aviation Wings of the Army and Navy and are authorised to maintain or service the aircraft and related systems. 21. Airworthiness Certificate Allowance. The allowance will be admissible to the aircraft technicians in the three Services authorised to sign Form-700 after having

qualified in the ―Aircraft Type‖ exam conducted by the competent authority and who are in possession of the necessary authorisation for assuming independent charge of the applicable operating machinery. The rates of the allowance are as follows:-

11 22. Air Steward Allowance. Air Steward Allowance is granted to Catering Assistants borne in the Air Force, while performing the duties of air stewards in VIP Flights at the rate of Rs. 600.00 per month. Authority:- MoD letter No.1/54/2008/D(Pay/Services) dated 04 Nov 08.

23. Boiler Watch Keeping Allowance. The Boiler Watch Keeping Allowance is admissible to sailors who are serving on board ships and specified units when so deployed for Boiler Watch Keeping duties. 24. Bhutan Compensatory Allowance (BCA). The rates are not yet revised:- 25. Composite Personnel Maintenance Allowance (CPMA) for PBORs. The following allowances have been clubbed and a Composite Personnel Maintenance Allowance sanctioned at the following rates:- S No Allowances Rates (p.m)

Armed Forces officers deputed to a project in an organisation, other than MoD, will be entitled to draw this allowance at par with Central Govt employees posted in that project on the same terms and conditions, provided they are not eligible for Field Service Concessions. CEA and RTF has been merged and will henceforth be known as ―Children Education Allowance Scheme‖(CEA Scheme) and can be claimed upto a maximum of two children. Re-imbursement includes Tuition Fee, admission fee, laboratory fee, special fee charged for agriculture, electronics, music etc. The amount also includes reimbursement for purchase of one set of text books and notebooks, two sets of uniforms and one set of school shoes in a year. The annual ceiling of the allowance is Rs. 12000.00 for an academic year. The re-imbursement can be claimed once every quarter. The amount that can be claimed in a quarter could be more than

Rs. 3000.00 and in another quarter less than Rs. 3000.00, subject to that annual ceiling of Rs. 12000.00 per child restricted to two children being maintained. Hostel subsidy can also be reimbursed by a Govt. servant upto the maximum limit of Rs.

3000.00 per month per child subject to a maximum of two children. However, both hostel subsidy and CEA cannot be availed concurrently. Reimbursement will be applicable for expenditure on the education of school going children only i.e classes nursery to twelfth. The CEA shall have no nexus with the performance of the child in his/her class. In other words, even if a child fails in a particular class, the reimbursement of CEA shall not be stopped. Note 1:- CEA is admissible for more than two children in case the number of children exceeds two as a result of multiple birth.

Note 2:- A physically/mentally disabled child of Govt. Servant studies in any Govt. Institution i.e. aided or approved by the Central/State/UT administration or whose fees are approved by any of these authorities, the CEA paid by the Govt. Servant shall be reimbursed irrespective of whether the institute is recognized or not. In such cases, the benefit will be admissible between the age limits 5 to 22 years.

Note 3:- In case where minimum qualifications for admission in the two years polytechnic is 10th class and the student joins the polytechnic after passing the 10th class , the re-imbursement of tuition fees shall also be allowed for the 1st and 2nd year classes of the said course. In all cases where death occurs while on active field service or serving in a mission/post abroad, the entire funeral expenses including cost of transportation, embalming and coffins may be charged against the State. When death occurs in peace areas, Funeral Allowance at a rate of Rs 4000.00 may be sanctioned and paid from Ship‘s Imprest on a Contingent Bill subject to Post Audit. The charges of mortuary may be reimbursed, as per actual, without any ceiling.

Official are to travel by Air India only to the hub/point closest to their eventual destination, beyond which the services of another airline which should also preferably be an alliance partner of Air India be utilised.

In case of stay/journey on Govt. ships, boats etc. or journey to remote places on foot/mules etc, for scientific/data collection purposes in organisation like FSI, Survey of India, GSI etc, daily allowance will be paid at rate equivalent to that provided for reimbursement of food bill. However, in this case, the amount will be sanctioned irrespective of the actual expenditure incurred on this account with the approval of the Head of Department/controlling officer. For journeys on foot, an allowance of Rs. 5/- per kilometer travelled on foot shall be payable additionally.

Note:- The rates of all the components of Daily Allowance shall automatically increase by 25% whenever the Dearness Allowance payable on the revised pay bands goes up by 50%.

75. Old Rates of Daily Allowance. The personnel are also authorised to claim old rates of DA. In that case, the above rates will not be entitled and can not be claimed by an individual. The option to claim will be available as a complete package for a particular tour and not by taking part of either orders. In other words, officers/sailors may choose to be governed either by orders dated 23 Sep 08 or dated 17 Apr 98, in regard to daily allowance on tour. The old Rate of DA as promulgated vide order dated 17 Apr 98 are as under and will be applicable to the revised pay scale as per table given below:-

The TA on transfer comprises a CTG equal to one month’s Pay in Pay Band plus Grade Pay Military Service Pay, *Classification Allowance, *Group ‘X’ Pay and *Non Practicing Allowance (*where

applicable) along with actual fares for self and family as per the entitled class. In

cases of transfer to stations which are at a distance of less than 20 kms from the old station and of transfer within the same city, one third of the CTG will be admissible, provided a change of residence is actually involved. Note:- At present, only one transfer grant is permitted if the transfer of husband and wife takes place within 06 months of each other from the same place to the same place. With effect from 01 Sep 08, in cases where the transfer take place within six months, but after 60 days of the transfer of the spouse, 50% of the transfer grant on transfer shall be allowed to the spouse transferred later. No transfer grant shall be admissible to the spouse transferred later, in case both the transfers are ordered with 60 days. The existing provisions shall continue to be applicable in case of transfers after a period of six months or more. Other rules precluding Transfer Grant in case of transfer at own request or transfer other than in public interest, shall continue to apply unchanged in their case.

32 79. Entitlements of Retiring Defence Personnel (Rule 200-A of TR 1991 (Revised Edition).

(a) Transportation of Conveyance. The expenditure on Transportation of conveyance by defence personnel shall be reimbursed without insisting on the requirement that the possession of the conveyance by them while in service at their last places of duty should have been in public interest.

(b) Lump-sum Transfer Grant and Packing Allowance. The Composite Transfer Grant equal to one month‘s Pay as defined in para 76 above may be granted in the case of those service personnel who on retirement settle down at places other than the last station of their duty located at a distance of or more than 20 km. As in the case of serving defence personnel who on retirement settle at the last station of duty itself or within a distance of less than 20 km may

be paid the composite transfer grant equal to one third of the Pay as defined in para 76 above subject to the condition that a change of residence is actually involved.

80. Additional Travel Facilities

(a) In partial modification of Rule 216, 217, and 218A of TR, travel by fastest means including air shall be authorised for onward and return journeys to dependants of deceased Defence Forces personnel for conducting customary social rites.

(b) In partial modification of Rule 94 Note (i) and Rule 108 of Travel Regulations, the authorised class of travel for hospital admission shall be the same as that authorised for official tours. (c) In partial modification of Rule 162 of Travel Regulations conveyance granted to two relatives of battle casualties at Govt. expense to meet service personnel admitted in a Military Hospital presented limited to the rank of Lt Col and equivalent has been extended to all Defence Personnel irrespective of rank.

LEAVE TRAVEL CONCESSIONS

81. Entitlement of Journeys for the purpose of Leave Travel Concession (LTC)(Rule 176 of TR 1991 (Revised Edition) – Mode and Class of Accommodation). The travel entitlements for the purpose of official tour/transfer or LTC, will be the same but no daily allowance shall be admissible for travel on LTC. In partial modification of earlier orders on this subject, the MoD has directed that all personnel entitled to travel by air are to travel by NACIL (Air India) only. The sectors not covered by Air India, the journeys are to be performed by utilising the services of another airline which should also preferably be an alliance partner of Air India. Further, air fare on LTC should not exceed the fare offered by NACIL(Air India) under LTC-80/LTC-Executive schemes. For sectors, not covered under LTC-80/LTC-Executive schemes of NACIL, officers should ensure that cheapest economy tickets are purchased by either booking through internet/airlines directly/authorised travel agents. In case of travel by road, the

facility shall be admissible only in respect of journeys performed in vehicles operated by the Govt. or any Corporation in the Public Sector run by the Central or State Govt. or a local body. Note:- The parents and/or step parents (step mother and step father), who are wholly dependent on the service personnel, have also been included in the definition of the family for the purpose of LTC, irrespective of whether they are residing with the service personnel or not. The definition of dependency will be linked to the minimum family pension i.e. Rs. 3500.00 per month. The extant conditions in respect of other relations included in the family including married/divorced/abandoned/separated/widow daughters shall continue without any change.

82. LTC to children staying in Hostels (Rule 177 and 184 of TR 1991 (Revised Edition). Children of service personnel staying in hostels are permitted to visit their family on LTC. 83. Encashment of Annual Leave along with LTC. The service personnel are allowed to encash ten days annual leave at the time of availing of LTC to the extent of sixty days during the entire career. The encashment of Annual Leave upto 10 days at the time of availing LTC is without any linkage to the number of days and the nature of leave availed while proceeding on LTC. The leave encashed at the time of LTC will not be deducted from the maximum amount of Annual leave encashable at the time of retirement. It is clarified that where both husband and wife are in service, the present entitlement for availing LTC shall remain unchanged, and encashment of leave equal to 10 days at the time of availing of LTC will continue to be available to both, subject to a maximum of sixty days each during the career. Grant of Free Railway Warrant to all Ranks of the Armed Forces serving in Flield/High Altitude/Counter Insurgency/Counter Terrorism Operational Areas. In partial modification of Rule 177 and 184 of Travel Regulation (1991 Revised Edition), One additional Railway warrant to all ranks of the Armed Forces serving in Field/High Altitude/Counter Insurgency/Counter Terrorism Ops area is entitle to travel to and from their duty station and Hometown/Selected Place of Residence (SPR) twice a year instead of one free railway warrant as existing today.

85. Maternity Leave to Women service officers in Defence Services. Women officers in the Defence services are entitled to 180 days Maternity Leave for each confinement subject to a maximum of two confinement/two surviving children.

86. Miscellaneous Provisions.

(a) Daily Allowance to Civilian Candidates. The quantum of DA admissible to civilian candidates called for interview for grant of commission in Armed Forces whenever free boarding and lodging facilities are not made available will be paid at flat rate of Rs. 60.00 per day in metropolitan cities and Rs 40.00 per day in other cities. (b) Travel on First Appointment - Officers. Officers on first appointment will be entitled to travel by AC II Tier. (c) Baggage Entitlement to and from Field Areas. The revised baggage entitlement while proceeding on permanent transfer to and from field areas will be as under:-

(i) Officers - 100 kgs (ii) CPOs & above/Equivalent - 50 kgs (iii) Pos and below/Equivalent - 25 kgs

(d) Conveyance of Families of Service Officers from one Hospital to another and back for Obtaining Appropriate Medical Attendance/ Treatment. Families of officers residing with the head of the family in a station where there is no Service hospital and requiring admission to hospital or specialist‘s examination will be entitled to free conveyance by rail/road/air/steamer from the station of duty of the individual to the nearest service hospital and back.

PENSION 89. Eligibility Condition for Grant of Pension. The Officers and Sailors are entitled to Retiring/Service Pension on completion of qualifying service. The minimum qualifying service required for earning pension is 20 years for officers and 15 years for PBORs. In addition, the following service rendered will also reckon towards pension:-

(a) Pre-commissioned Service rendered under the Central Govt. whether with Civil Department or in the Armed Forces shall count in full for the Qualifying Service.

(b) Fraction of a year equal to three months and above but less than six months shall be treated as complete one half year reckoned as Qualifying Service. (c) The qualifying service would commence from the date of commission. In case of Short Service Commission (SSC) is followed by Permanent Commission, the period during which an Officer holds SSC on probation will reckon for the purpose of pensionary benefits.

Retiring/Service Pension 90. The retiring pension in respect of officers and sailors is as follows:-

(a) Officers. The Retiring Pension of Defence Services officers shall be calculated at 50% of the reckonable emoluments last drawn which includes Pay in Pay Band, corresponding Grade Pay, Military Service Pay, Non Practising Allowance if any, or average of reckonable emoluments drawn in last 10 months whichever is more beneficial.

(b) Sailors. The Service Pension of Personnel Below Officers Rank (PBORs) shall be calculated at 50% of the reckonable emoluments last drawn which includes Pay in Pay Band, corresponding Grade Pay, Military Service Pay, Classification Allowance and ‗X‘ Group Pay if any, or average of reckonable emoluments drawn in last 10 months whichever is more beneficial.

Note 1:- The minimum of pension so calculated above will be subject to the provision that the pension in no case shall be lower than fifty percent of the sum of the minimum of the Pay in the pay Band, Grade Pay and Military Service Pay from which the pensioner has retired . Commutation of Pension 91. The officers and sailors can commute for a lump sum payment upto 50% of their Retiring/Service Pension. The balance will be called the Residual Pension. The commutation value will be worked out taking into account the age of the pensioner on the next birthday as per the following formula:- Commutation Value: 50% of Basic Pension x 12 x Value of years of Purchase Note:- The commutation table is placed at Appendix I.

40 Additional pensioner to Old Pensioners 92. The quantum of additional pension/family pension available to the old pensioners/family pensioners will be as follows:-

Note:- Dearness Relief shall be admissible on additional pension. Gratuity 93. Retirement Gratuity. The Retirement Gratuity is payable at ¼ of the reckonable emoluments admissible at the time of retirement and last drawn for each six monthly period subject to a maximum of Rs. 10 lakh. The reckonable emoluments for calculating the Gratuity for officers includes Pay in Pay Band, corresponding Grade Pay, Military Service Pay, Non Practicing Allowance where applicable and Dearness Allowance admissible at the time of retirement. In case of PBORs reckonable emoluments for calculating the Gratuity includes Pay in Pay Band, corresponding Grade Pay, Military Service Pay, Classification Allowance, ‗X‘ Group Pay where applicable and Dearness Allowance admissible at the time of release from service. 94. Service/Retiring Gratuity. The rate of Service/Retiring Gratuity is ½ month‘s emoluments which includes Pay in Pay Band, Grade Pay, Military Service Pay, Non Practicing Allowance/‘X‘ Group Pay, where applicable and DA last drawn for each six monthly period. The period of three months and above will be treated as one half year. The SSC Officers are entitled to Terminal Gratuity at the rates of ½ a month‘s Reckonable emoluments i.e. as applicable to Service/Retiring Gratuity. Note 1:- The maximum limit of all kinds of Gratuity i.e. Retiring/Retirement/ Service/ Invalid/Special/Terminal/Death Gratuity shall be Rs. 10 lakh. Note 2:- The adding of five years weightage for the purpose of computing qualifying service for Retirement Gratuity and Death Gratuity has been withdrawn with effect from 02 Sep 2008*. Family Pension 95. For the purpose of grant of family pension, the ‗Family‘ shall be categorized as under:- Category I

(a) Widow or widower, upto the date of death or re-marriage, whichever is earlier.

(b) Son/daughter (including widowed daughter), upto the date of his/her marriage/re-marriage or till the date he/she starts earning or till the age of 25 years, whichever is earlier.

41 Category II

(a) Unmarried/Widowed/Divorced daughter, not covered by Category I above, upto the date of marriage/re-marriage or till the date she starts earning or upto the date of death, whichever is earlier. (b) Parents who were wholly dependent on the Armed Forces personnel when he/she was alive provided the deceased personnel had left behind neither a widow nor a child.

Note 1:- Family pension to dependent parents, unmarried/divorced/widowed daughter will continue till the date of death. Note 2:- Family pension to unmarried/widowed/divorced daughters in Category-II and dependent parents shall be payable only after the other eligible family members in Category I have ceased to be eligible to receive family pension and there is no disabled child to receive the family pension. Grant of family pension to children in respective categories shall be payable in order of their date of birth and younger of them will not be eligible for family pension unless the next above him/her has become ineligible for grant of family pension in that category.

96. The dependency criteria for the purpose of family pension shall be the minimum family pension along with dearness relief thereon.

97. The childless widow of a deceased personnel shall continue to be paid family pension even after her re-marriage subject to the condition that the family pension shall cease once her independent income from all other sources become equal to or higher than the minimum prescribed family pension in the Central Government. The family pensioner in such cases would be required to give a declaration regarding her income from other sources to the pension disbursing authority every six months. 98. The enhanced rate of ordinary family pension shall be payable for a period of ten years, without any upper age limit from the date following the date of death of the personnel, to the family of a personnel who dies in service. These provisions will, however, not apply in cases where the period of seven years for payment of enhanced family pension has already been completed as on 01 Jan 2006 and the family was in receipt of normal rate of ordinary family pension on that date. There will be no change in the period for payment of enhanced family pension to the family in the case of death of a pensioner i.e. 7 years from the date of death or till attaining the age 67 years whichever is earlier. 99. A widow whose Special Family Pension (SFP) was stopped on her re-marriage before 01 Jan 1996 have now been made eligible for the same. Govt. Orders have been issued vide MoD letter No. 1(1)/2001/D(Pen/Policy) dated 20 Jan 09. Minimum/Maximum Pension

100. If the amount of any monthly pension (excluding disability element and Constant Attendance Allowance) viz. Retiring Pension/Service Pension/ Invalid Pension/ Special Pension/Family Pension works out to less than Rs. 3500.00 per month, it shall be stepped up to Rs. 3500.00 per month and authorised for payment at this rate. In cases where service element of disability pension falls short of Rs. 3500.00 p.m the same shall be stepped up to Rs. 3500.00 p.m. There will be maximum ceiling on the amount of Service Pension/Invalid Pension/Special Pension and ordinary family pension upto 50% and 30% respectively of the highest pay in the Government (the highest pay in the Govt. Is Rs. 90,000.00 per month since 01 Jan 2006). Disability element shall not be taken into account for the purpose of stepping up of service element to the minimum level of Rs. 3500.00 per month.

101. The Ex-gratia lump sum compensation to the next of kin of the deceased defence personnel with effect from 01 Jan 2006 are as follows:-

(a) Death occurring due to accidents in course of duties Rs. 10.00 Lakhs

(b) Death in the course of duties attributable to acts of violence by terrorists, etc.

Rs. 10.00 Lakhs

(c) Death occurring during enemy action in war or border skirmishes or in action against millitants, terrorists, etc.

Rs. 15.00 Lakhs

(d) Death occurring during enemy action in International war or war like engagements specifically notified.

Special Pension to PBORs 102. The Special Pension/Gratuity is admissible to PBORs who are discharged in large numbers in pursuance of Govt. Policy to reduce the strength or disband the units/Establishments. The minimum service required for grant of special pension will be 10 years in the case of Combatants and 15 years in the case of Non Combatants (E). Where the service is less than 10 years in the Combatants and less than 15 years in the case of Non Combatants (E), special gratuity will continue to be admissible. Authority:- MoD letter No 16(6)2008 (2)/D(Pension/Policy) dated 05 May 09. Invalid Pension 103. The minimum service required for grant of Invalid Pension will continue to be 10 years. In no case, the Invalid Pension will be less than Rs. 3500.00 per month. Where the total service is less than 10 years, invalid gratuity will be admissible. Authority:- MoD letter No 16(6)2008 (2)/D(Pension/Policy) dated 05 May 09. Service Element of Disability/Liberalized Disability/War Injury Pension on Invalidment 104. As hithertofore, Disability/War Injury/Liberalized Disability Pension in invalidment cases will consist of Service Element and Disability/War Injury element and shall continue to be admissible under the provisions laid down in MoD letter No. 1(2)/97/D(Pen-C) dated 31 Jan 2001. 105. The amount of service element shall be equal to retiring/service pension and should not be less than Rs. 3500.00 per month. There shall be no condition of minimum qualifying service having been actually rendered for earning this element, if otherwise admissible.

43 Authority:- MoD letter No 16(6)2008 (2)/D(Pension/Policy) dated 05 May 09. Disability Element of Disability Pension/Liberalised Disability Pension 106. The rates of disability element for 100% disability for various ranks shall be 30% of emoluments last drawn subject to minimum of Rs. 3100.00 per month for 100% disability. For disability less than 100%, it shall be reduced proportionately. In cases of disability pension where permanent disability is not less than 60%, the disability pension (i.e. total of service element plus disability element) shall not be less than 60% of the reckonable emoluments last drawn subject to a minimum of Rs. 7000.00 per month. Note:- The Disability Pension, i.e. ―Disability element and ‗Service Element‖ is exempted from Income Tax vide Ministry of Finance , Department of Revenue letter F. No.200/51/99-ITA.I dated 02 Jul 2001. Authority:- MoD letter No 16(6)2008 (2)/D(Pension/Policy) dated 05 May 09. War Injury Element of War Injury Pension 107. The rates of War Injury Element for 100% disability for various ranks shall be equal to the reckonable emoluments last drawn which would be proportionately reduced where disability is less than 100%. Disability Element/War Injury Element/Liberalized Disability Element on retirement/discharge from service shall continue to be regulated under the provisions of MoD letter No. 1(2)/97/D(Pen-C) dated 31 Jan 2001 at the rates given below:-

(a) Disability Element/Liberalized Disability Element shall be admissible at the rates as defined at para 106 above.

(b) War Injury Element shall be admissible @ 60% of reckonable emoluments last drawn subject to minimum of Rs. 6200.00 per month for 100% disability. For disability of less than 100%, the War Injury Element shall be proportionately reduced.

Note 1:- Service Element as admissible, will be paid in addition to disability element/War Injury Element from the date of retirement/discharge. Note 2:- The aggregate of service element and liberalized disability element shall not be less than 80% of the reckonable emoluments last drawn.

44 Note 3:- In no case the aggregate of service element and war injury element should exceed emoluments last drawn.

Constant Attendance Allowance 110. Constant Attendance Allowance shall continue to be admissible under the conditions as hithertofore. However, it shall be admissible at a uniform rate of Rs. 3000.00 per month, irrespective of the rank. Further this rate be increased by 25% every time the dearness allowance payable on revised Pay Band goes up by 50%. Authority:- MoD letter No 16(6)2008 (2)/D(Pension/Policy) dated 05 May 09. Special/Liberalised Family Pension/Dependent Pension (Special)/ Dependent Pension (Liberalised) 111. Special Family Pension, Liberalised Family Pension, Dependant Pension (Special), Dependant Pension (Liberalised)/2nd life award (in respect of PBOR including NCs(E), shall continue to be regulated at the rates and under the conditions laid down in the MoD‘s letter No. 1(2)/97/D(Pen-C) dated 31 Jan 2001 subject to the reckonable emoluments as defined at para 90 (a) and (b) above. 112. The amount of special family pension admissible to the families of Armed Forces personnel under the circumstances prescribed under category ‗B‘ and ‗C‘ of MoD letter dated 31 Jan 2001, will be subject to a minimum of Rs. 7000.00 per month. 113. The amount of liberalized family pension, admissible to the child/children of Armed Forces personnel under the circumstances prescribed under category ‗D‘ and ‗E‘ of MoD letter dated 31 Jan 2001, will be subject to a minimum of Rs. 7000.00 per month.
