Duringthecourseof2010,bothRussianandBritishpol­itics experienced several events which are certain toaffecttherelationshipbetweenthetwocountriesoverthecomingyear.

A Conservative­Liberal Democrat coalition came topower in Downing Street, exchanging an era of growth inpublic spending for a regime of strict budget economy. InRussia,awholesequenceofevents–startingwiththeJanu­arydemonstrationsinKaliningradandfinishinginDecem­berwithMoscow’snationalistyouthprotestingonManezhSquare – revealed that society is divided in its view of thecurrent system of government.All this is closely linked totheeconomicandforeign­policyinitiativesofbothgovern­ments,andactsasanindicatorofthedirectionfuturedevel­opmentofinter­staterelationsislikelytotake.

TherewasamomentduringLabour’stimeinpowerwhenthestateofcommunicationsbetweenLondonandMoscowreachedacriticallow,andexpertslinkedanimprovementinrelationstoachangeofpowerinDowningStreet.Aftertheelections, these hopes began to look well­founded. Speak­ing to the press, Russian diplomats in London noted theinteresttakenbytheirBritishcounterpartsinimprovingtherelationship with Moscow and, as they put it, the mood isthe same on Smolenskaya Square. Canada in the summerand Korea in November saw meetings at the highest levelbetweentheleadersofthetwocountries,andinOctobertheBritishMinisterforForeignAffairs,WilliamHague,cametoMoscowonanofficialvisit.

Before his trip to Moscow, Hague emphasised that theviewtakenontheBritishsidewithregardtothe‘LitvinenkoAffair’hadnotalteredwiththechangeofpartyinDowningStreet,butheexpressedawishtomakeco­operationbetweenthe two countries more pragmatic. This is hardly surpris­ing,themaintasknowfacingtheyoungBritishgovernmentbeingtoreducethelargestbudgetdeficitinEurope.Today’sCabinet of Ministers is prepared as never before to asserttheinterestsofBritishbusiness.ThefactthatMrHaguewasreceived in Moscow by President Medvedev was character­ised in the Russian Press as being a special honour – the‘handoffriendship’beingextendedfromtheEast.

At thesametime it is recognised inMoscow,where foralready a year the President has been promoting his new‘orderoftheday’–themodernisationofthecountry’secon­

omy – that without external support such ambitious goalswillnotbeachieved.ThuswhenGreatBritainputforwardher own initiative –“Partnership for Knowledge” – and inSeptember sent it to Moscow via diplomatic channels, theideawastakenupwithenthusiasm.

Thisisnotthefirsttimeinhistorythatspecificallyeco­nomicinterestshavebroughtRussiaandBritaintogether.In1920,ayoungSovietRussia, still recovering fromabloodycivil war, succeeded in overcoming diplomatic isolation tosenda tradedelegation toLondon.Thedelegationwas ledbyLeonidKrasin,whobecamethefirstrepresentativeoftheSovietgovernmentabroad.

Againtoday(notwithoutreasondotheysaythathistorymoves inspirals),economic interestsare forcingBritainandRussiatoforgettheirpoliticaldifferencesandlookforwaystobuildamutuallybeneficialrelationship.Exactlythiswashigh­lighted by the former RussianAmbassador to Great BritainYuriFedotovinhisfinalmeetingwiththepress.Thatthetwosideswereabletoavoidbundlingpoliticalgrievancestogetherwitheconomicinterests,MrFedotovmentionedasoneofthefundamentaldiplomaticsuccessesachievedduringhistimeinchargeoftheRussiandiplomaticmissioninLondon.

All the evidence suggests that both countries have nowreached a point where they are ready to forget old griev­ances,turnanewpageanddotheutmosttomaximisethehugepotentialwhichundoubtedlyexistsintherelationshipbetweentwostates.

Withinthelastfiveyears,companiesfromtheCIScoun­tries have been able, with the help of the London StockExchange, to attract more than $60 billion to their sharecapital. Fifty­five Russian companies trade their shares inLondon.Onlylastyear,ThomasCookcreatedajointventurewithIntourist,GlaxoSmithKlineclosedaframeworkagree­ment on the manufacture of vaccines on Russian territoryand joint participation in medical projects in two Russianregions,statecorporationRosnanosetupajointenterprisewithacompanyfromCambridgecalledCelticPharma,andGazprom and Shell signed an agreement on strategic co­operationinstartingupnewprojects.InNovember,DmitryMedvedevinvitedDavidCamerontovisitMoscow(aninvi­tation which was accepted), and the President also calledonBritishCompanies to takepart in theSkolkovoproject,whereBritishdesignagencyOveArupisalreadyatwork.

Allthefactsspeakofthepositivewayinwhichbothcapi­talsarenowviewingthefutureoftheirmutualrelationship.NeithersuspicionastotheaddressofaRussianassistanttoaBritishMemberofParliament,nordisappointmentstem­ming from the decisions of the FIFA committee, nor evenreciprocaldiplomaticexpulsionscanocclude theprofits tobemadeoutofRusso­Britishco­operation.

На Даунинг­стрит к власти пришла коалиция кон­серваторов и либерал­демократов, сменившая эпохуростасоциальныхрасходовнарежимстрогойэкономиибюджетных средств. В России целая череда событий –начиная с январских демонстраций в Калининграде изаканчивая декабрьскими выступлениями национали­стическинастроенноймолодежинаМанежнойплощадив Москве – показали, что общество неоднозначно оце­ниваетсложившуюсясистемууправлениягосударством.Всеэтотеснопереплетаетсясэкономическимиивнеш­неполитическими инициативами обоих правительств изадает вектор будущего развития межгосударственныхотношений.

Этонепервыйразвистории,когдаименноэкономиче­скиеинтересысближаютРоссиюсБританией.Вспомним1920­йгод,когдамолодаясоветскаяРоссия,ещенеопра­вившисьоткровопролитнойгражданскойвойны,сумелапробитьдипломатическуюизоляцию,ивЛондонотпра­виласьименноторговая делегацияво главе сЛеонидомКрасиным,ставшимпервымпредставителемсоветскогогосударствазарубежом.

Так и сейчас (недаром говорят, что история разви­вается по спирали), экономическаязаинтересованностьзаставляет Великобританию и Россию забыть полити­ческиеразногласияиискатьвариантывзаимовыгодныхотношений. То же самое подчеркивал бывший посолРоссиивВеликобританииЮрийФедотоввовремясвоейпоследнейвстречи с прессой. То, что две сторонысмо­глинеувязыватьполитическиеобидысэкономическойзаинтересованностью друг в друге, господин Федотовохарактеризовал,какодинизосновныхуспеховпосоль­ствазатовремя,покаонвозглавлялроссийскуюдипло­матическуюмиссиювЛондоне.

Всеговоритотом,чтонаданныймоментобестраныподошли к той черте, когда забываются старые обиды,переворачивают страницу и пытаются по максимумуиспользоватьтотогромныйпотенциал,который,несом­ненно,существуетвотношенияхдвухгосударств.

ЗапоследниепятьлеткомпанииизстранСНГспомо­щьюлондонскихбиржпривлекливсвоиактивыболее$60миллиардов. На лондонских площадках своими бумага­миторгуют55российскихкомпаний.Тольковушедшем2010­мгодуThomasCookсоздалсовместноепредприятиес «Интуристом», GlaxoSmithKline заключило рамочноесоглашениеопроизводствевакцинынатерриторииРос­сииисовместномучастиивмедицинскихпроектахвдвухроссийских регионах, госкорпорация «Роснано» создаласовместноепредприятиескомпаниейизКембриджаCelticPharma, а Газпром и Shell заключили договор о страте­гическомсотрудничествевосвоенииновыхпроектов.Вноябре Дмитрий Медведев пригласил Дэвида КамеронасвизитомвМоскву(начтобылоданопринципиальноесогласие),атакжепрезидентпризвалбританскиекомпа­ниипоучаствоватьвпроектеСколково,гдеужеработаетанглийскоедизайнерскоеагентствоOveArup.

Все эти факты говорят о том, что в обеих столицахсегоднясперспективойсмотрятвбудущеедвухсторон­нихотношений.Тувыгоду,которуюРоссияиБританиямогут получить от сотрудничества, не омрачат никакиеподозрения в адрес русских помощниц членов англий­ского парламента, ни разочарование в схемах принятиярешенийкомитетомФИФА,нидажевзаимнаявысылкадипломатов.

TheNewYearbeganwitharealshotinthearmforRusso­British business. The deal between BP and Rosneft todrillforoilintheArctic,withasignificantpurchaseofsharesbyeachintheothercompany,wasatremendous

demonstration of the strength of the business relationshipbetweenourcountries.Rosnefthas theoil;BPhas thetech­nologytobringittothesurface.

Therearetwoaspectsofthisdeal,though,whichdomakemeratheruncomfortable,foralltheboostitgivestoRusso­Britishbusiness.WhatisitgoingtocostinfinancialtermstoextracttheoilfromundertheArcticshelf?Andwhatmightitcostinecologicalterms?

Now,IhavetopointoutthatIamneitheraneconomist,nor a scientist. But as these subjects cause divisions evenamongthosewithafarmorein­depthknowledgethanIhave,Idothinkthequestionsareworthairing.

ThoseofuswhoremembertheoutcrywhenpetrolpricesintheUKreached–shock,horror!–onepoundagallonbackin the 1970’s could afford a wry smile recently when it was

Однакодвестороныэтогосоглашенияменятревожат,несмотрянавыгодудляроссийско­британскогобизнеса.Сколькостоитдобыватьнефтьнаарктическомшельфеикаковаможетбытьценавэкологическомплане?

Я, конечно, не экономист и не ученый. Но если этивопросывызываютспорыдажеусамыхсведущихвэтойобластилюдей,думаю,онистоятобсуждения.

Те,ктопомнятвозмущение,котороевызвалростценнабензинвВеликобритании–о,ужас!–доодногофунтазагаллонв1979­х,моглилишьусмехнуться,когданедав­нобылоотмечено,чтобританскийавтомобилистплатиттеперьшестьфунтовзагаллон.

Правда, многие молодые британцы даже не знают,чтотакоегаллон.Заменастаройимпериальнойсистемыизмерений метрической преуспела лишь в отношениизаменыгаллоновлитрами.Поэтомубританцыпо­преж­

немупокупаютпивовпинтахиизмеряютдлинувфутахидюймах.

Таксколькожебудетстоитьгаллон–илидажелитр–бензина из нефти, добытой на арктическом шельфе?Пожалуй,подорожешестифунтов.Инаверно,япростодилетант,номенянесколькобеспокоитмысльодобыченефтивтакихэкстремальныхусловиях,какнаднеаркти­ческогоморя.ВВР,конечно,будутутверждать,чтоурокиМексиканскогозаливаусвоены,нодействительнолибуре­ниевтакихместахсовершеннобезопаснодляэкологии?

В конце концов, такие решения принимаются не изэкономических или экологических или даже деловыхсоображений.Скорееизполитических.И,ксожалению,политикамнесвойственноприниматьвовниманиедол­госрочнуюперспективувтакихвопросах.Есливашсрокв правительстве 4–5 лет, вы хотите иметь немедленныйрезультат. Более того, если что­то затем пойдет не так,можнобудетвэтомобвинитьсвоихпреемников.

Такчто,привсейрадостизадвухгигантовроссийско­британского бизнеса, которые объединились для созда­нияамбициозногопроекта,можетбыть, стоитобратитьвниманиенаотдельныеголоса,которыепризываютболеесерьезно отнестись к использованию альтернативныхисточниковэнергии?

Sohowmuchwillagallon–orevenalitre–ofpetrolcostthat’sbeenbroughtout fromundertheArctic ice­cap?Cer­tainlymorethansixpoundsagallon.AndperhapsI’mjustanignorantnon­scientist,butthere’ssomethingthatmakesmeuneasyabouttheideaofdrillingforoilinsuchextremecondi­tionsasthoseatthebottomoftheseaundertheArctic.IknowthatBPwillinsistthatthelessonsoftheaccidentin2010intheGulfofMexicowillbelearnt;butistherereallynothreattotheecologyoftheplanetindrillingforoilinsuchareas?

Ultimately,thedrivingforcebehindsuchdecisionsisnoteconomicsorecologicalconsiderations,orevenbusiness.It’spolitics.And,unfortunately,politiciansarenotrenownedfortakinglong­termviewsofsuchissues.Ifyouaregoingtobeingovernmentforfourorfiveyearsandthenmaybeoutofoffice,youwanttoleaveanimmediatelegacy.Whatismore,ifthingsgowrongfurtherdowntheline,youwanttobeabletoblameitonyoursuccessors.

Sowhile it’s great to see twogiants of the Russo­Britishbusinesscommunitycomingtogethertocreateanincredibleproject, maybe someone should pay a little attention to thevoicescryinginthewildernessaboutseriouslyseekingalter­nativeenergysources?

Ifforeigncompaniesexaminingthepossibilityofenteringthe Russian market had gone by the many and well­respected international rankings available, we wouldhardly had experienced the recent period of investment

boom. In the “Doing Business 2011” rankings, publishedjointlybytheInternationalFinancialCorporation(IFC)andtheWorld Bank, Russia dropped three places from last yearandnowlies123rd(outof183),betweenUruguayandUganda.ItsfellowBRICcountriesaresignificantlyhigherupthelist.

Even thosewhoconsider suchratings tobepoliticalpro­pagandatoolscanhardlydisputethefactthatmoneyisleavingRussia:CentralBankstatisticsfor2010showthatthenetout­flowofprivatecapitaltotalled$38.3billion(rathermorethanthepredicted$22billion).Ofcourse,thisfigureisfarfromthe$133.9billionwhichwastakenoutofthecountryin2008,theyearofthecrisis.However,2007waslasttimethatRussiasawnetcapital inflow,(at$81.7billion);whatever itwasthatper­suadedpeopletoturnablindeyetotheratingstablesafewyearsagohasceasedtoexist.Theissueisnotjustaglobalfinancialcri­

Если бы иностранные компании, рассматривая воз­можностьвыходанароссийскийрынок,руководст­вовалисьмногочисленнымиуважаемымимеждуна­родными рейтингами, вряд ли бы мы сейчас

вспоминалидокризисныегодыкакпериодинвестицион­ного бума. В рейтинге «Ведение бизнеса­2011» (DoingBusiness), который ежегодно готовит Международнаяфинансоваякорпорация(МФК)совместносВсемирнымбанком,Россияопустиласьнатрипозициипосравнениюспрошлым годом и теперь занимает 123 место (из 183­х)междуУругваемиУгандой.ЕепартнерыпогруппеБРИКнаходятсязначительновышевсписке.

ThebalancebetweenprofitandriskintheRussianmarkethasshifted–andnotintherightdirection.Investorshavealreadybecomefarfromwillingtotakerisksthatincreasinglydonotpayoff.Thebusinessclimatetodayissufferingasneverbeforefromthedeficienciesoflegalandtaxregulation,corruption,bureau­cracy,poormacroeconomicconditionsandadecreaseinbusi­nessprofit.Itwouldseemthatthesearesimplyallthesameoldproblems,refusingtogoaway.Exceptthattoday,thecurtainofeuphoriaateasyprofitshavingrisen,theysuddenlyappearmuchmoreobvious.Post­crisismeasureshavenotyetputRussiaonahealthy,newpathofdevelopment; instead,even thecountry’sexistingadvantagesaredisappearing.Forexample,therelativelyadvantageouspre­2011taxregimehasbecomenoticeablymoresevere–particularlywithregardtopensioncontributions,whichhavebeen increasedto34percent.Thischangewill inevitablyhitsmallandmediumbusinessesthehardest,butitwon’tpleaselargeinvestorseither.Neitherwilltheshiftawayfromexpandingbusinessincomerevitalisethebusinessenvironment.

London­Court­Places­Injunction­On­Rosneft-BP­DealLondon'sHighCourt imposedonTuesdayan injunctiononthe strategic Rosneft­BP deal on share swap until February25 following a lawsuit by the AAR consortium of Russianshareholders in the TNK­BP joint venture. Central­Bank­to­Sell­MICEX­Stake­­Ahead­of­Merger­with­RTS

The new pipeline is set to carry 15 million tonnesof oil across the Russian­Chinese border every year for thenexttwodecades–arapidincreaseinoilexportsbetweenthetwo countries. Previously, Russian oil has been transportedtoChinabyrail.Theproject,whichcost$25billion(£16bil­lion), was partly financed by Chinese loans. Russia­Could­Complete­Talks­­on­WTO­Accession­in­April

The British Chamber of Commerce has downgraded its fore-cast for the UK's GDP growth in 2011 from the 2.2% it pre-dicted in September to 1.9%. What does this mean for UKTI? Will British companies look for more consumer demand over-seas next year?The Office for Budget Responsibility actually increased theestimateforGDPgrowthin2010andslightlyreduceditforthenextyear.ButinbothcasestheUKisinabetterpositionthan many westernEuropeancountries in termsof growth.Whenpeoplehavefearsofa“doubledip”intorecession,it’sencouraging that independent forecasters are seeing Britisheconomicgrowthcontinuing,especiallywithunemploymentlowerthanexpectedandgrowthhigherthanexpected.

ButitisclearthattheUKisnotexperiencingrapidexpan­sionandgrowth,andthismeansthatBritishcompaniesmustlookmoretooverseasmarkets;andthat’swhattheyareeffec­tivelydoing.AtUKTIwe’vehadasignificantincreaseinthedemand forour services andparticularly for tradewith therapidlygrowingeconomies.There’salsoa lotof focus fromBritish companies on increasing their exports as a propor­tionoftheircommercialactivityinSouth­EastAsia,theGulf,China and Brazil, but there’s also a focus on Russia and Iexpectthattocontinue.

The new British government has made it clear that the UK’s stakes will be focused on reinforcing export co-operation with BRICs. How high does Russia rank on the list compared to other BRIC countries? Some have even said that Russia should not be on the list at all.It’struethatsomehavesaidthat.Infactthelatestsuggestionsare that it should be BRICI or BICI with Indonesia addedinattheend.ButIthinkyoucanseethatweinBritaintakeRussiaveryseriouslyasamarketandwe’llcontinuetodoso.IleaveittoGoldmanSachs,whoinventedthetermBRIC,tostickwithitornot.FormeRussia,ofcourse,shouldbeonthelist, because it’s an exciting and a high­growth economy. The end of 2010 was marked by two significant developments in Russo-British business and diplo-matic relations. First, in October, Russia was visited by the Foreign Secretary William Hague. He was followed in November by Business Secretary Vince Cable, who brought with him a large business delegation and also took part in the Intergovernmental Steering Committee meeting with Alexei Kudrin, the Russian Finance Minister. All this represents the pragmatic approach adopted by the new British government in its dealings with Russia, and gives the business community cause to hope for increased development in business relations between our two countries. Sir Andrew Cahn, who has just stepped down after five years as CEO at the British government agency for trade and investment UKTI, discussed with us these new prospects.

Compared to other emerging markets, what are Russia’s com-petitive advantages?Ifyou lookat thevarioushigh­growthmarkets,Russia is thenext­doorneighbourtotheUKandtheysharemanyinterests.WhenIwasaschoolboyandastudentIdidn’treadasamat­terofcourse Indian,Chinese,MexicanorBrazilian literature,butIdidreadRussianliterature:Tolstoy,Dostoevsky,Pushkin,Chekov.So,firstly,Iwouldarguethatthereisacertainculturalfitbetweenourtwocountries.Secondly,Russiais,insomeways,amorefamiliarterritory–it’sprobablyeasierforaBritishcom­pany togo toRussia than tooperate theirbusiness inChina.Thirdly,businessgoestolotsofmarketsandgoingtoRussiaorChinashouldnotbeexclusive.Russia isagoodmarketwhichBritishcompanieswouldbe foolish toavoid.And letmepaytributetotheworkoftheRBCC–IthinkthatthemarketingandencouragingworkwhichtheRBCCdoesisabsolutelyvitaltogetcompaniestogotoRussia,torealisethatthisisamarket­placewhichworks,wheretheycanmakemoney,theycanfindpart­ners.Ineverymarket­placepeoplehavemisconceptions; therearemisconceptionsaboutRussiaanditisveryimportantthatwehavebodiesliketheRBCCwhicharetheretosetthemstraight.

The UK Business Secretary, Vince Cable, recently [November 2010] led a delegation of 36 British businessmen to Moscow. What was the general assessment of its results?It was a very successful trip. Mr Cable went to Russia withthelargestbusinessdelegationonecanrecallinthehistoryofbilateralrelations.ThecompanieswereverypleasedwiththeresultsaswasVinceCablehimself.Wemetafterwardsandhesaid that theyhadagoodprogramme, lotsofopportunitiesforbusinessandhe’sverykeenthatitisnotaone­offbutpartofacontinuingprocess.AndI think that the ISCprocess isnowbecomingmoreestablished:thereisarhythmtoitandit’simportantthatwekeepthatrhythmgoing.ISChasbeencon­veningforthreeyearsnowandthenextmeetingisthisyear,presumably in London. It is also important that we keep ahighlevelofpoliticaldialogueaswellasthebusinessdialogue,whichiswheretheRBCCcancontributealot.

Thomas Cook Group plc said it will acquire a 50.1 per cent stake in VAO Intourist. An alliance between GSK and Binnop-harm was also announced, paving the way for increased vac-cination programmes in Russia. In what other areas could we expect deals and agreements as a result of the visit? Certainlytherearedeals.Therearealready600Britishcompa­niesoperatinginRussia,andI’msuretherewillbemorebutwearereluctantontheBritishsidetotryandmastermindallthebusinessdeals;theprivatesectorshoulddothisandkeeptrackofthebusinesstransactionstakingplace.I’msuretherewillbemoredealsflowingasaresultofthatvisit.

How many of the companies which came along are totally new to the Russian market?

Onlyafew.Ithinkyou’veidentifiedtherealissuehere.IntheministerialdelegationyouusuallyhavethecompanieswhicharealreadyoperatinginRussiabecausetheywanttohavehighlevel business and political contact. The challenge, however,istogetnewcompaniestogetoutthere–andthisiswhereUKTIandtheRBCC,byworkingtogether,havetheopportu­nitytoachievesomething.

RBCC lobbies the interests of the SMEs, which is one of the priorities on the ISC agenda. What exact measures would you expect to follow which would actually develop co-operation in this area?I think these are all the things which are to flow from theRussianaccessiontotheWTO:thecommitmentsongovern­ance,onobservinginternationalstandardsandmarketaccess(whichwasoneof theproblemsdiscussedat the ISCmeet­ing), differentpolicieson customs, tax andvisa regulations,constraintsoninvestmentetc.InordertoincreasetheamountofinvestmentfortheRussiansideit’simportanttoensurethatcompaniesarecertainthatthey’llbetreatedfairly.Attheendoftheday,itallcomesdowntoastableandreliableregulatoryenvironmentwheretheruleoflawworkspredictably.Thisiswhatcouldencouragea lotof trade fromBritainandothercountries,andthereisstillprogresstobemadethere.Equally,ontheBritishside,IthinkwehavetodomoretomarketRus­siaasadestinationandcombatthemisconceptionsthatexist.

SMEs make up a big part of the UK economy, while their role in the Russian economy is not that palpable. How valuable is the British experience in this sense?Ithinkitisveryvaluable.IwasinMoscowlastyearandagreatfocus was on how we encourage the SME sector in Russia,becausebignumbersalwayscomewithbigcompaniesbutallthebigcompaniesstartedassmallcompanies.IfyouwanttofosterareallycompetitiveenvironmentyouneedtheSMEstopressfrombehind.AndIthinkit’stoRussia’sadvantagetohavemore entrepreneurial and innovative culture­based SMEs.We’llcertainlydowhatwecan,andIthinkwhatwecoulddoistohaveBritishSMEsgothereandprovideexamples.Ulti­matelyit’suptotheRussiangovernmenttotakeactionthough,andforRussianindividualstodecideiftheywanttosetupacompany.Butagain,Icomebacktothefactthathavingastableand predictable regulatory environment is essentialbecauseyouwon’twanttoputalotofeffortintosettingupacompanyif you can’t be sure that it’ll be treated on a par with othercompanies.AndIhavenodoubtthattogetareallyvibrantandvigorousbusinessenvironmentthisiswhatyouneed.

In 2010 at the St Petersburg forum you spoke about UK experi-ence at revitalising industrial cities which could help Russia to tackle the problem of ‘monogorods’. Has there been any development on the issue since then?I know that a number of British towns were quick to offeradvice,althoughtherearealotofotherplacesfacingthesametrouble, like some towns in North­Eastern America whicharebasedentirelyonthesteelindustry.ButIthinkRussiaisevenmoreextremeinthisrespectandtherearemoreofsuchtownsthere.Britishconsultingcompanieshavedonealotofresearchonhowyouhandlethisreallydifficultpolicyprob­

lem.Agovernmentcanpourinmoneybutmoneyisusuallywasted.Howthendoyouactuallygetthingsdoneandarealworldcommercialactivityhappeningwhichisprofitableandsustainable?Idon’tknowwhattheresulthasbeensinceIwastherebutIwasencouragedthattheBritishwereverycommit­tedtoprovidinghelpandassistance.

Following the announcement that Qatar will host the 2022 FIFA World Cup, UKTI encouraged British firms to look at business opportunities across the growing sports sector in the Gulf. Will a similar encouragement follow for companies to pursue 2018 opportunities in Russia when they host the World Cup, given that UK firms are very much involved in the Sochi project?Firstofall,IwouldoffermycongratulationstoRussiaforhav­ingwontheopportunitytohosttheWorldCup.Obviouslyweareverydisappointed thatwedidn’twin,butwecanalsobepleasedforothercountriesthattheywonandseehowtotakeacommercialadvantagefromtheirwinning.WhatwesaidaboutQatarappliesequallytoRussia.ThefactisthatBritainhasgreatexpertise inholding thesemajor sportingeventsandwe’llbeholdingtheOlympicsin2012.IntermsofexpertiseI’mspeak­ingabouttheconstructionofthestadia,thesecurityissues,thesignage(theUKisatrueleaderinthisarea)andactuallymanag­ingthesesportingevents.WhenIwasinMoscowinJuneIwenttovisittheSochiVice­Premier[DmitryKozak]andwehadaverygoodmeetinginwhichitwasmadeclearthatourrespec­tiveorganisersdoingtheLondonandSochiOlympicGamesareinclosecontact.IthinknowthatRussiahaswonthe2018WorldCupwe’llbelookingforwardtoRussiausingourexpertiseandgivingusgoodbusinessasaresult.Putitthisway–Russiacanpayusbackalittlebitbygivingusmorebusiness!

Would you expect any Visa easing for that occasion?RussiahasbidandwonthisopportunityandI’msurethattheRussianauthoritieswillwanttoshowcasetheircountrytotheworldwithoutanyglitchesoradministrativeproblems.TheyhavesomeeightyearstoplanthevisaissuesandI’msuretheRussianauthoritieswillbeefficient.

Skolkovo is mostly associated with the USA now as American firms are leading the way as future residents. Will UK firms contend this leadership?I think we are well aware of Skolkovo as a good businessopportunity,butthereareverydifferentviewsonwhetheryoucancreateatechnologyclusterlikethatbygovernmentdeci­sionasopposedtogrowingitorganicallythroughacompany.SiliconValleydidnotgrowbecauseWashingtonsaiditshould;itgrewaroundStanfordUniversity.Equallywehaveourcen­tre inCambridgeandour littlehubshere inOldStreetandShoreditch[London]–thesedidnotappearbecauseofgov­ernmentactivity.Ontheotherhand,it’squiteclearthatwhatthe government does can have an impact on the regulatoryenvironment, the tax environment, financial incentives etc.Simplyprovidingsomepoliticalsupportandlead,whichourPrimeMinisterhasjustshownforourShoreditchcluster,canmakeabigdifference.SoperhapswearetryingtodothesamethinghereinEastLondonastheRussiangovernmentistryingtodoinSkolkovo.I’msureBritishcompaniesare interestedandIverymuchhopethattheywillparticipate.

David Willetts, the Minister for universities and science, plans to visit Russia in 2011. What’s going on regarding edu-cation co-operation at the moment and how new academic links can help business?Theydohelpenormously.ItallgoesrightbacktotheculturallinksandthefactthatwehavealotofRussiansgoingtoschooland university here in Britain and we very much welcomethem.Ibelievethatit’sahugebenefitforthefuture,becauseyoungpeoplewhogo toschoolanduniversityhereretainalink,manyofthemenjoyitandmakefriends,someofthemmarryandkeephouseshere.Businessisallaboutnetworking,aboutpersonalcontactsandpersonal trust:youdobusinesswithpeopleyoulikeandyoutrust.Andeducationalandcul­turallinksunderpingoodbusiness.That’swhywedosomuchbusinesswithourneighbours.

Now upon stepping down from your office, what would you call your best achievement as UKTI CEO? When I first arrived I set out an ambition to my staff thatUKTIshouldbecomethebesttradepromotionorganisationinthedevelopedworld,andacoupleofmonthsagoinMexicowewontheawardfortheBestTradePromotionOrganisationinthedevelopedworld.Thatwasverysatisfying.It’sasymbolof achievement. But above all I am pleased that we initiallyhad a budget of about three million pounds a year and wehave independently­audited proof that wehave since addedover fivebillionpounds’value to thebottom­lineofBritishcompanieseachyear.InotherwordsthereisahugereturnfortheBritishtaxpayeronthemoneytheyspendonusandthisisthebestpossiblesuccessyoucanimagine:addingtothepros­perityofyourcountryandthewelfareofyourfellowcitizens.AndIfeelthatwe’vedonethat.

How would you recommend your successor follows in UKTI’s Russian operations?IwouldsimplysaythatRussiaisanimportantmarketplace,it’samajorpartner,andheorsheshoulddevoteconsiderableeffortthere­andshouldmakeavisitveryearlyon.

UK-Russia trade is currently worth £6 billion a year. UK exports to Russia in the year to August were £1.9 billion, an increase of 36 per cent on the previous year.

Nearly 600 British companies are active in Russia, and over 2,000 UK SMEs showed an interest in doing business in Russia in 2009.

Russian companies account for 13 per cent of all international IPOs on the London Stock Exchange.

English law is one of the UK’s most important exports to Russia. UK law firms in Moscow are amongst the largest and most successful in the world.

Pilkington’s biggest factory outside the UK is in Russia. Other major investors include blue chip companies like Cadbury, Astra Zeneca, Kingfisher (B&Q), Marks and Spencer and Monsoon.

The 2014 Sochi Olympic Games are expected to cost $35 billion, with the value of the opportunity to the UK estimated to be over £18 billion.

Поэтому я бы, преждевсего, отметил определеннуюкультурную связь между нашими странами.Во­вторых,Россиявомногомболеедоступна–пожалуй,британскойкомпаниипрощеобратитьсякроссийскомурынку,чемнаправиться в Китай. В­третьих, бизнес может разви­ваться в нескольких направлениях, и открытие россий­скихиликитайскихоперацийнедолжнобытьвзаимои­сключающим.Россияпредоставляетпрекрасныеделовыевозможности,исостороныбританскогобизнесабылобыглупоихупускать.ИяхотелбыотметитьработуРБТП:я считаю, что Палата проводит совершенно необходи­муюмаркетинговуюработудляпривлечениякомпанийнароссийскийрынок,помогаяимосознать,чтонанемможноработатьизарабатывать,можнонайтипартнеров.Окаждомрынкемогутбытьложныепредставления,онисуществуютиоРоссии,инамоченьнужнытакиеоргани­зации,какРБТП,чтобыразвеятьсложившиеся«мифы».

Какие конкретные меры могли бы помочь взаимодействию в этой области?Ядумаю,этовсето,чтодолжностатьрезультатомвступ­ления России вВТО:обязательства по корпоративномууправлению, соблюдению международных стандартовидоступукрынкам(этооднаизпроблем,освещенныхна заседании Межправительственного комитета), пере­менам в таможенной, налоговой и визовой политике, винвестиционных ограничениях и т.д. Чтобы привлечьинвестиции,российскаясторонадолжнаобеспечитьуве­ренность компаний, что с ними обходятся по справед­ливости.Вконцеконцов,всесводитсякустойчивомуинадежному правовому климату, в котором закон рабо­тает предсказуемо. Именно это должно способствоватьторговойактивностисостороныВеликобританииипро­чихстран,ивэтойобластиещеесть,надчемработать.

Такжесбританскойстороны,думаю,нужноприложитьбольше усилий по продвижению российского рынка иустранениюложныхонемпредставлений.

Малый и средний бизнес (МСБ) составляет большую часть британской экономики, тогда как их роль в российской экономике менее заметна. После объявления о том, что Кубок мира по футболу в 2022 году пройдет в Катаре, UKTI выступило с призывом к бри-танскому бизнесу обратить внимание на открывающиеся там возможности для спортивного бизнеса. Последует ли подобное «приглашение» для компаний использовать биз-нес-возможности в России, которая примет Кубок мира по футболу в 2018 году, ведь многие уже участвуют в проекте подготовки Олимпийских игр в Сочи в 2014 году?Во­первых, я бы хотел поздравить Россию с победой ивозможностью провести у себя Кубок мира. SMEs­Partnership:­­Starting­from­Scratch

Thisisindeedunbrokenground.Butinordertosuccess­fully cultivate it, therearea seriesof challengeswhichmustfirstbeovercome.

Firstly, the small and medium business sectors inRussiaandGreatBritainareatverydifferent stages in theirdevelopment.HereinRussiathesectorisonlyjustbeginningto raise its head in the struggle to overcome every possiblebureaucraticandotherbarrier.ThesamesectorintheUnitedKingdomrepresentsoneofthecornerstonesoftheeconomy.Infact,themiddleclassisthemostpowerfulandmostnumer­ouslayerofBritishsociety.

Thesecondpoint:anypartnershipimpliesapersonalrela­tionshipandclosecontact.Onthecontrary,however,itisnotparticularly easy for the representative of aRussian SME toapproachhispotentialpartner.Acrossthewholeoftheenor­mous territory that is Russia there areonly fiveBritish visacentres,sometimesthousandsofkilometresaway.Theentre­preneurcanexpendalotoftime,effortandofcoursemoneyingettingtooneofthesecentres.

Yettheoutcomeofthisordealiseverytimefarfromcer­tain.Asexperiencehasshown,itcanevenbenegative.InourassociationwefrequentlyhearfromRussianswhohavebeenrefusedavisa,orreceiveditonlywhenthetimefortravellingtotheUKfornegotiationshadalreadypassed.

Onthewhole,RussianSMEscomeupagainstvariouscon­straintswhen trying to enter theUKmarket.LargeRussiancompaniesareanothermatteraltogether.Severalofthemworksuccessfully in the City, where the London Stock Exchangerepresentsoneofthemainchannelsoverseasthroughwhichtoattractsharecapital.

How­could­the­situation­be­changed­for­the­better?Thosewhotakepartinbilateralandinternationalconferenceson small and medium enterprise, which I have attendedmore than once, call on officialdom in London to ease visarestrictionsforRussians.Thisistheonlywaytomoveforward.

Similarly,withoutthepoliticalwillofthoseinpoweritwillbeimpossibletoclearthewayofthosefamiliar“irritants”,liketheLit­vinenkoaffair,which–alas–continuetoaggravatethesituation.

The English are a pragmatic people, and they of courseunderstand that mutual suspicion, hostile“sparring” in thenews pages and so on, interfere with business dealings. Is itpossiblethatin2011wewillbeabletofocusonthepositive,tocontinuetheimprovementintheRusso­BritishclimatewhichhasslowlybegununderDavidCameron’sgovernment?

ThenewCabinetisdoingitsbesttolobbyfortheinterestsofBritishbusinessinvariouscountries,asthefollowingactionproves:Cameron’steam,takingtheideasoftheRussianPresidentinhand,suggestedthecreationofaprogrammeofco­operationbetweenthetwocountriesinthesphereofmodernisation.

DmitryMedvedevtalkedindetailaboutthisprogrammeat the G20 summit in Seoul, telling his audience about theimportanceofsmallandmediumenterprise,thedevelopmentof theeconomyand internationalcooperation.Toprovehispoint, immediatelyafterhisspeechthePresidentinvitedtheBritishPremiertocometoRussiaonanofficialvisitin2011.

TheRussiansalsohavealottodoifbilateralbusinessrela­tions are to be improved; amongst other things, to take onboardtheexperienceBritainhasinthedevelopmentofSMEs,theBritishhavingbuiltupahugestoreofpractical“capital”inthisarea.Itwas,ofcourse,preciselyinEnglandthatthecon­ceptof“scientific­technologicalprogress”wasborn.Genera­tionsofRussianshavetravelledtotheUKforscience,andintimehavebroughthomewiththemtrulypricelessknowledge.

ItshouldbesaidthattherootofBritishachievementliesinmanydifferentdirections, including invariousaspectsofthenationalcharacter.TheBritishhavealwayspraisedhold­ingback:theabilitytostaycoolandnotloseself­controlevenatthemostchallengingofmoments.Theirbiggestsecretyoucouldhonestlysayliesinthesaying“Getaholdonyourself”,andfairplayisofcourseamatterofpride.

This is a very important prerequisite for success in co­operation.Itwon’tbeachievedwithoutcommondesire,alotofenthusiasmandcourage­especiallyinsuchadifficulttaskasthecultivationofunbrokenground.

Will 2011 see an improvement in business relations between Russia and Britain? Recent meetings with local businessmen, financiers and political analysts have frequently given rise to the discussion of this topic. One course of action prescribed to heal the “rupture” is to activate small and medium business partnerships between the two countries.

Visa regulation is one of the most burning issues for Russo-British relations, especially for business travellers who are always pressed for time. Occasionally international business becomes too dependent and is often affected by the ability to get the right visa in time, which definitely adds to the overall state of business environment. We asked Barbara Woodward, Head of International group at UK Border Agency, to comment on the recent and expected developments of the UK visa regulations for Russian visitors.

Recently there have been a couple of high-profile visits to Russia by William Hague and Vince Cable. Do you think any changes regarding the visa system or visa reg-ulations could follow these? We’ve made a number ofchanges to the visa opera­tion in Russia in recentmonths. Between Janu­ary and September 2010,the visa section in Moscowprocessed over 98% of visaapplicationswithinourtar­get of 15 days and issued

over 90% of visas, which is higher than our global average.Wehavealso introducedadedicatedcustomer service teamintheEmbassyandapremiumloungeinourvisaapplicationcentreinMoscow.Wearepilotingaservicetoofferapplicantstheopportunitytoapplyforalongtermvisawithoutleavingtheirpassportwithus,sothattheycankeeptravellingwhileweprocesstheirvisaapplication.We’redelightedthatsomanyRussians continue tobe interested invisiting theUK;we’veseenacontinuedincrease intheirnumbersandthey’reverywelcome.BetweenJanuaryandSeptember2010wereceived112,000 applications, a rise of 12% on the same period in2009.We are always seeking to make improvements to thevisa operation and welcome the feedback we get from visaapplicantsandfromourMoscow­baseduserpanel,whichtheRusso­BritishChamberofCommerceisamemberof.

At the moment, compared to a Schengen visa, the British visa can’t be issued as quickly because of the biometric require-ments. Are there any other issues which impede the possibili-ty to make it quicker than it is at the moment?ThevisasectioninMoscowroutinelyexceedsourglobalcus­tomerservicestandards.Althoughwenormallyaskpeopletoleave15days,wecansometimesprocessapplicationsquickerthanthis.EveninAugust2010,duringtheheightofthesum­merpeak,wewereturningaroundsomebusinessvisasintwoto three days. I think the service we are able to provide tovisaapplicantsinRussiaisoneofthebestintheworld.You

arerightthatwecheckthebiometricsofvisaapplicants.Thishelpsprotectthemfromidentitytheftaswellasallowingusto perform necessary checks against criminal and immigra­tiondatabases.WeunderstandthattheEUplanstointroducebiometricsverysoonwhichwouldbringeverybodyintolineonthisissue.

After such success why wasn’t the express-service of issuing UK visas in three days that was almost announced in October 2010 developed?Wedowanttocarryonofferingpremiumorbusinessexpressrelated services but we don’t think it’s fair to do it at theexpenseoftheservicethatregularvisaapplicantsreceive.Theservicethatwetrialledin2009wasverypopularindeedwithbusinessvisitorsbutitmeantthatweweren’tabletoprocessvisasforregularvisaapplicantswithinourcustomerservicestandards,sowepausedandtookstock.OurbusinessloungeinMoscowisnowwellestablishedandwecansometimespro­cessbusinessvisasintwotothreeworkingdays.Iknowpeo­plewouldlikethingsfasterandweknowhowimportantitisforthetraderelationsbetweenourtwocountriestotryandintroducemorebusiness services, sowecontinue to lookatoptions.Webelievecustomersarewillingtopayabitextraforapremiumorexpressservice.

Maybe the process could be speeded up a bit if people did not have to submit their biometrics every time they apply for a visa? Yes,ofcourse!That’swhywerecommendthatregulartravel­lersgetalongtermvisa(validfortwo,fiveortenyears).Wedon’twanttoinconveniencevisaapplicantswhohavetotravellong distances to give biometric fingerprints.We are alwaysreviewinghowwecanmaintainthereliabilityofouridentitycheck while minimising inconvenience to applicants. themainairports,sothatifwehadalreadytakensomeone’sbiometricstogivethemavisa,whentheycametotheUKwewouldjustbrieflycheckthemattheborderandthereforewewouldn’thavetotakethemagainforanewvisa.It’snotintherealm of science fiction anymore, the technology exists, butwe’re stillworkingonhowexactly itwillwork.Thecurrent“Iris”eyescanidentitychecksystemisavailableonlyforUKfrequenttravellers.ThetechnologythatI’mdescribingwouldbemorewidespreadandwouldenableustouseitforvisitorscomingtotheUKratherthanjustBritishcitizens.

You mentioned the increased flow of people coming in: what category of visitors is it mostly due to?We’reseeingan increaseacross theboard fromRussia.As Imentioned,lastyearwesawanincreaseintheoverallnumberofapplications fromRussiannationals.Apart fromtouristsandbusinesspeople,wehaveseenstronggrowthinapplica­tionsfromstudents.Weissueabout90%ofvisaapplicationswereceivefromRussianstudents.Sincetheintroductionofthenewpointsbasedsystem,thechallengewithstudentshassometimes been to explain to people that for student visasmyofficershavenodiscretion.Theadvantagewiththepointsbased system is that a visa applicant can see immediatelywhether they are going to get the points; the disadvantageisthatthereisnodiscretion,sowedoverystronglyencour­age people to submit the supporting documentation thatthey need to. For example, bank statements really need toshowthattheaccounthashadmoneyinitfor28days.ThisaccountsformostoftherefusalproblemsthatwehavewithRussianstudents.

Would you expect more visa centres to be opened to meet the increased demand?We’realwaystryingtoincreaseourreachwithinourverystrictbudget.Weopenvisacentresverymuchaccordingtodemandand we work closely with our commercial partners [VFSGlobal]toassessthisdemand.Russiaisaparticularchallengebecauseofitsscaleandtheamountofvisaapplicants­it’seas­ilywithinourtopfiveorsixcountries.Butgiventhatwewanttomakeiteasierforpeopletoapplyforvisasacrosstheboard,having fixed centres in countries that are as large as Russiasometimesisnotideal.We’vebeenexperimentingacrossourglobaloperationwithmobilecentreswhichareabletotravelaroundanumberoflocations.Thismightbeanotheroptioninfuture,althoughwewouldneedtoensurethatourdatapro­tectionobligationsaremetandthatwecanensurethesecurityofourstaffinthesecircumstances.

Could you please tell us a little bit more about the recent changes to the immigration scheme regarding the quota for the working visas?TheUKgovernmentwantstocontinuetoattractthebright­estandthebest,toattractbusinessandinvestmenttotheUK,buttheyalsowanttomakesurethatBritishpeoplehaveafairchanceatgettingjobsandmigrationdoesnotcreateaburdenonsociety.WefindthatinsomecasespeoplegetvisastoworkintheUKinhighly­skilled jobs,butareactuallyworkinginquitelow­skilledjobsornotworkingatall.So,we’llmakesurethat we can still facilitate entry for people who are coming

fortrulyhigh­skilledjobsbuttosqueezeoutpeoplewhoarecomingtodolower­skilledjobsthatcouldbedonebyBritishpeoplethemselves.

Themainchangesarethatwe’vecreatedamuchsmallercategorythanbeforeforwhatwecallTier1,forhighly­skilledandrichentrepreneurs.Therewillbeabout1,000visas forthosepeople(althoughin2009weonlyreceivedabout400applications combined in these categories), but we’ll makesurethattheygenuinelyplantoinvestquitesignificantlyinthe UK economy. Over the course of the consultation thatwe had, we received views from the governments of othercountriesandalsofromtheCBI,businessorganisationsandbusinesses.Theyemphasisedhowimportantitwasforglobalmultinational companies to bring people in from overseasonintra­companytransfers,sowehaveexemptedthosepeo­plefromthelimit.Thenwehavesetalimitof20,700forthenumberofpeoplewhocancomeandworkinhighly­skilledjobs.

Have there been any changes to student visas as well?Notyet.InearlyDecemberlastyearthegovernmentlaunchedaconsultationonstudentvisasthatclosedon31January2011,andtheaimtherewasquitesimilartotheaimwithworkvisas:the government wants to make sure that people come hereto study and not simply to do a coupleof classes and thenbeginwork.Thequestionsthatweconsultedonwerethelevelof qualification that someone is coming to study for, e.g. ifweshouldgivestudentvisasonly tostudentswhoarecom­ingtostudyatdegreelevel,notfordiplomasandcertificates.AnothercategorywhichIthinkwillbeofinteresttoRussiansistheindependenteducationsector:theconsultationdidnotproposeanychangestothearrangementsforchildstudents.

Using The Iris Recognition Immigration System (IRIS)Registered passengers can use the iris recognition immigration system (IRIS) to enter the UK quickly through automated barriers at certain airports. IRIS makes use of the fact that the pattern of the iris in each person's eye (the coloured part of the eye) is unique. This enables a person to be identified simply by looking into a special camera at the IRIS barrier located in the immigration arrival hall.

The IRIS system uses a photograph of the iris pattern, converts it into a digital code and then compares it with others stored in a secure database. If the iris pattern matches the corresponding one on the database and the registration is still valid, that person can enter the UK by passing through the IRIS barrier in the immigration arrival hall.

You can register for IRIS if you are a passport holder of the UK, another country in the European Economic Area (EEA) or Switzerland. Permanent residents and certain other categories of people are also able to register. A registered traveller entering the UK can cross an IRIS barrier in about 20 seconds.

IRIS is in operation at the following UK airports: Four Heathrow terminals Manchester terminals 1 and 2 Birmingham terminal 1 Gatwick north and south terminals (the latter is being

redeveloped, and the IRIS barrier has been temporarily removed).

And have the forms been translated online?Wedon’ttranslatetheformsbutweprovideonlineguidanceinRussian.TheproblemisthatifwetranslatetheformandthevisaapplicantfillsitinRussian,itthenhastobetranslated

intoEnglish,andwecouldn’tguaranteethelegalcertaintyofthetranslationonbehalfoftheapplicant.

Will there be special visa regulations introduced for the Olym-pics in London in 2012?Allofthesebig,globalsportingeventspresentuswiththechal­lengeofwelcoming fansandcompetitors aswell asmakingsurethatpeopledon’tusetheeventtoslipintothecountrytodosomethingnotrelatedtosports.

We want to encourage people to come and support theathletesof theircountryduringtheOlympicsandParalym­pics,andourvisitvisawillensuretheycan.Thevisitvisaisamultiple­entryvisa,isvalidforsixmonthsandcostsonly£70.

Wehavealsoworkedwith theorganisersof theLondonGamestomakeiteasierforoverseasathletes,coachesoroffi­cials–whowanttocometotheUKinadvanceoftheGamestotrain,takepartintesteventsorprepareforthecompetitionitself– tocometo theUK.Thisselectgroupwillbeable toapplyforanOlympic/ParalympicvisawhichwelaunchedinNovember 2010. The Olympic/Paralympic visa allows themtocometotheUKasoftenastheylikebetweennowandtheendoftheOlympicsandParalympicsforthepriceofanormalvisitvisa.ButasIstatedearliertheOlympic/Paralympicvisaisonlyavailabletoathletes,coachesorofficialstakingpartintheGames,andisnotforthosewishingtocomeasspectators.

Иммиграционная система распознавания радужной оболочки глаза (IRIS)

Зарегистрированные пользователи иммиграционной си-стемы распознавания радужной оболочки глаза (IRIS) мо-гут в ускоренном режиме пересекать британскую границу в некоторых аэропортах. Система IRIS основана на том факте, что радужная оболочка глаза человека уникальна. Она позволяет быстро осуществить идентификацию че-ловека, которому достаточно посмотреть в специальную камеру на границе с оборудованием IRIS, расположенной у стойки иммиграционного контроля в зале прибытия.

Система IRIS использует снимок радужной оболочки глаза, переводит его в цифровой код, а затем сравнивает со все-ми прочими, содержащимися в защищенной базе данных. Если рисунок радужной оболочки пассажира совпадает с имеющимся в базе данных и его регистрационный статус подтвержден, он может пересечь британскую границу.

В системе IRIS может зарегистрироваться обладатель па-спорта Великобритании, любой странны из Европейской экономической зоны или Швейцарии. Постоянные рези-денты и некоторые категории граждан также могут заре-гистрироваться в системе. Зарегистрированный пассажир может пересечь границу примерно за 20 секунд.

We­remember­how­it­all­beganAlmostfifteenyearsago,inMay1996,BorisYeltsinsignedthefamouspre­electionDecreeNo.695,whichtriggeredthestartof large­scale tax reform in Russia.At that point, the mainareasforreformwereidentifiedas:

■■ reducing the number of taxes (the mid­1990s in Russiawastheeraof“creativetaxation”withtaxesnumberinginthehundreds);

■■ buildingastabletaxsystemwhichcouldensureunityandconsistencywhileatthesametimekeepingthetaxsystemunchanged throughout a financial year (from 1999, thefirstpartoftheTaxCodehasbeenamended45timesandthesecondpart216times!);

■■ easingthetaxburdenonmanufacturers.Inaddition,theDecreeproposed:

■■ to develop tax federalism (today, the Russian tax systemhas become closer to the tax systems of unitary states,though this is most likely a consequence of politicaldevelopments);

■■ tocutdownbenefitsandexceptionsinthegeneraltaxationregime(in2000,thenumberofbenefitswassubstantiallyreduced, but it is striking how tax benefits have beenthrownaroundlikeconfettiinthelastfiveyears);

■■ toholdataxamnestyfororganisationsin1996(thenextamnestywasheldin2007forindividuals).The best known new development brought in by the

DecreewastheVATinvoice,thoughtheguidinglogicbehindthishasevadedRussianaccountantsovermanyyears.

Weshouldgivethereformerstheirdue:aroundtheturnofthemillennium,somevitallyimportantchangesweremadetotheRussiantaxsystem.AlltaxpayershavebeenawareofandappreciatedtheliberalprovisionsofthefirstpartoftheTaxCode,whichreducedthenumberoftaxes,codifiedthemandcutrates.Thestatewasrewardedforthisbyrevenuegrowthinbudgetsatalllevels.

What­are­we­witnessing­today?Taxesareincreasing(theratesofsocialinsurancecontributionshavebeenraised,andthecadastralvalueoflandisgrowing,resultinginhigherlandtax).

TaxesarebeingtakenoutofthelistcontainedintheTaxCode:

■■ In2004,customsdutywasexcludedfromtheCode,thoughitwasandremainsessentiallyafiscallevy.

■■ In its Resolution No. 2­P dated 28 February 2006, theConstitutionalCourt focusedoncompulsoryallocationstotheuniversalservicereservebynetworkoperators.TheCourtruledthatsuchleviesmaybechargedalthoughtheyarenotstipulatedbytheTaxCode.

■■ Social tax is no longer referred to as Unified Social Taxbutasinsurancecontributions,thoughitstruenaturehasremainedthatofatax.New taxes are appearing, though they may be in a dis­

guisedform:■■ Oneofthefirstexamplesisthe“taxoncopyingaudioand

videofiles”,whichhasbeencreatedbytheGovernment’sResolutionNo.829dated14October2010withaviewtocompensatingauthors.Thetaxwillbeequalto1%ofthesalesorcustomsvalueoftherelevantgoodsandwillpaidbymanufacturersofequipmentandinformation­carryingdevices (portable computers, mobile phones, playbackdevices,laserdisksandflashdevices).

■■ InfluentialdeputiesintheStateDumahaveintroducedadraftlawwhichproposestolevyonmobilecommunicationsprovidersanadditionaltaxinfavourofauthors.Thiswillbeequalto2%oftheirrevenues.Amendmentstotaxlegislationaremadeatthelastmin­

ute.Thus,theclosingdaysofDecembersawthepublicationof four tax laws which were signed by the President on 28December. Some of their provisions come into force uponpublication and some on the next day.A law detrimentallyaffecting the situation of airlines in relation to social insur­ancecontributionswasevenmaderetroactive,itsapplicationextendedto2010.

Of course, it would be remiss not to note the importantchangesmadetothetaxsystemin2010whichaimtoimprovethebusinessclimateinRussiaandtoimplementplanstomod­ernisetheRussianeconomy.Theregimerelatingtoliabilityfortaxcrimeshasbeeneased.Therulesof taxcontrolhavebeenimproved.ArapidVATrefundprocedurewasadoptedforlargecompanies.‘Superbenefits’havebeengrantedtotheparticipantsintheSkolkovoproject.Newlegislativeinitiativeshavebeenpre­paredtoencourageinnovationsbygrantingtaxbenefits.

Which­way­will­the­pendulum­swing?AstheMinisterofFinanceA.L.Kudrinpubliclyacknowledged,raisingtaxesisatrendandnotatemporarymeasure.AheadlietheDumaandPresidentialelections,theWinterOlympics,thefootballWorldCup,therearmamentofthemilitaryandthefurtherre­equipmentofthepolice…Waysof“rebootingtaxation”, i.e. redistributing the tax burden, are now underconsideration. The first idea being examined is“squeezing”oil, gas and tobacco companies, completely scrapping taxbenefitsandraisingVATrates.

Undoubtedly,thelawconcerningthenewrulesforthetaxcontrol over transfer pricing will have a serious effect. TheStateDumawillmost likelypass the law in the firsthalf of2011anditwillcomeintoforcefrom2012.Thelawprovidesfortherangeofcontrolledtransactionstobereduced,whileatthesametimetheburdenofprovingthatthecontractpriceconformstothemarketpricewillshifttotaxpayers.Itispro­posedsimultaneouslytoenactrulesfor“group”taxation,butat the initial stageonlya fewcompanieswillbeable topaytaxes from consolidated profit owing to the tough require­mentsforfinancialinformationfromholdingcompanies.

TherulesforcollectingVATwillbesubstantiallyrevised.Inparticular,adraftlawfromtheGovernment,alreadyintro­ducedintheStateDuma,providesforVATtobetoppedup,i.e.therewillbeadditionalpaymentoftaxtothebudgetifastocktakerevealsaninsufficiencyofgoods.Itisretailchainswhowillsuffermostfromthismeasure,sincetheywidelyusemoderntradingtechniqueslikeself­serviceandallowingtheirconsumersdirect access togoods.Despite this,however, thestores will not be entitled to deduct losses arising from thetheftofgoodsforprofittaxpurposes!

Thereisseriousdiscussionofreinstatingthearticlecon­cerningcriminalliabilityforbusinesscarriedoutunderfalsepretences,whenfly­by­nightcompaniesareformedandusedonly for taxevasion, forcorporateraiders, forpayingbribesandsoon.Thearticleinquestionwasonlyrecentlyremovedfrom theRussianCriminalCodewitha view to liberalisingliabilityforeconomiccrimes.

Atthesametime,thereisnorealworkbeingundertakentoimplementtheinstructiongiveninMay2009bytheRus­sian President in his budget address: to codify judicialdoc­trinesaimedatcombatingtaxschemes.In2006,theRussianSupremeArbitrationCourthandeddownclarificationswhichestablishedregulationsconcerningprotectionfromtaxabus­es. These clarifications were temporary in nature and wereintendedtoprotecttaxpayersfromso­called“taxterror”andexcessively wide judicial discretion. Over the last few years,

practitioners have accumulated rich experience of applyingthese clarifications, and the experience needs to be drawntogetherandincludedintheTaxCode.Theadoptionofsuchalawwouldallowthestatetocollecttaxesfromnon­payersbutnotfromthoseworkingoutintheopenwhoarewithineasyreachofthesupervisorytaxauthorities.Forbusiness,thislawwouldmeancertaintyinlong­termplanningandprotectionfromhavingthebusinesspurposeofatransaction,abusinessprojectorreorganisationmeasuresscrutinisedonthewhimofsometaxinspector.

There are no documents which are any significant waydownthelinetowardscompletionconcerningrulesforacon­trolled foreign company, the tax residency of organisations,beneficial ownership and other cross­border supervisionissues.Inotherwords,nolegislationtodealwiththeseissueswillbeenactedin2011.

Itseemsthat,inthenearfuture,theConstitutionalCourtwillhavetoruleonthe legalityofthe“taxoncopying”cre­ated by the Government’s Resolution No. 829 dating fromautumn2010.Thistaxwascreatedwithaviewtocompensat­ingauthorsforincometheymissoutonbecausetechnologymakes itpossible freely to copy files. In contrastwith othertaxes,themandatorypayments“tosupportauthors”arepaidbymanufacturersandimportersnotintothestatebudgetbutto theaccountofanauthorisednon­profitorganisation, i.e.thepaymentsareparafiscal innature.Theconceptofparaf­iscal levies was extremely developed in France between the1970sandthe1990sandtheConstitutionalCourt’spositionwill dictate whether similar payments will now appear inRussia. For example, they could potentially be made to the2018WorldCupFund,tothePoliceServiceReserveortointo“Modernisation” Funds of state enterprises (no such struc­turesyetexist,anditistobehopedthatthisremainsthecase).

TheSupremeArbitrationCourt,whosedecisionswereheldayearagobytheRussianConstitutionalCourttohavetheforceofbindingprecedents,ispreparingimportantclarificationsontheprocedureforcompensatingtheharmcausedtoabusinessbycivilservants,aswellasontheprocedurefortaxauditsandtaxpayerliability.Thereisalsoactivediscussionoftheimper­missibilityforrulingsoftheSupremeArbitrationCourttohaveretroactiveeffectwhentheyaredetrimentalfortaxpayers.

Practitioners have serious misgivings over the sharpincrease in insurance contributions from payments byemployers to employees. It pushes small business, which isunable topass thecostsofnewtaxeson to itscustomersaspartoftheprice,tothebrinkofextinction,sometimesforc­ingthissectortoadapttothesituationusingunlawfulmeth­ods,i.e.hidingsalarypaymentsfromtaxcontrol.In2011thegovernmentintendstoassesstheeffectoftheincreasedratesonthetakeofthePensionFundandotherstatesocialfunds.Dependingonthis,itcouldmakeadecisionthatshowssomeniftytaxfootwork.

ThefamousYeltsinpre­electiondecreewasunexpectedfortaxpayers.Thereisnodoubtthatcompaniesandindividualsalike in Russia are also anticipating the next tax surpriseslinked to the forthcoming elections. The preparation of thebudgetforthenextfinancialyearandtheheatedautumnof2011willshowwhetherornotthesesurpriseswillbepleasantonesfortaxpayers.

Налоговая­политика­в­2011­году:­реформа­или­антиреформа?

Мы­помним,­как­все­начиналосьПочти пятнадцать лет назад, в мае 1996 года БорисомЕльциным был подписан знаменитый предвыборныйУказза№695,положившийначаломасштабнойналого­войреформевРоссии.Основныминаправленияминало­говойреформытогдабылиназваны:

■■ сокращениечисланалогов(всередине90­хвстраневрезультатеместного «налоготворчества»насчитыва­лосьоколосотниналогов)

■■ построение стабильной налоговой системы, обеспе­чивающей единство и непротиворечивость, а такженеизменность в течение финансового года системыналогов(с1999годаперваячастьНалоговогокодексаизменялась45раз,вторая–216!)

■■ облегчениеналоговогобременинапроизводителей.Крометого,Указомпредлагалось:

■■ развиватьналоговыйфедерализм(сегодняналоговаясистемаРоссиисталаещеближекналоговымсисте­мам унитарных государств, но это скорее следствиеполитическихпроцессов)

■■ сокращать льготы и исключений из общего режиманалогообложения(в2000годуколичествольготбылорезко сокращено, однако нельзя не заметить, что впоследниепятьлетльготывновьраздавалисьнапра­воиналево)

■■ провестив1996годуналоговуюамнистиюдляорга­низаций (ближайшая амнистия была проведена в2007годудляграждан).А самая известная инновация, внедренная Указом –

счета­фактуры, сакральный смысл которых российскиебухгалтерытакинепостиглизамноголет.

Надоотдатьдолжноереформаторам:нарубежетыся­челетий и веков произошли кардинальные измененияроссийскойналоговойсистемы.ЛиберальныеположениячастипервойНалоговогокодекса,сокращениеколичест­ваналоговиихкодификацию,атакжеснижениеставокзаметили и оценили все налогоплательщики, отплативгосударствуростомпоступленийвбюджетывсехуровней.

Что­же­мы­наблюдаем­сегодня?Налоги повышаются (повышены ставки страховыхвзносов,заметнорастеткадастроваястоимостьземлии,какследствие,размерземельногоналога).

Налогивыводятсяизперечняналогов,установленно­гоНалоговымкодексом:

■■ В2004годуизКодексаисключенатаможеннаяпошлина,котораябылаиостаетсяпосутифискальнымсбором

■■ КонституционныйСудвПостановленииот28.02.2006№2­ПдопустилвзиманиенепредусмотренныхНало­

говымкодексомРФобязательныхотчисленийопера­торовсвязиврезервуниверсальногообслуживания

■■ социальныйналогсталназыватьсянеЕСН,астрахо­выми взносами, хотя остался «верен» своей налого­войприроде.

Появляются новые налоги, причем в завуалированнойформе:

■■ Один из первых примеров – «налог на копированиеаудио­ и видеофайлов», введенный с целью сборасредств для выплаты компенсаций авторам Поста­новлением Правительства от 14.10.2010 № 829. Пла­тят его производители и импортеры оборудованияи материальных носителей (ноутбуки, мобильники,плееры, лазерные диски, флешки) в размере 1% отреализацииилитаможеннойстоимости.

■■ ВлиятельнымидепутатамивГосдумувнесензаконо­проект,которымпредлагаетсявзиматьналогвпользуавторовещеисоператоровсвязи,причемвразмере2%отвыручки.Изменениявналоговоезаконодательствовносятсяв

последний момент. Так, в последние дни декабря былиофициально опубликованы подписанные Президентом28 декабря 4 налоговых закона, некоторые положениякоторых вступают в силу с момента опубликования, анекоторые–наследующийдень.Закону,ухудшающемуположение авиакомпаний как плательщиков страховыхвзносов, и вовсе придана обратная сила – его действиераспространенонаушедший2010год.

Конечно, нельзя не отметить происходившие в2010году важные изменения в налоговой системе, направ­ленныенаулучшениеделовогоклиматавстранеиреа­лизацию планов по модернизации российской эконо­мики. Смягчен режим ответственности за налоговыепреступления. Усовершенствованы правила налогово­го контроля. Введен ускоренный порядок возмещенияНДСкрупнымкомпаниям.Предоставленысуперльготыучастникам проекта «Сколково». Подготовлены новыезаконодательные инициативы по налоговому стимули­рованиюинноваций.

НовыйруководительФНСРоссииобъявилоднойизглавных задач налаживание отношений с бизнесом ипомощь налогоплательщикам вуплате налогов.Можноожидать дальнейшего развития современных техноло­гий налогового администрирования – эти технологиипризваны выявлять налогоплательщиков, находящихсявзоненалоговогориска,небеспокояпрозрачныеинад­ежныекомпании.

Благодаря подписанию изменений в Соглашение сКипромобизбежаниидвойногоналогообложенияпоя­

вились первые ориентиры в политике государства поотношениюкофшорам.

Определенности в отношения налоговых органов ипредпринимателей добавили решения Высшего Арби­тражногоСудаРФкакглавнойинстанциипорассмотре­ниюналоговыхидругихэкономическихспоров.

В­какую­сторону­качнется­маятник?Как признал публично министр финансов А.Л. Кудрин,повышение налогов – это тенденция, а не временнаямера. Впередидумскиеи президентскиевыборы, олим­пиада,футбольныйчемпионат,перевооружениеармиииполиции…Сейчаспросчитываютсяспособы«налоговойперезагрузки», т.е. перераспределения налогового бре­мени. В первую очередь рассматриваются «дожимание»нефтегазовых и табачных компаний, тотальная отменальгот,повышениеставкиНДС.

Серьезное влияние на «участь» крупных компаний,несомненно,окажетзакононовыхправилахналоговогоконтролязатрансфертнымценообразованием.Повсейвидимости, в первом полугодии 2011 года закон будетпринятГосударственнойДумойивступитвсилус2012года.Законпредусматриваетсокращениекругаконтроли­руемыхсделоксодновременнымпереносомнаналогопла­тельщиковбременидоказываниясоответствиядоговор­ныхценрыночным.Одновременно планируется ввестиправила«группового» налогообложения,однаконапер­вомэтапеплатитьналогисконсолидированнойприбы­лисмогутлишьнесколькокомпанийвсвязисвысокимитребованиямкэкономическимпоказателямхолдингов.

Серьезно будут переработаны правила взиманияНДС.Вчастности,правительственнымзаконопроектом,внесенным в Госдуму, предусмотрено восстановлениеНДС, т.е. доплата налога в бюджет, если при инвента­ризации выявлены недостачи товаров. Пострадают отпоправкивпервуюочередьсетевыеритейлеры,посколь­куониширокоиспользуюттакойсовременныйформатторговликаксамообслуживание,предполагающеенепо­средственный доступ потребителей к товарам. Это притом,чтоубытки,возникающиеотхищений,магазиныневправеучестьприналогообложенииприбыли!

Всерьез обсуждается восстановление статьи об уго­ловной ответственности за лжепредпринимательство,когда «фирмы­однодневки» создаются и используютсялишькакинструментдляуходаотналогов,рейдерства,дачивзятокит.п.СтатьяэтабылаисключенаизУголов­ного кодекса РФ совсем недавно в связи с либерализа­циейответственностизаэкономическиепреступления.

В то же время, практически не ведется работа повыполнениюпоручения,котороеПрезидентРоссиидалвмае2009годавБюджетномпослании:кодифицироватьсудебные доктрины, направленные на противодействиеналоговымсхемам.В2006годунормыозащитеотнало­говыхзлоупотребленийбылиустановленывразъяснени­яхВысшегоАрбитражногоСудаРФ.Разъясненияносиливременныйхарактерибылипризванызащититьналого­плательщиковот«налоговоготеррора»ислишкомширо­кого судебного усмотрения. За прошедшие годы нако­пленбогатыйопытихприменения,которыйнеобходимо

обобщить и включить в Налоговый кодекс. Принятиеэтогозаконапозволитгосударствусобратьналогистех,ктонезаплатил,анестех,ктоработаетнавидуувсехилегкодоступенналоговымконтролерам.Длябизнесаэтотзаконбудетозначатьопределенностьприпланированиинанескольколетизащитуотнеобоснованногопересмо­трапоусмотрениюналоговогоинспектораделовойцелисделки,бизнес­проекта,реорганизационныхпроцедур.

Повопросамвведенияправилконтролируемойино­страннойкомпании,налоговогорезидентстваорганиза­ций,бенефициарногособственникаидругимвопросамконтроля при трансграничных операциях нет докумен­тов высокой степени готовности. Другими словами, в2011годуэтивопросынебудутурегулированызаконо­дательно.

В ближайшее время Конституционному Суду, види­мо,предстоитответитьнавопросоправомерностиуста­новленияПостановлениемПравительства№829осенью2010года«налоганакопирование».Этотналогустанов­лен сцелью выплаты компенсации авторам доходов,неполученныхиз­затехническойвозможностисвободногокопированияфайлов.Вотличиеотдругихналогов,обя­зательные платежи «в поддержку авторов» поступаютотпроизводителейиимпортеровневбюджет,анасчетуполномоченнойнекоммерческойорганизации,т.е.носятпарафискальныйхарактер.Парафискалитетыбыличрез­вычайноразвитывоФранциив70­90­хгодах.Отпози­цииКонституционногоСудабудетзависеть,появятсяливРоссииещеподобныеплатежи,например,вФондЧем­пионатамира–2018,вРезервполицейскогообслужива­нияилинасчетагоскорпорации«Модернизация»(такихструктурпоканети,надонадеяться,небудет).

Высший Арбитражный Суд РФ, чьи решения годназадКонституционныйСудРоссиипризналпрецеден­тными,готовитважныеразъясненияопорядкевозмеще­ниявреда,причиненногобизнесучиновниками,атакжеопроцедуреналоговыхпроверокипривлеченияналого­плательщикакответственности.АктивнообсуждаетсяивопросонедопустимостиобратнойсилыпостановленийВАСРФ,ухудшающихположениеналогоплательщиков.

Серьезные опасения у экспертов вызывает резкоеповышение страховых взносов с выплат работодателейработникам. Малый бизнес, который не имеет возмож­ности перенести новые налоговые издержки в цене напокупателей, поставлен на грань вымирания и вынуж­денприспосабливатьсякситуациипоройнезаконнымиметодами, т.е. скрывая заработную плату от налогово­гоконтроля.ПравительствонамеренооценитьвлияниеповышенныхставокнапоступлениесредстввПенсион­ныйфондидругиегосударственныесоциальныефондыв2011годуивзависимостиотэтогопринятьрешениео«налоговомманевре».

Знаменитый предвыборный ельцинский указ былнеожиданным для налогоплательщиков. Нет сомнений,чтовсвязиспредстоящимивыборамикомпанииигра­жданвРоссииожидаюточередныеналоговыесюрпризыот власти. Подготовка бюджета на очередной финансо­выйгодигорячаяосень2011годапокажут,будутлиэтисюрпризыприятнымидляналогоплательщиков.

At the of this year, it will be 20 years since the break-up of the Soviet Union. In that time, much in Russia has changed beyond recognition; already a new generation is studying and working who never knew the USSR. In order to highlight some of the huge changes which have taken place in this period, the archive

page in the RBCC Bulletin this year will look back at 1991, to compare business then and now.

July 17th 1991 – An Historic Occasion

There would probably be a slight hesitancy on the part of anyone asked to recite the list of the “Group of Seven” countries, particularly if the question was posed at a time other than the two

or three days each year when the “G7” meets. When the “G7” becomes the “G8” as it must surely do in the foreseeable future, the USSR will probably be the first country listed.

Media attention has played a significant part in focus-sing the eyes of the world on the invitation extended to President Gorbachev to attend the 1991 “G7”. If casual observers were not aware before, they will now appreciate the huge resources possessed by a vast nation, which are wasted by a grossly inefficient system and false pro perties.

No-one can help the Soviet Union with the political will to reform – this must come first and be self gener-ated. The second requirement must be that of technical expertise to implement reforms, and the third – money in the form of foreign investment.

The “G7” was not prepared to sign blank cheques to assist in the third requirement. They listened to the account of the reforms planned to meet the first, and came up with a six point plan in answer to the second requirement. They are: special status with IMF and World Bank; for all international institutions to work closely together and intensify efforts to support the USSR with advice and expertise to help it create a market econo-my; to work for price decontrol and privatisation in the Soviet Union; to intensify technical assistance in energy, “defence conversion”, food distribution and nuclear safe-ty; to promote Soviet Trade; and the G7 to keep in close touch with developments.

Competition to do business in the USSR will probably intensify as a result of July 17th 1991. We must be ready and willing to meet the challenge.

Gorbachev in London for G7 SummitAt the meeting which followed the G7 summit between President Gorbachev and the leaders of the seven leading industrial democracies on 17th July, a six-point package

of measures designed to integrate the Soviet Union into the world economy and aid its political and economic reforms was outlined. The G7 have agreed the following:

The USSR will have a “special association” with the International Monetary Fund and World Bank, which means that the two institutions will provide assistance and advice.

All international institutions, including the OECD and the European Bank for Reconstruction and Development will work closely together and will intensify efforts to sup-port the Soviet Union with the advice and expertise it needs to create a market economy.

Technical assistance will be increased, particularly in energy, conversion of defence industries for the manu-facture of goods for consumer use, improvement of food distribution and nuclear safety.

Soviet trade is to be promoted, particularly with East-ern Europe where, Mr Gorbachev said, trade had “virtu-ally collapsed”.

Mr Major, as Chairman of the G7 summit, will keep in close touch with developments and will visit Moscow before the end of the year. Helmut Kohl, the German Chancellor and Chairman of the next G7 summit, will continue this process in 1992.

The G7 Finance Ministers and Ministers for small businesses will go to Moscow as soon as possible to make studies of the economic situation.

Mr Gorbachev has been invited by Mr Kohl to attend the next G7 meeting in Munich in 1992. It was not clear whether Mr Gorbachev would be a full participant or, as in London this year, would attend discussions after the main meeting.

On 18th July, it was announced that Mr Norman Lamont, the Chancellor, would visit Moscow at the end of July to initiate “a process of dialogue and coopera-tion” with the Soviet side. During his visit Mr Lamont will probably meet with the representatives of the republics as well as the central Soviet authorities.

Mr Major also said the UK is to increase the Know How Fund, which was set up to help the Soviet Union develop a market-oriented economy, from £20 million for two years to £50 million over three years.
