TheseRulesandRegulationsareintendedforsafetyandcomfort,andtomakelifeatRockcliffemorepleasantforalltheresidents.
BuildingCodeRules1. AllshareholdersmustsubmitplansforalterationstotheResidentManagerforreview.TheResidentManagerwillsubmittheplanstotheBoardofDirectorsforapproval.(SeeAlterationPolicyattached).2. Shareholdersandotherresidentsareresponsibletoleaveduplicateapartmentkeysintheofficeincaseofanemergencyorlockout.Theduplicatekeysarekeptlockedintheoffice.
3. a. DoortodoorsolicitingandthedistributionofflyersunderapartmentdoorsattheRockcliffe Apartmentsbyanyoneisprohibitedexceptasotherwisesetforthbelow.
b. 7. Nothingshallbehungorshakenfromthedoorsorwindowsorplacedonwindowledges.Airconditionersandfansareauthorized.Windowsshallbekeptclean.Noarticlesareallowedtobestoredintheparkinggarages.
8. RockcliffeApartmentsOwners,Inc.,willnotberesponsibleforarticlesleftinthelaundryroomsorstorageareas.
9. QuestionsregardingtheserviceofthebuildingaretobedirectedtotheResidentSuperintendent/Manager.Complaintsshallbeinwritingtoavoidanymisunderstandingsandtoprovideawrittenrecordsothecomplaintcanbeinvestigatedandactiontakenasappropriate.

13. Noemployeesoftheresidents:maids,nurses,companions,etc.aretoparkintheupperparkingareas.Theymustparkinthelowerparkinglotinfrontofthelowergarage.
14. Obeythenoparkingsigns.Theserestrictedareasaresodesignatedfortheuseofemergencyvehiclessuchasambulancesandfireengines.Parkingatthenorthandsouthentrancesisauthorizedforloadingandunloadingforshortperiodsoftime,formaintenance,orwaitingforapassenger.

17.SnowRemoval:Shareholdersandtheirguestsarerequiredtoclearsnowfromtheirvehiclesnolaterthan36hoursafterasnowstormhasended.FailuretocomplywillresultintheRockcliffestaffclearingallremainingsnow-coveredvehiclesandchargingapplicableshareholderaccountsthesumof$25pervehicleforthisservice.Approximately12hoursbeforetheRockcliffestaffundertakestoclearsnowfromavehicle,theownerofthatvehiclewillreceiveaphonecallnotifyinghimorherofthestaff'sintenttocommencesnowremovalaction.Rockcliffewillnotbeheldliableforanydamagecausedbystaffeffortstoremovesnowfromvehicles.Oncesnowhasbeenclearedfromashareholderorguest'svehicle,theownershouldrelocatehisorhervehicletoaparkingspace/areathathasalreadybeenplowedsothattheRockcliffestaffcanproperlyandcompletelyclearthelots.
18.Ballplayingisnotallowedonthefrontlawn.
MaintenanceCode1. Hammering,drillingorheavyrepairworkshallbeperformedbetweenthehoursof8:00a.m.and5:00
p.m.MondaysthroughFridaysexceptholidays.Lightmaintenanceforemergencyrepairsofappliancesandotherwork,provideditwillnotbeadisturbancetotheotherresidents,maybeallowedatothertimeswiththeapprovaloftheResidentSuperintendent/Manager.
2. MovingVansarenotallowedonSaturdays,Sundays,holidaysorbetweenthehoursof5:00p.m.and8:00a.m.weekdays.ScheduleallmoveswiththeResidentSuperintendent/Managerwellinadvancesoastoavoidconflictswithothermovers.

4. Dogshallnotexceedaweightof25poundsexceptwherespecificbreedsarenecessaryasguide/servicedogs.OnlyoneTherapeuticDogpershareholder/apartment.
5. Dogsshallnotbepermittedtorideinpassengerelevators.Dogmayrideinserviceelevatorifbeingheld,orinacarrybag,wheninelevator(unlessusedasGuide/servicedogormedicallyunable).
6. Trainedattackorguarddogsarenotallowed.7. Anydogthatbites,clawsorscratchesanyperson("petattack")mayberemovedfromthe
building.PetownerwillholdRockcliffeApartmentsOwners,Inc.,harmlessfromanyrelatedclaims.
8. Dogmustbecurbedandwalkedawayfromplantingsandgardenbedsaroundbuildings,andkeptofflawn. Dogwastemustbepickedupanddisposedofproperly insealedbags.Dogwasteshouldnotbeleftintrashrooms.
9. Dogsarenotpermittedtorunlooseinthebuildingoronthegroundsandmustbeleashedatalltimeswhenoutsidetheapartment.Leashmaybenomorethen6ftlongwhenoutsideand4ft.wheninthebuilding. Dogsmaynotbetetheredoutside. Dogsarenotpermittedonanycommonareafurniture.
10. Dogmustnotcreateanuisanceforotherresidents.Anuisancecaninclude,but isnotlimitedto,thedogmakingrepeatedandprolongedsoundsornoisesthatareheardthroughwindows,walls,floorsorceilingsbyanotherapartmentand/orshareholder(suchasbarkingorcrying). Ifadogisfoundtobeanuisancetootherresidents,andifanamicablesolutioncannotbefoundindependentoforthrough theADRprocess,thenthedogcannotcontinuetoresideintheApartment.
11. Anydamagecausedtocommonpropertyresultingfromapetwillbetheresponsibilityofthedogowner.
12. ThefineforanyviolationoftheabovelistedrulesandregulationspertainingtoaTherapeuticDogis$100perincident.Anycontinuedviolationswillbecharged$100perdayforeachdaythattheviolationcontinues.

BeforeanyWorkbeginsyoumustprovideRockcliffewithacopyofyourarchitecturalplansandspecifications(the"Plans")andasignedAgreementforAlterationsandRenovations,togetherwithacheckintheamountof$500representingthefeerequiredforreviewofyourPlansbyanarchitectorengineeronbehalfofRockcliffe.InadditiontothePlans,youmustsubmitanAgreementforAlterationsandRenovationssignedbyyou.RockcliffewillthenreviewtheAgreement,havethePlansreviewedbyitsexpertandassumingthatthecontractisapproved,returntheAgreementsignedbyRockcliffetoyou.YouwillthenbeinformedoftheamountnecessarytobepostedasaDeposituntilthecompletionoftheWork.Afterthishasbeenaccomplished,youwillbeinapositiontosignacontractwithyourcontractorand/orvendorandtoscheduleastartingdatewithCommunityManagementortheResidentManager.

AGREEMENTFORALTERATIONSANDRENOVATIONS
THISAGREEMENT,madeandenteredintothis_______dayof_____________,20__,byandbetweenRockcliffeApartmentsOwners,Inc.,("Rockcliffe")havinganaddressof10CrestmontRoad,Montclair,NewJersey07042and___________________________("Shareholder"),havinganaddressat10CrestmontRoad,Apartment______________,Montclair,NewJersey07042(the"Apartment").
WITNESSETH
WHEREAS,theShareholderhasrequestedthatRockcliffeconsenttothealterationsand/orrenovationstotheApartment(the"Work")asshowinthearchitecturalplansandspecifications("Plans"),preparedby___________________________________("Architect")dated___________anddescribedinExhibitAattachedhereto;and
WHEREAS,Rockcliffeiswillingtograntitsconsentonthetermsandconditionssetforthherein.
NOW,THEREFORE,inconsiderationofthemutualagreementofthepartiescontainedherein,thepartiesherebyagreeasfollows:
1. RockcliffeherebygrantsitsconsenttotheShareholdertoperformtherenovationsandalterationstotheApartmentstrictlyinaccordancewiththePlansanduponthetermsandconditionssetforthherein;providedthattheShareholderisincompliancewiththetermsofthisAgreementandtheProprietaryLease.NochangescanbemadetothePlansorthescopeoftheWorkwithoutthepriorwrittenconsentofRockcliffe.
2. BeforeBeginningWork.BeforebeginninganyWork,theShareholderagreesasfollows:
a. TodelivertoCommunityManagementacopyofarchitecturalplansandspecifications(the"Plans").
b. TodelivertoCommunityManagementcopiesofallcontractswithcontractorsandsuppliersandascheduleofWorktobeperformedbyeachcontractorandsub-contractor;
c. ToprovideforeachcontractoraletterintheformattachedheretoasExhibitA;
d. ToobtainallnecessarypermitsandapprovalsfromtheTownshipofMontclairandanyothergovernmentalauthorityhavingjurisdictionovertheWorkdoneattheApartmentandtoprovidecopiesofsametoCommunityManagement.

e. Toobtainfromeachcontractor,sub-contractororotherpersonworkingintheApartmentanddelivertoCommunityManagementevidencethattherequiredinsurancecoverageisinfullforceandeffect.
3. Fees. TheShareholdershallpaythefollowingfees:
a. TheShareholdershallreimburseRockcliffeandCommunityManagementforallfeesandexpensesincurredbyeitherinconnectionwiththereviewofthePlansandforsubsequentorperiodicinspectionsduringoruponcompletionoftheWork,includingfeespaidtoarchitects,engineersandattorneys.Acheckintheamountof$500payabletoRockcliffeApartmentsOwners,Inc.shallbesubmittedwiththisAgreementsignedbytheShareholder.
b. AspartialsecurityforitsobligationsunderthisAgreement,ShareholderherebydeliverstoRockcliffeacheckintheamountofpayabletoRockcliffeApartmentsOwners,Inc.,representingasecuritydepositfortheWorkperformed(the"Deposit").TheDepositwillbeinanamounttobedeterminedbyRockcliffewhichwillequaltenpercent(10%)oftheestimatedcostoftheWork.TheDepositwillbeheldbyCommunityManagementtocoveranyexpenseduetothe·Shareholder'sfailuretocomplywithanytermofthisAgreement,including,butnotlimitedto,damagescausedbytheWork,thecostsofanyconsultants,cleaningcostsandovertimeand/orsecuritycostsoccasionedbytheWork.AnybalanceoftheDepositwillbereturnedonlyafterRockcliffedeterminesthattheauthorizedWorkhasbeencompletedandtheappropriateapprovalsobtainedfromtheTownshipofMontclairandproofoffullandfinalpaymenttoallcontractorshasbeenprovidedbytheShareholder.
c. Rockcliffe'sArchitectMUSTreviewallrenovationplans.Shareholderwillbebilledforreviewatarateof$130/hr.
4. GeneralRequirements.
a. TheShareholderwillassumeallrisksofdamagetotheBuildinganditsmechanical,heating,cooling,electricalorplumbingsystemsandtopersonsandpropertyintheBuildingattributabletotheWorkbeingperformedhereunder.lfRockcliffedeterminesinitssolediscretionthattheoperationoftheBuildingoranyofitsequipmentoranyapartmentintheBuildingisadverselyaffectedbytheWorkperformed,Shareholderwhensoadvisedwillremovewithin24hoursthecauseoftheproblemandceaseallWorkor,atRockcliffe'soption,reimburseRockcliffeforcostsofremovalandcorrection.
b. ShareholderrecognizesthattherewillbenochangesintheoperationoftheBuildingsystemstofacilitatethefunctioningofanyheating,airconditioning,plumbingorelectricalappliancesShareholdermaybeinstalling.

c. Theuseofelectrichammers,electricsawsorotherelectricalpowertoolswhichcauseormaycauseunduedisturbancetoothershareholdersisnotpermittedatanytimeunlessspecificallyapprovedbyRockcliffeinwriting.Nojackhammersofanykindmaybeused.
d. TheShareholderwilldirectallcontractorsandsub-contractorstofollowindustrystandardsinpaintremovingandsandingandtoprovidetheShareholderandanyotheroccupantoftheApartmentwiththeEPApamphletentitled"ProtectingYourFamilyfromLeadintheHome".TheShareholderacknowledgesthatRockcliffehasnoliabilityorobligationinconnectionwiththisnotificationorwithanyrequirementsoftheEPApertainingtotheremovalofleadpaint.
e. Allworkmustbeperformedandallmaterialsstoredintheapartment.NoworkmaybeperformedoutsidetheapartmentandnomaterialsmaybestoredoutsidetheapartmentunlesspermissioninwritingisobtainedfromRockcliffe.
f. TheShareholderandcontractoracknowledgethatRockcliffehastherighttoperiodicallyreviewtheworkintheapartment.
g. TheShareholderrecognizesthatbyenteringintothisAgreementRockcliffedoesnotexpressanyopinionastodesign,feasibilityorefficacyofanyrenovationsoralterationsundertakenbytheShareholdernorshallRockcliffe'sconsentbedeemedtoexoneratetheShareholderfromanyliabilityinconnectionwiththeWorkperformedintheApartment.
5. DurationofWork.TheShareholderagreesthatthealterationsandrenovationsshallbecompletedexpeditiously.
a. TheWorkanddemolitionshallcommenceby___/___/20___,andshallbecompetedwithin_____days(the"CompletionDate”)afterthedateofcommencement.Iftheworkdoesnotcommencewithin30daysofthedateofthisAgreement,thisAgreementshallbenullandvoid.ThedateofcommencementshallbeestablishedbyCommunityManagementorbytheResidentSuperintendent/Manageronthefirstdaythecontractorisonthejob.ThedateofcompletionshallbethedateallWorkhasceasedintheApartment,otherthanpaintingandwallpapering,andothercontractorshavevacatedtheApartmentascertifiedtobyCommunityManagementortheResidentSuperintendent/Manager.
b. NoWorkmaybecontinuedbeyondtheCompletionDatesetforthinthisAgreementwithoutRockcliffe'sspecificpriorwrittenconsent.IfWorkispermittedtocontinuebeyondthatdate,Rockcliffeshallbeentitledtoliquidateddamagesassetforthbelowforeachdayorpartthereofonwhichworkisperformed,paidinadvance,tocompensateRockcliffeandtheshareholdersforthecostsandinconvenienceofthecontinuationoftheWork.

d. ShareholdershallgivetheResidentSuperintendent/Manager,CommunityManagementandtheownersofadjacentpremisestelephonenoticeatleast5workingdayspriortothedateanydemolitionisscheduledtocommence.ShareholderunderstandsthatsuchdemolitionWorkmaybehaltedatanytimeif,inRockcliffe'ssolediscretion,RockcliffedeterminesthatsuchWorkisexcessivelynoisyorcreatesunduehardshipforanyothershareholdersoroccupants;however,theShareholdermayrecommencedemolitionWorkaftertheShareholderamelioratessuchsituation.
e. NoWorkshallbedone,exceptbetweenthehoursof8:30AMand5:00PM,andnoWorkshallbedoneonSaturdays,Sundaysorholidays.Ifthereisanyinterruptioninthenormalday-to-dayoperationoftheBuildingoriftheRockcliffeRulesandRegulationsareviolated,CommunityManagementortheResidentManagereachhavetherightatitsorhissolediscretiontohalttheWorkuntilthecontractorscomply.
6. Dust.AllprecautionswillbetakentopreventdirtanddustfrompermeatingotherpartsoftheBuildingduringtheprogressoftheWork.Materialsandrubbishmustbeplaceinbarrelsorbag,beforebeingtakenoutoftheApartmentdaily.Allsuchbarrelsorbags,rubbish,rubble,discardedequipment,emptypackingcartonsandothermaterialsmustbetakenoutoftheBuildingandremovedfromthepremisesdailybytheShareholder'scontractoror,ifthecontractorfailstodoso,RockcliffemayremovesameattheShareholder'sexpense.ShareholderrecognizesthatonlytheserviceelevatormaybeusedforsuchremovalandonlyatsuchtimeastheResidentManagermaydirect.InnoeventmaydebrisfromtheWorkbeallowedtoremaininthehallways,basementorotherpublicareasoftheBuilding.ShareholdermustinsurethatsuchpublicareasarekeptcleanandwillrepairanydamagecausedbytheremovalofdebrisfromtheApartment.
7. HouseRules.TheWorkbeingdoneontheApartmentshallnotinterferewiththenormaldailyoperationoftheBuildingorviolatethetermsandconditionsoftheProprietaryLeaseorRockcliffe'sRulesandRegulations.TheShareholder'scontractorsand/orsub-contractorsmustfollowandabidebytheinstructionsoftheResidentManagerorhisdesignatedrepresentative.
8. IndemnificationandRelease.
a. TheShareholdershallindemnifyandholdharmlessCommunityManagement,Rockcliffeanditsdirectors,officers,consultantsandemployees,andothershareholders,visitorsoroccupantsofRockcliffefromallcosts,liabilitiesordamageswhichariseasaresultoftheWorkperformedintheApartmentorfromanyfailuretocomplywiththisAgreement,

whetherornotcausedbynegligence,andtoreimburseCommunityManagement,Rockcliffeanditsdirectors,officers,consultantsandemployees,andothershareholders,visitorsoroccupantsforanyexpenseincludingwithoutlimitation,attorneys'feesincurredastheresultofsuchaction.
b. TheShareholderherebyreleasesCommunityManagement,Rockcliffeanditsdirectors,officers,consultantsandemployeesfromanyandallliabilityforlossordamagetoanypropertywhichmayresultfromorbeinanywayconnectedwiththeWork,andShareholderherebywaivesanyclaimswhichheorshemaynoworhereafterhaveagainstCommunityManagement,Rockcliffe,itsemployeesand/orconsultantsbaseduponinterruptionorsuspensionofthealterationsbyRockcliffeorCommunityManagementregardlessofthereasonforsuchinterruptionorsuspension.
9. Liens.TheShareholderwillpaytheentirecostofalterationsandinstallationsnotlaterthan30daysaftercompletionoftheWork.Ifanymechanicsliensarefiledforworkclaimedtohavebeendoneormaterialsallegedtohavebeensupplied,theShareholderwillcausesuchlienstobedischargedwithin10daysafterfiling.IftheShareholderfailstodoso,RockcliffemaytakeanyandactionsnecessarytodischargeorsatisfysuchlienandchargetheShareholderwithallcostsassociatedtherewith,includingattorney’sfees.
10. CertificateofOccupancy.AtthecompletionoftheWork,theShareholderwilldoallthingsnecessaryathisorhercostandexpensetodeliveraCertificateofOccupancyandproofthatallWorkhasbeendoneinaccordancewiththerequirementsoftheTownshipofMontclair.
11. FailuretoPay.Anyfees,costs,chargesorpenaltiesinconnectionwiththisAgreementwhicharenotpaidwithinl0daysafterbillsthereforehavebeensubmittedtotheShareholder,shallbeconsideredasAdditionalRentundertheProprietaryLeaseandRockcliffeshallbeentitledtoallremediesprovidedforthecollectionofAdditionalRentundertheProprietaryLease.
12. FailuretoComply.FailuretocomplywithanyoftheprovisionshereofshallbedeemedabreachoftheprovisionsoftheProprietaryLeaseandCommunityManagementmayalsosuspendallWorkandpreventworkmenfromenteringtheApartmentforanypurposeotherthantoremovetheirtoolsandequipment.
13. Miscellaneous.ThisAgreementmaynotbechangedorally.ThisAgreementshallbebindingontheShareholderandRockcliffeandtheirauthorizedsuccessorsandassigns.

APARTMENTDECORATINGAGREEMENT
Irequestpermissiontoperformdecoratingandcosmeticalternationstomyapartmentasdescribedinthisapplication.
Iagreethatbeforeworkbegins,RockcliffewillbeprovidedwithacompletecopyofeveryAgreementIwishtoenterintowithmycontractor(s)and/orvendor(s).
Iunderstandthatbeforecommencingwork,Imustprocurefromanycontractorwhodoesworkinmyapartmentacomprehensivepersonalliabilityandpropertydamageinsurancepolicyintheamountof$1,000.000namingRockcliffeApartmentsOwners,Inc.,CommunityManagementandmyselfasinsuredparties.ThepolicywillprovidethatitcannotbeterminateduntilRockcliffeandCommunityManagementhavereceivedten(10)dayswrittennoticeoftheproposedtermination.
Inaddition,IwillhaveanycontractorsdoingworkinmyapartmentsubmittoCommunityManagementworker'scompensationpoliciescoveringallemployeesofthecontractor.
IwillalsoobtainfrommycontractorandsubmittoCommunityManagementaletterfrommycontractorintheformattachedheretoasExhibitA.
IunderstandthatIamliableforalldamagewhichmaybecausedtothebuildinganditsmechanicalsystems,andtopersonsandpropertyinthebuildingwhichmayresultfromorbeattributabletotheworkbeingperformedinmyapartmentandthatanycostsincurredbyRockcliffeasaresultofsuchdamage,willbetreatedasAdditionalRentunderthetermsoftheProprietaryLeaseandaddedtomyMaintenanceFees.
IherebyindemnifyandholdharmlessRockcliffeApartmentsOwners,Inc.,CommunityManagementandtheshareholdersandoccupantsofRockcliffefordamagessufferedtoanypersonorpropertyasaresultoftheworkperformedinmyapartment.IherebyagreetoreimburseRockcliffe,CommunityManagementandtheshareholdersofRockcliffeforanyexpenses,includingattorneyfees,incurredastheresultofworkperformedinmyapartment.
Noworkshallbedoneexceptbetweenthehoursof8:00AMto5:00PM,MondaythroughFriday.Ishallinstructthecontractorsworkinginmyapartmentthattheymustconcludeallworkandcleanupandexitthebuildingnolaterthan5:00PMeachday.Noworkmaybeperformedonweekends,holidaysorduringextendedworkinghourswithoutthepriorwrittenconsentofRockcliffe.
Iwilldirectanycontractorworkinginmyapartmenttotakeallprecautionstopreventdirtanddustfrompermeatingotherareasofthebuildingduringtheprogressofwork.Allmaterialandrubbishwillbeplacedinbarrelsorsturdytrashbagsbeforebeingtakenoutoftheapartment.Allrubbish,rubble,discardedequipment,emptypackingcartons,etc.willbetakenoutofthebuildingandremovedfromthepremisesatmyexpense.Iwilldirectmycontractorstousetheserviceelevatoratalltimes.

Irecognizethatbygrantingconsenttothework,Rockcliffehasnotexpressedanopinionastothedesign,feasibilityorefficacyofthework.
MyfailuretocomplywithanyoftheprovisionsofthisAgreementshallbedeemedabreachoftheprovisionsoftheProprietaryLease.
IrecognizethatRockcliffehastherighttosuspendallworkandpreventworkmenfromenteringmyapartmentforanyreasonotherthantoremovetheirtoolsorequipmentintheeventofabreachofthisAgreement.
Iwilldirectmycontractorstofollowindustrystandardsinpaintremovingandsanding.IwilldirectmycontractortoprovidemeandanyotheroccupantoftheapartmentwiththeEPApamphletentitled,ProtectingYourFamilyfromLeadintheHomeandIwillprovideawrittenacknowledgmentofreceipttomycontractor.IacknowledgethatRockcliffehasnoliabilityorobligationinconnectionwiththisnotificationorwithanyrequirementsoftheEPApertainingtotheremovalofleadpaint.
