    AN ACT REDUCING THE MINIMUM AGE OF THE DIFFERENT

    ELECTIVE LOCAL OFFICIALS BY AMENDING SECTION FORTY-TWO OF BATAS PAMBANSA BLG. TATLONG DAAN TATLUMPU'TPITO, OTHERWISE KNOWN AS THE LOCAL GOVERNMENT CODE.Section 1. Section forty-two of Batas Pambansa Blg. Tatlong DaanTatlumpu't Pito is hereby amended to read as follows: chanroblesvirtualawlibrary"Sec. 42. Qualifications. (1) An elective local official must be acitizen of the Philippines, a registered voter in the barangay,municipality, city or province where he proposes to be elected, a

    resident therein for at least one year at the time of the filing ofhis certificate of candidacy, and able to read and write Filipino,English, or any other local language or dialect. chanroblesvirtual law library"(2) Candidates for the position of governor, vice-governor, ormember of the sangguniang panlalawigan must be at least twenty-three years of age on election day. h a o b l e vr ta a i b r ay"(3) Candidates for the positions of mayor or vice-mayor must beat least twenty-one years of age on election day."(4) Candidates for the positions of member of the sangguniangpanlungsod or member of the sangguniang bayan must be at least

    eighteen years of age on election day. If elected as a member ofthe sangguniang panlungsod or sangguniang bayan, the member isqualified to fill any vacancy in the office of mayor or vice-mayoror may be appointed by the President upon recommendation ofthe Secretary of Local Governments as mayor or vice-mayorpursuant to Chapter 2, Title Two of this Code: Provided, That saidmember is at least twenty-one years of age at the time of hissuccession. a o b l e r ta a i b r ay"(5) Candidates for the positions ofpunong barangay or member of

    the sangguniang barangay must be at last eighteen years of ageon election day and actual residents in the barangay in whichthey shall be elected."(6) Any law on civil capacity and the capacity to act to thecontrary notwithstanding, any member of the sangguniangpanlungsod or sangguniang bayan, punong barangay or member ofthe sangguniang barangay, chairman or member of the kabataang

    barangay or organization to replace the same, can exercise all thepowers and discharge all the duties of his office or any otheroffice to which he may succeed pursuant to this Act. a o b l e vr ta a i b r ay"(7) Candidates for chairmanship of the kabataang barangay ororganization to replace the same must be at least fifteen years ofage but not more than twenty-one years of age on election day." a o b l e r ta aw i b r aySec. 2.
