Puducherry Agro Products, Food and Civil Supplies Corporation Limited (PAPSCO) invites quotations from the eligible interested Registered Companies, Cooperative Societies, individual or partnership firm, or any other legal entity in India who are the Manufacturers involved in the trade of crackers, etc., for supply of Crackers, Sparklers, Chakra, Flower Pots& Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc., to meet out the common public requirement at Deepavali Bazaar 2021 of PAPSCO under market intervention programme.

3. The sealed Quotations shall be submitted to the Managing Director, PAPSCO, Agricultural

Complex, Thattanchavady, Puducherry – 605 009 till 11.30 AM on 12.10.2021. Quotations received after the end date and time (i.e.) 12.10.2021 11.30 AM will not be entertained and summarily rejected.

4. If the quotation submission end and opening date mentioned above was declared as holidays,

the Quotations will be received and opened on the next working day at the same hours mentioned therein.

5. Application Form and Terms & Conditions (not transferable) can be downloaded from the websites http://www.py.gov.in at free of cost.

6. The Application fee of Rs.2,500/- (inclusive of tax) and requisite EMD should be either in the form of Demand Draft/Bankers’ Cheque/FDR or by means of RTGS/NEFT in favour of M/s.

PAPSCO, Puducherry payable at Puducherry should be submitted to the Office of the Managing Director, PAPSCO, Agricultural Complex, Thattanchavady, Puducherry – 605 009 upto the scheduled date. Copy of the RTGS/NEFT payment made particulars should be enclosed along with submission of Quotations also.

7. The Manufacturers who are blacklisted by the Government/ State Agency/any institution are not entitled to file/ participate in the quotation.

8. Minors/insane are not eligible to participate. 9. Only off-line payment/documents/samples as stated in Application conditions of technical bid

will be accepted in physical mode. Conditional Quotations and casual letters sent by the bidders also will not be accepted.

10. Purchase preference will be given to Government Organisations/Govt. Undertakings/Coop.

Societies, etc., who are also to be a manufacturer of crackers, sparklers, etc., and at least have three years experience and private Manufacturers who have been continuously under the satisfactory supply to PAPSCO in the recent past previous Deepavali Bazaars conducted by PAPSCO subject to their satisfactory performance and capability/capacity which is at the discretion of PAPSCO.

11. The bidders shall not directly or indirectly concerned or in any way deal with the officers or

other persons employed by or under the authority of the Corporation in making the supplies hereby contracted for, nor shall the bidders either directly or indirectly give or promise to pay or give, or permit to be given to any person or persons or in any department under the Corporation, money or gratuity, fee or reward for any matter of thing or any way relating to the performance of the contract.

12. PAPSCO reserves the rights to reject/accept any/all Quotations or cancel the Quotations

with or without assigning any reason.

Since 1992, PAPSCO conducts Deepavali Sirappu Angadi every year in Puducherry and Karaikal regions as a market intervention programme establishing Mega Stall(s) at Puducherry & Karaikal regions in the heart of the city and considerable number of small Centres in the prominent localities covering rural and urban areas and makes available all essential commodities & Crackers required for the celebration of Deepavali festival under one roof; Wherein, some essential grocery and oil items are sold at subsidized rates fixed by the Dept. of Civil Supplies & Consumer Affairs, Govt. of Puducherry as a measure of arresting the spiraling raise in price of essential commodities during the festival season and sales of vegetables, other groceries, pulses, rice, crackers, etc., at nominal/affordable prices affordable to the common public SCOPE OF WORK In the large public interest and demand, the Corporation this year also has proposed to conduct Deepavali Sirappu Angadi 2021 in Puducherry and Karaikal regions tentatively for a period of about 11 days before the Deepavali festival with an anticipation of about Rs.4 Crores to Rs.5 Crores sales in crackers exclusively and expecting a customer turnout of about 3 lakhs common public may get benefited.




In the celebration of Deepavali festival, in general and traditionally, common public especially children enjoys with firing Crackers, Sparklers, etc. As there is no standard variety and sizes involved and also there were numerous items with different segments made available in the market, the Manufacturers also introduces new items/products in the market every year in different segments, it was experienced that specific items could not be called for as tender or e-tender.

Therefore, PAPSCO invites Quotations from the eligible interested Registered Companies, Cooperative Societies, individual or partnership firm, or any other legal entity in India who are the Manufacturers involved in the trade of crackers, etc., for supply of Crackers, Sparklers, Chakra, Flower Pots & Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc., to meet out the common public requirement during Deepavali 2021 by means of sale at Deepavali Bazaar 2021 of PAPSCO under market intervention programme of Govt. of Puducherry.

INSTRUCTIONS TO BIDDERS (ITB)

1. Bidders mean all eligible interested Registered Companies, Cooperative Societies, individual or partnership firm, or any other legal entity in India who are the Manufacturers involved in the trade of Crackers, Sparklers, Chakra, Flower Pots& Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc.

2. Applications are available both in electronic format which bidders can download

free of cost from website http://www.py.gov.in and also in physically from the Head Office, PAPSCO situated at Agricultural Complex, Thattanchavady, Puducherry – 605 009 on payment of Rs.2,500/-.

3. Bidders who downloaded the Application from http://www.py.gov.in, should enclose

the Application fee of Rs.2,500/- either in the form of Demand Draft/Bankers’ Cheque or by means of RTGS/NEFT in favour of M/s. PAPSCO, Puducherry payable at Puducherry should be submitted to the Office of the Managing Director, PAPSCO, Agricultural Complex, Thattanchavady, Puducherry – 605 009 upto the scheduled date. Copy of the RTGS/NEFT payment made particulars should be enclosed along with submission of Quotations also.

4. The quotation required to be submitted in physical form with required Application document Fee and documents as stipulated in Application check list.

5. Also no fax, email, SMS, letters or any other form of communication will be

entertained. 6. PAPSCO reserves the right to select/reject the lowest bid or any bid or cancel the

Quotation even at the stage of award of contract or at any stage with or without assigning any reason, if the object of the quotation called for not materialized in implementation of the market intervention programme.

7. All bidders are advised not to wait last date and submit their Quotation/bid at the

earliest. The Corporation shall not be responsible for any inconvenience in website and no extension in deposition of quotation be allowed for any bidder.






ELIGIBILITY CONDITIONS:

1. The bidder viz., the eligible interested Registered Companies, Cooperative Societies, individual or partnership firm, or any other legal entity in India who are the Manufacturers involved in the trade of sale of crackers, etc., from within and outside Union Territory of Puducherry for supply of Crackers, Sparklers, Chakra, Flower Pots & Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc., shall have an annual turnover of Rs.50 lakhs during any of the last three financial years.

2. The bidder shall be capable of trading the crackers, sparklers, etc., as stated above. In

this regard, a turn over certificate as per Annexure- IV and Balance Sheet and Profit & Loss Account along with Auditor’s Report are required to be submitted.

3. The tenderer should be an Income Tax Assessee. In support of this, attested copy of Permanent Account Number (PAN) and last three years Income tax and GST certificate are required to be submitted.

4. The bidder should not have been black listed or debarred for any default connected with handling of Crackers, etc., from any Govt. Dept./Organization. An affidavit as per Annexure – V duly attested by the Oath Commissioner/Notary is required to be submitted in support thereof.

5. Any sister concern(s) of the bidder applying against the same quotation, would lead to disqualification of the quotation. Sister concern means a Company, Society, partnership firm or proprietorship having one or more common person as Director/ Partner/member/owner.

6. Unregistered partnership firm shall not be eligible.

7. The bidder should submit copy of registered partnership deed in case of partnership firm, registration certificate in case of firm/limited company/Co-operative Society.

8. The tenderer should submit copy of GST registration certificate, trade license/ import/export license issued by competent authority.

9. The tenderer should have any experience in supply of crackers, sparklers, etc., items to the Government Organisations/Public Ltd Companies/Private Companies, a copy should be submitted.

10. The Managing Director reserves the right to relax/cancel any of the provisions contained herein above or cancel the tender at any stage.




TERMS AND CONDITIONS 1. GENERAL

a) Bidders should duly furnish the required information as per the Application.

b) On download and submission of Application, the Application fee of Rs.2,500/- should be submitted in the sealed Quotations cover of Quotation in the form of Demand Draft/Bankers’ Cheque in favour of M/s. PAPSCO, Puducherry payable at Puducherry.

c) Quotations should be strictly in conformity with the prescribed terms and conditions. Quotations should not contain any conditions other than the prescribed. Quotations, who deviate from these terms and conditions, are liable to be rejected.

d) PAPSCO has the right to amend any of the terms and conditions, as may be desired. If such an amendment is absolutely necessary, the same shall be communicated to the Applicants which shall be made available on websites till before the last date of receipt of quotations.

e) Bidder should submit pamphlets of the brand of crackers, etc., whatsoever their product clearly displaying all the informations required to be printed thereon.

f) Bidders should be capable of completing the supply of the ordered quantity of specified Crackers, Sparklers, Chakra, Flower Pots & Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc., whatsoever indented within 10 days before the Deepavali festival as per schedule of PAPSCO from the date of acceptance of offer and delivery should start within 3 days of from the date of issue of supply order.

g) The eligible Manufacturers who are blacklisted by the Government/State Agency/any firm are not entitled to file/ participate in the Quotations. The Bidders have to submit an affidavit in the prescribed proforma (Annexure-V) that they are not blacklisted by the Government/State Agency. If the blacklisted firm, etc., file Quotation in benami name, the same shall be stand rejected apart from forfeiture of the payment any pending settlement of bill.

h) Minors/insane are not eligible to submit quotations.

i) The Manufacturers should have engaged person for manufacturing the crackers and other related items/products are above 18 years and are in compliance with Explosive Act.

j) Application Form is not transferable. Bidder should sign on all pages of the Application Form.




k) A bidder may withdraw, substitute or modify its bid after it has been submitted in accordance well before the specified time of receipt of quotation.

l) No bid shall be withdrawn, substituted or modified after the last time and date fixed for receipt of bids.

m) Validity of bid offer is 3 months from the date of opening the quotation.

n) All the disputes and differences arising out of or in any way touching or concerning this quotation whatsoever (except as to any matter the decision of which is expressly provided for in the contract) shall be referred to the sole arbitration of the Secretary of Civil Supplies & Consumer Affairs, Puducherry. In case the arbitrator to whom the matter is originally referred is transferred or vacates office or is unable to act for any reason whatsoever, the Dept. of Civil Supplies and Consumer Affairs, Puducherry shall be competent to appoint another person as Arbitrator. There will be no objection that the person so appointed is or was in the employment of the Corporation/ administration of the Govt. of Puducherry and as an employee of the Corporation had during the course of his duties expressed views on all or any of the matter of difference or dispute. The award of such arbitration shall be final and binding on the parties to this contract. The Courts of Puducherry only will have the jurisdiction in the matter of arbitration.

o) PAPSCO reserves the right to relax/cancel any of the provisions contained herein above.

2. EARNEST MONEY DEPOSIT

a) Every technical bid should be accompanied with Earnest Money Deposit @ 2% of total value of entire quantity of the items for which the bidder quoted by means of an Account Payee Demand Draft/Bankers’ Cheque drawn on any Nationalized/ Scheduled Bank in favour of “M/s PAPSCO” payable at Puducherry; The EMD may also be paid by means of RTGS/NEFT through Bank to the PAPSCO State Bank of India (Thattanchavady) Current A/c. No.35889668749; IFS Code SBIN0006842. The tenderer without EMD stand summarily rejected.

b) The tenderer may be quoted one or more of the listed items and relevant EMD for the

no. of items quoted in a single tender application. PAPSCO reserves the right to select one or more quoted items according to the quality & rate.

c) In case of unsuccessful tenderer, the EMD will be returned after the successful

tenderer executes the agreement.




d) The EMD of the successful tenderer shall be retained towards performance security,

which will be refunded after successful completion of the supply contract period

e) EMD is liable to be forfeited in case the tenderer withdraws or modifies his offer after opening of the tender or after the acceptance of the offer by PAPSCO or fails to enter into agreement or fails to accept the supply order within the specified time; and apart from the above, the tenderer will be blacklisted.

Note: The new products, which are introduced by the bidders, may also be considered by PAPSCO, which is at its sole discretion and no bidder compel or challenge it.

b) The anticipated value of the sale of crackers, sparklers, etc., may be around Rs.4 Crores to Rs.5 Crores. The quantities & value may be increased or reduced as and when PAPSCO may think fit subject to its requirement.

c) The orders for supply to the selected bidder/bidders will be placed by PAPSCO and accordingly, the Bidder should supply the quantity at the contracted rate as per the schedule mentioned in the supply order.




d) PAPSCO does not guarantee any volume of quantity or value at any given time and the decision of PAPSCO in this regard would be final and binding on the bidders and shall not be called into question by any bidder. PAPSCO reserves sole discretion in the matter.

4. RATE OFFERED

a) The rate may be quoted for FOR Puducherry region is also applicable for Karaikal region in the prescribed proforma, for the products/items/brands which are all they deal and eligible for Crackers, Sparklers, Chakra, Flower Pots & Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc.,

b) The rates are inclusive of rate per box/pack, packing charges, GST and any other statutory taxes as applicable from time to time, discounts, all expenditures of LOADING charges at their point, transportation to the specified PAPSCO Godown of Puducherry/Karaikal at or any other places/units specified by PAPSCO, transit insurance and unloading charges, etc. at and upto the specified places.

c) The rate quoted shall be in Indian Rupee and would be in force for the entire contract period. PAPSCO is not responsible for any fluctuation of prices either in Domestic Market or International Market and no request or representation for revision of rate will be entertained.

d) The cash discount and credit period discount may be specified by the bidder; which should not be included as component of the rate quoted; which may be considered by PAPSCO on its own discretion and the bidders shall not question.

e) Based on the lowest or best rates received as the case may be according to its brands and other discount factors, etc., PAPSCO reserves the right to select the rate according to the Brand and variety of crackers, sparklers, etc., to meet its Deepavali Bazaar 2021 requirement in implementing the market intervention programme at Puducherry and Karaikal regions; and award supply contract to one or more bidders and the same would be final and binding on all the bidders.

CONTRACT PERIOD

a) The rate contract is for entire 3 months supply period of October’21 to December ’21 and PAPSCO reserves the right to extend the contract period to further 3 months or more (or) to reduce to any extent at the accepted rate or at the rate at which specified by the PAPSCO subject to its requirement and decision.

Note: The specifications in Quotation Format should not differ from the original

specifications; otherwise quotation may be liable to be rejected.




5. SUBMISSION OF QUOTATION

a) Quotation should be sealed by the bidders and kept in a cover duly superscribed as

“QUOTATION FOR SUPPLY OF CRACKERS, SPARKLERS, ETC., FOR DEEPAVALI BAZAAR 2021”

and should be addressed to “The Managing Director, PAPSCO, Agricultural Complex, Thattanchavady, Puducherry – 605 009” and shall have the name and address of the bidder. The pamphlets, samples and the Application Fee should be placed in the Quotation cover, which is also part of the Quotation. For all items, the samples should be submitted invariably. Otherwise, the items may not be accepted. PAPSCO may or may not test the items.

b) If the samples are subjected to test, which is at the discretion of PAPSCO; any time

fixed by PAPSCO, which will be intimated over phone/writing, on that day, the bidder may be present or may not present. Based on the satisfaction of quality and worthiness of the product, PAPSCO may accept/reject the product. The bidder should not compel for testing and the decision of PAPSCO will be final.

c) The Quotation may be submitted by the bidders either in person in the Tender Box

placed in the Registered Office or sent by means of Registered Post/Speed post/ Parcel/Courier, etc., as the case may be reaching the above address within the stipulated time. PAPSCO will not be held any kind of responsible for any kind of loss of the bid in transit, damage by rain, etc., whatsoever the reason. The bids received after the stipulated time will be summarily rejected.

6. OPENING OF QUOTATIONS:

a) Quotations filed will be opened at 2 PM on 12.10.2021 at the PAPSCO, Head Office situation at Agricultural Complex, Thattanchavady, Puducherry – 605 009. The selection of quotations will be announced either on the same date or some other day as per announcement be made by PAPSCO at that time.

b) If the date fixed for opening of quotations happens to be Govt. holiday, the quotations

filed/received will be opened on the next working day at the same time specified above.




c) During opening of the quotations, the Bidders may attend either personally or through their authorized representative. Only single authorized person will be allowed. The authorized person should produce authorization letter duly attesting the signature of the authorized representative by the bidder, to participate in the said process of quotation.

d) The Quotation of the Bidder who qualifies in the Eligibility Criteria only will be considered. Only the eligible bidders in Eligibility Criteria will be eligible and allowed to participate in further quotation process.

e) Rate offered by the qualified bidders will be taken into consideration to arrive at the lowest rate offered by the bidders viz L1, L2 and so on for the items viz., Crackers, Sparklers, Chakra, Flower Pots & Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc.

f) The rate accepted is for the supply of contracted quantity in all respects for the Quantity Quoted for the prescribed period. Any request for revision of the rate accepted due to price fluctuations in International and Domestic Markets or for any other reason during the contract period will not be entertained and stands rejected.

g) After deciding the Lowest Rate by the Tender Committee, PAPSCO reserves the right to place purchase order on one or more Bidder(s) at the lowest rate for any quantity for any region, as may be agreed to be supplied by the Bidders on the same terms and conditions for supply of the approved Brand & variety of crackers, sparklers, etc., within the time stipulated by PAPSCO.

7. VALIDITY/LEGALITY:

The bids of all bidders who have participated in the bidding will remain valid upto 3 months from the date of opening of the bid.

8. NEGOTIATIONS

a) PAPSCO may conduct negotiation on the same day of opening of the quotations or shall inform the Bidders about the date and time of the negotiations as per its decision.

b) During negotiations the bidders should attend either personally or through their authorized representative. The authorized person should produce authorization letter duly attesting the signature of the authorized representative by the Bidder, to participate in the said process to Bids.

c) Depending on the lowest rates received, negotiations may be conducted with L1 Bidder and in case, the lowest Bid is not in a position to supply the required




quantity of Crackers, Sparklers, Chakra, Flower Pots & Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc., negotiations will be made with the second lowest bidder to supply the balance quantity at the rate quoted by the first lowest Bid and so on.

d) PAPSCO reserves the right to award the Bid in full or in part to one or several parties. The decision of the Managing Director is final and binding on the Bidders.

9. PERFORMANCE SECURITY

a) The EMD of the successful tenderer shall be retained towards performance security, which will be refunded after successful completion of the supply contract period.

b) If the successful tenderer prefers to produce Bank Guarantee in lieu of the

DD/Bankers’ Cheque, on production of Bank Guarantee, the amount paid by way of DD/BC/RTGS/NEFT will be released. The Bank Guarantee shall be in favour of Puducherry Agro Products, Food and Civil Supplies Corporation Limited, from any Nationalized Bank to be got verified from the issuing Bank.

c) The validity of the Performance Security Deposit shall be for 60 days beyond the

date of completion of the contract period as per clause 4(f). d) The Performance Security Deposit shall be refunded to the Supplier upon

successful completion of the agreement and on production of “No Demand Certificate” from the authorized officer, which is subject to the satisfaction of clause 4(f).

e) In case of the successful tenderer fails to supply the ordered quantity in full/ partially, the Performance Security stands forfeited/Bank Guarantee, if any furnished, will be invoked and the tenderer will be blacklisted.

10. AGREEMENT

a) Successful tenderer should execute agreement as per terms & conditions on Rs.100/-

non judicial stamp paper with PAPSCO within three days on furnishing prescribed Performance Security to M/s. PAPSCO. In the event of failure to execute the agreement, the Performance Security or EMD as the case may be, stands forfeited apart from cancellation of supply contract besides blacklisting of the tenderer.

b) PAPSCO is entitled to collect liquidated damages, if any, from the tenderer for his

failure to comply with the terms and conditions of the Tender.




c) The supplier, if breaches any condition or clause of the agreement, M/s. PAPSCO is entitled to cancel the agreement and also entitled to demand and recover the losses incurred to it due to such breach agreement condition/clause.

d) PAPSCO reserves the right to extend/modify/cancel the agreement according to the

contract period and as per clauses 4(f), subject to the decision of the PAPSCO/Govt. of Puducherry.

e) If the Deepavali Bazaar programme is closed or partly revised or modified due to

accidental decision of the State/Central Government or any amendment and the proceedings of purchase is stopped or revised or modified, then the agreement will automatically come to an end or partly continues for which supplier is not entitled to demand/receive any type of loss amount or cannot initiate any legal proceedings against M/s. PAPSCO.

11. RIGHTS OF PAPSCO:

PAPSCO reserves the right to accept/reject any or all the Bids at any stage with or without assigning any reason whatsoever and the decision of the Managing Director in this regard is final and binding on the Bidder and cannot be called into question.

12. SUPPLY ORDER

a) Successful bidder shall be issued offer of acceptance in respect of Crackers, Sparklers, Chakra, Flower Pots & Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc., in which, the approved bidders shall provide consent of the firm.

b) PAPSCO is entitled to collect liquidated damages, if any, from the Bidder for his failure

to comply with the terms and conditions of the Bid.

c) The supplier, if breaches any condition or clause of the terms and conditions of the supply order, PAPSCO is entitled to cancel the supply order and also entitled to demand and recover the losses incurred to it due to such breach of the terms and conditions/clause.

d) PAPSCO reserves the right to extend/modify/cancel the supply order for any Brand for any quantity with any supplier during the contract period and as per clause 3(a) and 4(f) above, subject to the decision of the PAPSCO.




e) If the market intervention programme (i.e) Deepavali Bazaar 2021 is closed or partly revised or modified due to accidental decision of the State/Central Government or any amendment and the proceedings of purchase is stopped or revised or modified, then the agreement will automatically come to an end or partly continues for which supplier is not entitled to demand/ receive any type of loss amount or cannot initiate any legal proceedings against PAPSCO.

13. SPECIFICATIONS a) Only good quality of Crackers, Sparklers, Chakra, Flower Pots & Walas, Fancy Comets,

Gift Box, Match Box, Roll Caps, etc., manufactured in India with the procedures and guidelines prescribed will be accepted.

b) Stocks conforming to the specifications will only be accepted. Stocks not conforming to specifications stands summarily rejected and it is the responsibility of the supplier to take back the rejected stocks and replace the stock conforming to the specifications at the earliest but not beyond 2 days at the own risk and cost. Otherwise, the necessary penalty/damage/demurrage will be charged, for which, the PAPSCO reserves the right and PAPSCO will not take any responsibility or otherwise once the stocks are rejected.

c) No banned crackers and unspecified varieties, sound, size, etc., whatsoever existing or be declared from time to time by the Government of India will be accepted; and even if order was placed for such items, on receipt of communication by any means received will be cancelled;

d) The onus rest on the approved supplier from time to time during the supply, in the

capacity of manufacturer and trading the Crackers, Sparklers, Chakra, Flower Pots & Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc.

e) PAPSCO will not be responsible for such trading of banned items which is supplied

by the approved supplier and any penalty thereupon, litigation, cost of expenditure, loss to the PAPSCO should be borne by the approved supplier for his default.

f) Bidder should demonstrate the samples of Crackers, Sparklers, Chakra, Flower Pots

& Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc., on the need of PAPSCO either before the approving the quotation or even after effecting supply order or during the course of supply.

g) If the demonstration not satisfies the specifications of the Crackers, Sparklers, Chakra, Flower Pots & Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc.,




PAPSCO reserves the right to reject the quotation/cancel the supply order and liquidate the damages from its bill and block list.

h) Supply may be subjected to quality analysis and the PAPSCO at its discretion shall send samples of any consignment to the accredited or any other laboratory for analysis. In such cases, the result of accredited/lab is final.

i) If the lab report/statements confirms that the quality of the products fails to the prescribed specification or the quality of the products supplied was unfit for trade, PAPSCO reserves the right to either charge penalty (or) to withhold the payment (or) the payment will not be made for the specific consignment or for the entire supply order, as the case may be, which is at the discretion of PAPSCO and should not be disputed by the supplier.

14. PACKING

a) The contents of the Crackers, Sparklers, Chakra, Flower Pots & Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc., shall conforming to the packaging rules in vogue prescribed for the trade.

b) Supply of carry bags should be at free of cost to meet out the entire quantity sale to the

public. Only of approved supplier bag will be entertained. Labeling on the bag, if any, should be as per the instructions of PAPSCO and not of the bidder or other third parties. In case of any deviation in this regard, the supplier will be blacklisted and the supplier only be responsible for any consequences arising out the deviation.

15. DURATION AND PLACE OF DELIVERY a) The supplier should deploy a representative of its firm throughout the supply period. b) The supplier should start the supply of the ordered quantity of selected/approved

crackers/ sparklers, etc. within the stipulated period as per specification prescribed and complete delivery should be made at the specified places of M/s. PAPSCO at the respective region viz., Godowns at Puducherry & Karaikal or any other place/unit within 15 days before Deepavali festival from the date of acceptance of offer and delivery should start within 3 days of from the date of issue of supply order by the Corporation at the agreed rate including transportation and other expenditure.




16. PENALTY ON DEFAULT/EXTENSION OF TIME

a) The entire ordered quantity of selected/approved crackers/sparklers, etc. should be supplied within the stipulated time at the respective region. No extension of time will be granted for supply of beyond the specified date fixed.

b) But in exceptional circumstances and if it is sufficiently proved that the delay in supply is due to the circumstances beyond the control of the suppliers, extension of time will be granted at the discretion of the PAPSCO subject to the following conditions:

(i) A penalty of 5% of the value of the quantity of the products supplied at the region concerned after the due date fixed at the time of payment, according to the veracity of the default of the supplier.

(ii) If the supplier requires an extension of time for completion of the contractual supply, on account of occurrence of any hindrances, he shall apply in writing for extension on occurrence of hindrance but not after the stipulated date of completion of supply.

(iii) The PAPSCO may extend the delivery period with or without liquidity damage in case they are satisfied that the delay in the supply of goods are on account of hindrances beyond control, such reason shall be recorded while granting extension.

b) Supply of stock less than the ordered quantity is not permitted. If the ordered quantity is not supplied in full, the besides blacklisting, the pending bills if any will not be settled.

c) In the event of failure to supply the ordered quantity by the successful Bidder within the stipulated time, the PAPSCO reserves the right to cancel the orders for the unsupplied quantity and place orders with the remaining suppliers for the supply of the said quantity or purchase the unsupplied quantity through limited quotation system at the risk and cost of such supplier and the supplier is liable and responsible to make good the financial loss sustained by PAPSCO. If the rate in this case is cheaper the benefit will not accrue to the supplier.

d) In the event of failure by the successful bidder (L1), PAPSCO is at liberty and also reserves the right to purchase the ordered quantity from the next lowest bidder(s)(L2) to ensure uninterrupted supplies. In such circumstance, the differential cost, transport charges, incidental charges and other excess expenditure, if any, will be recovered from the successful bidder (L1). If the rate is cheaper, the benefit will not accrue to the supplier.




e) PAPSCO reserves the right to charge penalty or withhold payment for any

unsatisfactory stocks of supplied by the supplier for any consignment without prejudices to other rights and the decision of the PAPSCO is final and cannot be called into question. The supplier is liable to reimburse/compensate PAPSCO or to third party for any loss, damage, injury, etc caused or arising out of the negligence in supply of low or inferior quality of stocks or any breach of contract.

f) Notwithstanding anything contained in the terms and conditions of this Applications and Quotatiosn called for the PAPSCO is the ultimate authority in deciding the recovery of penalty from the supplier taking into account the stock position and future requirement of supply in the larger interest of PAPSCO.

17. RETURN OF UNSOLD GOODS;

a) PAPSCO will not be responsible for any slow sale/non sale of the product of the supplier, which may be due to the impact of the demand, competition, brand identity, good will, etc., of the product.

b) The supplier should take back the unsold goods of their products supplied for Deepavali

Bazaar 2021 immediately after the close of Deepavali Bazaar or the date specified by PAPSCO, for which, the entire transportation and other costs should be borne by the supplier and the bill should be reduced to that extent towards purchase price.

18. FURNISHING INFORMATION

a) Supplier shall obtain the details of schedule of dates, quantity of items, etc., to be supplied from PAPSCO, Puducherry and supply accordingly.

b) Supplier should inform and confirm PAPSCO, the quantity to be supplied well in advance by a day (i.e) prior to the day of supply.

c) PAPSCO may undertake pre-dispatch inspection of stock by representative of its

own office or any other Govt./Private Agency entrusted for that purpose at the premises where from the supplies are going to be made at the respective region.

d) Supplier shall furnish a daily report to the authorized Officer at the respective region on supply of stocks truck wise and destination wise quantity delivered through e-mail and Fax also.

e) Supplier should maintain complete account of supplies made and also furnish the details as and when requested by the authorized Officer of the respective region.




19. ADVERTISEMENT: The advertisement charges should be borne by the approved supplier. The

advertisement should be as per the informations provided by PAPSCO. 20. FORCE MAJEURE

a) In any of the force majeure circumstances, namely act of God, natural calamities, fire, Govt. of India’s policy, Govt. of Puducherry’s policy, any restriction imposed by State/Central Government (excluding any stock limits), strikes or lock out by workers, war, military operations of any nature and blockades preventing the Seller/Buyer, the performance of the contract shall be extended for as long as these circumstances prevail by PAPSCO.

b) In the event of the circumstances, if the continuation takes place for more than three months, the party can have the right to refuse its contractual obligations without title to indemnification of any losses which it may thereby sustain. The party which is unable to carry out its contractual obligations shall immediately advise the other party of the commencement and the termination of the circumstances preventing the performance of the contract.

21. BLACKLISTING AND RECOVERY OF LOSSES

a) In the event of failure by the bidders at any stage of quotations process/supply the PAPSCO apart from cancellation of quotation/award of contract and blacklisting, recover the consequential losses, if any, and Earnest Money Deposit/Performance Security or Bills of supply will be forfeited apart from cancellation of award of order and blacklisting.

b) If it comes to know that the bidder selected is already blacklisted and not eligible at the time of this bidding, the selected bidder order will be cancelled by PAPSCO for the respective region besides black listing and recovery of consequential losses, if any, sustained by the Corporation on calling of another limitation quotation, etc. as the case may be.




22. PAYMENT

a) The bills/Invoices falling in line with GST Invoice Rules 2017 and compliance thereof for Interstate/Intrastate, way bill, etc., as the case may be, should be submitted in triplicate, along with acknowledgement along with quality certification and advanced stamp receipt duly verified by the Official Incharge of PAPSCO at the respective region of the Deepavali Sirappu Angadi (DSA) venues in Puducherry and Karaikal Region or any other place specified by PAPSCO, Puducherry.

b) The supplier shall comply with the GST Returns to be filed as per GST Rules 2017 as applicable from time to time and any delay and its resultant loss, if any, shall be adjusted in payment.

c) The cash discount and credit period discount may be specified by the bidder; which

may be considered by PAPSCO on its own discretion and the bidder shall not question.

d) Payment of interest on late payment of bills etc. will not be acceptable.

e) No advance payment of any kind for the supply of the products will be made to the bidder.

f) No right to claim any payment before completion of the supply order. However, any payment according to the work completion may be made at the discretion of the PAPSCO in fair manner.

23. SUB-LETING: The supply contract awarded should be executed by the successful bidders

only and sub-letting any of the functions under the contract is not permitted.

24. INDEMINITY: The bidders shall indemnify the Corporation against all claims which may arise in supply of inferior and low quality of selected/approved products.

The rate quote should be for per box/ inclusive of rate per box/pack, packing charges, GST (IGST or CGST or SGST) as applicable from time to time and any other statutory taxes as applicable, discounts, all expenditures of loading charges at their point, transportation to the specified PAPSCO Godown of Puducherry/Karaikal at or any other places/units specified by PAPSCO, transit insurance and unloading charges, etc. at and upto the specified places. The bidder has to bear the additional taxes or any other duty imposed by the Government from time to time.

The rate may be quoted in the prescribed proforma appended below for the products/items/ brands which are all they deal and eligible for Crackers, Sparklers, Chakra, Flower Pots & Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc. The rate quoted shall be in Indian Rupee and would be in force for the entire contract period. PAPSCO is not responsible for any fluctuation of prices either in Domestic Market or International Market and no request or representation for revision of rate will be entertained. The cash discount and credit period discount may be specified by the bidder; which should not be included as component of the rate quoted; which may be considered by PAPSCO on its own discretion and the bidders shall not question.

The rate contract is for the entire 2 months supply period of October’21 and November’21 and PAPSCO reserves the right to extend the contract period to further 3 months or more (or) to reduce to any extent at the accepted rate or at the rate at which specified by the PAPSCO subject to its requirement and decision.

ANNEXURE-II FINANCIAL UNDERTAKING

I/We, on behalf of M/s. _________________________________________ solemnly declare that we have submitted all the documents as mentioned in the Application and Quotation called for. We also understand that non compliance of any documents will be treated as non-respective bidder and we will lose our claim to participate in the Quotation Enquiry automatically and our quotation is liable to be rejected.

I/We have clearly understood all the terms and conditions of the Application and Quotation called for and agree to undertake the supply of Crackers, Sparklers, Chakra, Flower Pots & Walas, Fancy Comets, Gift Box, Match Box, Roll Caps, etc., at the rate quoted by me/us at the destinations specified by PAPSCO at the respective region.

I/We shall assure that I/we shall strictly abide by the terms and conditions and the instructions issued by PAPSCO from time to time. I/We have clearly understood that In the event of failure to supply the ordered quantity by as in case of successful bidder within the stipulated time, PAPSCO reserves the right to cancel the orders for the unsupplied quantity and place orders with the remaining suppliers for the supply of the said quantity or purchase the unsupplied quantity through limited quotation system at the risk and cost of such supplier and the supplier is liable and responsible to make good the financial loss sustained by PAPSCO. If the rate in this case is cheaper the benefit will not accrue to the supplier. Further, In the event of failure by us as the successful bidder (L1), PAPSCO is at liberty and also reserves the right to purchase the ordered quantity from the next lowest bidder(s)(L2) to ensure uninterrupted supplies. In such circumstance, the differential cost, transport charges, incidental charges and other excess expenditure, if any, will be recovered from the successful bidder (L1). If the rate is cheaper, the benefit will not accrue to us.

ANNEXURE – III COMPLIANCE WITH THE CODE OF INTEGRITY AND NO CONFLICT OF INTEREST

Any person participating in procurement process shall –

i. not offer any bribe, reward or gift or any material benefit either directly or indirectly in exchange for an unfair advantage in procurement process or to otherwise influence the procurement process;

ii. not misrepresent or omit that misleads or attempts to mislead so as to obtain a financial or other benefit or avoid an obligation.

iii. not indulge in any collusion, Bid rigging or anti-competitive behaviour to impair the transparency, fairness and progress of the procurement process;

iv. not misuse any information shared between the procuring Entity and the Bidders with an intent to gain unfair advantage in the procurement process;

v. not indulge in any coercion including impairing or harming or threatening to do the same directly or indirectly, to any party or its property to influence the procurement process;

vi. not obstruct any investigation or audit of a procurement process;

vii. disclose conflict of interest, if any; and

viii. disclose any previous transgressions with any Entity in India or any other Country during the last three years or any debarment by any other procuring entity.

CONFLICT OF INTEREST

The Bidder participating in a bidding process must not have a Conflict of Interest. A Conflict of Interest is considered to be a situation in which a party has interests that could improperly influence that party’s performance of official duties or responsibilities, contractual obligations, or compliance with applicable laws and regulations.

i. A Bidder may be considered to be in Conflict of Interest with one or more parties in a bidding process if, including but not limited to;

a. have controlling partners/shareholders in common; or

b. receive or have received any direct or indirect subsidy from any of them; or

c. have the same legal representative for purposes of Bid; or




d. have a relationship with each other, directly or through common third parties, that puts them in a position to have access to information about or influence on the Bid of another Bidder, or influence the decisions of the Procuring Entity regarding the bidding process; or

e. the Bidder participates in more than one Bid in a bidding process. Participation by a Bidder in more than one Bid will result in the disqualification of all Bids in which the Bidder is involved.

f. the Bidder or any of its affiliates participated as a consultant in the preparation of the design or technical specifications of the Goods, Works or Services that are the subject of the Bid; or

g. Bidder or any of its affiliates has been hired (or is proposed to be hired) by the Procuring Entity as engineer-in-charge consultant for the contract.
