    a) the details of demands put forward by teaching and non-teaching staff of Jawahar Navodaya

    Vidyalayas;

    (b) the date from which the demands of the representatives of various staff associations of these

    vidyalayas would be considered in a time-bound manner and by when this process would becompleted; and

    (c) the reasons for not considering their demands so far?

    (a)&(b) The teaching and non-teaching staff of some of the Jawahar Navodaya Vidyalayas

    (JNVs) had proceeded on strike with effect from 6.02.2013 for fulfillment of various demandsrelating to their service conditions. The studies of the students were seriously disrupted due to

    this strike close to the annual examinations and it was of serious concern to the Government as

    Jawahar Navodaya Vidyalayas have been set up to enable talented students from rural areas toprogress at faster pace to compete with their urban counterpart on an equal footing. After

    detailed discussions with the representatives of various Staff Association of Jawahar Navodaya

    Vidyalayas, the strike was called off with effect from 15.2.2013 with an assurance to the

    employees for a sympathetic consideration of all the genuine demands. A list of 23 demands putforward by teaching and non-teaching staff of Jawahar Navodaya Vidyalayas is annexed.

    2. The major demand of the employees was for introduction of Pension-cum-GPF Scheme underPension Rule 1972 for the employees recruited before 1.1.2004. For this inter-ministerial

    consultations have already been started and are presently at an advanced stage. Some demands

    related to service conditions like up-gradation of pay scales, sanction of additional posts, some

    allowances and other miscellaneous demands relating to day to day working conditions of theJNVs.

    3. Detailed discussions have already been held by the Ministry and the Navodaya Vidyalaya

    Samiti with the representatives of the employees. Several demands require consideration bydifferent Ministries/Department of Government of India and Navodaya Vidyalaya Samiti (NVS).

    15 of the 23 demands have already been settled.

    The First Meeting of Joint committee on MACP was held on 25-5-2010 . Altogether 8 issues

    related MACP anomalies were discussed in the meeting.

    The MACPS (Modified Assured Career Progression Scheme) order was issued on 19-5-2008.

    Since then all the Central Government Employees Federations, confederations are demandingthat Grade Pay of the next Promotional Post to be granted under the new MACP Scheme instead

    of granting next higher Grade Pay in the revised Grade Pay Hierarchy.

    Now it has been informed through the circular published by confederation that the above saidcore issue of MACP was taken for discussion in the meeting. Staff side pressed for placement in

    the Grade Pay of the Promotional Post instead of next higher Grade Pay in the hierarchy of

    revised Pay Band and Grade Pay. It was insisted because the career progression only means thepromotion in the hierarchy and not to a Grade Pay which is not present in the hierarchy of the

    respective department.

    But after that, it is believed that the Staff Side also gave an alternative that first two MACPs after

    10 and 20 years should be to the next promotional post as per the hierarchy of respective

    department as under the erstwhile ACP scheme and thereafter the third MACP in the next GradePay of the Revised Pay Band and Grade Pay.

    Why should the Staff Side compromising their position of demanding promotional Grade Payunder MACP,by suggesting that first two MACP should be in promotional hierarchy and third

    MACP can be in Grade Pay hierarchy?

    AGENDA ITEMS FOR JOINT COMMITTEE ON MACP SCHEME

    I. Financial Upgradation under MACPS in the casse of staff joined another

    Unit/Organisation on request

    Under the old ACP Scheme which was effective from 1.10.09, the regular service rendered in theprevious organisation shall be counted alongwith regular service in the new organisation in those

    cases of staff joined another post/organisation on own request even in lower post.

    But in the MACPS such benefit of financial upgradation (hitherto allowed) is not admissible.

    This needs to be reviewed and the extant provision suitably amended facilitating continuance of

    financial upgradation benefit.

    II. Denial of Benefit on Account of Para 8.1 of MACPS

    Para 2 of the MACPS contained in DOPT O.M. No. 35034/3/2008-Estt. (D) dated 19.5.2009

    envisages merely placement in the next higher pay. In terms of this para, the staff in certain

    departments who are already in Grade Pay of Rs. 4500/- should legitimately be placed in the next

    Grade Pay of Rs. 6600/- in PB-3 on fulfilment of the stipulated years of regular service.

    However vide Para 8.1 of the MACPS it has been stated that the Grade Pay of Rs. 5400/- in PB-2

    and PB-3 shall be treated as separate Grade Pay for grant of financial upgradation. Thisstipulation has resulted in denial of benefit to those who are placed in Grade Pay of Rs. 5400/-.

    It would therefore be necessary to suitably amend or delete para 8.1 of the MACPS.

    III. Counting of Training Period for MACPS

    In certain departments, the staff are recruited for the purpose of imparting induction training andthere after absorbed as regular staff. During the period of training stipend is paid to them. This

    training period is counted as part of service under the extant provisions for pensionary benefits,

    annual increments etc., Hence, the period of training should be counted along with regularservice for the purpose of MACPS.

    IV. Staff re-deployed in other Cadres/Organisations consequent upon their MedicalDecategorisation

    There are medically decategorised (Railways) re-deployed in the lower posts in other

    cadres/departments. Under the 2 ACP concept, the previous service in the higher grade isallowed to be counted for ACP benefit. In the present MACPS, there is no such provision.

    Suitable amendment to MACPS be made for extending the benefit of financial upgradation to the

    medically decategorised employees re-deployed in lower grade posts.

    V. Application of MACPS to the Surplus Staff Re-deployed to lower posts in other

    Cadres/Organisations.

    The extant provision in the MACPS is not clear in regard to counting of service in the previous

    post/cadre in the case of surplus staff re-deployed in the lower grade posts.

    Clear clarification is needed for reckoning the previous service and equally for protecting theirpay.

    VI. Anomalous situation surfaced in the Course of implementation of MACPS:-

    Illustrations highlighting the occurrence of anomalous situations are given below:-

    Pension Scheme for the employees of Jawahar Navodaya Vidyalayas (JNVs)

    Number of various categories of posts in teaching as well as non-teaching categories in the

    Jawahar Navodaya Vidyalayas..?

    Whether persons appointed in JNVs prior to the year 2004 in teaching as well as non-teaching

    categories are not getting pension after retirement..?

    The Ministry has replied to the questions above mentioned in Lok Sabha on 13.3.2013 as under...

    "The number of teaching as well as non-teaching categories of posts sanctioned in the Jawahar

    Navodaya Vidyalayas (JNVs) in the country is given below:-

    The employees of JNVs appointed before 01.01.2004 have not been found eligible for the grant of

    pension under the CCS (Pension) Rules, 1972 as the Navodaya Vidyalaya Samiti (NVS), an

    autonomous organization, was registered after 01.01.1986, the cut-off date for determining the

    eligibility of employees of autonomous bodies, for pension under CCS (Pension) Rules, 1972. These

    employees have been representing for this pension and some sections of them had proceeded on

    strike with effect from 06.02.2013 for fulfillment of their demands, of which the major demand

    related to grant of pension. The strike has since been withdrawn with effect from 15.2.2013 after

    assurances from the Government that all their legitimate demands would be sympathetically

    considered in a time-bound manner.

    The Government has approved the introduction of the New Pension Scheme (NPS) for all the

    regular employees of the NVS, joining on or after 1.4.2009. Those employees who had joined the

    Navodaya Vidyalaya Samiti on a regular basis before 1.4.2009, including those appointed prior to

    the year 2004, shall have the option either to continue with the existing Contributory Provident

    Fund Scheme or to join the New Pension Scheme".
