Acquisition of Land Act 1967 TAKING OF EASEMENT NOTICE BY THE MINISTER

(No 04) 2016Short title

1. This notice may be cited as the Taking of Easement Notice by the Minister (No 04) 2016.Easements taken [ss.6 and 9(7) of the Act]

2. The easements described in Schedule 2 are taken by Fraser Coast Regional Council for drainage purposes and vests in Fraser Coast Regional Council on and from 29 July 2016.

Rights and obligations3. That the rights and obligations conferred and imposed by each

easement include the matters set out in Schedule 1.SCHEDULE 1

1. PARTIESIn this Easement:-a. “the Owner” means each registered owner of an interest in the land

burdened by the easement and its successors in title from time to time;

b. “the Council” means the Fraser Coast Regional Council and its successors from time to time;

c. “the Easement Area” means area of land affected by the easement in the lot burdened by the easement.

2. RELEVANT WORKSIn this Easement the expression “the relevant works” means overland or underground drains, pipes, conduits and channels for the passage or conveyance of rainwater and other lawful discharges to local authority drainage through, across or under the Easement Area together with

protection and/or support of all such things.3. RIGHTS OF THE COUNCILThe Council shall have the full and free right and liberty at all times (by day and by night) and from time to time hereafter to enter upon the Easement Area for the purpose of constructing and thereafter forever

from time to time and in so doing the Council by its employees agents and other persons authorised by it with or without motor cars lorries wagons trucks cranes earth moving or earth digging equipment shall have the right to:-a. construct install extend deepen widen cleanse add to remove inspect

maintain and repair the relevant works and when and where thought

relevant works (whether of a similar nature to those replaced or not);

b. dig into sink shafts in and erect scaffolding upon the Easement Area and to open and break up the soil of the Easement Area or any part thereof including the sub-surface thereof;

c. remove and dispose of spoil created as a consequence of the Council exercising its rights hereunder;

d. clear and keep clear the Easement Area by any means or method and to cut and remove timber trees and undergrowth from the Easement Area and to burn off such timber trees and undergrowth;

e. construct and maintain on the Easement Area such access tracks gates and appurtenant works as the Council considers necessary;

f. enter upon and remain pass and repass on and over the Easement Area for all or any of the purposes aforesaid with or without vehicles plant and equipment of any description whatsoever;

g. enter and exit to and from the Easement Area over such part or parts of the Owner’s land adjoining or adjacent to the Easement Area as the Council considers most convenient or necessary for the purpose of passing between the Easement Area and the most convenient point of entry to or exit from the Owner’s land (whether adjoining a constructed road or not);

h. do such other works and things through across in or under the Easement Area as are incidental to the proper exercise of the rights granted to the Council hereunder.

4. PROPERTY IN RELEVANT WORKSAll the relevant works are and remain the property of the Council

Area and the Council shall be solely responsible for the operation and maintenance of all the relevant works.5. NOTICE TO BE GIVEN BY COUNCILThe Council shall (whenever practicable) give reasonable notice to the Owner of its intention to enter upon the Easement Area for the purpose of exercising its rights granted under this Easement PROVIDED ALWAYS that in the case of an emergency the Council shall not be required to give any such notice to the owner as aforesaid.6. REMOVAL OF FENCINGFor the purpose of gaining access to the Easement Area the Council shall be entitled to pull down or break open any fencing on or adjacent to the Easement Area but where livestock are contained within the

livestock to be secured.7. REINSTATEMENT OF FENCINGThe Council must either:-a. reinstate all fences where the same have been damaged by the

Council in the exercise and performance of any of its rights and liberties granted herein; or

b. in lieu of reinstating any such fence install a gate the quality of the materials and workmanship of which except with the Owner’s consent shall be no less than the quality of the materials and workmanship in the existing fence. A gate so installed shall become the property of the owner of the fence in which the gate is installed and thereafter shall be maintained by the Owner.

8. NO STRUCTURES ETC ON THE EASEMENT AREAThe Owner shall not at any time without the express written permission of the Council:-a. erect any buildings or structures (other than fences) upon the

Easement Area or any part thereof or otherwise permit the Easement Area or any part thereof to be used in such a way as to obstruct or interfere with the relevant works and/or the proper and effective use thereof by the Council;

b. install concrete bitumen or other pavements or driveways on the Easement Area or gardens or landscaping involving concrete brick or other permanent materials;

c. remove or stockpile or permit the removal or stockpiling of any soil sand gravel or other substance or material on the Easement Area or construct any roads dam walls or other earthworks on the Easement Area which would in anyway obstruct or interfere with the relevant works and/or the proper and effective use thereof by the Council.

d. The Owner shall not at any time without the express written permission of the Council permit any vegetation to grow or to remain on the Easement Area other than grass which is to be kept

properly mown by the Owner at all times.10. DAMAGE TO STRUCTURES ETCThe Council shall in its sole discretion determine how and in what manner the rights of the Council hereunder are exercised. The Council must not wilfully damage or destroy any matter to any extent greater than is reasonably necessary in order to exercise the Council’s rights hereunder but (unless otherwise expressly provided herein):-a. the Council shall not be otherwise responsible for any damage to

or destruction of any matter in the course of the exercise by the Council of its rights hereunder;

b. the Council shall not be under any obligation to reinstate or repair any matter damaged or destroyed in consequence of the exercise by the Council of its rights hereunder and its only obligation where any such matter has been so damaged or destroyed shall be to leave the Easement Area in as clean and tidy a state as is practicable having regard to the nature of the matter which has been damaged or destroyed and the work which it has done;

c. the Council shall not be responsible in any event for any inconvenience or disturbance to the Owner or the occupier of the Easement Area arising out of the course of or by virtue of the exercise by the Council of its rights hereunder.

In this clause the term “matter” means buildings structures or other materials or things erected placed found or installed upon the Easement Area (whether in contravention of Clause 8 or otherwise) and vegetation within the Easement Area.11. REMOVAL OF UNAUTHORISED STRUCTURESIf a building structure or other material or thing is erected placed found or installed upon the Easement Area in contravention of Clause 8 the

given the Owner reasonable notice of its intention to invoke this clause enter upon the Easement Area and remove or demolish the relevant matter and if it does so:-a. it may dispose of the relevant matter or any resultant demolition

account to the Owner therefore (except as provided in Clause 11 b. hereof); and

b. it may recover in any Court of competent jurisdiction costs actually incurred by it in taking that action (including internal wage and salary costs) less any money actually received by it as a result of disposing of the relevant matter or any resulting demolition materials.

12. PROTECTION OF RELEVANT WORKSThe Owner shall not do any act or make any omission likely to jeopardise or prejudicially affect the safety or reliable working of the relevant works.13. FURTHER ASSURANCES

Easement Area so as to ensure to and bind all persons deriving title thereto from and under the Owner and the Council respectively and the Owner shall whenever required by the Council or the person or

all such things and give all such assurances as are reasonably required to effectuate the rights conferred hereunder but not so as to render the Owner liable to be called upon by the Council to contribute towards the maintenance and upkeep of the relevant works.14. COSTSThe costs and outlays (including any surveyor’s fees and mortgagee’s consent fees) of and incidental to the preparation stamping and registration of this Easement shall be paid by the Council.

THE SEAVIEW HOTEL, 65 PIER AVENUE, SHORNCLIFFE (TLPI 04/16)

At its meeting on 2 August 2016, Brisbane City Council adoptedTLPI 04/16 which will commence on 5 August 2016 and ceaseto have effect at the end of 4 August 2017 (unless repealed atan earlier date).

Purpose and General Effect

TLPI 04/16 is intended to protect the Seaview Hotel andnominated adjoining land. It facilitates assessment of thesuitability of development or reuse of land at 65 Pier Avenue oron adjoining land until Brisbane City Plan 2014 (City Plan) isamended to provide protection under the Heritage overlay andHeritage overlay code.

TLPI 04/16 will implement policies in the Strategic framework of CityPlan. This includes contributing to Brisbane’s outstanding lifestyleby ensuring that development or reuse of the Seaview Hotel oradjoining land will not detract from the cultural heritage significanceof the Seaview Hotel, including any Aboriginal cultural values.

TLPI 04/16 applies to the following properties at Shorncliffe:

• 65 Pier Avenue, described as Lots 2 to 5 on RP4520, Lot 4on RP4519 and that part of Seaview Lane sharing acommon boundary with Lots 1 to 4 on RP4520, Lot 3 onRP4530, the northern boundary of Lot 4 on RP4519 and thesouthern boundary of Lot 5 RP4520;

• 53 Pier Avenue, described as Lot 1 on RP4520;

• 56 Yundah Street, described as Lot 3 on RP4530;

• 62 Yundah Street, described as Lot 1 on RP42404; and

• 15 Seaview Lane, described as Lots 1 to 6 on SP208433.

Current development approvals over these properties will notbe affected by TLPI 04/16.
