Queensland Skilled Occupation List (QSOL) Skilled – Nominated (provisional) – subclass 489 Effective date: 3 September 2014 The State of Queensland provides nominations to skilled migrants with skills in demand who can make a contribution to Queensland’s economy. Requests for Queensland nomination for skilled visas are usually processed within two weeks, once your full application has been received by BSMQ. To be eligible for Queensland nomination, applicants must: Meet the eligibility criteria set by the Australian Department of Immigration and Border Protection. Have an occupation on the QSOL for visa subclass 489 and meet any necessary requirements or specialisations for that occupation. Applicants must hold a valid license, registration or membership that allows them to work in Queensland. Have a positive skills assessment in your nominated occupation from the relevant Australian assessing authority that is three months or greater from its expiry date and eligible for migration purposes. Validity periods and assessing authority details can be found at www.immi.gov.au/asri. Have sat the International English Language Testing System (IELTS) and scored at least a six (6) on each of the four bands (Writing, Speaking, Listening, Reading), noting that: o Certain occupations require a higher standard of English in order to obtain a positive skill assessment. Please refer to the assessing authorities' English language requirements. o For all occupations, applicants who hold a passport for the United States, United Kingdom, Republic of Ireland, Canada or New Zealand are not required to sit an English language test unless the registration/licensing body for that occupation requires an IELTS/OET test or the applicant requires additional points to meet DIBP requirements. − Submit a completed BSMQ application form which will be provided to you once you lodge an Expression of Interest on SkillSelect. A non-refundable application fee must be paid prior to finalising your application. Fees can be found at www.migration.qld.gov.au.

− Occupations have programme targets and when these places have been filled the occupation will be closed.

− Programme targets do not apply to applicants who meet the requirements outlined in the QSOL and are currently working in Queensland as per the “Offer of Employment” conditions as outlined below.

− The status of that occupation will be regularly updated to indicate whether applications are now being accepted.

− As BSMQ sends requests for further information to complete the application process to multiple people at the same time, applicants are encouraged to lodge a full and complete application before the programme target is closed. If this occurs, BSMQ will refund your application fee and close your application.

− BSMQ will not contact you if your occupation is opened at a later date.

− Applicants are encouraged to review QSOLs regularly to check the status of their occupation. It is at BSMQ discretion when programme targets will be opened or closed.

− Applications must apply for nomination by submitting an EOI through SkillSelect. Applicants seeking Queensland as their nominating state will be considered before candidates selecting ‘any state’.

− The QSOLs are regularly reviewed and updated to reflect current labour market conditions.

− Applying for nomination correctly does not guarantee you will be granted a nomination or a visa.

− Nomination is granted at the discretion of Business and Skilled Migration Queensland and once a decision has been made it is final.

− Business and Skilled Migration Queensland does not endorse any appeals to Department of Immigration and Border Protection or the Migration Review Tribunal.

− Offer of employment:

o The offer of employment must meet all of the following conditions:

Be in your nominated, or closely related occupation as defined by the Australian Skills Recognition definition;

Be based in regional Queensland, for visa subclass 489 this must be in an area outside of South East Queensland (please check eligible postcodes at www.immi.gov.au)

Be for at least one year; and

A minimum of 35 hours a week.

o The legitimacy of your job offer will be checked. If Business and Skilled Migration Queensland are not satisfied with the job offer, you will not be nominated.
