WHEREAS in and by section 3 of Chapter 3of the Acts passed by the Legislature of PrinceEdward Island in the 3rd Session thereof held inthe year 2001 and in the fiftieth year of OurReign intituled "An Act to Amend the CivilService Act" it is enacted as follows:

“This Act comes into force on a date to befixed by proclamation of the LieutenantGovernor in Council.”,

NATURAL PRODUCTS MARKETING ACT POTATO MARKETING PLAN REGULATIONS

AMENDMENT

(Approved by His Honour the Lieutenant Governor in Council dated 26 February 2002.)

Upon the recommendation of the Prince Edward Island Marketing Council and under authority of subsections 4(2) and (3) of the Natural Products Marketing Act R.S.P.E.I. 1988, Cap. N-3, Council made the following order:

1. Section 1 of the Natural Products Marketing Act Potato Marketing Plan Regulations (EC173/90) is amended

(a) by the revocation of clause (k) and the substitution of the following:

(k) “potato production unit” means any part of a farm unit which grows a minimum of 20 acres of potatoes and has the necessary land, buildings and equipment, as determined by Board policy, to carry on the activities of the production unit, or the activities of the production unit in conjunction with other activities of the farm unit;

(b) by the renumbering of the section as subsection (1) and the addition of the following:

(2) A potato production unit which is registered with the Board immediately before the date this subsection comes into force and which grows less than 20 acres of potatoes, is deemed to be a potato production unit and to be registered as such for the purposes of these regulations as long as it meets the other conditions of registration or until it is removed from the register pursuant to subsection 9(7).

2. These regulations come into force on March 9, 2002.

EXPLANATORY NOTES

This amendment increases the minimum potato acreage required for a farm unit to be recognized as a potato production unit, but permits existing production units to remain as production units.
