Prepare Resolution Town of Almond Local Bridge #04-19 Mr. Henry requested a resolution to approve funding for the bridge referenced below under the County/Town Cost Share Program- Resolution No. 65-95. Bush Road, Town of Almond, B.I.N. 2213880, Local Bridge #04-19 Total County Share 85% $382,500 Total Town Share 15% $ 67,500 Total Estimated Cost: $450,000 This request was approved on a motion by Legislator Curran, seconded by Legislator Ricci, and carried. Prepare Resolution Weidrick Road Bridge Update Mr. Henry gave the committee an update on the Weidrick Road Bridge in the Town of Wellsville. New York State DOT issued a Red Flag in November 2019 for deteriorated steel within some gusset plates. It was deemed the repairs were not feasible and the Town of Wellsville closed the bridge on the December 18. The bridge is scheduled for an LDSA Project and the department is still hoping to replace the bridge in the summer of 2020. There is a meeting scheduled for January 15, 2020, with the design consultant Foit-Albert and NYSDOT to discuss the cost estimates and the project schedule for the bridge replacement. Transfer of Funds

Mr. Henry requested a resolution transferring $29,000 from H1629.200 (Building Improvements-County Clerk) to H1903.200 (River Bank Repair-Courthouse) to cover a portion of the funding needed to repair the bank behind the Courthouse. Mr. Henry stated these funds were leftover from the County Clerk’s Office remodel. This request was approved on a motion by Legislator Healy, seconded by Legislator Ricci, and carried. Vegetation Control Contract Mr. Henry requested permission to extend the Vegetation Control Contract with Allen Chase Enterprises Inc. for the following approximate miles: Price for 690 edgeline miles to be covered: $15.396.00 Price per mile for 350 edgeline miles or more: $ 22.31 Price per mile for 350 edgeline miles or less: $ 37.22 Legislator Graves asked if these funds have been budgeted, and Mr. Henry stated, yes, and Allen Chase Enterprises did a great job last year. This request was approved on a motion made by Legislator Graves, seconded by Legislator Ricci, and carried. Request to Fill Summer Help Employees

Mr. Henry requested permission to hire summer help employees. Seasonal employees are critical and a vital part of the department’s operation. These employees are County residents that are either college bound or are already college students, and they provide “extra hands” to supplement our decreasing full-time workforce. These positions will be paid at the minimum wage rate of $11.80 per hour. Legislator Graves asked if they have a lot of recruits. Mr. Henry stated, yes, Mr. Scholes is working on who is available from last year, and they will then fill in the gaps. This request was approved on a motion made by Legislator Dibble, seconded by Legislator Graves, and carried. Refer to Ways and Means SOLID WASTE Request to Bid Services for Household Hazardous Waste Day Public Works Deputy Superintendent Dean Scholes requested permission to bid services for Household Hazardous Waste Day that will be held the first Saturday in September. asked if we are still receiving some reimbursement, and Mr. Scholes stated, yes. This request was approved on a motion made by Legislator Graves, seconded by Legislator Ricci, and carried. LSWMP Update Mr. Scholes stated they are finishing up the final review of the draft from Barton and Lajudice for the Local Solid Waste Management Plan that is required by the NYSDEC. The plan is an examination of current practices within the Planning Unit (Allegany County) to identify opportunities to reduce waste and increase recycling opportunities over a ten-year period. The plan will be developed at the local level, and will require review and approval by the state. Mr. Scholes hopes to receive plan approval by the end of the calendar year. Legislator Barnes asked what the current situation is with recycling. Mr. Scholes stated steel and scrap metal prices have fluctuated a lot, and gave credit to customers who do a great job separating their commodities which helps them get a better price. Legislator Decker asked what the issue is with caps on plastic bottles. Mr. Scholes stated not having the caps on the bottles helps ensure the bottles are completely emptied. Committee Chairman Fanton stated they are also a different type of plastic that is not considered recyclable. Legislator Harris asked if we have enough volume on scrap to store it until the market is advantageous to sell. Mr. Scholes stated they currently do not have any place to store scrap metal and explained that in the past, staff took the initiative to experiment with separating recycled scrap metal components by hand to increase the rebate to the County, but it proved to be too inefficient. BUILDING AND GROUNDS Courthouse Bank Update Mr. Henry stated the Courthouse bank has been stabilized. Committee Chairman Fanton congratulated the crew on a great job stating it looks good, and they also were able to use up some of our beams. Mr. Henry indicated they saved approximately $29,000 by using those beams. Weidrick Road Bridge Update Mr. Henry stated they recently had a meeting with a consultant as well as the DOT that resulted in the unfortunate news that the Weidrick Road Bridge in Wellsville will no longer be able to be constructed in 2020 and is now slated to begin in 2021. There was also a public meeting held at the Wellsville Library on January 29 that went well, and they are currently working with the Town of Wellsville to mitigate any problems that may occur from the bridge being closed for a long period of time. Legislator Graves asked if there will be a detour, and Mr. Henry stated, no. Legislator Graves asked if the closure will impact anything. Mr. Henry stated school buses; however, because of the three-ton limitation, the buses couldn’t use it anyways. As it stands, the biggest entity affected is Shorts Gas Station who don’t feel they are getting the same business from college students that they used to. Legislator Graves asked if there is any notable affect to public safety, and Mr. Henry stated, no. Legislator Ricci asked if the project being put on hold will affect any grant monies being received, and Mr. Henry stated, no. Legislator Barnes referenced the plan for replacement being different than what was discussed a year ago. Mr. Henry stated it was also decided in their meeting to make a final determination on the types of beams being used, adding that a year ago they were looking at replacing the trusses in-kind; however, it is no longer feasible due to cost restraints. Legislator Barnes asked how the estimated life of 75 years is determined. Mr. Henry stated that number comes from the DOT, and he is unaware of the criteria they use; however, it is the preventative maintenance that gets you to the life use. Committee Chairman Fanton indicated that we have a number of bridges that are older than 50 years throughout the County.

HIGHWAY Request to Fill HMEO II Position

Public Works Superintendent Justin Henry requested permission to fill one full-time Heavy Motor Equipment Operator II (HMEO II) (AFSCME, Grade 14) and all subsequent positions including hiring from the outside due to a retirement. This position is responsible for the operation of heavy equipment such as gradall, grader, and crane. The annual salary of this position is estimated between $38,238.59 and $46,647.95 with benefits estimated between $16,347 and $19,942. This position is funded 100 percent with County funds. Legislator Decker asked if we just filled one of these positions. Mr. Henry stated they are constantly filling positions and the position Legislator Decker is referring to was in District IV. Public Works Deputy Superintendent Dean Scholes indicated they will probably have four to five more retirements before the year ends. This request was approved on a motion made by Legislator Graves, seconded by Legislator Dibble, and carried. Refer to Ways and Means Re-Appropriation of CHIPS Funds

Mr. Henry requested a resolution adjusting the amount of SFY 2020-21 Consolidated Highway Improvement Program (CHIPS) funds to appropriate carryover funds remaining from 2019 in the amount of $86,817. The Budget adjustment is as follows:

Legislator Barnes asked what NOVA is. Mr. Henry stated it is oil emulsion with stone added to it. Legislator Graves asked if any of the bids are piggyback, and Mr. Henry stated, no. Legislator Hopkins stated she was under the impression that County Road 23 between Hume and Rushford was going to be done. Mr. Henry stated it is included in their 5-year plan; however, he is not sure what year it will be completed. The request to award the 2020 Material and In-Place bids was approved on a motion made by Legislator Graves, seconded by Legislator Dibble, and carried. 2020 Construction Mr. Henry distributed a project map that outlines the tentative 2020 planned construction projects. The committee collectively agreed that the map is very nice. Mr. Henry stated that Engineer Technician Rory O’Hagan created the map and did a great job. Permission to Lease Equipment Mr. Henry requested permission to lease equipment (paver and heavy duty roller) for the 2020 construction season per the rental quote that was distributed with the agenda. Legislator Decker asked if they will have them for the whole season and can towns and villages use them. Mr. Henry stated the towns and villages have used our equipment and that will continue. Legislator Curran asked if they are going to stick with renting in the future. Mr. Henry stated this is their year to try it and see how it goes, noting that a brand new paver is $500,000 and used pavers cost between $300,000 and $400,000. Legislator Curran indicated they have bought a used paver before. Mr. Henry stated they have; however, the difference is size. The paver being rented is 120 horsepower, and the previously purchased paver is only 40 and typically used for parking lots. Legislator Graves asked if the rental rates are state bid rates. Mr. Henry stated, yes, the bid is off OGS who always gives them a better price. Legislator Graves asked if the amount includes delivery. Mr. Henry stated, yes, the initial delivery is included. This request was approved on a motion made by Legislator Healy, seconded by Legislator Curran, and carried. Transfer of Funds – Equipment Rentals Mr. Henry requested permission to transfer funds in the amount of $19,800 from D5110.408 (General Supplies) to D5110.413 (Rentals – Personal Property). This request was approved on a motion made by Legislator Curran, seconded by Legislator Dibble, and carried. Notify County Treasurer Transfer of Funds – Under-Bridge Unit

Mr. Henry requested permission to transfer funds from Capital Account H5197 – DPW Highway Equipment & Capital Outlay to cover additional costs discovered upon inspection that are required to rebuild our current Aspen A-40 under-bridge unit. Resolution No. 34-19 established the Capital Project for this rebuild at the anticipated amount of the project. The transfer is as follows:

Legislator Healy asked if there is any type of warranty included. Mr. Scholes stated there is a three to five-year warranty on the unit, noting it is on a brand new chassis, and they expect it to have quite a life expectancy. Mr. Henry added there is a 6-month warranty on replacement parts. The committee briefly discussed the different uses of the equipment. This request was approved on a motion made by Legislator Dibble, seconded by Legislator Curran, and carried. TV Collection Event Mr. Henry announced a TV collection event to be held Saturday, March 7, from 8:00 a.m. to 3:30 p.m. at the Cuba/Friendship Transfer Station. Committee Vice-Chairman Ricci asked if there is a fee, and Mr. Henry stated, no. Mr. Scholes stated customers can bring up to two TVs at no cost, adding this event is specifically for televisions. The next electronics event will be held on April 25. Fiscal Manager Mr. Henry acknowledged the retirement of Fiscal Manager Yvonne Marks stating it is her last week, and she will be sorely missed as she has done a great job and was instrumental to their department. Legislator Graves stated they have appreciated her service to the County. Chairman Crandall continued this meeting is not open to the public, and any department heads with items to address are waiting in the hallway to be called in. Chairman Crandall stated they appreciate everyone’s patience as we work through COVID-19, and they’re glad to be able to conduct business. Mr. Henry requested a resolution to enter into a power purchase agreement for natural gas with Direct Energy Business Marketing, LLC (Direct Energy) covering a 32-month term (beginning January 1, 2021, ending August 31, 2023). The purchase price will be a “Fixed Price” of $3.405/Dth. This request was approved on a motion made by Legislator Dibble, seconded by Legislator Ricci, and carried. Public Works Superintendent Justin Henry gave a brief update on roads and bridge projects throughout the County. Mr. Henry stated they still have not received an update on whether or not they will receive 20 percent of CHIPS funding; however, they are still hopeful to receive it and have work lined up if they do. SOLID WASTE Local Solid Waste Management Plan Public Works Deputy Superintendent Dean Scholes distributed the draft Local Solid Waste Management Plan as well as a brief history to the committee for review. Mr. Scholes stated unless there are additional suggestions from the committee, he recommends moving forward with submitting the plan to the DEC. A motion was made by Legislator Graves, seconded by Legislator Decker, and carried to submit the draft Local Solid Waste Management Plan to the DEC for review. Purchase of Used Baler Mr. Scholes requested permission to purchase a used baler from Steuben County in the amount of $2,000. These funds are included in the Budget and will come out of Public Works .204 account. Mr. Scholes stated the County recycles loose paper and no longer has a vendor as the new company is no longer interested in purchasing our loose paper. This baler will allow them to bale the paper and sell it for market price plus $15. Legislator Harris asked how many tons of loose paper are generated. Mr. Scholes indicated that in 2019 there was 267 tons of loose paper, adding each bale is 1,200 pounds. BUILDINGS AND GROUNDS Mr. Scholes thanked the Village of Angelica Electric Department for helping them with the use of their bucket truck to tidy up some work on the front of the old Courthouse Building. Request to Fill HMEO I Position Mr. Scholes requested permission to fill one full-time Heavy Motor Equipment Operator I (AFSCME, Grade 13) position. This position is responsible for the maintenance and operation of specialized heavy motor equipment necessary to the daily operation of the County’s Solid Waste Recycling Program. The annual salary of this position is $37,074.89 with benefits estimated at $14,822.54. This position is funded 100 percent with County dollars. Mr. Scholes stated this position is tied to their request to fill from June when the Board stated that any requests to hire from the outside needed to come back through committee for approval when they reached that point in the hiring process. This request was approved on a motion made by Legislator Graves, seconded by Legislator Dibble, and carried. Refer to Ways and Means Household Hazardous Waste Day Mr. Scholes stated that Household Hazardous Waste Day will be held Saturday, September 19, from 8:00 a.m. to 12:00 p.m. at the County Landfill. Pre-registration is not required but strongly recommended by contacting Recycling Coordinator Timothy Palmiter. Legislator Barnes asked if this was advertised. Mr. Scholes stated, yes, they advertise in the local newspapers, online, and it’s always included in their annual newsletter. Legislator Barnes asked what is considered to be hazardous waste. Mr. Scholes stated mercury, solvents, dangerous items, etc., adding any questions or concerns can be directed to Mr. Palmiter. Town of Andover Bridge Legislator Healy suggested that the Town of Andover as well as the County look into naming the Town of Andover bridge in honor of Charles H. Joyce who passed away in 2013 and for all of the contributions he and his family have made not only to Andover but to the County as a whole. Legislator Graves stated he is happy to discuss this with the town. Mr. Henry requested permission to award the hauling of sand and salt for 2020 – 2021, and his request was approved on a motion made by Legislator Healy, seconded by Legislator Ricci, and carried. Mr. Henry noted that last year was the first year DPW performed sand/salt deliveries to towns in the northeast of the County. They started these deliveries to gain cost savings for the County by utilizing a current Livingston County contract to purchase salt directly from the salt mine. Mr. Henry continued that Livingston County does not participate with the OGS contract and because of that, their contract does not include delivery and salt is $42 per ton vs $56 delivered. Mr. Henry stated it worked out quite well, and after the material cost, mileage, equipment, and manpower, they still received a savings of approximately $9,000. Mr. Henry noted they plan to do the same thing for a total of three towns this year, and if projections work out, they are hoping to save roughly $60,000. Legislator Graves asked if they are essentially piggy backing, and Mr. Henry stated, yes. Legislator Healy stated it is always good to see a maximum efficiency of manpower in any of our departments. Update on Town of Birdsall, County Route 16, Black Creek Bridge (BIN#3047860)

Mr. Henry stated they entered the construction phase on the Town of Birdsall, County Route 16 over Black Creek Bridge (BIN#3047860) this season, and up until last Thursday it was going quite smoothly. Mr. Henry noted this is a Local Design Services Agreement (LDSA) project. Mr. Henry went on to say the day they were supposed to have four concrete beams delivered to their worksite, the first beam got hung up on the off ramp in Angelica in the early afternoon which caused some stresses to the beam. They were able to get it under control, make repairs, and move forward; however, later that same day at approximately 4:30 p.m. when installing the beam, there was a malfunction that caused the beam to drop and rendered the beam unusable. Mr. Henry stated he, personally, has been involved with this process many times and has never encountered anything like it. Mr. Henry stated he met with all parties involved as well as held an onsite meeting, adding they have worked through everything, and he is comfortable saying the County will not incur any extra cost. Unfortunately, the bridge will have to remain closed for the winter season which is an unfortunate delay; however, he is glad that not only did no one got hurt, there is no extra cost to the County. Committee Chairman Fanton stated with this being a federal project, there is no responsibility delivering or setting the beams, so there should be no cost as it’s the contractors responsibility. Legislator Dibble stated it’s a good thing no one was hurt or killed. Update on CHIPS Funding

Mr. Henry stated he has no new information since the recent memo regarding CHIPS funding that was sent out; however, after recently speaking with the Town of Genesee Supervisor Alex Smith who explained the predicament they are in, Mr. Henry offered to present to the committee an email Mr. Smith was going to send that explained their situation. Mr. Henry stated this email will show how fortunate the County was to pull out of the project before incurring any costs as one of our towns has already incurred the cost and are stuck with the bill. Legislator Dibble suggested they reach out to our Senator and Assemblyman on behalf of the Town of Genesee. Legislator Harris asked if the materials they purchased can be held over until next year, and if not, is it the type of material the County could purchase to alleviate their stress. Mr. Henry stated he is not 100 percent sure what the material is, but he assumes it’s an oil product which the County doesn’t purchase. Legislator Harris asked if a product like that will hold. Mr. Henry stated without knowing for sure what it is, he doesn’t know. Legislator Stockin indicated there are more towns than just Genesee that has experienced this.

SOLID WASTE Local Solid Waste Management Plan (LSWMP) Update Mr. Henry stated the DEC has reviewed the draft Local Solid Waste Management Plan prepared by Barton and Loguidice, and they are good to move forward with the Public Hearing. Mr. Henry requested approval to set the date of the Public Hearing to review the Local Solid Waste Management Plan. New Business Legislator Dibble suggested that Public Works apply for an Appalachian Regional Commission grant to send out a Request for Proposal for an engineering study to be done designating 32 miles of County road as scenic byway. Mr. Henry stated he has researched this as far as he can, noting it is a fairly large project and just the materials to widen the roads will cost approximately $4 million. Committee Chairman Fanton asked what an RFP will do for them. Mr. Henry stated it would be a one to two-page submittal that they would send out to five consultants on their short list to receive costs for engineers to perform a study for the total cost of the project. Legislator Ricci asked if there is a cost to the County to do an RFP. Mr. Henry stated, no, just time, adding it would be under 20 hours of man hours. Legislator Healy asked if they are working in conjunction with the Planning & Economic Development Committee. Legislator Dibble stated the objective is to have County development, and this is just stepping stone, adding he doesn’t see any County money involved at this point. Legislator Healy asked if this step is part of an overall plan that is in place. Legislator Dibble indicated he has been in touch with several entities to establish a committee. Legislator Root stated the newly established WNY Trails & Outdoor Recreation Advisory Committee would be great place for this to go as it works into their plan for trail development.
