AGENCY INFORMATION

The Division of Capital Asset Management and Maintenance (DCAMM), in collaboration with the Essex Sheriff’s Office, seeks to procure professional services from a design firm with broad experience in planning, certifiable building studies, design, and construction, to support DCAMM’s mission involving capital asset management and maintenance for correctional facilities. DCAMM is responsible for strategic planning and technical analysis to support decision making, programming and building studies for all phases of design, and construction.

The Essex Sheriff’s Office is responsible for pre-trial detainees and those sentenced for 30 months or less. The Essex Sheriff, Kevin Coppinger, operates three separate holding facilities in Essex County, with the Middleton Facility, at 20 Manning Avenue, being both the Headquarters and the largest facility, housing an average daily population of 1225 inmates.

PROJECT OVERVIEW

Project Background

The Commonwealth faces a formidable challenge in maintaining over 65 Million gross square feet of state-owned

facilities. A significant backlog of deferred maintenance within an environment of constrained resources poses

major hurdles to institutional operations.

Together with our user agency clients and design team, we need to prioritize critical projects and identify

innovative solutions to solve problems within a limited budget. Successful projects will employ innovative

solutions, enable resource-sharing between departments, explore options for operational efficiencies, build

flexibility and minimize portfolio expansion. We are seeking design partners willing to address this challenge with

creative solutions while balancing aesthetics, cost, functionality, and schedule.

Replacement of Existing Inmate Services Building

The Division of Capital Asset Management and Maintenance (DCAMM), in collaboration with the Essex Sheriff’s Office is seeking a Design Team with professional skills and expertise for the study, design and construction administration for the replacement of the existing Inmate Services Building at the Middleton Jail and House of Correction.

General Scope of Work

The purpose of the study is to replace the existing Inmate Services Building (ISB) which currently houses their kitchen and food service, medical and miscellaneous other operational support functions for the Middleton Jail and House of Correction, Middleton, MA. The existing ISB, an approximately 29 year old two story modular steel building has multiple building failures, is a candidate for replacement. The current ISB provides the following services to approximately 1225 inmates. None of these services can be

interrupted:

• Medical services

• Visitors, both family and attorney consultations

• Food services

• Administrative functions for the Jail, including IT

Because the jail site is very constrained, designing a replacement for the existing ISB will be a complex project,

requiring phased implementation. It will be necessary to identify how the inmates can be fed for the duration of

construction, where the various functions can be relocated in swing space, and the sequence of moves from the

existing building to swing spaces, and moving the functions back into the replacement facility or facilities.

The final product of the initial effort will be a certifiable Study that incorporates Schematic Design

The scope of work will include, but will not be limited to:

• Evaluation of current and future programmatic needs

• Review of best practices in the design of correctional institution facilities, with particular regard to security during construction projects

• Finalization of program

• Development of the preferred sequence of relocation, demolition, construction and restoration of the jail’s function in the new facilities

• Development of conceptual design building alternatives and selection of preferred alternative

• Development of preferred alternative

• The project will include study and schematic design services initially, with the intent to continue into design development, construction documentation and construction administration services for the recommended option identified by this Study, using a Construction Manager at Risk (CMAR) process

Middleton Jail and House of Correction Campus Plan

The Middleton Jail and House of Correction is located at 20 Manning Avenue, Middleton MA, off Maple Street

(Route 62). The entire campus was built in 1990, and a new Intake building added in 2014. Several cell block

buildings were built with precast modular cells. Other buildings in the facility were built with modular steel box

construction, with field-applied Exterior Insulated Foam System (EIFS) facades. These EIFS facades have been

problematic and are being replaced on several other buildings on campus through a separate project.

The Inmate Services Building (originally called the Intake Building) was one of the original modular steel box

buildings. The inmate intake function is now located in the newest building on the campus. The Inmate Services

Building now includes administrative spaces for jail staff, a room for people to visit inmates, small meeting rooms

for inmates to meet with their attorneys, video conferencing facilities, as well as IT rooms. It also includes the only

kitchen and related dining room, storage for the kitchen, and on the second floor, the infirmary for the entire

facility.

The Inmate Services Building also has a failing EIFS façade, though that is not the extent of its problems. Built with

a suspended concrete first floor on metal deck, the supporting steel beams are partially buried in the soil below.

Thus, there is no crawl space to provide access to below-floor systems. With a very intensive use, 365 days per

year, the plumbing systems, particularly the drainage system below the floor, have frequently failed and are very

difficult to service. These issues are complicated by the combination of food service and medical waste drainage.

Based on a study by Simpson, Gumpertz & Heger, working with Kleinfelder, along with discussions with the Essex

Sheriff’s staff about these and other issues with operating the building, DCAMM determined that the best course

of action to resolve the building’s problems would be to demolish and replace the Inmate Services Building.

Project Goals

The goal of this project is to replace the existing Inmate Services Building. Multiple scenarios for how the

renovation and/or addition to other buildings, the demolition of the existing building, then the construction of a

new building, or buildings, to house the functions provided in the Inmate Services Building, while also maintaining

these functions in alternate locations within the facility’s secure perimeter have been explored. The Designer

retained for this project will be required to evaluate these alternative scenarios, develop others, and recommend,

in conjunction with DCAMM and the Essex Sheriff’s staff, the most effective and efficient approach to executing

the project through to completion.

Program Components

The existing Inmate Services Building is a two story building, approximately 55,750 GSF, which includes the

following facilities:

• Kitchen

• Dining Hall

• Video Conference Room

• Staff Commander’s Room

• Women’s Transitional Room

• Inmate Visiting Room

• Parole Board office

• Detail officers

• IT

• Roll Call room (used at the beginning of each shift)

• Infirmary (entire second floor)

The actual Intake function is no longer in the ISB. A new one-story Intake building, built about 2014, is contiguous

with, and forms a part of, the secure perimeter of the facility. Structured to support a second floor, some program

elements could possibly be moved to this location.

The programming for the new building, or buildings, may incorporate all (less any relocated elsewhere) of the

programmatic functions listed above, but may also incorporate other program elements currently housed in other

buildings. The Designer will be responsible for working with the facility to establish the final program for the

replacement building(s), as well as options for relocation of program elements.

Strategic Implementation

One of the major design aspects of this project is how to implement the project while maintaining continuous

daily 24-hour operation of the facility. The jail’s population of inmates varies slightly but is approximately 1250

inmates. The kitchen provides about 1300-1500 meals, three times daily. This cannot be interrupted; Some

number of inmates require medical attention daily, and these services must be available throughout the duration

of the project; Inmates receive visitors every day, and as a legal matter, this opportunity must be provided.

Inmates confer with their attorneys regularly, and this must be maintained. This project requires the demolition of

the very facilities that house these critical functions. Therefore, development of a logical sequence of arranging

temporary facilities, moves, demolition, further construction and moving back in will be essential to the success of

the project. Development of outside services to supplement or replace the in-house services, for example,

catering meals, must be explored and verified as viable. Installing temporary facilities inside the secure perimeter

can be considered, if feasible. Discussion with the facility staff and leadership will be necessary to ensure everyone

completely understands what is going to happen and how it is going to work.

Existing Conditions

The Inmate Services Building currently incorporates all the functions listed above. In general, the condition of the

spaces in the building is serviceable, but very worn as one might expect from a heavily used building nearing 30

years old.

The exterior EIFS system, an early example of this method of façade construction, fails frequently, with large

sections of the façade simply falling away, occasionally pulled off by the suction generated by high winds. The

cementitious veneer on the insulation panels cracks, allowing the gypsum board backup to get wet because of the

lack of interior drainage in the foam cladding, and is failing. The building drainage systems run beneath the floor,

but since the steel floor beams supporting the floor rest in the dirt, there is no crawl space. To repair breaks in the

lines below the floor requires jack hammering open the floor, usually in the kitchen, and once the pipe has been

located, dug up and repaired, filling the hole in the floor. These drain lines carry both medical waste from the

Infirmary on the second floor and kitchen waste; there is clearly a danger of contaminating the food within the

kitchen area.

The second floor infirmary is not well organized for the functions performed there. There are both medical issues

resulting from fights between inmates and also infections, viral and otherwise. There are also inmates with

psychiatric issues and no appropriate facilities to house them.

The facility for visiting inmates is overly spacious, and not well organized.

The Roll Call room, which seats approximately 70 jail staff and is used at the beginning of every shift, is not ideally

suited for its purpose and should be evaluated for opportunities to relocate or replace.

The shift commander’s room is occupied by two officers working together in a crowded room.

The IT facilities are an adaptation of conventional rooms with supplementary air conditioning, and are typical of a

30-year old IT facility.

DRAFT STUDY PHASE

Task 1 – Project Start Up & Work Plan

Project Start Up:

• Attend an Administrative Conference to review all project requirements and DCAMM administrative and project management policies, procedures and protocols.

• Conduct a Study Workshop with DCAMM and user agency working group to review project goals and objectives, planning process, schedule of milestones, information and data requirements, etc. All design team members (including key sub-consultants) will be introduced to the user group, and their roles and responsibilities described. The Designer should assume bi-weekly working sessions throughout the duration of the study phase unless otherwise notified. The Designer is required to provide meeting minutes for all meetings, which are subject to review, editing and approval of the DCAMM Project Manager.

• Upon contract signing, the Designer, with DCAMM, will generate a Project Work Plan that will provide a detailed Scope of Work (SOW) including all required Tasks, Deliverables, Schedule and Fee Breakdown for this Study. Both DCAMM and the Designer will review and approve this Work Plan. During the course of the Study new opportunities or constraints may be uncovered and require a re-thinking of original intentions. If necessary, a memo will be issued outlining any revisions to the Work Plan that might be required. The Work Plan at a minimum will include:

- A statement of understanding of the vision, goals, scope, budget, and schedule for the project; - Confirmation of team members’ roles and their expected participation including MBE/WBE

participation; - Evaluation of the preliminary costs developed by DCAMM; - A detailed schedule of meetings and workshops through the study phase including key attendees,

draft topics agendas, projected time frames for design and construction, and permitting.

Task 2 – Program Development & Existing Conditions Documentation and Analysis

During this phase of the study, the emphasis will be on collecting and analyzing data and documentation which will inform the alternatives developed in Task 3.

Program

The Designer, with their sub-consultant(s), will confirm all program requirements for the Inmate Services building replacement as agreed with the Essex Sheriff. This will include an analysis of the existing program relative to right-sized standards as well as future program requirements. The Designer will provide a narrative that justifies program needs as well as a preliminary tabular program expressed in net square feet with net to gross ratios and gross square feet requirements, and typical room layouts and adjacency diagrams indicating key relationships and technical requirements. The program will be reviewed and endorsed by the Essex Sheriff, and DCAMM before proceeding to the development of alternatives. The Designer will:

• Schedule and facilitate a tour (s)/site visit(s) of comparable facilities to assist the Essex Sheriff and DCAMM in the planning process;

• Interview the Essex Sheriff and the Middleton Jail and House of Correction representatives to gain a thorough understanding of their mission, programs, staffing, functional and technical requirements and any other relevant planning-design considerations;

• Provide a narrative which documents and presents a justification for all programmatic needs and requirements;

• Develop detailed tabular space program broken down by individual functional area and sub-area and identifying all net useable square footage, and all departmental and building gross area requirements. Evaluate the program with respect to industry standards and norms as well as the established budget;

• Provide typical room layouts and spatial adjacency diagrams indicating key relationships, and technical requirements;

• Outline building systems requirements.

Scope – Site and Building

• Existing Documentation Review and Analysis - Review documentation provided by DCAMM and identify any additional material or information

needed to complete this Study;

• Existing Building and Site Conditions Analysis and Documentation - Interview DCAMM Energy Team, facility and maintenance staff for input on the design and

operation of building(s). Review operations and maintenance procedures with Essex Sheriff facilities staff and identify areas of potential improvement and alignment with current best practices;

- Review Executive Orders 484 and 569 to establish applicable criteria for this project. - Review LEED criteria and other applicable performance data relevant to the project and develop a

base case profile for energy and water use to comply with the referenced Executive Orders.

- Provide a thorough survey and analysis of hazmat conditions in the Inmate Services Building and the Intake Building, including scope, methods and cost for remediation as required to do this project;

- Provide a complete code analysis including a chapter 34 analysis of the Intake Building, including confirmation that the building will support a new second floor. Identify necessary permits, reviews and interactions with regulatory agencies and factor into detailed timeline for project delivery. Detail all relevant concerns and propose approaches for resolution to be incorporated in the alternatives developed in Task 3.

- DCAMM will utilize its Accessibility Consultants to provide technical assistance and oversight for accessibility compliance during the study, design and construction process. The Designer is responsible for coordinating all work with DCAMM’s Accessibility consultant.

Cost

• Provide a Preliminary budget estimate for the project escalated to the midpoint of the project construction schedule, per phase.

- Recommend potential options to reconcile preliminary costs with project budget for review by the Project Team.

Schedule

• Prepare preliminary phasing plan along with a design and construction schedule plan for each phase. Show permitting and regulatory reviews required and their impact on timeline. Outline an approach to maintain 24/7/365 operation of the existing building(s);

Deliverables

Provide a summary Existing Conditions report, including:

• Complete annotated list of all documentation provided to the Designer by DCAMM;

• List of additional documentation or information identified by Designer as required to complete this Study;

• Facilities Conditions Assessment if required for the Intake Building; provide an overall summary and building condition narrative at Uniformat II Level 3

• Base document set including: - Site Plan; - Dimensioned floor plans, elevations and sections of the proposed buildings - Photographs documenting conditions of the existing Inmate Services Building and the Intake

Building and areas of site that will be impacted by this project;

• Complete code analysis identifying permits, reviews and interactions with regulatory agencies required; and including a comprehensive Chapter 34 analysis of the Intake Building

• Summary of findings, issues and factors expected to have an impact on design alternatives and costs

• Draft prioritized list of recommended Life Safety, access, MEP and other required building systems, site and infrastructure improvements to be considered;

• Conduct workshop to present analysis and key findings to confirm project scope, budget, performance standards and schedule.

• Technical memoranda on costs, including life cycle cost analysis, possible approaches to cost control, and results of workshops.

• Meeting Minutes.

Task 3 – Development & Evaluation of Alternatives

This phase of the study will focus on developing and analyzing a minimum of three meaningful alternatives for this project. These scenarios will define and prioritize the deficiencies in the building and site and identify the best and most cost effective approach to address them and achieve the goals of this study.

Strategic Approach

• Review and evaluate potential strategic approaches developed by DCAMM to the sequence of operations necessary to execute the project, and provide alternative scenarios developed by the Designer. Identify methods to provide food service to the inmates without interruption. Identify how the visitors, both attorneys requiring confidential privacy, and family visitors can be temporarily accommodated for the duration of the project. Identify how IT and Jail management staff will be temporarily accommodated. Document the required sequences of construction, moves and relocations will work to allow the Jail to operate throughout the project with minimum disruption to normal operations.

Program

• Create and analyze three meaningful alternatives for implementing the recommended program in phases as required

• Further develop the Tabular Program

• Provide preliminary pre-schematic diagrammatic plans for each phase of the project, including blocking and stacking diagrams as required.

• Identify any site issues. Include circulation diagrams and indicate accessible paths of travel.

Scope – Site and Buildings

• Present a matrix that illustrates a pros and cons analysis of alternatives in regards to criteria established by the Designer, the Essex Sheriff, DCAMM including but not limited to: accomplishing the goals of the project, feasibility, constructability, reduction of energy and water consumption, improved overall resilience of the building, improved accessibility throughout the building and site, impact on maintenances and operations, cost avoidance, construction schedule, implementation difficulty and potential impact on day to day operation of building and any other implementation requirements and criteria identified by the project team.

Cost

• Provide magnitude of cost estimates for each alternative. Costing should incorporate all costs for each phase of the project in each alternative, including swing space, incremental construction phases, renovation, demolition, and enabling works.

Schedule

• Further develop the project schedule for design through construction including required permits and associated required regulatory review which can impact the schedule.

• Evaluate schedule options and issues, including swing space needs and timing.

Deliverables

• Documentation of findings.

• Prioritized list of projects illustrating construction and funding schedule.

• Cost analysis of each alternative.

• Comparative matrix illustrating pros and cons in regards to The Essex Sheriff & DCAMM goals for the project, costs, construction schedule, and potential implementation impact.

• Technical memorandum on costs, including comparable costs and assessments, possible approaches for cost control, and results of workshops.

ST-GW – Project Review Workshop

A half-to-full day workshop, led by the design team, will be scheduled to provide all project participants and stakeholders an opportunity to comment on the key issues identified by the Study and to review the alternative concepts and preferred option selected from the work in Task 3. An appropriate presentation should be prepared for the Project Review Workshop and the selected alternative refined and documented per the outcome of the Workshop.

Task 4 – Development of Preferred Concept & Draft Study

Develop the preferred concept and plan for its implementation as accepted by DCAMM and the Essex Sheriff. Include comments from the Project Review Workshop(s)

Program

• Narrative outlining all components to be included in the building and rationale for inclusion;

• Finalized detailed tabular program listing all programmed and support spaces;

• Revised relationship diagram depicting important adjacencies;

Fee Negotiation

The fee associated with Task 5 and 6, Schematic Design Documents and Certifiable Building Study Report, will be negotiated during the study phase, following the determination of the final scope of work to be completed and the estimated construction cost. The Designer’s contract will be amended to incorporate the Schematic Design/Certifiable Study fee and scope for this phase of work.

Task 5 - Schematic Design

Building Program

• Narrative outlining all components to be included in the building(s) and the rationale for inclusion.

• Relationship diagram depicting important adjacencies

• Room Data Sheets including room layouts as required for illustration

• Equipment lists, including performance requirements Scope – Site and Building

• Narrative explaining the preferred sequence of developing swing space, moves to and from swing space, construction, demolition, as developed for the project in the study phase

- Floor Plans–Site Relationship: The Designer must submit four elevations from the main orientation points of view indicating the relationship to site configurations;

- Floor Plans–Program Spaces and Site Configurations: Two cross-sections with floor heights, including any basement spaces identifying program spaces and relationship to site configurations;

- Models–Designer’s Studies: A three dimensional representation, axonometric, perspective drawing or an aerial photographic view of the Designer's Study model to convey the general massing of the project; a computer generated model in context is preferable;

- Floor Plans–Scales: The plan, section, and elevation drawings shall be 1/4” = 1’0”. If the building is large or irregular in shape and will not adapt to the use of match lines, 1/8” = 1’0” scale may be approved for submission;

- Sheet size to be half-size.

Task 6 – Certifiable Building Study Report

Prepare draft study report compiling the products of all tasks. Incorporate comments from Draft Report into a final report for certification, including an Executive Summary and Project Narrative. Submit one copy for final DCAMM review and comment prior to final submission in digital and spiral-bound hard copy formats (three copies maximum).

Deliverables

• Draft report compiling and revisiting the products of Task 2, 3, 4 and 5 for review and comment by DCAMM and The Essex Sheriff;

• Final Report that incorporates comments from the draft report for certification in required digital and hard copy formats. The report package should provide a sufficiently detailed information package that describes all relevant aspects of the proposed phased renovation strategy and includes: the executive summary, project narrative, project justification and rationale for selection of consensus renovation plan, schematic design package, final ADA, Operations, MEP and site narratives, code analysis, energy costs, sustainable and resilient design approach, a phased construction cost estimate and narrative, an operating cost analysis, and a proposed project schedule (Gantt chart).

Applications from MBE and WBE firms as prime designer are encouraged. Applicants that are themselves MBE or WBE certified will be required to bring a reasonable amount of participation by a firm(s) that holds the certification which is not held by the applicant to the project. Proposed MBE/WBE participation plans that include solely MBE or solely WBE participation, or have only nominal participation by one or the other to meet the combined goal, will not be considered responsive. Applicants are strongly encouraged to utilize multiple disciplines and firms to meet the MBE/WBE goal. Consultants to the prime can team within their disciplines in order to meet the MBE/WBE goal, but must state this relationship on the organizational chart (Section 6 of the application form).

Energy & Sustainability

Executive Order 484: Leading by Example – Clean Energy and Efficient Buildings

Projects undertaken under this contract shall comply with all applicable requirements of Executive Order 484 (EO 484): see http://www.mass.gov/anf/docs/dcam/dlforms/energy/energy-eo484-final.pdf. All building studies shall include preliminary estimates of the project’s energy use, water use, and greenhouse gas emissions using protocols established by EOEAA or as determined by DCAMM. No building study shall be certified for final design unless all means, methods, and commitments required to mitigate the project’s impact on the operating agency’s plan for meeting EO 484’s goals are documented in the consensus solution, implementation plan and estimated construction cost.

LEED Certification

This project shall be certifiable at a level of Silver or higher, including Mass LEED Plus requirements. All measures proposed to achieve a LEED rating shall be incorporated into Final Design as part of the Designer’s base fee; administration of the certification process by the Designer during the Final Design and Construction phases of the project will be negotiated.

Universal Design/Accessibility

Universal Design

Design solutions provided under this contract are expected to meet the diverse and changing needs of users across age, ability, language, ethnicity and economic circumstance. DCAMM welcomes innovative design strategies that are usable by the widest range of people operating in the widest range of situations without special or separate design.

Accessibility

The designer’s design must comply, at a minimum, with 521 CMR, The Rules and Regulations of the Architectural Access Board (http://www.mass.gov/ocabr/government/oca-agencies/dpl-lp/opsi/consumer-prot-and-bus-

The designer is also expected to understand and reflect in its design the civil rights obligations of the Commonwealth under Title II of the Americans with Disabilities Act (http://www.ada.gov/regs2010/titleII_2010/titleII_2010_regulations.htm) to provide equal access to programs, services, activities and comply with ADA scope requirements for alteration of primary function areas, as

applicable. DCAMM will use its Accessibility Consultants to provide technical assistance and oversight for

accessibility compliance during the study, design and construction process, including accessibility audits of existing buildings.

Policies & Procedures

Security Sensitive Information

Please note that this may be designated a Security Sensitive Information (SSI) project. The Designer may be required to enter into an agreement to keep all information strictly confidential and adhere to document distribution protocols.

Financial Statement

Chapter 7C, Section 51 requires that on public design contracts where the total design fee is expected to exceed $30,000 or for the design of a project for which the estimated construction cost is expected to exceed $300,000 the designer shall: a) File its latest CPA or PA audited financial statement with the Division of Capital Asset Management and

Maintenance (DCAMM), and continue to do so annually throughout the term of the contract; b) Submit a statement from a CPA or PA that states that they have examined management’s internal auditing

controls, and expresses their opinion regarding those controls to the DCAMM.

DCAMM Procedures

The designer will follow the procedures established in DCAMM’s Designer Procedures Manual dated August 2008 (https://www.mass.gov/files/documents/2017/12/19/designers-procedures-manual-aug08.pdf). Applicants are urged to review and become familiar with the following supplemental material, which is available on the web at: (http://www.mass.gov/dcam).

PMAS

Designers will be required to use DCAMM's electronic web-based Project Management and Accounting System (PMAS) as a repository for all project correspondence, documentation, and project budgeting, and scheduling. No special software is required.

Workshops

DCAMM and the Designer will hold periodic workshops to ensure that critical issues are not overlooked and that all team members have an opportunity to contribute their expertise, to anticipate potential obstacles, to identify potential solutions, and to expedite the decision-making process. Attendance by key design team members will be required at all workshops.

Environmental and other supplemental services

DCAMM reserves the right to obtain supplemental services through independent consultants who will collaborate with the Prime Firm and the Design Team. Asbestos inspection, design and monitoring, and indoor air quality testing and monitoring will be extra services under this contract.

Cost Estimating

Cost estimates, cost models, and estimator participation in both the study and the design phases shall meet the requirements of the current DCAMM Cost Estimating Manual and will be submitted in Uniformat II in the study phase and in both Uniformat II to Level 3 and CSI Masterformat in the design phase. Building Information Modeling (BIM)

Building Information Modeling (BIM) will be used in the study, design, and construction phases of the project. The BIM List of Services can be found at http://www.mass.gov/anf/docs/dcam/pubbldgconstr/16-2-27-bim-list-of-services.pdf . This List of Services document is a general statement of DCAMM’s current requirements regarding the use of Building Information Modeling technology in agency projects. The specific requirements regarding use of the BIM will vary depending on the nature of the project, the Levels of Development delineated in the DCAMM approved BIM Execution Plan for the project, and the diverse purposes for which DCAMM will use the BIM during the life cycle of the facility from design through facility operations. In all instances, the language of the project contract(s) will be controlling.

Building Commissioning

DCAMM will include an independent third party building commissioning agent as part of this project. The commissioning agent will develop in collaboration with DCAMM an operations and maintenance plan as a reimbursable expense during the building commissioning phase. The commissioning agent will meet with DCAMM’s design team during planning, design and construction to evaluate design proposals and make recommendations to ensure the maintainability and operational efficiency of the new building.

CM at Risk

The construction of this project will be performed utilizing a construction management at-risk (CMAR, sometimes referred to as CM/GC) contract in accordance with MGL Chapter 149A. It is anticipated that the CM will be on board during the Schematic Design phase of Final Design project.

Integrated Project Delivery Approach/Lean Construction Tools

To the extent allowed under the Commonwealth public procurement laws and regulations, DCAMM may elect to use some aspects of an Integrated Project Delivery (IPD) approach, as generally described in the AIA document Integrated Project Delivery: A Guide (2007) – (see http://info.aia.org/SiteObjects/files/IPD_Guide_2007.pdf for informational purposes). To the extent the IPD approach and/or Lean Construction Tools conflict with DCAMM’s contract terms or the laws governing DCAMM, then the contract documents and laws shall take precedence. DCAMM's preliminary approach to IPD will use Construction Manager at Risk procurement with the goal that DCAMM, Client Agency, Designer, CM, Trade Partners, and other key stakeholders will work as an integrated project delivery team within the existing statutory and contractual frameworks.

DCAMM may elect to use Lean Construction Tools as part of the IPD project delivery approach. The Lean Tools that DCAMM may use in connection with the project include Value Stream Mapping, Set Based Design, Target Value Design, A3 Decision-making, and Last Planner™ - (see http://www.leanconstruction.org/media/docs/LCI_Glossary12232015.pdf for informational purposes).

CONTRACT REQUIREMENTS

Contract for Study, Final Design, and Construction Administration Services DCAMM uses one standard Contract for Study, Final Design and Construction Administration Services (January 2019) (“Contract”). The Contract will be signed when the study services are procured. If this Advertisement indicates that the Schematic Design/Certifiable Building Study fee is to be negotiated, following successful fee

negotiations, the Contract will be amended to incorporate a scope and fee for schematic design and certifiable study services. If study certification pursuant to M.G.L. c. 7C is completed, the Contract may be amended to incorporate the design and construction administration scope of services and fee. Designers awarded the Contract for Study and/or schematic design are not guaranteed to be awarded the Design Phase. Study Phase: Pursuant to a recent revision to M.G.L. c. 7C Section 59, the Schematic Design will be included in the certified Study. DCAMM has established a goal of Ten (10) months to complete a Study, including Schematic Design. If selected for study services, the applicant agrees to execute the Study/Design Contract or its successor, without revisions or modifications. DCAMM compensates the Designer during the Study Phase for approved products in accordance with the approved work plan. Design Phase: DCAMM has established a goal of Ten (12) months to complete design (DD and CD). At the conclusion of the study, if the applicant is requested by DCAMM to perform final design services, the applicant agrees to amend the Study/Design Contract’s scope of services to include final design and construction administration services (Attachment G – Design Phase Scope of Services), and the certified study, and any other documents as necessary. CONDITIONS FOR APPLICATION

The applicant’s current or updated Master File Brochure must be on file with the Board prior to the date of application. As a condition of application, each applicant, if selected for the new project, agrees to carry professional liability insurance in an amount equal to the lesser of $5,000,000 or 10% of the Project’s Fixed Limit Construction Cost, but in no event less than $250,000 per claim in accordance with the Design Contract (i.e., minimum coverage of $250,000 up to $5,000,000 depending on the construction cost).
