Public Entity Crime - As defined in section 287.133(1)(g), Florida Statutes, "public entity crime" is a violation of any state or federal law by a person with respect to and directly related to the transaction of business with any public entity or with an agency or political subdivision of any other state or with the United States, including, but not limited to, any Reply or contract for commodities or services, any lease for real property, or any contract for the construction or repair of a public building or public work, involving antitrust, fraud, theft, bribery, collusion, racketeering, conspiracy, or material misrepresentation.

Reply – A response to this ITN.

Responsible Vendor - A Vendor judged by the Lottery to have the capability in all respects to perform fully the Contract requirements and to have the integrity, security, and reliability which will assure good faith performance.

Responsive Reply - A Reply submitted by a responsive and responsible Vendor that conforms in all material respects to the solicitation.

Secretary - The Secretary of the Florida Lottery or an employee of the Lottery authorized to act on behalf of the Secretary.

State - The State of Florida and its departments, boards and commissions, officers and employees.

Subcontractor - Any person other than an employee of the Contractor who performs any of the services listed in this ITN for compensation.

Substantial Subcontractor - Any subcontractor to which the Contractor subcontracts a substantial portion of the work to be performed under the Contract, as provided in section 24.111(2)(a)4, Florida Statutes. This includes related work that is critical to the security, integrity, or operational performance of the Lottery. The term “substantial subcontractor” includes, but is not limited to, afirm that provides media buying services (if applicable) and a third party website translation provider.

Failure of a Vendor to provide the appropriate detailed information or materials in response to each stated requirement or request for information may result in lower scores for the Vendor; however, redundant or extraneous information is discouraged.

In order to expedite the evaluation of the Reply, Vendors should adhere to the following format and instructions:

a) Replies should be submitted in 8.5” by 11” page format.b) Replies should be in a 3-ring binder (or organized as such if submitted in a

The weight factor for each criterion will be multiplied by the average multiplier score determined pursuant to subsection 6.4.1 to arrive at the Vendor’s total score for that criterion. The criterion scores will be added together to determine a Vendor’s total Technical Reply score. The maximum number of points available for this section is 1,325.

6.4.3 Work Assignment & Presentation /Interview (Phase II = 500 Maximum Points)

In Phase II, the top three (3) ranked Vendors (Finalists) will be required to complete a work assignment and make an oral presentation to the Evaluation Committee in an open public meeting in Tallahassee. The work assignment and evaluation criteria can be found in Attachment N. Only those individuals identified by the Vendor in its staffing plan for fulfilling the contractual responsibilities in connection with this ITN, e.g. Account Manager, Creative Director, Media Director etc. may participate in the presentation process. Participation by other proposed staff shall be permitted if at least fifty percent (50%) of the staff member’s work will be performed on the Lottery account.

Vendors are cautioned that every criterion is important and that a poor response to a lesser-weighted criterion still can have a significant impact on the Vendor's continued consideration in the process as well as its final score as compared with other Vendors’ scores.

The Vendors will be ranked in descending numerical order based upon their technical Reply scores.

6.4.4 Cost Reply

The Florida Lottery will not calculate points for Cost Replies. The Florida Lottery reserves the right to negotiate cost or to accept a Cost Reply as submitted for contracting purposes.

1. A historical overview of the agency in providing the same or similar type of services sought through this ITN.

The response to this section should include a complete history of the company’s structure for the past 5 years. Historical information should include all information concerning mergers, sell-offs, buy-outs, etc., and the business reasons for these decisions. The names of current key officers and department heads who were employed in a previous firm structure and who remained in employment following restructuring should also be identified. Also include a list of existing office locations, services available at each office and length of time each location has been established.

2. Résumés for each key officer and department head currently on staff and length of time with firm under its current name.

Answers to Questionsfrom ALMA

1) Question: Could you please outline and describe your current efforts for Spanish language advertising? How many creative initiatives do you currently support and of those how may are original vs. adaptations of work from your general agency?

Answer: Currently the Lottery advertises on TV, Radio, Radio Live Reads, Online and Print for the Hispanic market. Occasionally advertisements are conducted on digital billboards (OOH). During the last six (6) months the Lottery supported one (1) creative initiative from the Spanish Language Advertising Contractor and four (4) have been adaptations from our General Market Advertising Contractor.

2) Question: When considering TV executions, is it your expectation that these would be full up productions are co-productions with your general agency?

Answer: TV executions could be full up productions completed by the Contractor or co-productions completed with the Lottery’s General Market Advertising Contractor. Currently it’s varied as the Lottery may receive a creative concept from both of its advertising Contractors and the best creative for a specific campaign is chosen.

3) Question: Please provide details per initiative in terms components required based on your current media plan for reference (ie: TV, radio, print, OOH, etc.)

Answer:

TV markets: Miami, Tampa, Orlando, Ft. Myers and West Palm BeachRadio markets: Same markets as TV.Hispanic Live Reads: Same markets as TV.Hispanic Print: Same markets as TV.Hispanic Online: Statewide.Hispanic OOH (when needed): Miami only.Haitian Radio: Miami only.Haitian Print: Miami only.

4) Question: Please provide details regarding scope on media planning and buying for the Spanish language services? On page 20 of the ITN document you mention it as a possible optional service. Hence, it is our assumption we should not consider media planning and buying as part of our financial proposal. Is this correct?

Answer: Correct, media planning and execution as referenced in Section 3.1 titled “Introduction” is listed as an optional service, however Vendors are requested to describe their experience in providing such services as listed in Section 5.4.1 “Agency Qualifications and Experience” item number 12. The compensation model as specified in Section 5.5 titled “Compensation and Cost Reply” specifies a fixed fee (commission percentage) to be applied towards pass-through costs for services delivered. Based on this costing model, it is not anticipated that a Vendor would include specific levels of service into their Cost Reply.

5) Question: a) Could you please describe the estimated point of sale management units required? b) Provide a reference of how many would you anticipate to be original and how many

adaptations? c) Is agency responsible for production of all assets? d) What’s the role of the selected agency regarding printing, shipping and handling of these materials?

Answer: a-d) A specific scope of deliverables, quantities and Contractor responsibilities for this contract cannot be defined. However, currently all of the Lottery’s point-of-sale pieces are adaptations of the general market point-of-sale. Additionally, the Spanish Language Advertising Contractor is responsible for the translation of those pieces, and historically has not been responsible for the printing, shipping and handling of the materials.

6) Question: You reference miscellaneous translations, can you please provide a brief description of materials to be translated as well as estimated unit count?

Answer: Refer to answer 5a above; however, currently miscellaneous translations includes:

� How To Play brochures for each promotion� Retailer Flyers for each promotion� Monthly Launch Pads for Scratch-Off tickets� Copy points for interviews� “The Winning Ticket” retailer brochure (every three months)� Some press releases

No estimated unit count is available.

7) Question: Please describe your current PR, promotion and community outreach efforts (or tactics) in order to get a sense anticipated needs? Are these an overlay and/or synergistic with your general market partner agencies?

Answer: The Lottery conducts PR for every promotion. Promotions are in synergy with our General Market Advertising Contractor efforts for each campaign. Campaigns are conducted by in-house communications staff.

8) Question: Could you provide more information regarding the retailer recruitment program? What does it entail? What are the deliverables and how frequently do they need to be executed?

Answer: The Lottery has a decentralized retailer recruitment program and from time to time we may require assistance in the recruiting of potential Hispanic retailers.

9) Question: Could you please explain the relationship between your English and Spanish languages websites? Are they 100% focused on the same content? (i.e. the Spanish version is currently a translation of your English version). Is the expectation that this continues as such?

Answer: The English and Spanish website have the same content. The expectation is to continue as such.

10) Question: Could you please describe the frequency of your Spanish language website updates? What kind of content is updated with what frequency?

Answer: The Spanish text changes daily as the Lottery’s English website is updated.

11) Question: Please confirm that hosting can be managed by a third party vendor and that cost is managed as such, separate from agency compensation. And if so do we need to submit the name of a 3rd party partners responsible for the website hosting on the 1/2/2014 reply document?

Answer: a) Third party hosting is acceptable. Yes.

12) Question: Where is the current platform hosted on so we can assess our needs? What is the current site built in?

Answer: The current Spanish site is translated and hosted by MotionPoint Corporation on a server and platform of their choice.

13) Question: Do we need to / can we make recommendations on the current content before we move the site?

Answer: Currently only the translated content is hosted and is merged with the English content from the Lottery’s website upon user request. The Contractor may make recommendations for transitioning content to the Lottery for its consideration.

14) Question: Could we provide alternatives to the CMS if we feel another would be better?

Answer: Refer to Section 5.4.5 titled “Website Translation” which states “A Vendor’s Reply should describe how it will meet or exceed the service level requirements set forth in Attachment C.”

15) Question: Regarding Phase 2 (oral presentation of creative assignment), is attachment N the formal brief or a template of a formal brief? i.e. is a formal brief going to be shared with the top 3 finalists? When do they expect this to happen and how much time the agency will have betweenbrief and presentation?

Answer: a) Attachment N includes the work assignment that will be required of Vendors qualifying as a Finalist; the Oral Presentation Guidelines that will apply to the Finalists presentation; and the scoring form Evaluators will use when recording their scores for each Finalist evaluated. No additional details will be provided. b) A specific date for the Finalistpresentation is not known at this time. All Vendors responding to the solicitation will have the potential to be a Finalist and will receive significant advance notice of the date the work assignment is to be completed in connection with Phase II activities.

16) Question: On page 22 you describe your expectations regarding a Business Recovery Plan. However, we don’t understood as this plan being part of the ITN response, but rather a document that should be provided by the selected agency, correct?

Answer: Correct. The Business Recovery Plan is a contract deliverable required of the Contractor.

17) Question: Could you please confirm the attachments/certifications required as part of the reply on 1/2/2014 and which ones are only required once the finalists agencies are selected? (Based on our interpretation we need to submit by 1/2/2014 Attachments D, E, F, H, I, K

Answer: The following forms attached to the ITN document should be completed, executed and submitted as part of the Reply:

20) Question: General: Should vendor reply consider “ITN Details” or “Attachment H” for the weight distribution of responses since they differ?

Answer: There is a typographical error on page 39 concerning the total weighting factor for Section 5.4.1 and the corresponding section on the Evaluator Score sheet for Phase I . Please refer to Addendum #1.

21) Question: Part 2 Section 2.6 – When does the insurance coverage policy need to be acquired? Is the policy required before or after the vendor selection?

Answer: The insurance policy is required to be submitted by the Contractor; therefore it is required after vendor selection.

22) Question: Section 2.7 - Performance Bond – Can there be a combination of proofacceptable form of security (I.e. 250K performance bond, and 250K letter of credit or an asset)?

Answer: Yes.

23) Question: Section 3.1 - What do “promotions” & “community outreach and partnerships”consist of? Can additional details be provided to help clarify what the scope of “promotions” means?

Answer: Every time the Lottery launches a new product, a promotion is conducted. Promotions, community outreach and partnerships may include:

24) Question: Section 3.4 - Item #2 - Can you provide more clarification on the typical relationship between the Hispanic and General Market Agency? How much of work is translationvs. custom campaigns specific to the USH audience?

Answer: Every time we advertise a new product the Florida Lottery chooses the best creative for the campaign. Sometimes it doesn’t translate well, so each agency produces a :30 TV spot. Sometimes it’s only a translation of the general market spot.

25) Question: Section 3.4 - Item #6 - Can you provide more clarification on what “new mediaoutlets” consists of?

Answer: New media outlets would be online media that’s internet or smart phone based.What we mean by this is emerging technologies – we want to be one step ahead.

26) Question: Section 5.4.1 – Question 1 – Are actual resume’s required, or can we provide bio’s instead.

Answer: The solicitation requests that resumes’ be provided.

27) Question: Section 5.4.1 – Question 4 – Do we include Strategy POVs, Research, etc., as part of our added-value services?

Answer: Refer to Section 3.1 titled “Introduction’ for the level of services the Lottery considers as basic capabilities/services of the Contractor.

28) Question: Section 5.4.1 – Question 11 – What do "Florida Markets" consist of? Are the markets where our advertising appeared?

Answer: Refer to the answer for question number 3 above for the TV markets.

29) Question: Section 5.4.1 – Can you confirm if a detailed biography will suffice for key officersand department heads currently on staff?

Answer: Refer to the answer for question number 26 above.

30) Question: Section 5.4.4.2 – Will (1) DVD include all individual examples including televisionand radio ads, outdoor advertisements, social media campaigns, retail point of sale material, and newspaper/magazine ads?

Answer: The solicitation requests that the TV and radio ads be on the DVD. The other media should be submitted as requested.

31) Question: Section 5.4.4.2 - Item #1 - Are TV ads also inclusive of online video?

Answer: Yes.

32) Question: Section 5.4.5 - Is a complete list of translatable file formats available? The ITN states “Text, XML files, translatable graphics, new images, navigation, alt tags, meta tags, etc.”

Answer: Currently we require translation of text within HTML files. This includes translations of ALT tags on images, meta tags and some text within javascript sections.

33) Question: Section 5.4.5 -For the “Daily drawing results tool” what format is the content stored in and how will it be provided?

Answer: The results are dynamically displayed in HTML text.

34) Question: Section 5.4.5 -What levels of access will be provided to the database containing content materials?a. Direct accessb. A duplicate of the databasec. Script Versionsd. Exported data (i.e. CSV, etc.)

Answer: No direct access will be provided to the database. All data is available from the website(s). Dynamic content is not planned for translation.

35) Question: Section 5.4.5 -Can a copy of the site database be provided for review?

Answer: Refer to answer to question 34.

Answer: Refer to Attachment C for current specifications. The costs charged by the current provider, MotionPoint Corporation is included as Attachment #1 to Addendum #1.

38) Question: Section 5.4.5 -Are there any specific security or facility requirements the hosting provider/server must meet?

Answer: The hosted content must be able to handle HTTPS. The Lottery expects that Vendors will address security and facility aspects in their Reply.

39) Question: Section 5.4.5 -Besides uptime of the hosting server, who will be responsible for management of the server? (i.e. updates, backups, security, etc.)

Answer: The Contractor is responsible for the management of the server.

40) Question: Section 5.4.5 -Are there any specific backup requirements the server must meet?

Answer: No. Vendors should determine their own backup requirements to meet the performance requirements specified in the ITN.

Current Website Translation Cost Schedule

Management and Support fee: $438.00 per month.

The Management and Support Fee shall be increased by: an additional $100 per additional 25 Giga-Bytes of data transferred per month over 50 Giga-Bytes per month. Total data transferred in a month is calculated from Web server log files. Data transfer usage charges are included in the monthly Management and Support charge specified in above.
