Re: Monthly report February 5, 2020

I am scheduled to be in Court during the February Public Safety Meeting, so I wanted to

give you the verbal portion of my report via this memo.

You may notice what look like significant differences in our numbers for January of this

year when compared to 2019. We are now attempting to coordinate with other providers

(conflicts and assigned counsel) to make sure our case counts match. To that end, we

are meeting and resolving any discrepancies. The meetings will take place mid-month.

To avoid confusion our reports will now specify the exact dates covered, rather than by

month only.

From my point of view the biggest problem with bail and discovery reform thus far has

been the misinformation circulated concerning the requirements of the law. The Public

Defender’s Office is making every attempt to promulgate facts not fear. For example,

there is no requirement that charges be automatically dismissed if discovery is not

provided within 15 days of arraignment. Sex offenses are still subject to bail. If a

defendant commits a felony while at liberty on a previous felony, the order of

recognizance or non-monetary conditions can be revoked.

Our office does not represent all criminal defendants in the County. However, we do

handle the majority of criminal cases. To date, none of our clients who were released

under the new bail rules have failed to appear for a subsequent court date without an

approved adjournment.

MEMORANDUM OF EXPLANATION

COMMITTEE: Public Safety January 30, 2020

A request is being made for a resolution approving an agreement between Rehabilitating & Empowering Disadvantaged Youth (R.E.D.Y.) 180 N. Park Ave., Suite C, Warren, OH 44481 and the Allegany County Probation Department to provide mentoring services. R.E.D.Y. provides staff who assist youth with truancy Problems to get to school. Their staff also provide one-on-one mentoring services for these youth.

The Allegany County Department of Social Services had a prior agreement with R.E.D.Y. to provide these services. However, DSS wants Probation to assume this agreement and manage it. We have agreed to do so. The agreement shall be from January 1, 2020 to December 31, 2020. The Allegany County Probation Department shall pay to R.E.D.Y. a sum to not exceed $29,101.00 for their services. There is money in the Allegany County DSS budget to pay for this service. This money will be transferred to the Allegany County Probation Department’s budget after the Allegany County Treasurer’s Office establishes the correct budget line items for Probation.

MEMORANDUM OF EXPLANATION

COMMITTEE: Public Safety January 30, 2020

A request is being made for a resolution approving an agreement between Catholic Charities of Buffalo and the Allegany County Probation Department to provide Multi-Systemic Therapy (MST) services. MST is a strength -focused approach to family systems therapy. MST is effective in helping youth ages 11-18 who are displaying Juvenile Delinquency or PINS type behaviors.

The Allegany County Department of Social Services had a prior agreement with Catholic Charities to provide the MST Services. However, DSS wants Probation to assume this agreement and manage it. We have agreed to do so. The agreement shall be from January 1, 2020 to December 31, 2020. The Allegany County Probation Department shall pay to Catholic Charities a sum to not exceed $153,459.00 for MST services. There is money in the Allegany County DSS budget to pay for this service. This money will be transferred to the Allegany County Probation Department’s budget after the Allegany County Treasurer’s Office establishes the correct budget line items for Probation.

January 2020

Spent most of month organizing inspection information for State Annual

report and County Annual report.

State report includes types of inspections done, hours conducting each type

of inspection and results of these inspections.

I spent time changing files to make doing annual reports more effective.

I checked six pharmacy scales in Wellsville, Fillmore, Friendship, Alfred and

two in Cuba.

I rechecked diesel pumps in Friendship after a new install.

I rechecked gas pumps in Belfast after drive-off damage caused new meter

install.

I am preparing to transport equipment that is in need of five-year

recertification to Albany next month. I am trying to get all inspections

utilizing this equipment done prior as I will be without it for approximately

three-four weeks.

I traveled approximately 450 miles in the month January activities:
