Each year, the YLS IP Committee brings together a panel of judges from the Northern District of Illinois to discuss various hot topics in IP law and recent case decisions that may have had an impact on IP law throughout the past year.

TOPICS:• Akamai Tech., Inc. v. Limelight Networks, Inc. and

McKesson Tech., Inc. v. Epic Sys Corp. (Fed. Cir. 2012) (en banc). How will expansion of induced infringement liability affect disposition of cases at the district court level?

• The AIA and inter partes review. How has the AIA affected litigation so far? How do the panelists think it will affect motions to stay, considering, for example, the increased costs that will be involved in participating as compared to inter partes reexamination?

• The AIA and the new joinder rules under 35 U.S.C. 299. How do judges plan to deal with multiple but related lawsuits under this provision?

• Already v. Nike: Does a party’s counterclaim create a justiciable controversy sufficient to allow the District Court to exercise subject matter jurisdiction when the plaintiff, owner of a federally registered trademark promises not to assert its mark against the party’s then-existing commercial activities? (USSC deals with MedImmune Controversy)

• The Circuit Split on trademark licensees’ rights in bankruptcy; focusing on cases such as the recent Seventh Circuit decision in Sunbeam Prods., Inc. v. Chicago Am. Mfg, LLC, Case No. 11-3920, 2012 WL 2687939 (7th Cir. July 9, 2012), and whether a licensee loses its right to use licensed intellectual property when the license agreement is rejected in bankruptcy or if rejection of a license agreement under the Bankruptcy Code merely constitutes breach of an executor contract?
