FORESTRY AND WILDLIFE ECOLOGY
During Construction Stage
Wildlife
Parameter: Survey of wildlife around the project area including species, status and abundance.
Location: Within a radius of 5 km around the project site.
Duration: Six months from the beginning of the construction. The measure specified the survey of wildlife be conducted around the project area for
species, status and abundance in the area within 5 km radius of the project site for six months after the
project construction.
From the results of environmental impact surveillance on wildlife resources in the area
during this early part of the construction phase of Nong Saeng Power Plant Project, it was found that the
conditions of wildlife habitats and ecology in the area were changed very slightly and no impact was
imposed on the local wildlife resources and the associated diversity, abundance and status of wildlife in the
project area. The observed resultant change was found to be naturally seasonal-based, which was considered
as normal. Therefore, the results implied that the mitigative measures for wildlife resources were effectively
implemented as specified in the EIA report of Nong Saeng Power Plant Project. Details are presented in the
Environmental Measures Report, No.2/2011.
During Operation Stage
Parameter: Survey of wildlife around the project area for the study of their diversity, species, abundance
and all survival in the project area.
Location: Within a radius of 5 km around the project site.
Duration: At the beginning of the project operation and every 3 years thereafter with a survey in each
of the rainy and winter seasons of the year and for a total time period of 10 years. If the
findings do not indicate any tendency of the project-induced impact, the survey will be
determined.

AQUATIC ECOLOGY AND FISHERY
During Construction Stage
Aquatic Ecology
Parameter: Phytoplankton, zooplankton, benthos
Location: Klong Huaiba (Klong Nong-Ngu-Loem); (i) 500 meters upstream of Nong Saeng Power Plant Project Site; (ii) Discharge point of the project and (iii) 500 meters downstream of the project’s discharge point.
Duration: Every three months throughout the construction period.
Sampling Method:
- Phytoplankton : Vertical plankton tow with plankton net mesh size 20-60 µm.
- Zooplankton : Vertical plankton tow with plankton net mesh size 100-200 µm for zooplankton and mesh size 300 µm for fish eggs and larvae.
- Benthos : Ekman Grab used to collect samples from the bottom layer of sediment.
The programme of aquatic ecology monitoring specified that the types and densities of
phytoplankton, zooplankton and benthos be monitored every 3 months during construction phase in the area
of Klong Huaiba (Klong Nong-Ngu-Loem) at 3 locations, i.e., 500 meters upstream of Nong Saeng Power
Plant Project Site, Discharge point of the project, and 500 meters downstream of the project’s discharge
point.
First Monitoring Results (September 3, 2012)
(1) Klong Huaiba at 500 meters upstream of Nong-Saeng Power Plant Project Site
- Phytoplankton : 11 species in 3 Divisions of phytoplankton were found, i.e., 1 species in
Cyanophyta, 7 species in Chlorophyta and 3 species in Chromophyta with the total density
of 40,320 cell/l. The predominant species was found to be Eudorina sp. and the diversity
index of phytoplankton was 0.9746
- Zooplankton : 4 species of Phylum Rotifera and 1 species of Phylum Arthropoda were
found. The total density was found to be 3,780 ind./litre. The predominant species was
found to be Polyarthra sp.. and the diversity index of zooplankton was 0.8378
- Benthos : Only one phylum was found to be Mollusca with 1 species, i.e., Pilsbryoconcha sp..
The total density was found to be 45 ind./m2. The diversity index could not be determined
since only one species was found.
(2) Klong Huaiba (Klong Nong-Ngu-Loem) at Discharge point of the project
- Phytoplankton : 8 species in 3 Divisions of phytoplankton were found, i.e., 1 species in
Cyanophyta, 4 species in Chlorophyta and 3 species in Chromophyta with the total density

of 3,655 cell/l. The predominant species was found to be Strombomonas sp. and the
diversity index of phytoplankton was 1.9562.
- Zooplankton : Only 1 species in Phylum Arthropoda was found, i.e., Copepod naupil. The
density was found to be 430 ind./litre. The diversity index could not be determined since
only one species was found.
- Benthos : Three phyla of benthos were found, i.e., 1 species (Lumbriculidae) in Phylum
Annelida, 1 species (Chironomus sp. ) in Phylum Arthropoda and 1 species (Indonaia sp.) in
Phylum Mollusca with the density of 89, 134 and 45 ind./m2 respectively. The diversity
index of benthos was 1.0123.
(3) Klong Huaiba (Klong Nong-Ngu-Loem) at 500 meters downstream of the project’s discharge
point
- Phytoplankton : 12 species in 3 Divisions of phytoplankton were found, i.e., 1 species in
Cyanophyta, 7 species in Chlorophyta and 4 species in Chromophyta with the total density
of 16,400 cell/l. The predominant species was found to be Dictyosphaerium sp. and the
diversity index of phytoplankton was 1.8449.
- Zooplankton : Only 1 species in Phylum Protozoa was found, i.e., Coleps sp. with the
density of 200 ind./litre. The diversity index could not be determined since only one species
was found.
- Benthos : No benthos was found in this area.
Second Monitoring Results (December 20, 2012)
(1) Klong Huaiba at 500 meters upstream of Nong-Saeng Power Plant Project Site
- Phytoplankton : 16 species in 3 Divisions of phytoplankton were found, i.e., 3 species in
Cyanophyta, 10 species in Chlorophyta and 3 species in Chromophyta with the total
density of 56,945 cell/l. The predominant species was found to be Aulacoseira sp. and the
diversity index of phytoplankton was 2.0469.
- Zooplankton : Only 1 species in Phylum Rotifera was found, i.e., Polyarthra sp. with the
total density of 470 ind./litre. The diversity index was not determined since only one
species was found.
- Benthos : Two species in two phyla were found, i.e., Naididae in Annelida and Chironmus sp.
in Arthropoda. The density was found to be 45 and 445 ind./m2 respectively, and the diversity
index of benthos was 0.3068
(2) Klong Huaiba (Klong Nong-Ngu-Loem) at Discharge point of the project
- Phytoplankton : 17 species in 3 Divisions of phytoplankton were found, i.e., 2 species in
Cyanophyta, 10 species in Chlorophyta and 5 species in Chromophyta with the total
density of 136,515 cell/l. The predominant species was found to be Pandorina sp. and the
diversity index of phytoplankton was 1.1754.

total density of 285 ind./litre. The diversity index was not determined since only one

(3) Klong Huaiba (Klong Nong-Ngu-Loem) at 500 meters downstream of the project’s discharge
point
- Phytoplankton : 19 species in 3 Divisions of phytoplankton were found, i.e., 2 species in
Cyanophyta, 12 species in Chlorophyta and 5 species in Chromophyta with the total
density of 52,877 cell/l. The predominant species was found to be Pandorina sp. and the
diversity index of phytoplankton was 2.1357.
- Zooplankton : No zooplankton was found in this area.
- Benthos : 4 species in 3 phyla were found, i.e., 1 species (Lumbriculidae) in Annelida,
1species (Chironomus sp.) in Arthropoda, and 2 species (Indonaia sp. and Scabies sp.) in
Mollusca. The total density was 268 ind./m2 and the diversity index of benthos was 1.3314.
Summary of Monitoring Results of Aquatic Ecology
- Phytoplankton : The monitoring results revealed that Divisions mostly found in all 3
monitoring areas were Division Cyanophyta (blue green algae), Division Chlorophyta
(green algae) and Division Chromophyta (diatom). These Divisions are generally found in
surface water resources or freshwater. The diversity index indicating the variety of lives
was found to be close to or more than 1 implied that the environmental conditions and
surface water quality were not imposed by any impacts. The results of diversity index were
mostly found to be more than 1 in all 3 monitoring areas, so the surface water quality was
considered to be good.
- Zooplankton : The monitoring results revealed that the phyla found in the monitoring areas
were Phylum Rotifera, Phylum Arthropoda and Phylum Protozoa. Only one species were
mostly found in the monitoring areas, thus the diversity index was not determined.
No zooplankton was found at Station No.3 on December 20, 2012.
- Benthos : The monitoring results revealed that Phylum Annelida, Phylum Arthropoda
(larvae), Phylum Mollusca (quahog) were mostly found in the sampling areas. Comparing
the monitoring results on September 3, 2012 and December 20, 2012, the density and
diversity index at Station No.1 and No.3 were found to be increased indicating better water
quality. However, the monitoring results at Station No.2 were decreased.

The environmental measures specified a survey be conducted on socio-economic status and opinion

For the meetings and interviews with community leaders and representatives of the concerned
government agencies recorded during July to December 2012, it was found that the project had held a
meeting of the Community Participation Committee about every month. The meetings involved community
leaders, and representatives of the locals and concerned government agencies.
Socio-economic surveys were conducted during December 10-12 and 24-25, 2011, and on January 17
and 25, 2012, using questionnaires as a tool to interview community leaders, household heads or representatives,
and the concerned authorities or representatives. The interviewed households were those in communities near the
project area (within a 5-km radius around the project site) and subject to the project-related impacts. The survey
results indicated that the upcoming power plant would bring about more advantages than disadvantages to
communities.

SOCIAL PROTECTION
1. General discussion on compliance with applicable Thai labor regulations and ADB’s Social Protection Strategy which requires compliance with core labor standards. The Company, its contractors and subcontractors are covered by and will comply with Thai labor regulations which has provisions that are consistent with core labor standards. The core labor standards are the elimination of all forms of forced or compulsory labor; the abolition of child labor; elimination of discrimination in respect of employment and occupation; and freedom of association and the effective recognition of the right to collective bargaining, as per the relevant conventions of the International Labor Organization.

4. Report on Power Development Fund (PDF)
PGS to ensure copy of Annual PDF Report is shared with ADB. The ADB recognizes that the Company has no direct hand in the implementation, use, and selection of projects to be funded under the fund. Annual report is expected to be shared with ADB through out the project operation stage.
The Energy Regulatory Commission still has not started to put any money into the Power Plant Development Fund because the plant construction works is not commenced yet.
5. Lawsuits Situation

Lawsuit asking for Saraburi Comprehensive City Plan implementation
A plaint was filed against the government authorities by the protesters to the Central Administrative Court on March 23, 2010, claiming for the enforcement of the Ministerial Regulation on the Saraburi Provincial Town Planning. The protesters also filed a request for a temporary injunction for suspending any government authorities to issue permits for the Project. GNS was summoned by the Court as the interpleader. On July 14, 2011, the Court dismissed a request for a temporary injunction. Currently, GNS has completely submitted the testimonies as required by the Court’s procedures and the Court issued an order for cessation of fact finding procedure on August 14, 2012.
On January 15, 2013, the Court had an order striking the case from the docket, giving the reason that since the Ministerial Regulation on the Saraburi Provincial Town Planning has been enforced, it was unnecessary for the Court to examine the case.
Lawsuit to nullify the EIA approval
A plaint was filed against the government authorities by the protesters to the Central Administrative Court on September 21, 2010, claiming for the revocation of GNS’s Factory Operation Permit and the approval on GNS’s EIA. The protesters also filed a request for a temporary injunction for suspending any activities performed in the Project area. GNS was summoned by the Court as the defendant. On March 4, 2011, the Court dismissed a request for a temporary injunction. GNS has completely submitted the testimonies as required by the Court’s procedures and the Court issued an order for cessation of fact finding procedure on October 13, 2011.
On January 31, 2013, the Court dismissed the case based on the ground that considerations made by the governmental agencies were legitimate under existing laws and regulations.
