MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE

By virtue and in execution of that certain mortgage given by William P. Kotoski, Jr. and Matthew S. Billet, Trustees of Laine & Aidan Real Estate Trust u/d/t dated November 1, 2007 and recorded with the Worcester District Registry of Deeds at Book 42041, Page 284, to Flagship Bank and Trust Company dated November 6, 2007, and recorded with the Worcester District Registry of Deeds at Book 42041, Page 298, for breach of conditions of said mortgage and for the purpose of foreclosing the same, said premises, and the buildings thereon, will be sold at Public Auction at 10:00 A.M. on the 18th day of June, 2009, on the mortgaged premises at 289 South Main Street, Gardner, Worcester County, Massachusetts, all and singular, the premises described in said mortgage:

Route 2 and the point of beginning. Containing about 49,600 square feet. The above described premises are conveyed subject to the following rights to the extent that the same are still in force and applicable:

1. Right of way for any and all purposes over a strip of land, 15 feet in width, lying easterly of and adjacent to the above described course running by land of the Boston and Main Railroad.

2. Rights granted to the Commonwealth of Massachusetts to erect and maintain retaining walls on or adjacent to the herein granted premises where the premises abut Route 2 and Victoria Street, which connects South Main Street and Pearson Boulevard.

The description of the premises contained in the mortgage shall control in the event of a typographical error in this publication.
