Apartment- Documents you need to check

• Check all the approvals/permission/original approved master plan of the project before investing.

• Give all payments by cheque & take receipts.

• Builder buyer agreement is generally executed after builder receives 20% of B.S.P.

• On the offer of possession ask for completion certificate from the Developer. Developer is not authorized to offer you possession unless he gets the completion certificate from the authority.

• On offer of possession letter don’t pay the balance blindly. First go and check the flat you have got v/s what you were promised.

• Registry of the property should be done within 3-6 months of taking the possession.

Buying a property in resale?• Original Builder Buyer agreement signed with the Developer.

• Receipts of all payments made to Developer.

• Cross check the authenticity of Builder buyer agreement with the builders office before making any payments to the seller.

• Status of the project.

Independent House- Documents you need to check• Original chain of papers.

• Documents related to revenue records/mutation.

• Check the pendency of any utility bills(electricity bills, water bills etc.)

• Exact seller details as per the original sale deed.

DeveloperIn case of cheating /excess demand/

late delivery/quality issues with the Developer you can opt for filing complaints which are criminal or civil in nature at forums like Police Station, Complaint to the magistrate, Consumer courts at District/State/national Forum.

Property issues within family/landlord-tenant dispute/illegal possession….?

• For majority of the reliefs prayed from the Civil court, Court fees which can vary from as low as 2-10% of the Cost of the property has to be deposited in the Court to initiate the legal proceeding. The Civil suit can take any where between a minimum of 2- Unknown number of years.

• In case of emergencies like creation of 3rd party interest etc. by the person in possession of the property the complainant/petitioner should pray for immediate stay/status quo.

• In Case your civil case has been pending for years or slow in pace you can file an application in the Court concerned for early hearing.
