PROGRESSION AGREEMENT BETWEEN THE UNIVERSITY OF HULL AND THE UNIVERSIDAD DE JAÉN
PROGRESSION AGREEMENT
BETWEEN
1. THE UNIVERSITY OF HULL of Cottingham Road, Hull, HU6 7RX, United
Kingdom ("HULL")
and
2. THE UNIVERSIDAD DE JAÉN ofCampus Las Lagunillas, EDF. Rectorado B-
1, 23071 JAÉN, Spain ("JAÉN")
WHEREAS
A. HULL is an English Higher Education Institution offering, amongst other
things, programmes of undergraduate and postgraduate higher education.
B. JAÉN is a Spanish Higher Education Institution offering, amongst other things,
higher education programmes.
C. JAÉN wishes to o:ffer its students the opportunity to transfer at key stages to
certain progrannnes at HULL and HULL wishes to uccept such studcnts
provídcd that they meet the criteria set dow11 under this Agrt:t:1u~nl.
HULL and JAÉN therefore agree as follows:
l. JAÉN STUDENTS
Subject to the other provisions of this Agreement, HULL will allow suitably qualified
students from JAÉN progression into those programmes listed in the schedule(s)
attached to this Agreement and subject to any specific provisions contained therein. A
student is suitably qualified for the purpose of this Agreement if he or she meets the
entry requirements outlined in the respective schedule.
2. OPERATING PROVISIONS
2.1 For the avoidance of doubt, HULL is not responsible for the validation,
authorization and accreditation of those of JAÉN's awards which lea.el to the
progression of students under this Agreement.
2.2 Applications for progression to the programmes listed in the schedules to this
Agreement must be submitted directly to HULL and HULL reserves the right to
make the final judgment on the adrnissibility of any Students. HULL may also,
at its sole discretion, assess a student's language proficiency (if applicable) or
previous academic background before admitting that student to any programme
and may refuse entry to any student on the grounds that the studenf s academic
background is inadequate or unsuitable.
2.3 The schedules will be reviewed every five years in accordance with HULL's
Code of Practice for the Approval and Monitoring of Progressíon Agreements as
stated in HULL's Quality Handbook. Programmes may be discontinued or
added following such review. Any additional prograrnmes must be approved by
HULL in accordance with the Code of Practice for the Approval and Monitoring
of Progression Agreements.
3. PRINCIPAL OBLIGATIONS OF THE PARTIES
3.1 Any modification to a programme listed in thc attached schedules must be
notified in writing to the other party at least two months befare the change takes
place. All modifications must be npproved hy HULL from time to time
according to the criteria set out its Code of Practice for the Approval and
Monitoring of Progression Agreements. Any programme of JAÉN which ceases
to meet such criteria will be deleted from the appropriate schedule.

Any limitation on the number of students able to apply for progression shall be
set out in the relevant schedule.
Prior to their arrival at HULL, JAÉN will advise students that thcy must possess

the requisite visas and appropriate documents and that they will need adequate
financia! support for the duration of their studies at HULL.
3 .4 Each student who registers at ID..JLL under the terms of this Agreement shall be
subject to the regulations of HULL and is liable to meet the full cost of HULL
tuition fees, accommodation charges and living expenses.
4. RESTRICTIONS
4.1 HULL is under no obligation to provide JAÉN with marketing support, with the
exception of providing JAÉN with guidelines for the use of HULL's visual
identity.
4.2 Any mention of HULL in promotional material produced and published by
JAÉN in connection with this Agreement must be approved in writing in
advance by HULL.
4.3 HULL is under no obligation to aid visa applications for students from JAÉN
other than through the provision of an offer letter and CAS number.
S. TERMS OF AGREEMENT AND AMENDMENT
5 .1 This Agreement shall remain in force until terminated by either party in
accordance with this clause. Any revisions to this Agreement mnst be approved
in writing by both Parties. Either Party may request a review of this Agreement
at any time.
5 .2 This Agreement may be tenninated by cithcr party giving 3 months written

notice to the other, or by either party immediately should the other party
commit serious breach of the tenns of this Agreement or should the other party
become bankrupt or enter into líquidation or other form of formal winding up .
For the avoidance of doubt, should grounds exist to termínate this Agreement
but an opportunity is given to the Party in breach to remedy that breach, then
this shall not be regarded as the innocent Party having waived the right to
termínate at a later date should the Party in breach failed to remedy that breach

in the time and manner (in any) specified.
5.4 Should either Party tenninate this Agreement in accordance with Clause 5.2,
there will be no new adrnissions of students onto the programmes. The
following obligations shall survive until all registered students already on the
programmes listed in the attached schedules at the date of tennination have
completed their course of study at both HULL and JAÉN.
a) Both Parties shall perform in full their obligations under this Agreement
b) Both Parties shall make every reasonable effort to support the existing cohort
of students.
5.5 In the event of this Agreement being terminated by either party students already
studying at JAÉN will qualify for progression provided they are suitably
qualified at the end of their programme of study at JAÉN.
6. GENERAL
6.1 This Agreement does not create any right to enforce for any person not a party to
it except a person who is a successor to or assignee to eíther party is deemed to
be a party under this Agreement. This Agreement may be rescinded or varied
without the consent of or the need to give notice to any person not a party to it.
6.2 This Agreement, and any schedule identified within this Agreement constitutes
the entire written agreement between the parties, supersedes any similar
agreement, whether oral or in writing as may exist between the parties, and may
only be modified in written amendment signed by the parties.

Both parties agree that in the performance of this Agreement, they will not
discriminate unlawfully against any person on the basis of race, colour, national
origin, religion, sex, sexual orientation or disability.
This Agreement will be governed by the laws of England.
