    This Standard Bidding Document (SBD) for Procurement of Works has beenprepared by the o!ernment of "epal (o"), Public Procurement Monitoring Office

    (PPMO) to facilitate post#$ualification bidding procedures used for the procurement

    of %or&s through 'nternational ompetiti!e Bidding ('B)

    The SBD includes* a format for the 'n!itation of Bids, Bidding Procedures,

    +e$uirements and onditions of ontract and ontract orms

    -hile using the SBD, the follo%ing directions should be considered

    (a) defines, for the purposes of this pro!ision, the terms set forth belo% asfollo%s?

    (i) Icorrupt practiceJ means the offering, gi!ing, recei!ing, orsoliciting, directly or indirectly, anything of !alue to influenceimproperly the actions of another party*

    (ii) Ifraudulent practiceJ means any act or omission, including amisrepresentation, that &no%ingly or rec&lessly misleads, orattempts to mislead, a party to obtain a financial or other benefit or

    (aa) deliberately destroying, falsifying, altering or concealing ofe!idence material to the in!estigation or ma&ing falsestatements to in!estigators in order to materially impede ao"0DP in!estigation into allegations of a corrupt, fraudulent,coerci!e or collusi!e practice* and0or threatening, harassing orintimidating any party to pre!ent it from disclosing its&no%ledge of matters rele!ant to the in!estigation or from

    pursuing the in!estigation* or

    (bb) acts intended to materially impede the e4ercise of theo"s0DPs inspection and audit rights pro!ided for undersub#clause 2G belo%

    (b) %ill reAect bid(s) if it determines that the bidder has, directly orthrough an agent, engaged in corrupt, fraudulent, collusi!e,coerci!e, or obstructi!e practices in competing for the contract in$uestion*

    (c) %ill sanction a firm or indi!idual, including declaring ineligible, fora stated period of time, to be a%arded a o"0DP#financed contractif it at any time determines that the firm has, directly or through anagent, engaged in corrupt, fraudulent, collusi!e, coerci!e, orobstructi!e practices in competing for, or in e4ecuting, a o"0DP#financed contract

    21 The Bidder shall not carry out or cause to carryout the follo%ing acts %ith anintention to influence the implementation of the procurement process or the

    procurement agreement ?

    (a) gi!e or propose improper inducement directly or indirectly,

    (b) distortion or misrepresentation of facts,

    (c) engaging in corrupt or fraudulent practice or in!ol!ing in such act,

    (d) interference in participation of other competing bidders,(e) coercion or threatening directly or indirectly to cause harm to the person

    or the property of any person to be in!ol!ed in the procurementproceedings,

    (f) collusi!e practice among bidders before or after submission of bids fordistribution of %or&s among bidders or fi4ing artificial0uncompetiti!e

    bid price%ith an intention to depri!e the ;mployer the benefit of opencompetiti!e bid price,

    (g) contacting the ;mployer %ith an intention to influence the ;mployer%ith regards to the bids or interference of any &ind in e4amination ande!aluation of the bids during the period from the time of opening of the

    bids until the notification of a%ard of contract

    (a) if con!icted by a court of la% in a criminal offence %hich dis$ualifiesthe Bidder from participating in the contract,

    (b) if it is established that the contract agreement signed by the Bidder %asbased on false or misrepresentation of Bidders $ualificationinformation,

    be ineligible to bid for a contract during the period of time determined by theo", PPMO and0or the DP

    2G The ontractor shall permit the o"0DP to inspect the ontractors accountsand records relating to the performance of the ontractor and to ha!e themaudited by auditors appointed by the o"0DP, if so re$uired by the o"0DP

    26 DP unded? 'n pursuance of the fraud and corruption policy, the DP

    (a) %ill reAect a Bid if it determines that the bidder recommended for a%ardhas directly or through an agent, engaged in corrupt, fraudulent,collusi!e, coerci!e, or obstructi!e practices in competing for thecontract in $uestion*

    (b) %ill cancel the portion of the loan0 credit0 grant allocated to a contractif it determines at any time that representati!e(s) of the o" or of a

    beneficiary of the fund engaged in corrupt, fraudulent, collusi!e, orcoerci!e practices during the procurement or the e4ecution of thatcontract, %ithout the o" ha!ing ta&en timely and appropriate actionsatisfactory to the DP to address such practices %hen they occur

    (d) they ha!e a relationship %ith each other, directly or through commonthird parties, that puts them in a position to ha!e access to informationabout or influence on the Bid of another Bidder, or influence thedecisions of the ;mployer regarding this bidding process* or

    (e) a Bidder participates in more than one bid in this bidding processParticipation by a Bidder in more than one Bid %ill result in thedis$ualification of all Bids in %hich the party is in!ol!ed Fo%e!er, thisdoes not limit the inclusion of the same sub ontractor in more than one

    bid* or

    (f) a Bidder or any of its affiliates participated as a consultant in the

    preparation of the design or technical specifications of the ontract that isthe subAect of the Bid* or

    (g) a Bidder or any of its affiliates has been hired (or is proposed to be hired)by the ;mployeras ;ngineer for the ontract

    (b) DP unded? as a matter of la% or official regulation, "epal prohibitscommercial relations %ith that country, pro!ided that the DP is satisfiedthat such e4clusion does not preclude effecti!e competition for the supplyof goods or related ser!ices re$uired*

    (c) DP unded? a firm has been determined to be ineligible by the DP inrelation to their guidelines or appropriate pro!isions on pre!enting andcombating fraud and corruption in proAects financed by them
