Themainsourceofevidenceabouttherecordofadvicegiventocourt,andthereasonsforit,willbethewrittenreport.ForStandardandFastreports,thiswillbethetypedreportitself.ForOralreports,itwillbetheuploadedcopyofthereport.Thewrittenrecordoforalreportsmaybebrieforevennon-existent,butourjudgementisstillbasedonthat.UnderthecurrentworkingarrangementswithHMCTS,wecannotexpectreportstobelengthydocumentsinallcircumstances.Wecan,though,expectthemtomakeanappropriateproposal,basedonsufficientinformation.Wewouldalsoexpectthemtobepersonalised.Thereasonforthisisthatthewrittenrecordofthereportiswhataresponsibleofficerwillbasetheirsupervisionon.Theresponsibleofficerneedstounderstandwhatwasproposedtothecourtandwhy,andthecontentofthereportmayformpartofabreachcaseinthefuture.OurrecentthematicinspectionofCourtReportsfoundthatthepresentationincourtoforalreportswasgenerallyofanacceptablestandard.However,onQ&Iinspections,wehavefoundthatthewrittenrecordoforalreportsisnotalwayssogood.
R1.12 Whatproposalwasmadetocourt?Inspectorswillrecordboththenatureofsentenceproposed(discharge,fine,communityorder,suspendedsentenceorder,immediatecustody),andanyrequirementsthataresuggestedtothecourt.

TheHomeOfficedefinitionofdomesticviolenceandabuseis:Anyincidentorpatternofincidentsofcontrolling,coercive,threateningbehaviour,violenceorabusebetweenthoseaged16oroverwhoare,orhavebeen,intimatepartnersorfamilymembersregardlessofgenderorsexuality.Theabusecanencompass,butitisnotlimitedto;psychological,physical,sexual,financial,emotional.Domesticabuseispervasive,andonlyasmallproportionofincidentseverreachthepointofcharge/conviction.Ifthereisanyknownconviction/charge/allegation/behaviourthatmeetsthecriteriafordomesticabuse,answerthisquestion'yes',unlessthereisevidenceofasubstantialchangeinbehaviourorthatbehaviourissohistoricalastobeirrelevant.Alsoanswer'yes',eveniftheserviceuserisnotcurrentlyinanintimaterelationship.

However,theRoSHscreeningisproduced,weexpectittobefullandaccurate.Weexpectittorefertoallknownoffencesandbehaviourthatisindicativeofpotentialriskofseriousharm,notjusttoseriousoffencesthathavebeencommitted.Itmustutilise,andbeconsistentwith,otherinformationthatisavailableatthetime,includingpreviousOASysassessments,nDeliusrecordsetc.
R2.14 DidtheRoSHscreeningindicatetheneedforafullRoSHanalysis?
ThepurposeofaRoSHscreeningistoidentifywhethertherearefactorsinthecasethatshouldbesubjecttoafullRoSHanalysis.Insomecircumstances,wheretheonlyoffending/behaviourofconcerniseitherveryminororhistorical,anexemptionfromcompletingafullanalysiscanbeusedjustifiably.Insomecircumstances,afullRoSHanalysisisneededtoexplainandjustifyanassessmentofLowRiskofSeriousHarm.Inallcaseswherethecorrectlevelofriskofseriousharmismediumorabove,afullRoSHanalysisisneededtoexplaintherationaleforthelevelthatisset.
2.15 WasafullRoSHanalysiscompletedbeforethecasewasallocated?
IncasesallocatedtoaCRC,theNPSisrequiredtodoaRoSHscreening,onOASysornDelius.Ifthescreeningindicatesthatafullanalysisisneeded,theNPSisrequiredtocompleteafullRoSHanalysis,againitmaybedoneeitheronnDeliusorOASys.TheNPSisworkingtowardscompletingallsuchriskassessmentsonOASys,butinmanyareasnDeliusisstillbeingused.IncasesallocatedtotheNPS,thescreeningandfullanalysisifrequired,canlefttobecompletedbytheallocatedresponsibleofficer.A“sufficientandaccurateriskofseriousharmassessment”will:•refertoallconvictionsandknownbehaviourwhichindicateapotentialtocauseharm•analysepreviousconvictionsandknownbehaviourtojudgethelikelihoodofharmbeingcausedinthefuture•indicatethenatureofharmthatcouldbecaused,andidentifypotentialvictims•willincorporaterelevantinformationfromotheragencieswhererequired•identifythelevelofriskofseriousharm,followingthedefinitionsonOasysIncaseswheretherehasbeennopreviousbehaviourindicatingpotentialtocauseharm,ascreeningalonewillbesufficienttojustifyananswer“Yes”.Incaseswherethereispreviousbehaviourindicatingpotentialtocauseharm,afullanalysis(OasysornDelius)willberequired.requiredtodothattoo.OntherareoccasionswhereaStandardDeliveryReportiscompleted,thescreeningandanynecessaryfullanalysiswillbecompletedaspartoftheOasysforthatreport.Inmostothercases,theROSH_FAAformonnDeliuscontainstheRoSHscreening,althoughitisnotasdetailedasthatonOasys.Itdoesnotspecificallyaskfordetailsofallpreviousviolentoffences,andrequiresthepersoncompletingittonotethoseunder“otherinformation”.HMIPexpectsthatwheretheROSH_FAAisusedasthescreeningdocument,itscreensinthesamewayasOasys,i.e.itleadstoafullanalysisinallcaseswheretherehavebeenpreviousviolent/sexualoffencesorotherbehaviourindicatingthepotentialtocauseseriousharm,includingemotional.Ideally,ifafullanalysisisneeded,theNPSwillcompletethatonOasys.Aninterimpolicyhasbeeninoperationsince2015,toallowtheNPStocompletethefullanalysisonnDelius,
wherethereare“resourceconstraints”.TheROSH_FAAcontainsthatalso.TheconsequenceofusingthenDeliusformratherthanOasys,isthattheCRChastostartanOasysfromscratch,tocompletetheinitialsentenceplan,whichisadditionalworkforthem.IncasesallocatedtotheNPS,thescreeningandfullanalysisifrequiredarelefttobecompletedbytheallocatedresponsibleofficer.So,'sufficient'couldbejustascreening(OasysornDelius)whenthescreeningdoesnotindicatetheneedforafullanalysis.'Sufficient'couldbeascreeningandfullanalysis,wherethefullanalysisisrequired.'Wherenecessary'meansinallcasesthataregoingtobeallocatedtoCRCs.Asufficientandaccurateriskofseriousharmassessmentwillrefertoallconvictionsareknownbehaviourwhichindicateapotentialtocauseharm,andwillanalysepreviousconvictionsandknownbehaviourtojudgethelikelihoodofharmbeingcausedinthefuture.
R2.16 WhatwasthelevelofRoshassessedatthepointofallocation?

StatutoryVictimsarethosewhohavebeenavictimofanoffender,whohasbeensentencedto12monthscustodialsentenceormore,foraviolentorsexualoffence.Thereisalonglistofqualifyingoffences,asanappendixtoProbationInstruction48-2014.Weareonlyinspectingcaseswherevictimsarecoveredbythestatutoryscheme,notanywhomayhavebeenoffereddiscretionarycontact.Incomplexcases,withmultiplevictims,itispossiblethatonlysomevictimsqualifyforstatutoryvictimcontact.Wheretheoffencehascausedthedeathofanindividual,the'victim'istakentobethenextofkin,ornearestrelative.Wherethe'victim'wasachildatthetimeoftheoffence,andisstillachildatthetimeoftheinspection,aparentorappropriatecarershouldbeidentifiedtoreceivevictimcontactservices.Toanswerthisquestioninspectorswillneedtoreadtheprosecutiondocuments,onnDelius.Forsomeoffences,wherephysicalviolenceoracontactsexualoffencehasbeencommitted,itisclearthattherehasbeenadirectpersonalvictim.Inothercases,suchasarsonorproductionofindecentimagesofchildren,theywillneedtoreadthedetailoftheprosecutiondocumentstounderstandwhethertherehasbeenadirectpersonalvictim.Thequalifyingsentencelengthof12monthsormoreappliestotheindividualoffence,notthetotalsentence.Insomecases,therewillbejustonevictim,inotherstherecouldbemany.EachcaseisrecordedontheNationalVictimDatabasebynameofperpetratorandthevictimsarelistedwithineachrecord.
