What’s new with DBE Participation Plans?
• Beginning January 1st, 2017 DBE Participation Plans must be
submitted to the Division no later than 5 days after the bid
opening.

Why?
49 CFR Part §26.53
• When we establish a DBE contract goal, we must award the contract only to the
bidder who makes good faith efforts to meet it. There are two ways for contractors to
demonstrate a good faith effort.
1. Document (DBE Participation plan) that enough DBE participation has been obtained
to meet the goal. Or
2. Document that adequate good faith efforts have been made even though the goal
could not be met.
• States may choose to require this information at the time of bid (as a matter of
responsiveness) or “no later than 7 days after bid opening as a matter of responsibility.
The 7 days shall be reduced to 5 days beginning January 1, 2017.”

So what?... Why does it matter?
49 CFR Part §26.101:
• If DOH fails to comply with any requirement of 49 CFR we are
subject to formal enforcement action such as suspension or
termination of Federal funds or refusal to approve projects.

What happens if the deadline is missed?
• CFR 49 Part §26.53 (d) If you determine that the apparent successful bidder/offeror has failed to meet the requirements of paragraph (a) of this section, you must, before awarding the contract, provide the bidder/offeror an opportunity for administrative reconsideration.

• A revised Special Provision for DBE Utilization is in development for use in 2017.
• Highlights from SP – Failure to submit within specified timelines may result in being deemed
unresponsive, irregular, and forfeiture of bid bond.
– Administrative reconsideration process will become more formalized
– Submittals will go directly to EEO Division via email or fax

• Major Updates – PWL New section new Item numbers 410
– Milling new item numbers etc.
– Asphalt Binder Grading – PG 64-22 = PG 64S-22
– Pavement Markings Section Rewritten
• Special Provisions: – Rubblization SP
– Ultra-Thin – Binder type
• Special Provision Coming – Intelligent Compaction
– Infrared Temp
• As per the specification, all necessary safety features must be in place to be deemed substantially complete.
• There have been projects that contain contract language that supersede the spec and determines substantial completion by other means.
• Projects that do not contain this language cannot be changed after letting/award.
• However, using the Bidx Q&A feature you can inform us of potential issues and possibly prior to the bid letting, completion dates may be extended or contract language added to alter the definition of substantial completion.

– Districts had very little help from MCS&T for 2016
– Independent Audit using PWL
Independent Assurance Issues
• 2014 FHWA did an Independent Assurance Audit.
• A finding from that was that we cannot use Contractor’s Testing results as part of our acceptance methods as it relates to the DOH Independent Assurance requirements.
• BTW – I’m no longer saying “Independent Assurance”…
• “IA”
Independent Assurance Issues
• DOH needed a plan to address these IA Findings as it’s a requirement of 23 CFR 67 to have independent assurance testing on all projects along the National Highway System
• First we would deal with Asphalt Testing
• Then Concrete Testing
• Then Aggregate Testing
Independent Assurance Issues
• This has been briefly discussed with Industry how we would do this.
• At a Construction SubCommittee meeting Paul Farley mentioned requiring the AMRL System Approach on all personnel involved in testing.
• Nobody like it.
• Logistics and more importantly $$$
Independent Assurance Issues
• As we said it’s a requirement… we looked at what is the requirement.
• On NHS routes – WV has about 2000 miles of roads that are classified as NHS routes.
• Most of which are 4 lane roadways.
• Looked at what our paving procedures are for these types of roads…. Mostly PWL.
• With the PWL specifications the DOH does all the testing for acceptance.
Independent Assurance Issues
• Thus we will not have to have to certify any Contractor’s personnel for testing.
• But…
• This will require us to use PWL in some locations we told industry we said we would rather not. Several two lane roads. WV RT 2 for example.
• That does create some issues and in those locations were we will need to do some split samples with the contractor, but again no AMRL certification required on the part of the contractor.

• Clendenin Warranty Project – The 2016 was conducted on September 26th
– Year 5 PSR is 96.4
– Year 4 PSR was 98.9
– Year 3 PSR was 99.2
• Big Otter Warranty Project: – Construction Complete: September 6, 2016
– 3.43 miles (Warranty Area = 2.96 miles)
– High RAP mixes over rubbilized concrete
– We hope that the PSR is 100

– Continue to teach the concept of preserving before failure
• We heard the Secretary and State Highway Engineer tell us that WV DOH will continue to use preservation

• Difficulty in getting mixes verified
• Trouble keeping the paver or MTV full
• Issues with poor tack coat
• Difficulty in getting compaction
• Trucking practices (too much release agent, using diesel fuel)
• MTV used when not required

• Online testing started in 2016
• How did it work…?
2016 Technician Training
449 Technicians attended training at three
different sites for the eight different certifications offered.
AFCT Techs were certified through the
Asphalt Field and Compaction Technician program.
54 Students took their exam via the online
system that can be done on either a computer
or a tablet.
Certification exams were
offered through the online testing
system.
All 8 Exams will
be offered online for the 2017
certification cycle.

• More and More Online Training and Testing • Hope to eventually get to 100%. With the
exception of practical.
• Understand this can be new and seem difficult for parts of our workforce so please fill out the survey’s that are provided at the classes this year.

technology.. We need to use it. • IT IS THE FUTURE – WE NEED TO EMBRACE IT • The DOH has it’s own LMS, which we used to
some extent last year, but we hope to implement the use of TC3 more.
