TECHNICAL EVALUATION

Bidders have to fill all Technical Data Sheets of Appendix B of Volume 4.

When expected values are provided in Technical Data Sheets, the value shall be confirmed by the bidder otherwise it will be treated as a deviation.

Bidders have to provide a pre RAM plan in accordance with Clauses 4.2.1.1 and 4.2.1.2 of Section 4 ,Volume 4. The pre RAM plan shall demonstrate the proposed facilities have ability to meet the RAM requirements specified .

Bidders have to provide details of rigid overhead catenary system as per clause ITB 24.1 (d) of BDS.

The above information is to be included in Attachment 4 of ITB Clause 9.3

Minor deviations shall be listed in Attachment 6 to the Bid as per the form contained in Annexure 10 of ITB.

ABB Limited is a large company of a repute and also Capable of carrying out large projects with it's own resources and credit limits with Indian banks. Also, as you are well aware, ABB Limited is a Market leader for Metro Rail Project business in India having executed majority of Delhi Metro Rail Projects and are also carrying out Metro Rail Projects in Bangalore and in Mumbai. In view of these reasons, the requirement of parent company guarantee & parent company undertaking may please be waived for ABB Limited. Pease confirm.

Please increase the amount of advance payment to 20% as 5% will result in a severely negative cash flow for the Contractor..

Please confirm that 5% retention money withheld from each interim payment can be replaced by an equivalent bond.Alternatively, please consider to release 50% of retention money upon Operational Acceptance of Stage 1 and the remaining 50% upon Operational Acceptance of Stage 2 (as the Performance Security shall be valid until the end of the Defects Liability Period anyway).

Please confirm that the provisions of Clause 7 do not apply as the payments shall be released to the Contractor by the Employer (see inter alia Clause 2.1).

Patent indemnity obligations cannot be extended to claims on account of the sale of the products produced by the Facilities in any country, as the Contractor cannot be liable for patent infringement of products produced in the Facility. Hence the same is to be deleted. Indemnity for patent infringement will not be provided to the Employer in the following cases: a) Modifications to the product/ equipment made in accordance with specifications/ modifications required by the Employer b) Designs/ documentation provided by the Employer c) Use of the product/equipment supplied by us, in contravention of our instructions for use.

The exclusion of the obligation of the Contractor to repair or replace defective Equipment from the overall liability cap to be removed.

Since tender provides for High Sea Sale transactions, Please confirm that the project registration with customs would be done by CMRCL for all imports for the projects and the contractor obligations will be restricted only to facilitate the clearnce of the customs.

We request you to specify the notice period in cases of termination for convenience.

The sales tax authority of Tamil Nadu is in the process of assesment for the year 2005-06 recently and hence we will not be in a postion to produce the clearance certificate due to non completion of assesment by the authorities. However, we can submit copy of VAT Registration certificate and latest monthly returns to ensure that we are registered and making regular VAT payment in state of Tamil Nadu. Please arrange to modify the clause suitably.

As per the provsiion of Tamil Nadu VAT Act , interstate Own manufactured items & imported supplies are outside the purview of the works contract in Tamil Nadu. Hence, no TN VAT will be payable for these trasanctions. Please confirm that no Works Contract TDS will be deducted on the above transactions.

For local supplies ,if contractor submits non deduction certificate from their assessing authorities , WCT should not be deducted. please confirm .

Since the project is Metro rail project and under the provision of service tax 69 , services / labour portion of Railway project is outside the ambit of service tax. Please confirm whether service tax is applicable for this project .

We request you to consider the following as Defects Laibility period.For Stage 1 : the Defect Liability Period shall be twenty four (24) months from the date of Completion of the Facilities or Thirty (30) months from the date of despatch of last consignment for the Stage 1, whichever occurs earlier.For Stage 2 : the Defect Liability Period shall be twenty four (24) months from the date of Completion of the Facilities or Thirty (30) months from the date of despatch of last consignment for the Stage 1,whichever occurs earlier.

Events mentioned in sub clauses ii, iii, iv, vi, vii, viii and ix are events beyond control of contractors and hence right of extension of time is needed. We request you to delete the above sub clauses.

Suspension of work for reasons not solely attributable to the Contractor should entitle the Contractor to costs incurred. We request you to delet this clause.

While payment of exgratia is acceptable,Providing employment to the dependent of the deceased is not acceptable. We request you to delete this requirement.

We are not responsible for registration or payment of cess under BOCW Act'1996 and Welfare Cess Rules'1998. You are requested to confirm that you shall not deduct any amount during the execution towards BOCW & Welfare cess.

As almost all electronic equipment is prepared for ambient 35°C and max. 40°C with max. 90% humidity, We request you to modify this clause accordingly. Air conditioning should be specified for these values.

As not all suppliers use AUTOCAD for drawings at allwe propose to produce all drawings with appropriate CAD-Systems and transfer them finally into dwg- or dxf-files that can be transmitted into the AUTOCAD-System. Kindly confirm that same is acceptable.

Queries Performance of the overhead line system shall be demonstrated according to OHLE/pantograph dynamic behaviour for the maximum design speed (80km/h + 10%).

Normally, a Simulation is done to determine the performance of the overhead line system when the dynamic behavior of the OHLE with pantograph interaction is studied. The tension in the OHE Conductors, pre-sag, dropper spacing etc and the pantograph characteristics such as upward pressure, primary and secondary suspension properties etc are taken into account for Simulation. The dynamic behavior is studied for various speeds and the maximum recommended speed is arrived at. This Simulation is done only for new OHLE Designs. Since we are going to use only proven designs, already certified for speeds 80 kmph and above (upto nearly 120 kmph), this Simulation may not be required. CMRL may please review & confirm.As per cl.2.2.9 ( c), it is envisaged to provide One ASS at every passenger station and Two ASS at Koyembedu depot, whereas as per cl. 3.2.4.4, it is envisaged to proVIDE One ASS at every passenger station and Three ASS at Koyembedu depot. Please clarify and confirm the requirement. “It is envisaged to provide one ASS at every passenger station and 2 ASS in Koyambedu Depot”.In Underground Stations also, will there be only 1 ASS with 2 transformers?.Incoming bays, Power Transformer bays & coupling bays (at RSS):The description of these clause refers / suits for Air-Insulated Substation, whereas the requirements are gas Insulated Substations. Please clarify and may amend the specification.As per clause 3.2.1.4.3 e, gas flooding system is required for all equipments in the switchgear room, wheras as per clause 6.6.2.4.5.9.8, 4 Nos of 5kG CO2 portable fire extinguishers shall be supplied for the power equipment room. Please clarify and confirm the requirement of fire protection system for switchgear / power equipment room.We presume that acquistion of land, right of way & other permissions for laying 110kV cabling works shall be in the scope of CMRL. Please confirm.

Queries Supply and erection of a) HV (110 KV) Cables from the TNEB metering station to RSS. Contractor will provide these cables and terminate them in the Cable end boxes / cable termination structure at the TNEB metering station at one end & CMRL RSS at the other end.

CMRL may clarify• Who will provide the Cable termination Structures in the TNEB Metering Station• Who will provide the Instrument Transformers (CT, PT), for protection and measurement, in the TNEB Metering Station• Incidentally, there is no “Interface Sheet” (between AEP-01 & TNEB), in the Bid document. CMRL may consider providing a suitable interface sheet.This item talks about ‘foundations’ for OHE. It is understandable if it is only for ‘at-grade’ sections. Normally, the Viaduct and the parapet are designed taking into account the loads due to OHE and the Holding Down Bolts are provided by the Viaduct Contractor where the OHE Contractor ‘fastens’ the OHE mast via Base Plate and Nuts. The drawing also shows a “Typical OHE Mast foundation on Viaduct”. The arrangement needs to be clarified.“Automatically switched neutral section at all neutral sections and feeding posts”, is included. The “Traction feeding and Sectioning Diagrams” show “Short Neutral Sections”. CMRL may please clarify as to what system is intended to be used.

In the list of items included in the Scope of Work, “Supply and erection of Booster Transformers and Spider return Conductors, if required (items) is also included. It is not clear who will decide, and how, whether the BT’s and RC is required of not. This will have a substantial implication on the Contract price CMRL may please clarify. In the same list (item 4), it is stated, “Mast Foundations and Geotechnical investigations shall be done as per foundations design and calculation”. It is not clear. CMRL may please clarify.

The Auxiliary Transformer capacities have been specified in this para. Since we do not have any control on the downstream loads and the same (downstream loads) are not in our scope of works, we shall consider specified capacities for auxiliary transformers, for estimating the lumpsum price. Specification calls for complete painting in the metal surfaces of the switchgear. However we will offer panels made up of special environment friendly material called "Alu Zinc" which is used globally by leading switchgear manufacturers. Alu Zinc is light in weight, has more strength, and extremely corrosion resistant compared to normal CRCA sheets and this does not require any surface treatment like powder coating. Panels shall be made up of Alu Zinc material except front doors & end covers which shall be painted sheet steel. We shall provide powder coated paint only for front doors and end covers,which shall be made of CRCA sheet.

As per this notification, all imports are eligible for a basic customs duty of 5%. Kindly confirm that these notification and concessional customs duty rate of 5% is applicable to Chennai Metro Rail Project also.

As per tender conditions, this project is eligible for "Deemed Export" benefits and also this tender is being called under ICB and funded by JICA, please confirm whether Project Authority Certificates will be issued to enable us to get the claim of deemed exports benefits under Foreign Trade Policy.

Please confirm whether all taxes and duties such as CST, VAT, ED, Import duties (CVD+Customs Cess+SAD ) will be considered for evaluation purpose.

We request to allow contractors to submit their price breakups for each cost centres as per the actual calculations and we request you no to limit with apportionments.

Since the price break up in the tender is on milestone basis and the milestone includes supply, installation and testing at site, the invoicing for milestones can be done only after completion of testing at site. The time lag between supply and successful tetsing at site would be too long for getting the payments and this could adversley affect the project cash flow in turn the projectprogress. Hence, we request you to accept a break up of cost centres based on supply separately and installation & testing separately.
