1.0 PURPOSE

The purpose of this document is to define the Skikda New LNG Train Project responsibilities for the coordination of all parties involved in the inspection and test activities, at fabrication shops and jobsite that are subject to the approval and acceptance of the Algerian Regulatory Authority (ARA), through agencies Direction du Patrimoine Energie et des Mines (DPEM), and National Office of Legal Metrology (ONML).

2.0 GENERAL

The requirements of this procedure apply to the equipment, devices and material that are subject to ARA control. These requirements do not have any effect on the inspections required by Purchaser and any waiver by ARA is not to be construed as a waiver of any other requirements for inspection by Purchaser or any other obligation of the Supplier noted elsewhere in the Purchase Order.Supplier and Suppliers sub-suppliers will be subject to inspection of all materials and equipment being manufactured or supplied. The Supplier shall pass on the requirements of these DPEM inspections to all of the Suppliers contracts (purchase orders) to its sub-suppliers. These inspections are in addition to any other inspection or testing requirements noted elsewhere.

The Supplier will undertake to facilitate all inspections made by ARA, Client personnel, or other third parties related to ARA or Owner, under authority of ARA, on the premises. The Supplier further undertakes to facilitate ARAs attendance at all inspection or acceptance tests planned or required by contract to be conducted by the Supplier or Sub-supplier.

REFERENCE: DPEM Circular No. 2 & 4, Algerian Decrees 90-245, 90-246 & 88-353.0 TYPE OF EQUIPMENT SUBJECT TO DPEM CONTROL

The following types of equipment are generally subject to DPEM regulations and testing when they meet the criteria detailed below.

Pressure equipment, with conditions.

Safety systems such as CO2, fire water pump and foam extinguishing systems.

Fire fighting gas bottles and mass-produced pressure bottles of ASME UM design (stamped or not)

Electrical equipment rated at 5.5 kV or higher.

Pressure Safety Valves, with conditions.

Valves (Control Valves, and other valves meeting piping criteria)

Gas or vapour compressors, with conditions.

Instrument Air Compressors- air compressor casing

Fire extinguishers whose capacity exceeds five (5) Litres, with conditions.

Auxiliary Systems for Packaged Equipment

Filters, fuel gas filters.

Lifting device above 5 tons. (ex: Overhead Crane and Man Lifts) Shop Fabricated & Field-Erected Tanks (see paragraph 6.2.4)A Preliminary and a Final Dossier are required for all the equipment and material falling within DPEMs scope.

For off-the-shelf, (stock) items of piping materials safety systems components, electrical power cables or other electrical items (5.5 Kv and higher) that fall under the DPEM criteria, the supplier shall submit a Technical File The contents of the dossiers above are detailed in Sections 7.4, 7.5 and 7.7 of this procedure. All documents must be provided In French & English and in quantities shown in Section 10, and as summarized in Attachment 3.4.0 DEFINITIONS

The definitions below refer to terms used in this procedure and are used for convenience of reference in this procedure only. Contractual terms shall be as defined in the Project Terms and Conditions of Purchase.

Preliminary & Final Dossier: A compilation of mandatory documents which provides a record of quality checks performed by the Supplier throughout the design and manufacture of the item. The Dossiers require Algerian Regulatory Authority approval.

Direction du Patrimoine Energie et Mines (DPEM): An Algerian Regulatory Authority Agency responsible for compliance with applicable decrees and regulatory technical controls, and for performing independent Inspection and Witness of Equipment Test at fabrication locations and Algerian construction Sites.

National Office of Legal Metrology (ONML): An Algerian Regulatory Authority Agency responsible for compliance with applicable decrees and regulatory technical controls, and for performing independent Inspection and Witness Testing of Fiscal Metering Package at Suppliers location and Algerian construction Sites.

Quality Control Plan (Inspection & Test Plan): Purchase Order specific document that clearly identifies in chronological and sequential order all manufacturing Inspection & Testing requirements performed by the Supplier / Sub-supplier with facility for all parties to indicate proposed Quality Control activities. The Quality Control Plan identifies the witness and hold points for the Supplier, Purchaser, Owner and ARA. Owner and ARA witness and hold points will be provided by Purchaser Supplier Document Requirements (SDR): A listing of documents required to be submitted to Purchaser including document submittal codes and target dates for submittal. Inspection and Test Plan (ITP): A Purchasers quality control form contained in requisitions. Originals: The supplier document that contains wet stamp, signatories and endorsed original from which copies are made. The originals of the Dossiers shall be delivered to the Purchaser.

5.0 RESPONSIBILITIES

5.1 Purchaser

The Purchaser (KBR) is responsible for the following:

Facilitating the service agreement between Purchaser and the relevant ARA.

Advising the Supplier of relevant ARA involvement by including this procedure in the inquiry (request for quotation) documents.Ensuring Purchaser Inspector performs a review of Preliminary & Final Dossier at Supplier location prior to submittal to Purchasers home office for processing and forwarding to ARA.

Controlling and expediting the submission and distribution of the Suppliers Preliminary and Final Dossier to the relevant ARA and Owner.

Ensuring the Purchasers inspector performs the required activities prior to the ARA Inspection.

Issuing all inspection and test notifications to relevant ARA per Section 11.0, and confirmation of ARA inspection activities to the Supplier.

5.2 SupplierThe Supplier is responsible for the following:

5.2.1 Identifying, in the Bid, all items, components and/or appurtenances in the scope of supply that meet the criteria of paragraph 6.0 and, hence, are subject to ARA involvement. This is particularly important for equipment such as compressors, control valve actuators, hydraulic power supplies and the like that contain piping, accumulators, filters and other components and appurtenances that are dependant on the Suppliers design.

5.2.2 Submitting to Purchaser an overall schedule, including tests, within the time shown after receipt of Purchase Order in the Purchasers SDR included in the Purchase Order.5.2.3 Ensuring that Attachment 1 Document 2, Certification by the Chamber of Commerce of the Fabricator Signatures Algerian Consulate Stamp and Document 3 Certificate of Conformity and of Internal and External Inspections, Attesting that the Equipment Constructed Conforms to the Country of Origin is completed and fully signed by all parties, including the Fabricators local Chamber of Commerce (as applicable). 5.2.4 Ensuring Certificate of Conformity and of Internal and External Inspection (Attachment 1 - Document 3) are stamped by the Algerian Consulate.

5.2.5 Compiling the Preliminary Dossier and submitting it to the Purchaser preferably 6 weeks after purchase order / sub-order placement (but not less than 50 calendar days prior to commencement of fabrication) for items relevant to DPEM / ONML involvement. See Attachment 1 for Contents of this Dossier.5.2.6 Issuing to the Purchaser all inspection notifications for DPEM / ONML activities as indicated in the agreed Quality Control Plan. Notifications shall be made at least 45 days in advance the tests in accordance with the production and testing schedule. (See Section 11.0)5.2.7 Ensuring the applicable documentation is prepared and available for DPEM inspectors review prior to test, per Section 8.1.5.2.8 Submitting Final Dossier to Purchaser within thirty (30) calendar days after successful completion of scheduled works and prior to shipment.5.2.9 Ensuring a French and English copy of each approved Preliminary Dossier is retained for DPEM Inspectors review per paragraph 8.1.5.3 DPEM / ONML

The DPEM/ONML is responsible for the following:

5.3.1 Approving the Preliminary and Final Dossier of designated equipment and materials as indicated in the Convention (Contract).

5.3.2 Reviewing and approving Preliminary Dossier and issuing approval consent within forty five (45) calendar days of submission.

5.3.3 Confirming attendance or non-attendance by their representative at the indicated inspection activity, per Suppliers Quality Control Plan (Inspection and Test Plan).5.3.4 ONML is responsible for the Independent Inspection and Witness calibration of Fiscal Metering packages.

5.3.5 Endorsing all relevant Final Dossier documents at Suppliers facility (Documents 19, 20 & 22) during their visit.

6.0 ITEMS SUBJECT TO involvement of dpEM / ONML

6.1 General:If a device (pressure container) or material is within the DPEM scope as defined below, the supplier is notified by the inclusion of this procedure in the procurement package. Members of DPEM will conduct an inspection or witness testing. If DPEM does not attend, they may request the Purchaser to assign a third party to inspect or witness on their behalf. 6.2 Detailed Requirements and Criteria Pressure Devices (Reference: Algerian Decree 90-245, Gas Pressure Equipment) The following items are some examples that are considered as pressure devices:

Furnaces-C02 Bottles (and other gasses) Reactors-N2 Fire Extinguishers Columns-Compressor Heat Exchangers-Piping Air Coolers-Pressure Vessels Separators-Filters

Please see Attachment 7 for Equipment Listings that require DPEM presence. For detailed information see the individual Articles6.2.1 Other Gas Pressure Devices (Pressure Containers)Gas Pressure Devices that are not steam or hot water vessels come within DPEM scope when they are handling liquid hydrocarbon, compressed gas, liquefied or dissolved gas and pressurized overheated liquids, and if the following conditions are simultaneously met (Decree 90-245, Article 2, Item 1): The design pressure exceeds 4 BarG The characteristic number; i.e. the product of the design pressure expressed in BarG, multiplied by the capacity expressed in Liters, exceeds the number 80.

6.2.2 Steam Pressure Devices (Reference: Algerian Decree 90-246, Steam Pressure Equipment)

This portion of the Algerian Regulations is not applicable to this procedure for the Skikda New LNG Train Project.6.2.3 Storage Tanks

The hydrocarbon, hazardous product and fire water storage tanks are within the scope of DPEM.

The water storage tanks (other than fire water) are not subject to DPEM inspection

Tanks operating at atmospheric pressure, with direct access to the atmosphere, are generally excluded from the scope of DPEM. Supplier is required to notify and obtain the advice of the Purchaser for any tank designed to contain hazardous liquids which could, under maximum overfill conditions, be subject to a hydrostatic pressure such that the stress in any member is equal to, or exceeds, five eighths (5/8) of the elastic limit of the material being used.

6.2.4 Pumps (Decree 90-245, Article 2, Item 1)

Pumps, except firewater pumps, are generally excluded from the DPEM scope but Supplier / Sub-supplier shall notify and obtain advice from Purchaser for any pump which has a fabricated casing or body. In that case, the criteria for gas pressure devices, paragraph 6.2.2, shall apply.

6.2.5 Turbines

DPEM does not witness the testing of the turbines but will witness its components that are under DPEM jurisdiction (e.g. lube oil systems/piping systems).

6.2.6 Compressors (Decree 90-245, Article 1, Item 3)

Compressors of gases or vapors other than steam are within the DPEM inspection scheme if the following two conditions are simultaneously met for the fluids specified.

A. Non hazardous liquids

Delivery pressure exceeds 10 BarG Characteristic Number, i.e., the product of the maximum delivery pressure (expressed in BarG), multiplied by the maximum design flow rate under delivery conditions (expressed in cubic meters per minute), exceeds the value 50.

B. Hazardous liquids (Explosive, flammable, toxic or corrosive)

Delivery pressure exceeds 4 BarG Characteristic Number exceeds the value 20.

C. DPEM shall attend hydrostatic testing of casting or body.

6.2.7 Appurtenances

Supplier is reminded that electrical ancillaries, instruments, filters and interconnecting pipe work will be subject to DPEM scrutiny if they exceed the characteristics defined in the relevant paragraphs of this procedure.

6.2.8 All Gas Pressure Devices (Pressure Containing Equipment)Supplier shall ensure that the equipment is designed for hydrotest at 1.5 times the design pressure in the installed condition. Further, under a pressure equal to the design pressure, the stress in the metal in the wall under pressure is less than the lower of the following two values: One third (1/3) of the tensile strength of the metal at normal temperature

Five eights (5/8) of the yield stress (0.2% permanent elongation) of the metal at maximum operating temperature.

If the operating conditions are likely to cause creep of the metal, the work rate must also be limited according to the specified temperature and service life.6.2.9 Motors and Engines

Low voltage utility Motors and Engine drivers are not normally subject to DPEM scrutiny. High voltage and fire or emergency service motors and engines may come under their scrutiny. If an item comes within the DPEM scope, a Preliminary Dossier is required to be submitted for DPEM review and approval.

A. Motors are subject to DPEM inspection if:

The maximum voltage rating is equal to or exceeds 5.5 kV

The motors drive fire pumps or other essential or emergency services

DPEM shall attend routine and final acceptance tests of motors.

B. Engines are not normally subject to DPEM scrutiny unless they drive, either directly or indirectly, fire pumps or other essential or emergency service. In these cases Preliminary and Final Dossiers shall be submitted.

C. Appurtenances: Electrical ancillaries, instruments, fuel / oil filters, pneumatic and hydraulic accumulators, and interconnecting pipe work will be subject to DPEM scrutiny if they exceed the characteristics defined in the relevant paragraphs of this procedure.

6.2.10 Mechanical Handling, Passenger Lifts / Man-riding Hoists, Overhead Cranes, For Mechanical handling equipment where the designed safe working load equals, or exceeds, 5 metric tons, DPEM require that one of its accredited Algerian third party inspection agencies (like ENACT) attend load testing.

For items deemed within the scope above, a Technical File will be submitted for the inspection agency for review and approval.

6.2.11 Electrical (Reference: DPEM Circular No. 2)

Electrical equipment may be subject to DPEM scrutiny. For items deemed within the scope, a Preliminary Dossier, containing design premises etc., is to be submitted for DPEM review and approval.

The following electrical equipment and material are within the DPEM scope if the voltage rating is equal to or exceeds 5.5 kV.

A. Transformers

B. MCC

C. Switchgears

D. Switches (Large transition switching units)

E. Generators

F. Motors

G. Cables

DPEM retains an interest in emergency power supplies and other safety related aspects such as grounding arrangements, lightning protection, interlocks etc. Details of emergency switchboards and safety related aspects may be required.

DPEM shall attend final acceptance tests of electrical appliance to confirm compliance with IEEE, IEC and NEMA regulations

6.2.12 Instruments

With the exception of Pressure Safety valves, instruments and instrument material are not normally subject to DPEM inspection.

A second Algerian Authority ONML (National Office of Legal Measurement) will be concerned only with legal measuring components or systems, such as Fiscal Metering devices.A. Pressure Safety Valves & Control Valves

Pressure Safety Valves are within the scope of DPEM. These valves need to be checked for opening and closing pressures and tightness. Their primary concerns will be the disposition of PSVs within a system, the witnessing of off-line tests and correct installation. Design appraisal and witnessing of tests of individual PSVs in the factory will, if at all, be limited to large, novel or particularly critical applications. Supplier shall notify Purchaser of any non -standard items and obtain advice. The valve body shall be classified by the criteria shown for piping materials.

Control valves that will contain potentially hazardous gasses or liquids under pressure may also be within the scope of DPEM, in which case the above requirements for design appraisal and testing shall apply.

DPEM shall attend hydrostatic testing of Pressure Safety Valves and Control Valves. (Functional Test, Pressure Setting, Leak Test).

B. Legal Measuring Instruments

Instruments concerned with measurement of physical properties of a product for custody transfer are subject to approval, calibration and certification by ONML. A Preliminary Dossier shall be prepared for each type of instrument, such as LACT, MPFM, or other fiscal metering device.C. General InstrumentsAll instruments and instrument material shall be selected and /or designed such that they are suitable for the purpose for which they are intended to be used. Instruments with an electrical content that could therefore be spark or heat-generating shall be suitable for use in the area specified and defined by the Hazardous Area drawings, and as stated in the Purchase Order or Subcontract and its attachments.D. CertificationsSuitable internationally recognized Hazardous Area Certification shall be submitted to PURCHASER for all explosion proof electrical instruments intended to be located in hazardous areas.

6.2.13 Piping, Process Piping and Pipeline System

Piping material may be subject to DPEM control. For items deemed within the scope, a Preliminary Dossier, containing design premises etc. is to be submitted.

A. Process Piping (Ref: Decree 90-245, Article 2, Item 4)

The piping for plant is subject to DPEM inspection if the following three (3) conditions are simultaneously met:

The design pressure exceeds 10 BarG The internal diameter exceeds 80 mm

The Characteristic Number, i.e., the product of the design pressure expressed BarG, multiplied by the internal diameter expressed in mm, exceeds the number 1500.

B. Piping for Flowlines and Export Pipeline (Ref: Decree 88-35)

This portion of the Algerian Regulations is not applicable to this procedure for the Skikda New LNG Train Project.6.2.14 Valves

Valves, other than control valves and PSVs, made in accordance with internationally recognized Codes and Standards are considered by DPEM as pipe fittings.For non-standard valves, the criteria laid down for Pressure Vessels in Section 6.2.2 will apply.

DPEM shall attend hydrostatic testing of valves within its scope (body hydro and leak test).

6.2.15 Process Pipe & Pipe Fittings (Supplier shop fabrication and field fabrication) Pipe and pipe fittings for use in services other than steam and water are within the DPEM inspection scope if the following three (3) conditions are simultaneously met:

A. Non-hazardous gases and liquids other than steam or water Inside Diameter > 80mm

Design Pressure > 10 BarG Characteristic Number > 1500 (the product of the design pressure expressed in BarG multiplied by the internal diameter expressed in mm, exceeds the number 1500) B. Explosive, flammable, corrosive or toxic gases or liquids

Inside Diameter > 80mm

Design Pressure > 4 BarG Characteristic Number > 1000

C. Requirements for Steam and Super-heated water pipes are not applicable to the Skikda New LNG Train Project due to the diameter of the pipe.

NOTE: Cold water pipes are not within the DPEM inspection scope.

6.2.16 Piping Specialties

Piping specialties are considered by DPEM as pressure retaining items. The criteria laid down for pressure vessels in paragraph 6.2.2 of this procedure apply.

6.2.17 Loss Prevention Systems and Equipment

Loss prevention systems and equipment are normally subject to DPEM control. For items deemed within the scope, a Preliminary Dossier, containing design premises etc is to be submitted for DPEM review and approval before manufacture starts. (Ref: Circular No. 2).A. Fire Fighting

Fire fighting systems are within the scope of DPEM. DPEM will appraise firewater distribution, drawings, firewater demand calculations, the positions of hydrants, monitors, hose-reels etc.

Foam, powder and inert gas systems will similarly be examined.

Fire extinguishers and other mobile or portable fire fighting devices shall also be examined for suitability of design and construction as well as their disposition on site.

DPEM shall attend hydrostatic testing and functional testing for all fire fighting equipment.

Pressure retaining items shall be considered as pressure vessels as defined in paragraph 6.2.2 of this procedure. Supplier shall notify and obtain the advice of Purchaser regarding the inclusion of any pressure retaining item within the DPEM scope.

B. Bottles of Carbon Dioxide, Nitrogen and other gasses are within the DPEM scope if the following two conditions are simultaneously met:

Design pressure greater than 4 BarG The product of the design pressure expressed in BarG multiplied by the capacity expressed in Liters; exceeds the number 10.NOTE: CO2 and N2 gas bottles are typically supplied to the Supplier direct from their Sub-supplier, under the Suppliers responsibility, in accordance with the specification provided. Supplier shall submit Preliminary and Final Dossiers in accordance with this procedure. When the DPEM Engineer visits site and reviews the dossiers, they will stamp the bottles alongside the supplied serial number, manufacturer name and date of manufacture. These stamps are required to enable refilling of the bottles in Algeria.C. Fire Extinguishers (with parts having a capacity greater that five (5) liters) are within the DPEM scope if the following two (2) conditions are simultaneously met: (Ref Decree 90-245, Article 2, item 5) Design pressure greater than 4 BarG The product of the design pressure expressed in BarG, multiplied by the capacity expressed in Liters, exceeds the number 80, or if the capacity is greater that one (1) liter, the product is ten (10)D. Fire & Gas Detection Equipment (in Plant Safety Dossier) gas, flame, smoke, cold and heat detectors and alarms shall be subject to DPEM approval. Location drawings and details of each detector type deployed shall be submitted.

The fire and gas system logic, panels, and data transmission is subject to DPEM review.

DPEM shall attend functional tests of Fire and Gas Detection systems.

6.2.18 Sewage Networks (Ref: DPEM Circular No. 2, Plant Safety Dossier)

Sewage Networks shall be within DPEM scope. The following shall be subject to control by DPEM:

A. General map of sewage networks

B. Construction of sumps and manholes

C. Hydraulic guard against flame spread / propagation

D. Calculation of sewage network flow rates

E. Material used.

6.2.19 Pipelines associated with Hydrocarbons Productions (Ref: DPEM Circular No. 4, Pipeline System Dossier, and Decree 88-35) See paragraph 7.8 for Table of Content The following pipelines are considered as associated with hydrocarbons production:

A. Flowline pipelines that connect either the wellhead to the center for hydrocarbon gas processing or separation and processing centers to the re-injection facilities, or the separation centers to the flow main centers (C.P.C).

B. Service pipelines that connect the re-injection facilities to injection wellhead.

C. Sewers that connect either the processing centers to the main pipelines, or either flowline main centers to main pipelines, processing and separation centers located in an exploration license area to a re-injection center in another exploration license area.6.2.21For package units, skids and systems, the Supplier is to review the individual components to see if they fall under DPEM regulations, if so, each individual item requires a Dossier. The Supplier shall supply KBR with a detailed list of each individual component and their characteristics that relate to DPEM criteria for that type of equipment (ex.: design temperature and pressure, flow rate, volume and size).7.0 Documentation SUBMITTALSThis Section details documents to be prepared and submitted by suppliers, subcontractors and/or the contractor, and the general sequence of submittal. (See also paragraph 10.0 and Attachment 5) 7.1 Suppliers Bid Inclusion (Pre-Award)

The Purchasers Requisition Form SDR will indicate the requirement to submit Preliminary and Final Dossiers or Technical files for relevant items, parts and appurtenances of the scope of supply that are to be involved with the DPEM based on the criteria listed in Section 6.0.

The Supplier shall include within his quotation the relevant items/parts of the scope of supply that are in accordance with the criteria.

The Supplier shall also confirm that his quotation includes all documentation and submittals relative to DPEM involvement (Schedules, Preliminary Dossier, Final Dossier, Technical Files and relevant Test Data) in accordance with this procedure and SDR.

The Supplier shall be aware of the documentation requirements contained in this procedure. It is incumbent on each Supplier to ensure that the necessary reviews and approvals can be obtained in a timely manner such that there will be no slippages in equipment deliveries.

Summarized ARA document submission and Inspection Notification Schedule etc, are shown in the DPEM documentation and activities Coordination Schedule (see Attachment 5 for reference).

7.2 Inspection Coordination Schedule

The Supplier is to prepare an overall schedule including shop fabrication, inspection and testing activities and document submission that can be used by the Purchaser and DPEM for planning inspection visits for the equipment, and to maintain the schedule updated as required. The schedule is to be issued to Purchaser within the time after Purchase Order commitment as indicated in the Purchase Order form SDR. Further submissions shall be attached to the weekly/monthly report or made as required by the. SDR.7.3 Quality Control Plan (Inspection & Test Plan)

The Supplier is to submit a specific and unique Purchase Order Quality Control Plan (Inspection & Test Plan) in accordance with project requirements (SDR) to cover all the activities; Fabrication, Inspection & Test performed by the Supplier necessary to provide the equipment (See Attachment 1, Document 8).

Purchaser Requisitioning Engineer, Quality Manager, and Project Procurement Quality Control Manager will review the Suppliers Quality Control Plan (Inspection & Test Plan) which must be tied together with the Suppliers Fabrication Schedule in the shop.

The DPEM Representative will be invited to witness the testing of equipment in accordance with the criteria stated in paragraph 8.1 The Supplier is responsible for indicating on the Quality Control Plan (Inspection & Test Plan) the required Inspection/Testing activities of the DPEM in accordance with the criteria stated in paragraph 8.1.

7.4 Preliminary Dossier Supplier shall prepare Preliminary Dossier in accordance with this document and submit to Purchaser. The Purchaser will check the Dossier and submit to DPEM for approval.Preliminary Dossier for items relevant to DPEM involvement is to be submitted to the Purchaser preferably 6 weeks after purchase order / sub-order placement but no less than 50 calendar days prior to commencement of fabrication of the relevant item.

Purchaser shall submit the Preliminary Dossier to the DPEM for approval on the Suppliers behalf. Purchaser shall also expedite the required approval and inform the Supplier when this has been obtained.

The Preliminary Dossier shall be composed of the documents mentioned below.

The Preliminary Dossiers shall be separate to the Final Dossier and shall be complete with a cover sheet (per Attachment 1) and an index with clearly indicated section dividers containing the relevant document number, indicating selected contents.

Provide a Table of Contents, (if more than one volume, each volume shall have Table of Contents)

Section 1A letter of request for approval of the Preliminary Dossiers (Attachment 1 Document 1). Supplier to complete and insert (2 originals in English & French). Signed by the responsible Supplier Project Director or Manager.Section 2Certification by the local Chamber of Commerce of the Fabricators Signatures and Algerian Consulate Stamp (Att 1, Doc 2) (2 originals in English & French). It requires endorsement and stamping by Chamber of Commerce or State Department & Algerian Consulate. This document is the Suppliers responsibility for completion including the signature of the local Chamber of Commerce and the stamp of the nearest Algerian Consulate to the place of fabrication.

Section 3Certificate of Conformity and of Internal and External Inspections (Att 1, Doc 3) (2 originals in English and French). Requires endorsement and stamping by local Chamber of Commerce or State Dept. & Algerian Consulate. This document is the suppliers responsibility for completion, including the stamp of the nearest Algerian Consulate to the place of fabrication. Section 4Equipment / Material description (Att. 1, Doc 4)

Section 5Design Calculations (Att. 1, Doc 5)

Section 6Drawings and Data Index listing the pertinent document numbers applicable to the equipment (Att 1, Doc 6) include general arrangement drawings other relevant detailed drawings and / or data sheets.

Section 7Approved Welding Procedure Specifications (WPS) (signatures affixed) Section 8Quality Control Plan (Inspection and Test Plan) (Att 1, Doc 8).

The above Dossier, once completed per sample Attachment 1, shall be sent in accordance with Purchase Order SDR to Purchasers Document Control Center, who shall submit them to the relevant parties.

The Supplier shall not proceed with fabrication activities before obtaining DPEM approval. Time frame for approval, including transmission period is 7 weeks after receipt of the Preliminary Dossier by the Purchaser who checks it and sends it to DPEM. After this period the Purchaser shall authorize the Supplier to commence fabrication in the absence of a DPEM reply.Notes:

1. An advance Preliminary Dossier can be forwarded without the official Countrys Chamber of Commence or State Department or equivalent entity and Algerian Consulate stamping and signature for Section 2 and 3 in cases where these documents would require a lot of time and cause a delay in the transmission of the Preliminary Dossiers to the DPEM. In the Preliminary Dossier, Supplier shall state that the Chamber of Commerce and Algerian Consulate stamping and signature is being obtained and in progress. The outstanding stamped and endorsed documents, sections 2 and 3 are to be transmitted by the Supplier to Purchaser within 3 weeks of the Preliminary Dossier submittal.

2. A series of identical equipment shall be grouped in one (1) single Preliminary Dossier; however, this file must indicate each item number in the complete list. A Final Dossier must be provided for each item.

3. For equipment description (Section 4) for reactors, columns, heat exchangers, air coolers exchangers, compressors, separators, filters, pressure vessels and tanks, the DPEM model (Attachment 1, Document 4) shall be used.

For equipment description for other pressure devices (valves, pressure safety valves), electrical equipment and material and for the overhead cranes, the DPEM model (Attachment 1, Document 4) shall be modified with regard to the specifics of each kind of apparatus.

4. The calculations (Attachment 1, Section 5), concerning the pressure devices required in the Preliminary Dossier shall detail principally the thickness of the parts under pressure (shells, heads, nozzles) and opening reinforcements.

5. The Welding Procedure Specification (WPS) is required only for pressure devices, tanks, valves and line pipes for pipeline.

6. Number of copies required to be submitted are shown in Section 10 of this procedure.

7. The Table of Contents in Attachment 1 is mandatory for pressure equipment. If a section is not relevant, please indicate Not Applicable.

8. Purchaser recommends that documents 1, 2 & 3 (of Attachment 1) are produced on relevant supplier / sub-supplier letter head paper.

9. Supplier is required to retain a copy of each Preliminary Dossier (English and French) for DPEM inspectors review during the shop visit.

10. The Preliminary Dossier is a separate document from the Final Dossier.

11. The Purchasers assigned inspector, where possible, will review and endorse the Preliminary Dossier at the Supplier / Sub-supplier location to ensure correct compilation prior to submittal to the Purchaser.12. If changes to the work are made after approval of the Preliminary Dossier, for example, item tagging, or instrument manufacturer or model number, a revised dossier must be submitted in the same manner as the original.13. The requirements for endorsement and stamping by the Chamber of Commerce, Department of State or other such entity prior to stamping by the Algerian Consulate vary from country to country. PURCHASER advises the Supplier to verify the requirements in their country as soon as possible. In some areas the Supplier may find a document authentication service provider to obtain the endorsements and stamps.

7.5 Final Dossier

The Supplier shall prepare a Final Dossier in accordance with this procedure as per Attachment 2. The Final Dossier is separate from the Preliminary Dossier and shall be completed with a cover sheet (Attachment 2) and an index, with clearly indicated section dividers containing the relevant document number, indicating section contents.

The Final Dossier for relevant items of DPEM involvement is to be submitted to the Purchaser within 30 calendar days after successful completion of scheduled works and prior to shipment.

The Purchasers assigned inspector will review the Final Dossier at the Suppliers location on successful completion of scheduled DPEM test activities to ensure correct compilation prior to submittal to Purchaser.

This shall include the drawings in Section 6 of the Preliminary Dossier plus any other applicable drawings.7.6 Plant Safety Systems Dossier (Ref DPEM Circular No. 2)A Plant Safety File dossier is a Purchaser/Contractor-compiled document for a site installed system, and shall be submitted to DPEM by the Contractor prior to Pre-Commissioning. The files of the safety systems must be approved by DPEM, with concurrent review by a designated Sonatrach Safety Manager. To this end, the Supplier shall transmit to the Purchaser/Contractor (KBR) a Technical File covering his scope of work, for the systems listed below; to enable the Purchaser to include the data in the safety system file dossier.

A. Emergency shutdown system

B. Flare network

C. Fire, heat, cold, smoke and gas detection

D. Fire fighting systems (Network of fire water, CO2 and chemical extinguishing systems).

E. Grounding network

F. Lightning protection system

7.7 Technical File (For Safety System Components and certain other items as indicated in 7.6 )

To facilitate approval, the Supplier shall prepare a Technical File containing the documents listed below as appropriate, and send them to the Purchaser. All documents must be provided in French & English.

This document is the suppliers responsibility for completion, including the stamp of the nearest Algerian Consulate to the place of fabrication.

Section DEquipment / Material description (Att 1, Doc 4).Section ECopy of letter or fax requesting the presence of DPEM Inspector (Att 2, Doc 11). (Purchaser will provide to Supplier, as applicable).Section FInternal & External Inspection certificate (Att 2, Doc 18) (2 originals in English & French) signed by attending DPEM or his delegated representative, Purchasers & Suppliers Inspectors.Section GHydrostatic Test Certificates (Att 2, Doc 19). (2 originals in English & French), signed by attending DPEM or his delegate representative or Purchasers & Suppliers Inspectors to include Suppliers test certificates or ASME U1A form or TEMA forms.Section HMaterial Test Certificates (MTRs): Legible certificates, identifying materials, parts components, including welding electrodes (Att 2, Doc 15). NDE reports (Att 2, Doc 16) if applicable.

Some equipment may require a different format for the technical file. The Supplier may propose a format to Purchasers ARA Liaison coordinator for approval. The ARA Liaison coordinator is identified at the Kickoff meeting or Pre-inspection meeting between the Purchaser and Supplier.The front cover for Technical File dossiers shall be modified to say Technical File (See sample Dossier Cover page, Attachment 1 or 2).

The Technical Files shall be sent to Purchaser within 14 calendar days after issue of a Purchasers Inspection Release Certificate. Purchaser will then forward to DPEM for review and approval.7.8 Pipeline System Dossier:This portion of the Algerian Regulations is not applicable to this procedure for the Skikda New LNG Train Project.8.0 Scope of DPEM Inspection (DPEM Circular 02 and 04)

The list below summarizes typical Test and Inspection activities to be witnessed, and/or documents to be reviewed, by the DPEM.8.1 At Suppliers Shop

8.1.1 DPEM will witness testing including, but not limited to, tests listed here.

A. Review of Material Test Certificates.

B. Review of Test and Inspection Records previously conducted by Supplier.

C. Visual and Dimensional Check.

D. Non Destructive Test Reports where applicable.

E. All Hydrostatic Tests Pressures to be a minimum of one and a half (1.5X) times the Design Pressure.

F. Functional or Performance Test where applicable.

8.1.2 For all inspections, Supplier shall make available for Purchasers & DPEM inspection, the complete inspection, test records and certificates, whether witness or non-witnessed.

8.1.3 The Supplier shall also have available a copy of each approved Preliminary Dossier (for the DPEM Inspector).

8.1.4 If the results of the test are satisfactory, DPEM Inspector (or his delegate) witnessing the testing shall sign the test certificates (Document 18, 19 and/or 21), jointly with representatives of Purchaser and the Supplier. The DPEM Inspector shall then stamp the inspected equipment.

8.1.5 In the event or non-reply or non-arrival of DPEM Inspector to the location of tests, these shall be carried out as scheduled in the presence of Purchaser and the agreed assigned Suppliers Third Party Inspectors. The test results shall be submitted to Purchaser then forwarded to DPEM for review and approval.

8.2 Typical TestsTypical DPEM Tests carried out which fulfill the criteria indicated in this procedure are as follows:

8.2.1 Pressure Retaining Equipment: Hydraulic or, where approved, pneumatic tests.

8.2.2 For Tanks: (shop and/or field tests)A. Stationary Roof Tanks

Tank strength and tightness tests (hydrostatic, under and over pressure tests)B. Floating Roof Tanks

Hydrostatic Test

Reports on other field or shop tests and inspections, signed by Engineer and Client, shall be made available to DPEM representative.

8.2.3 Gas Compressors: Hydraulic or, where approved, pneumatic tests (body/casing hydrostatic test).

8.2.4 Relief Valves: Verify the opening and closing pressures and seat tightness.

8.2.5 Pipelines: As noted above.

8.2.6 Electrical Equipment rated 5.5kv or higher:

A. Motors 5.5 KV and above

In accordance with Project Specifications

8.2.9 Fire Extinguishers: Hydraulic or, where approved, pneumatic.

Other tests, required by the standards and regulations in force, will be done in the presence of Purchaser. All documentation and records from those tests will be given to the DPEM inspectors upon their request.

The relevant Test Procedures for the equipment associated with DPEM / ONML involvement must be submitted by the Supplier for Purchasers review within 2 (two) weeks prior to the test date.

9.0 Nameplates

Supplier shall affix the Standard Code Stamped Nameplate for ASME or TEMA code (as required). Additionally, Supplier is to affix a DPEM model Nameplate, in French, in accordance with Attachment 2 Document 20 or 22 on all pressure-containing equipment in accordance with the Purchase Order, and as follows:

Nameplate size: 160 x 200 mm.

Material: 7 mm Thick, 304 Stainless Steel.

Character and stamping to be preferably 6mm high but not less than 4mm high with a depth of 0.5mm.

The Official DPEM Stamp is less than in diameter.

The DPEM Nameplate (French) is to be stamped by the DPEM, for equipment that has been witnessed by DPEM.

Nameplates are to be supplied for pressure containing equipment only.

Electrical equipment > 5.5 kV that has been involved with the DPEM does not require the French nameplates.

10.0 Document Quantity & FormatThe DPEM requires English & French or bilingual documents (Doc 1 to 24 per Attachment 1 and 2), as indicated in Attachment 3, which shall be used for official submission. Each document shall be prepared in two (2) original copies (1 French & 1 English or 2 bilingual). Purchaser recommends the use of bilingual documents in both English and French and has stated this option in the text of this procedure.10.1 Quantities

10.2 Format

The Preliminary Dossier, Final Dossier, Technical File and Safety Dossier are all separate and shall be in hard cover 3 or 4 ring binders.

Provide a general Table of Contents. If more than one (1) volume, each volume shall have a Table of Contents.

These Dossiers shall have section dividers and numbered accordingly. Each section shall have a title page. If a section is not relevant to a particular item of material or equipment, the divider shall be included and the title page shall be annotated Not Applicable.10.3 Front Cover & Spine

The front cover and spine of the Preliminary, Final or Technical Dossiers shall contain information as shown in the attached sample pages, the first sheet each of Attachment 1 and Attachment 2. 11.0 NOTICE OF INSPECTION & TEST

When items, components and appurtenances subject to ARA involvement are agreed between the supplier and the purchaser and ARA activities indicated on Suppliers Quality Control Plan, Supplier shall notify the Purchaser of indicted ARA inspection activities. The notification shall be sent to the Purchasers Project Procurement Quality Control Manager and Purchasers ARA Liaison coordinator. This shall be sent by the supplier at least forty five (45) calendar days before the expected date of test. The defined date shall be confirmed by the Supplier as indicated above twenty-one (21) calendar days before the test. Contact information for the ARA Liaison coordinator and other Purchaser personnel will be provided at the Kickoff meeting or the Pre-inspection meeting between the Purchaser and Supplier.The Purchasers ARA Liaison coordinator, on receipt of the notifications from the Supplier, will forward to the relevant ARA the request for Inspection per Attachment 4.

The relevant ARA will confirm their intention on the indicated inspection at least fourteen (14) calendar days prior to the defined inspection date, Purchasers ARA Liaison coordinator will relay it to the Supplier at least seven (7) days prior to Defined Inspection date with a copy to Purchasers Project Quality Control Manager.

In the event of a non attendance reply from the ARA, the Purchasers ARA Liaison coordinator may instruct the Supplier to assign a third party inspector to perform activities on behalf of ARA on the schedule date.

The PURCHASER assigned third party inspector will not stamp nameplate on behalf of the ARA.12.0 Equipment Release Certificates

Final equipment release paperwork should describe the individual items which have been DPEM witnessed, e.g. compressor fuel gas drums mounted on a skid with filter, pump, etc., and indicate DPEM witness.If not witnessed, the releases should also describe the individual items, and indicate lack of DPEM witness.Equipment which has not been stamped, but is subject to DPEM Inspection and Tests in supplier shop, must be reported to the ARA with the Purchasers Inspection Report. DPEM will review these dossiers in the field.13.0 ATTACHMENTS

ATTACHMENT 6: FLOWCHART PRELIMINARY DOSSIER

1. Supplier will submit Preliminary Dossiers per paragraph 10.1.1 or 10.1.2 to the Purchaser Document Control Center at least fifty (50) calendar days before commencement of fabrication.

2. The Purchaser will transmit one French or one (1) bilingual original to DPEM for approval at least forty five days before commencement of fabrication.

3. The Purchaser will retain one English or one (1) bilingual original and 2 French copies for records, the Client will receive 1 English and 1 French or 2 bilingual copies via the Purchaser.
