The 10th meeting of the IPO Policy Board was held on

September 15, 2015, at 11:00 a.m. in the Committee Room

of NTC-HQs Building, Sector G-5/2, Islamabad, under the

Chairmanship of Mr. Shahid Rashid, Chairman,

Intellectual Property Organization of Pakistan (IPO-

Pakistan). The following attended the meeting:

(i) Mr. Teepu Mahabat Khan, Additional Secretary,

Cabinet Division, Islamabad;

(ii) Engr. Aamir Hasan, Director General, IPO-

Pakistan, Islamabad (Secretary of the Board);

The Chairman welcomed the Members and noted that the

Board meeting was being held after six months and the last

meeting, which was held on February 24, 2015, was

convened after five years. A number of important decisions

were taken on var ious issues concerning the

improvement/streamlining of the working of the

organization and strengthening its linkages with important

stakeholders like FBR.

1. Meeting on the Proposal of Legislative Updates for Pakistan's Intellectual Property Regime under the Commercial Law Development Programme (CLDP).

A meeting was held in the Committee Room of IPO-HQs,

Islamabad on July 27, 2015 under the Chairmanship of Mr.

Shahid Rashid, Chairman, IPO-Pakistan to discuss the

Terms of Reference (TORs) of the proposal of legislative

updates for Pakistan intellectual property regime under the

Commercial Law Development Programme (CLDP) of the

United States Department of Commerce (USDOC). The

Chairman and Director General of IPO-Pakistan

emphasized that this exercise should consider both aspects

i.e., bringing the laws specified in the Schedule of IPO-

Pakistan's Act, 2012, in consonance with the IPO-

Pakistan's Act, 2012, and bringing the IP laws of Pakistan

in line with the International Best Practices of IPR

protection and enforcement.

2. Seminar on Intellectual Property Rights (IPRs) Protection in Pakistan.

Anti Counterfeit & Infringement Forum (ACIF) in

collaboration with USAID, US Patent and Trademark

Office (USPTO) and CLDP organized a seminar on IPR

Protection in Pakistan at Hotel Avari Towers, Karachi on

August 12, 2015. The Director General, IPO-Pakistan

attended the seminar and delivered the closing address.

3. Visit of Director General, IPO-Pakistan to IP Registries in Karachi.

The Director General, IPO-Pakistan along with Director

(Admn/HR) visited the IP Registries in Karachi on August

13, 2015. The Registrar of Trademarks gave a briefing to

Director General on HR issues, pending trademark cases,

action on IPO-HQs directives, initiatives on the

recommendations of Senate Standing Committee on

Cabinet Secretariat and action taken on Supreme Court of

Pakistan's directives on adoption of Urdu language etc.

After briefing, the Director General visited different

sections of Trade Mark Registry (TMR) to see their

working and environment. The Director General issued

directions regarding detailed HR proposal with

justifications; detail of pending cases of examination,

opposition, rectification, demand notices, registration

certificates, renewal certificates; proposal for bringing

improvement in functionality of TMR; empowerment of

Regional Office, Lahore by posting an Assistant Registrar

at Lahore office after delegation of powers.

4. Meeting of Chairman, IPO-Pakistan with the representatives of UNIDO and Academia on IP Awareness/Capacity Building Activities.

Chairman, IPO-Pakistan held meeting with Dr. Ali Abbas

Qazilbash, OiC Trade Related Technical Assistant (TRTA-

II), United Nations Industrial Development Organization

(UNIDO) and Dr. Arshad Ali, Vice Chancellor, National

Textile University (NTU), Faisalabad on August 21, 2015

to discuss the work plan for conducting National seminars

and workshops on IP awareness/Capacity building.

Director General, IPO-Pakistan and concerned officers

also participated in the meeting.

It was discussed that multiple activities including national

IP awareness seminars, practical training workshops on

Patent Drafting, IP valuation & licensing, use of PiNET (an

e-forum to strengthen the university-Industry linkage)

would be held at Islamabad, Lahore, Karachi and

Faisalabad during Nov-Dec, 2015 with the cooperation of

UNIDO, Higher Education Commission (HEC) and

Academia.

5. Meeting of Representatives of Government of Punjab and Grower's Associat ions with Chairman IPO-Pakistan.

The Chairman IPO-Pakistan held a meeting with

representatives of Grower's Associations led by Mr. Nasir

Rafique, Chief WTO cell, IC&I Department, Government

of Punjab on September 8, 2015 at IPO-Regional Office,

Lahore. In the meeting, post registration modalities for the

implementation of collective mark system in Pakistan

were discussed.

Trademark Registry has recently issued final decisions for

the grant of collective marks for four GIs; Multan Mango,

Sargodha Kinnow, Sharaqpur Guava and Phulkari under

Trademark Ordinance, 2001. The Chairman, IPO-Pakistan

stressed the need to work out a roadmap for commercial

exploitation of registered GIs under collective mark

system. In this regard necessary coordination with the

concerned Federal and Provincial organizations is

required. Pakistan Standard and Quality Control Authority

PSQCA, Pakistan National Accreditation Council (PNAC)

would be consulted to devise a regulatory mechanism to

ensure the standards and quality of products intended to be

commercialized under given collective marks. In this

connection it was also decided that a meeting of relevant

Provincial Departments and Associations would be

organized by Government of Punjab in near future.

Further, meetings at Federal level would be organized

under the auspices of IPO-Pakistan.

6. Secretaries' Committee Meeting.

A meeting of Secretaries' Committee was held on

September 8, 2015 in the Committee Room, Cabinet

Division, Islamabad. An agenda item on “Enforcement of

Intellectual Property (IP) Laws” was discussed and Engr.

Aamir Hasan, Director General, IPO-Pakistan delivered a

brief presentation on Enforcement of IP Laws in Pakistan.

The meeting appreciated IPO-Pakistan's efforts and

advised the Director General to enter into MoU with

Federal Investigation Agency (FIA), as is being done with

FBR.

7. Meeting with IP Attorneys.

Chairman IPO-Pakistan met with a delegation of IP

attorneys led by Mr. Taswir Tirmizi, President, Punjab IPR

Attorneys Group on September 18, 2015 at IPO-Regional

Office, Lahore. Mr. Abdul Qadir Orakzai, Registrar

Trademark and Syed Anjum Raza Bokhari, In-charge IPO-

Regional Office, Lahore also attended the meeting. The

attorneys shared their concerns over long delays in the

registration and opposition procedure of Trademarks,

quality of examination and search reports. Matter of acute

shortage of officials at IPO-Pakistan was also brought into

discussion. Moreover, in order to speed up the Trademark

registration procedure, possibility of Trademark

applications examination at IPO Regional office, Lahore

was discussed.

8. Kickoff Meeting on the Legislative Updates for Pakistan's Intellectual Property Regime under the CLDP .

A meeting was held in the Committee Room of IPO-HQs,

Islamabad on September 21, 2015 under the Chairmanship

of Mr. Shahid Rashid, Chairman, IPO-Pakistan and Engr.

Aamir Hasan, Director General, IPO-Pakistan to discuss

the legislations that need to be amended along with

finalization of phases and timelines for the project of

legislative updates for Pakistan intellectual property

regime under the CLDP of USDOC. After brief

introduction, the Director General, IPO-Pakistan,

welcomed the participants. Mr. Joe Yang, Senior Counsel,

CLDP thanked IPO-Pakistan for hosting the kickoff

meeting of the legislative updates for Pakistan's

Intellectual Property Regime and informed that this project

will be funded by United States Agency for Industrial

Development (USAID), Pakistan. The Director General

informed that removing inconsistencies of IPO-Pakistan

Act, 2012, with the laws specified in its Schedule may be

considered as top priority from the perspective of IPO-

Pakistan. He added that in relation to Enforcement, Federal

Investigation Agency (FIA) had already submitted a

proposal to IPO-Pakistan for enhancement of punishments

in the Copyright Ordinance, 1962 (As amended in 2000).

1. IP Tribunals

IP Tribunals were established by Federal Government in

December 2014, in the exercise of powers conferred by

Section 16(1) of the Intellectual Property Organization of

Pakistan Act, 2012. Federal Government established three

(3) IP Tribunals one each in the Province of Punjab, Sindh

and Islamabad Capital to exercise the jurisdiction under

the said act with territorial limits mentioned herein above.

Two presiding officers for the territorial jurisdiction of

Punjab and Sindh, have been appointed, namely

Muhammad Khalid Nawaz (District & Sessions Judge)

and Mr. Shakil Ahmed Abbasi (Advocate), respectively.

2 . Syndicate Research Paper on Intellectual Property Issues

IPO-Pakistan has prepared a Strategy / Action Plan for

strengthening the IP regime in Pakistan. One of the

elements of the above strategy is to introduce a syndicate

research paper on IP in the syndicate research carried out

during the Common Training Programme (CTP) of the

Civil Services Academy (CSA). In this regard, the Director

General, CSA, Lahore was requested to assign a research

paper on the topic “Why is intellectual property

development and protection a neglected area in the overall

socio-economic framework of Pakistan? A strategy to

improve the intellectual property regime in Pakistan” to

the Probationary Officers for completion of the Syndicate

Research Paper. The same has been included in the

syndicate research to be carried out during the on-going

CTP (42nd).

3. Hiring of Office Space for One-Window Operation of IP Registries in Karachi

IPO-Pakistan has taken an important initiative to house all

three IP Registries of Karachi in one building to provide

improved service delivery to its fee paying clients. In this

context, the advertisement/tender was given in newspaper,

Public Procurement Regulatory Authority (PPRA) and

IPO-Pakistan's websites to hire such an office

space/building that can house all three registries.

Finalization of building is under process and it is expected

that within next few weeks, IPO-Pakistan will be able to

place its all IP Registries in Karachi under one building.

It will be a great achievement to initiate one window

operation in Karachi. It will not only facilitate IP applicants

to submit all types of IP applications at one place but also

improve working of IPO-Pakistan in an effective and

efficient way.

4. Service and Financial Rules of IPO-Pakistan

IPO-Pakistan's Service and Financial Rules are being

framed. For this purpose a consultant firm Messrs ABS &

Co, Islamabad have been awarded a contract after fulfilling

codal formalities on August 26, 2015 for formulation of the

“Service & Financial Rules of IPO-Pakistan” within a

period of three (03) months. Upon successful formulation

of the draft Service & Financial Rules of IPO-Pakistan by

the consultant firm, the same shall be placed before IPO-

Pakistan's Policy Board for consideration / approval.

5. Trademark Guidelines for Filing Application in Pakistan

Trademark Guidelines had been prepared and placed on

the website of IPO-Pakistan for filing trademark

applications in Pakistan, in which different formalities

required to be fulfilled by the applicant for filing an

application, are explained for facilitation of the clientele of

IPO-Pakistan.

6. Upgradation of IT Infrastructure

IPO-Pakistan is committed to provide better and improved

service delivery through automation of its offices. IT

infrastructure is being upgraded by replacing obsolete

technology with modern technology. To start with Servers,

PCs, Heavy Duty Scanners, Firewall, Antivirus, UPS etc.

for IPO-HQs and the Patent Office, Karachi are being

procured.

7. Briefing to Minister In-charge, Cabinet Division on Plant Breeders' Rights Bill, 2015

A delegation of officers of Cabinet Division and IPO-

Pakistan visited the office of Minister In-charge, Cabinet

Division, Sheikh Aftab Ahmed on September 29, 2015 for

briefing on Plant Breeders' Rights Bill, 2015;

It was informed to the Minister In-charge that Plant

Breeders Rights (PBRs) are specific type of Intellectual

Property Rights (IPRs) granted to the breeders of new

varieties of plants. The draft Plant Breeders' Rights Law is

prepared to give effect to the provisions of sub-paragraph

(b) of paragraph 3 of article 27 in Part II of the Agreement

on Trade Related Aspects of Intellectual Property Rights

(TRIPS) which the Government of Pakistan has ratified,

relating to protection of new plant varieties. PBR system

will be helpful to provide an effective intellectual property

right system for granting protection to the development of

new plant varieties and to establish a viable seed industry

for the improvement of agriculture to ensure the

availability of high quality seeds and planting material to

the farmers. It will promote Research and Development

(R&D) in the field of agriculture and attract Foreign Direct

Investment (FDI) for economic development of Pakistan.

The Minister In-charge appreciated efforts of IPO-

Pakistan and assured that the Bill will shortly be submitted

in the National Assembly for enactment after necessary

arrangements according to Rules of Business.

8. Third meeting of the Pakistan Thailand Joint Trade Committee.

Third meeting of the Pakistan Thailand Joint Trade

Committee was organized by Ministry of Commerce at the

Serena Hotel, Islamabad on August 12-13, 2015. Mr. Aftab

Muhammad Khan, Director, IPO-Pakistan represented

IPO-Pakistan in the meeting.

D . ACTIVITIES AT NATIONAL LEVEL BY IPO-PAKISTAN

1. Symposium on Emerging Technologies in Information Technology, August 9-11, 2015 at Bara Gali Summer Campus, University of Peshawar

Computer Science Department, University of Peshawar in

collaboration with Khyber Pakhtunkhwa Information

Technology (KPK IT) Board organized a symposium on

Emerging Technologies in Information Technology from

August 9 to 11, 2015 at Bara Gali Campus, University of

Peshawar. Mr. Zahoor Ahmad, Patent Examiner, IPO-

Regional Office, Lahore attended the symposium and

delivered a lecture on Patent Filing and Drafting.

2. One-day Workshop on “Intellectual Property Rights and Enforcement of Copyright Laws”, August 25, 2015 at PEMRA-HQs, Islamabad

On August 25, 2015, IPO-Pakistan in collaboration with

Pakistan Electronic Media Regulatory Authority

(PEMRA) organized a workshop on IPRs and

Enforcement of Copyright Laws in PEMRA auditorium,

Islamabad. The Seminar was attended by PEMRA officials

and a large number of stakeholders from Electronic and

Print Media. During his welcome address, acting

Chairman PEMRA, Kamaludin Tipu shed light on various

issues of copyright violations and relevant provisions in

PEMRA laws to deal with copyright issues.

Mr. Muhammad Ismail , Deputy Director (IPR

Enforcement), IPO-Pakistan delivered a detailed lecture

on "Overview of IPO-Pakistan and Enforcement of IPRs"

that covered Intellectual Property and its types, IP

Management in Pakistan, Core Functions of IPO-Pakistan,

IPR Enforcement Coordination, Enforcement Strategy of

IPO-Pakistan, International Perception, Achievements of

IPO-Pakistan, Data of Enforcement Actions by

Enforcement Agencies, Issues and Problems, Future

Action Plans to strengthen IPR Enforcement in Pakistan.

Ms. Nadia Zubair Shah, Deputy Director (Law), IPO-

Pakistan delivered lecture on "Copyright Laws: National

and International Aspects of Copyright Protection".

During her presentation she highlighted issues of

copyright, International Conventions/Treaties, Copyright

Ordinance 1962, Copyright Based Industries, Role of

Copyright Industries in Economy & Enforcement, where

Copyright is honored and illustrations were given for the

same. Both the speakers from IPO-Pakistan fielded the

questions from the participants in the least session.

enforcement agencies (i.e. FIA, Police) and the members

of business community at the conference hall of

Directorate of Training and Research (Customs),

Islamabad. Mr. Aftab Muhammad Khan, Director, IPO-

Pakistan, and Ms. Nadia Shah, Deputy Director, IPO-

Pakistan, Islamabad represented IPO-Pakistan.

Ms. Nadia delivered presentation on the "Role and

Function of IPO-Pakistan". The seminar enhanced

awareness and coordination between all concerned

departments and stakeholders to effectively combat the

problem of piracy and violation of IPR Laws.

4. One-day Workshop on Intellectual Property Rights (IPRs), August 28, 2015 at Govt. College for Women University (GCWU), FaisalabadIPO-Pakistan in collaboration with Pakistan Scientific and

Technological Information Centre (PASTIC), Govt.

College Women University (GCWU), Faisalabad and

Pakistan Science Foundation (PSF) conducted a one-day

workshop on IPRs at GCWU, Faisalabad. Mr. Zahoor

Ahmad, Patent Examiner, IPO-Regional Office, Lahore

delivered a presentation on IPRs.

5. One-day Workshop on Intellectual Property Rights (IPRs), September 9, 2015 at Gujrat Chamber of Commerce & Industry (GTCCI) Sub-office, Mandi Bahauddin and Ittifaq Rice Mills, PhaliaIPO-Pakistan in collaboration with Small & Medium

Enterprise Development Authority (SMEDA) and Gujrat

Chamber of Commerce & Industry (GTCCI) conducted a

one-day workshop on IPRs at GTCCI-Sub Office, Mandi

Bahauddin and Ittifaq Rice Mills, Phalia. Mr. Zahoor

Ahmad, Patent Examiner, IPO-Regional Office, Lahore

delivered presentation on “Importance of IPRs for SMEs”.

He explained the business community importance of IPRs

in business; how to adopt the IP System; what are the

procedures for IP registration and what can one do with IP

once one has it?

1. Workshop on Management of Intellectual Property Rights (IPRs) in Pakistan, September 30, 2015 at PAF-KIET, Karachi

IPO-Pakistan in collaboration with PAF-Karachi Institute

of Economics and Technology (KIET) organized a

workshop on Management of IPRs in Pakistan on

September 30, 2015 at PAF-KIET, North Campus,

Karachi. Following officers of IPO-Pakistan participated

in the workshop as speakers on the topics mentioned

against each:

The idea of Workshop was to present an overview of the

IPR System in Pakistan. The key objectives were to raise

awareness to students, researcher and scholars of PAF-

KIET about the concept of IPRs and how to deal with IP

issues in Pakistan. After attending this workshop, students,

researcher and scholars of the PAF-KIET would be able to

understand the IPR System in Pakistan and the benefits of

protection of IP. The Workshop was very interactive and

completed with appreciation from management and

students of PAF-KIET.

1. 3rd ECO Coordination Committee Meeting on Industrial Property Rights and Workshop on Role of Intellectual Property Rights (IPRs) in Technology Transfer, August 17 to 19, 2015, Tehran, Republic of Iran

The Third ECO Coordination Committee Meeting on

Industrial Property Rights followed by Workshop on

Technology Transfer was held from August 17 to 19, 2015

in Tehran, hosted by the State Organization for

Registration of Deeds and Properties of the Islamic

Republic of Iran (General office for Intellectual Property)

in cooperation with the ECO Secretariat. The Meeting was

attended by the delegates of the ECO Member States

namely: the Republic of Azerbaijan, the Islamic Republic

of Iran, the Kyrgyz Republic, the Islamic Republic of

Pakistan, the Republic of Tajikistan, the Republic of

Turkey and a delegation from the ECO Secretariat. In the

meeting the latest trends of Industrial Property Rights were

reviewed and priority areas for the IP Offices and the

coordination mechanisms were discussed.

The meeting was followed up by Workshop on Role of

IPRs in Technology Transfer conducted at PARDIS

Technology Park Iran Silicon Valley, Tehran. Paradise

Technology Park is established to encourage and support

hi-tech companies to increase their ability to compete in

the international market with the goals of Cooperation

between Universities and Industries, Commercialization,

Competitiveness of Hi-Tech companies, Attract Foreign

Investment and Speed up Technology Transfer.

Patent is defined as a set of “Exclusive Rights” granted by a

sovereign State to an inventor in lieu of his advanced

technology invention for a limited period of time in

exchange for its detailed public disclosure. The patent

system promotes inventiveness and support the growth of

local companies in countries around the world by assuring

the intellectual property (IP) rights of inventors and

investors.

Advance Research and Development (R & D) in the field

of technology always involves resourses in terms of

services of field experts, enabling environment (i.e

Equipped Laboratory etc.) and necessary public sector

support which costs a massive investment. In the

Developed countries, the R & D is either supported by the

government or by large Multinationals Companies

(MNCs) with the hope of expected outcomes.

This is a fact that all research outcomes cannot be

commercialized immediately; for example some research

work only results into a discovery of natural laws. It is

observed worldwide that only one out of each 10 patented

inventions can be commercialized. However, such results

can be utilized to other research outputs of commercial

value. The award of Patent rights also indicates that

research outcome qualify for the eligibility criteria of a

patent which can be regarded as "quality check".

Unlike the developed countries, the investment on R & D

sector has always remained a big challenge for developing

countries. The R & D situation in Pakistan is not much

different from other developing countries. The patent filing

from the local/nationals is considered one of the indicators

of status of local R & D. Therefore, the share of local filing

of patent applications not exceeded from 8 % in Pakistan in

the past.

Since the inception of IPO-Pakistan, the challenge to

promote inventors was taken seriously and a countrywide

IP awareness campaign was initiated by the IPO

management. In the recent two years, a numbers of steps

were taken in the right direction. This includes the

organizing of IP awareness seminars, roundtables and

workshops. A number of local training sessions were

organized by IPO-Pakistan and its partner organizations.

IPO-Pakistan also provided its technical experts as

resources person in such events.

R & D Sector was specially focused by the organization.

In academia, the capacity of the relevant human resource

of Office of Research, Innovation & Commercialization

(ORICs) centers was built by their nomination in national

as well as international training sessions. To achieve the

goal of R & D promotion, IPO-Pakistan is successfully

moving ahead by the active role and support of Higher

Education Commission (HEC); National University of

Sciences & Technology (NUST); COMSATS Institute of

Information Technology (CIIT); Institute of Space

Technology (IST); University of Agriculture, Faisalabad

(UAF) and other stakeholders etc. On the other hand

private sector was also taken on board with the support of

Chambers of Commerce & Industries and SMEDA etc.

The following results of last five years indicating gradual

increase in number of patent application filed by the

national inventors are evident of fruitfulness of IP

awareness activates and technical support of IPO Pakistan

with the help of its partners:

The above shown figures are encouraging that increased

filing by local applicants is a positive sign towards the

progress of R & D in the field of technology, in the country.

However, the efforts to support R & D, technology transfer

and transformation of technology into commercial product

will be considered at level of satisfaction when the share of

national patent filing surpasses international application

filing.

The special incentives to the inventors like special fee

waiver and speedy examination process may also be

among supportive measures in this direction. Further, the

policies of developed countries can be followed as a model

like success stories of Technology Transfer from academia

and R & D sector with the support of public sector.

This increased share in the number of filing of patent

application by nationals will make feasible the

environment of the country to accede the Patent

Cooperation Treaty (PCT). After increase in patent filing

by the nationals, the next target would be production of

quality patents.
