Gohagan& Company in writing, accompanied by the required deposit, byOctober 1, 2010. In the event a “discounted” reservation mustbe cancelled, no “replacement” reservation can be substituted atthe discounted rate. A “replacement” reservation is, in effect, anew reservation and can be substituted only at the full-fare tariff.Change and/or cancellation fees apply as outlined in this “Contract:Terms and Conditions” for the “replacement” reservation and thecancelled reservation.CANCELLATIONS AND REFUNDS: Cancellations for all orany part of the trip will not be effective until received in writing inthe offices of Thomas P. Gohagan & Company. Should you haveto cancel, the following terms will apply: reservation cancellationsare subject to a $200 per person administrative fee from the timeof booking through 120 days prior to departure; from 95 through119 days prior to departure, $600 per person; from 60 through 94days prior to departure, 50% of your trip cost; cancellations 59days or less prior to departure, a no-show, or early return from thetrip will result in forfeiture of 100% of your trip cost. In addition,any applicable airline cancellation fees and administrative fees willbe assessed.PRE-CRUISE AND POST-CRUISE CANCELLATIONS: Shouldyou have to cancel, the following terms will apply: reservationcancellations are subject to a $50 per person administrative feefrom the time of booking through 120 days prior to departure;from 95 through 119 days prior to departure, $200 per person;from 60 through 94 days prior to departure, 50% of your tripcost; cancellations 59 days or less prior to departure, a no-show orearly return from the trip will result in forfeiture of 100% of yourtrip cost. In addition, any applicable airline cancellation fees andadministrative fees will be assessed.

Because these cancellation policies are strictly enforced, westrongly recommend for your protection that you purchase tripcancellation insurance. Trip cancellation insurance is availablethrough Thomas P. Gohagan & Company for comprehensivecoverage of such expenses in conjunction with cancellation due toillness or accident, as well as damaged or lost luggage. We will sendyou an application after you make your reservation.RESPONSIBILITY: Thomas P. Gohagan & Company, thesponsoring institution or association, and its and their employees,shareholders, subsidiaries, affiliates, officers, directors or trustees,successors, agents, and assigns (collectively “Gohagan”), do notown or operate any entity which is to or does provide goods orservices for your trip including, for example, lodging facilities,airline, vessel, or other transportation companies, guides orguide services, local ground operators, providers or organizers ofoptional excursions, food service providers, etc. All such personsand entities are independent contractors. As a result, Gohagan isnot liable for any negligent or willful act or failure to act of anysuch person or entity of any third party.

In addition and without limitation, Gohagan is not responsiblefor any injury, loss, death, inconvenience, delay, or damage toperson or property in connection with the provision of any goodsor services whether resulting from, but not limited to, acts of Godor force majeure, acts of war or civil unrest, insurrection or revolt,animals, strikes or other labor activities, criminal or terroristactivities of any kind, sickness, illness, the lack of availabilityof or access to appropriate medical attention, overbooking or

downgrading of accommodations, mechanical or other failure ofairplanes or other means of transportation, or for any failure ofany transportation mechanism to arrive or depart on time.

If due to weather, flight schedules or other uncontrollablefactors, you are required to spend an additional night(s), youwill be responsible for your own hotel, transfers and meal costs.Baggage is entirely at owner’s risk. The right is reserved to declineto accept or retain any person as a participant on these trips atany time. Specific room/cabin assignments are within the solediscretion of the hotel/cruise line.

Gohagan reserves the right to change the itinerary or tripfeatures at any time and for any reason, with or without notice,and Gohagan shall not be liable for any loss of any kind as a resultof any such changes. Gohagan may cancel a trip for any reasonwhatsoever; if so, its sole responsibility is to refund monies paid bythe participant to it. Gohagan is not required to cancel any trip forany reason including without limitation, United States Departmentof State, World Health Organization or other Warnings orAdvisories of any kind. All fares, as well as ship schedules, portcalls, hours of arrival and departure, special programs and guestlecture series (if applicable), are subject to change or cancellationwithout prior notice. Gohagan shall not be required to refundany portion of the fare or make any other compensation underthese circumstances. Gohagan is not responsible for penaltiesassessed by air carriers resulting from operational and/or itinerarychanges, even if Gohagan makes the flight arrangements or cancelsthe trip. Gohagan reserves the right to substitute vessels or hotelsof a similar category for those listed in this brochure.
