A House saved is House Constructed The need of Seismic Analysis
Editorial
During the last decade and half, we have witnessed earthquakes of
damaging effects of different characteristic sources viz :
Continental collision boundary (Himalaya)
Sub duction zone (Andaman & Nicobar)
Ancient rift ( Narmada, Kutch )
Non-rifted zone ( Peninsular shield ) Reservoir triggered ( Koyana)
Earthquakes of killari 1993 Jabalpur 1998, chamoli-1999 Bhuj 2001,
Andaman Sumatra 2004, muza ffarabad 2005 and the latest seismic tremors
felt across northern and eastern India in September-2011, have revealed that
human and property losses are mainly due to collapse of very large vulnerable
building stock in the region.
During Bhuj (2001) earthquake, a staggering number of livestock were
lost and innumerable agricultural structure or assets were destroyed ordamaged.
Such events clearly demonstrate the high risk from intensive damage
and highlight the need for a comprehensive disaster risk mitigation
programme.
Growing population, ill planned habitat and non-engineered building
practices have compounded the risk of many urban and rural conglomerations.
Post Disaster Studies :-
Post Disaster studies especially after issuing earthquake have given the
engineering community both architects and structural engineers no. of
important lessons, which lead to be adequately addressed so as to mitigate
the effect of study hazards in future.

Existence of non-engineered buildings, no doubt, has been one of the
major cause of collapse of buildings in most of the affected regions but poor
quality of construction materials was also observed an important cause of
failure.
Adherence of IS Code :
Indian structural Code for Earthquake Resistant Design and construction
prescribes, besides other things, use of proper quality of building materials in
a proper way. It is important to follow the provisions of the Codes in a sincere
way.
Earthquake resistant buildings are required to have the ability to sway
back and forth during an earthquake and to withstand the earthquake effects
with some damage, but without collapse.
To tackle the issue, National Building Code ( 2005) has been developed
with hazard specific code of practices and guidelines. But the existing Town
and Country Planning Acts, Master Plans, Area Development Rules and
Building Byelaws and regulations needs amendments to address safety
requirements of build environment.
Hence it is necessary to focus on :-
Creating mechanism to retrofitting and strengthening.
- To ensure issue of building use permits.
A house saved is a house constructed, Hence, it is necessary to
carry out seismic analysis of existing buildings to make them safe against
earthquake forces ensuing established seismic retrofitting techniques.

show initiative and evolve strategies by which the underlying objective behind
the implementation and adherence to building codes can be achieved and
mitigate the risk of natural disasters in future

At present, about 26 posts of Assistant Executive Engineer (Electrical) out oftotal 47 posts are falling vacant in the year 2015-16. Due to these vacancies, the
serving Assistant Executive Engineer (Electrical) will be overloaded which may affectthe day-to-day activities of sensitive Electrical works. The entry level Assistant
Engineer (Electrical) / Junior Engineer (Electrical), the Section Officer posts ofElectrical Wing have put more than 25 years of Service without getting even first level
of promotion.
The panel for the post of Assistant Executive Engineer (Electrical) for the year2012-13 has been approved and promoted. At present panel for the year, 2013-14,2014-15 and 2015-16 has to be approved for the post of Assistant Executive Engineer(Electrical).

we have submitted the following for your kind reference. The Hon'ble High Court waspleased to dispose of the Writ petition Nos. 34276, 14865 and 24783 of 2007regarding G.O. Ms. No .66 PWD dated 12.03.2007 by ordering as hereunder,
(i) The Junior Engineers, coming under Tamilnadu Engineering SubordinateService, re-designated as Assistant Engineers from the date of theiracquiring B.E degree shall continue to be under the category of JuniorEngineer and such re-designation shall not amount to appointment as
Assistant Engineers and should be considered to continue underTamilnadu Engineering Subordinate Service (TNESS) only and
accordingly, their promotion, (i.e., recruitment by transfer, as AssistantExecutive Engineer) shall be made within the 25% quota available for
Junior Engineer of TNESS and not within the 75% quota earmarked forAssistant Engineers of Tamilnadu Engineering Service (TNES);
(ii) The decision of the Hon'ble Supreme Court 2nd referred above protectsonly the re-designated Assistant Engineers who were wrongly promotedas Assistant Executive Engineer earlier within the 75% quota earmarked

for Assistant Engineers of Tamilnadu Engineering Service before thedate of judgement of the Hon'ble Supreme Court from demotion andtheir seniority had not been dealt by the Hon'ble Supreme Court and
hence the Government shall have to revise the inter-se-seniority, i.e., inthe promoted category of Assistant Executive Engineer based on theratio laid down by the Hon'ble Supreme Court.
2. We submit that the ratio laid down by the Hon'ble Supreme Court in thejudgment 2nd cited is that a re-designated Assistant Engineer shall continue to beJunior Engineer in Tamilnadu Engineering Subordinate Service and such re-designatedAssistant Engineers shall be considered for promotion as Assistant Executive Engineeronly within the quota of 25% earmarked for Junior Engineers of TNESS.
3. We submit that accordingly, the re-designated Assistant Engineers shall not
be considered for inclusion in the seniority list for the category of Assistant Engineerand such re-designated Assistant Engineers shall be included only in the seniority list
of Junior Engineers.
4. We further submit that the Hon'ble High Court have now ordered in thereference 1stcited above, to revise the seniority of re-designated Assistant Engineerspromoted as Assistant Executive Engineer considering them within the 75% quotaearmarked for Assistant Engineers of Tamilnadu Engineering Service and publish theseniority of Assistant Executive Engineers within 6 months based on the ratio laid
down by the Hon'ble Supreme Court. The ratio laid down by the Hon'ble SupremeCourt as stated supra, is that the re-designated Assistant Engineers shall be
considered for promotion only within 25% quota earmarked for Junior Engineers. TheHon'ble High Court have categorically held that the Hon'ble Supreme Court have notdealt the seniority of the re-designated Assistant Engineers promoted already asAssistant Executive Engineers and hence the Government is bound to revise the
seniority of Assistant Executive Engineers based on the ratio laid down by the Hon'bleSupreme Court. It is well settled law that any promotion in violation of rules will notconfer any right to seniority. Therefore, the seniority of Assistant Executive Engineersshall be revised treating both the re-designated Assistant Engineers who were wronglypromoted as Assistant Executive Engineers within 75% quota and the Junior Engineerswho were promoted (recruitment by transfer) as Assistant Executive Engineers
already, i.e., before 27.11.2013 as Junior Engineers only and fitting them within 25%quota and fitting the Assistant Engineers from Tamilnadu Engineering Service within75% quota and publish the seniority list of Assistant Executive Engineers so revisedwithin 6 months as directed by the Hon'ble Court.
5. We, therefore, submit that the re-designated Assistant Engineers who were
promoted within the quota of 75% earmarked for Assistant Engineers of TamilnaduEngineering Service shall not be entitled to be considered for promotion as ExecutiveEngineer until he becomes eligible on his turn within the quota of 25% earmarked for
Junior Engineers according to their original seniority in the category of JuniorEngineer.
Therefore, for the reasons stated above, we kindly request that-
(i) The re-designated Assistant Engineers already promoted as AssistantExecutive Engineers within the quota of 75% earmarked for Assistant
Engineers of Tamilnadu Engineering Service and the Junior Engineers

promoted (recruitment by transfer) as Assistant Executive Engineers earlierto 27.11.2013, the date of judgement of the Hon'ble Supreme Courtreferred 2nd above be fitted within the 25% quota earmarked for Junior
Engineers and accordingly revise the seniority in the category of AssistantExecutive Engineers duly fixing the inter-se-seniority between AssistantExecutive Engineers promoted from Assistant Engineers of TamilnaduEngineering Service and the Assistant Executive Engineers appointed byrecruitment by transfer from the Junior Engineers and from there-designated Assistant Engineers as directed by the Hon'ble High Courtfollowing the ratio laid down by the Hon'ble Supreme Court as aforesaid;
(ii) The panel of Assistant Engineers / Junior Engineers fit for promotion /appointment by recruitment by transfer as Assistant Executive Engineersapproved after 27.11.2013 be revised by reverting the excess JuniorEngineers / re-designated Assistant Engineers as per the ratio laid down by
the Hon'ble Supreme Court;
(iii) The Assistant Engineers re-designated from Junior Engineers should not beconsidered for promotion as Assistant Executive Engineers within the 75%
quota of vacancies earmarked for Assistant Engineers in TamilnaduEngineering Service but to consider them only within the 25% quota
earmarked for Junior Engineers in the ensuing panel for promotion Asst.Executive Engineers.
(iv) The re-designated Assistant Engineers already promoted as AssistantExecutive Engineers within the 75% quota of Assistant Engineers inTamilnadu Engineering Service earlier to 27.11.2013 should not be
promoted further as Executive Engineer till the publication of seniority list ofAssistant Executive Engineers as aforesaid under item no. (i) above.
We also wish to add that, the Honble High Court of Madras has also orderedthe state government to apply its mind to the issue of inter-se-seniority in the context
of the aforesaid judgement and accordingly circulate a draft seniority list, inviteobjections and thereafter publish the final seniority list within a maximum period of six
months from 15.10.2014. Even though six months of period has gone, the orderof the Honble High court was not implemented till date.
We, therefore, request the Principal Secretary to Government, PWD tobe kind enough to take immediate appropriate action to implement the aboveHonble High Court judgement and publish the seniority list at the earliest.

Wesubmit the following points for your kind consideration.
1) Regional Chief Engineers with wide jurisdiction are subject to frequent site visit
and has to attend various meetings at Government level.
2) In the absence of the Regional Chief Engineer, Deputy Chief Engineer (EE
Cadre) has to co-ordinate and obtain the details required from the
Superintending Engineers of the Region resulting in difference in hierarchy
since the Deputy Chief Engineer post (EE Cadre) is lower post than the
Superintending Engineer post.
3) As per powers delegated in G.O. Ms. No.28, Public Works (G2) Department,
dated 01.02.2012, the Tender received and submitted by the Superintending
Engineers for acceptance are scrutinized by the Deputy Chief Engineer (EE
Cadre) who is a lower level officer in Chief Engineer Office.
4) Intermediate check / scrutiny by Joint Chief Engineer post (in the cadre ofSuperintending Engineer) shall be useful because of wide exposure gained on
the Tender clauses and other technical subjects for functioning Chief Engineersoffice in the absence of the Chief Engineer.
5) The lower level Deputy Chief Engineer (EE Cadre) Officer is now reviewing the
works with Superintending Engineers under their respective Regional ChiefEngineers control which result in hierarchy difficulty.
6) In the absence of Chief Engineer, the second level officer Superintending
Engineer is absolutely required.
7) All other Chief Engineers Office except the Regional Chief Engineers Office are
having the post of Joint Chief Engineer at present.
Hence the upgradation of the post of Deputy Chief Engineer in the Office of the
Regional Chief Engineers to Joint Chief Engineer is considered to be absolutely
necessary.

The additional expenditure for the upgradation of the post can be compensated

The First Parent Executive Committee Meeting of Association of Engineers andAssistant Engineers Association was held on 09.08.2015 at 9.30 AM in Associationoffice building, PWD campus, Chepauk, Chennai.
Er.K.Mohanraj, President/AOE presided over the meeting and conducted the
proceedings. The President/AOE in his presidential address welcomed the newlyelected Office bearers and requested every P.E.C. Members to untidily work for the
welfare of the Association. The President/AOE has briefed about the proposal ofreconstruction of Poriyaalar Ramalingam Illam and various steps to be taken forraising the funds for Reconstruction of Poriyaalar Ramalingam Illam by reviving
Engineers Cultural Society.
Er.R.Raviraj, General Secretary/AOE, extended his warm wishes to the newOffice bearers and briefed the activities of our Association over the following subjects,
1) Pay case in Supreme Court Present status and follow up action.2) 2015 Pay case in High Court Follow up action.3) Promotion panels and postings.4) Preparation of Classified list of A.Es by implementing Judgement of Honble
High Court Present status and follow up action.
The General Secretary/AOE assured the P.E.C. Members that all efforts arebeing taken to fasten the pay case in Supreme Court and 2015 AssistantEngineers contempt case in High Court. The General Secretary/AOE further
informed the P.E.C. that the draft classified list of Assistant Engineers byimplementing the judgement of Honble High Court is getting a final shape and willbe issued very soon.
The P.E.C. unanimously thanked Chief Election Committee/ Parent body andBranch Election Convenors for conducting the Parent body Election smoothly and
successfully.
The General Secretary/AOE clarified the quarries raised by P.E.C. Members andinformed P.E.C. that a draft proposal for Reconstruction of Poriyaalar RamalingamIllam, Chennai will be presented in the next P.E.C. for discussion.
The P.E.C. appreciated the services of Staffs of Poriyaalar Ramalingam Illam
and Resolved to increase the pay of Staffs of Poriyaalar Ramalingam Illam asfollowing with effect from August 2015.
