CourseDescription:ThiscourseexaminestheconstitutionalpolicymakingoftheUnitedStatesSupremeCourtintheareaofcriminalprocedure.WewillprimarilybeexploringsomeofthebasicprotectionsthattheBillofRightsaffordscitizensagainstthegovernmentinthesphereofcriminaljustice.Wewillalsoexamineanddiscussothersalientissuesincontemporarycriminaljustice,socialpolicy,andlegaldiscourse.

ThingstoKnow:
1. Examsarenon-comprehensive.Studentsareresponsibleforallbackgroundandrelatedmaterialofferedinthetextandlectures.Studentswhohavealegitimatereasonformissinganexammustnotifytheprofessorbeforetheexamandprovidetheprofessorwithvalidatingevidence(e.g.,notefromdoctor).Studentswithavalidexcusewillbeallowedtomakeupthefirstexamduringtheprofessor’sofficehoursnolaterthanoneweekaftertheregularlyscheduledexaminationdate.Beforewarned:Iwillmakeexceptionsunderonlythemostunusualofcircumstances.

Participationrepresentsanintegralpartofthiscourse,andattendancewillbeobserved(andalsoformallytaken)inallclasses.Youshouldattendclass,asmuchaspossible,allofthetime.That’sagoodgeneralruletofollowforallofyourclasses,notjustmine.Itensuresthatyoudon’twasteyourmoney,oryourparent’smoney,orthemoneyyou’veearnedwithallofyourhighschooldiligence.Still,youshoulddomorethansimply“show-up.”Participationpointsarepartlybaseduponregularattendance.Theotherportionofthegradeisderivedfromactualclassparticipation,includingdiscussionoftheassignedreadingandcases,Classprepshouldincludereadingand“briefing”casespriortoclass.Occasionally,Iwilladministercasebriefquizzessotoassesswhetherstudentsareactuallydoingtheassignedcasebriefs.Thesewillalsocounttowardsclassparticipation.
3. Hypotheticalquestionsarethoseinwhichyouaregivenacasescenarioandexpectedtocomposeanattorney’sargumentinresponsetothecasedescribed.Theywillbegivenonassigneddayswiththetopicknownbeforehand(oneweekinadvance).
4. MockTrialJurySimulation–Participationasajuror, which requires that each studentparticipate fully by watching the trial andparticipatinginjurydeliberations.
