-1- POKÉMON COSPLAY CONTEST OFFICIAL RULES Pokémon Cosplay Contest (the “Contest”) is sponsored by Nintendo of Canada Ltd., 2925 Virtual Way, Vancouver, BC V5M 4X5, Canada (“Sponsor”). Eligibility: Contest is open only to individuals who are legal residents of Canada (excluding Quebec) who are at least 13 years of age at the time of entry (or over the age of majority in entrant's province of residence). Directors, officers and employees of Sponsor, and any of its respective affiliate companies, subsidiaries, agents, professional advisors, and advertising and promotional agencies, and immediate families of each, are not eligible to win any prizes. Limit one entry per person. Contest Period: The entry period for the Contest (“Entry Period”) begins on Friday, November 18, 2016 at 10:00 am and ends on Sunday, November 20, 2015 at 6:00 pm local time (the “Contest Entry Period”). How to Enter: NO PURCHASE NECESSARY. To enter, you must (1) complete and submit an entry ballot, which includes your first and last name and phone number, and (2) have a Nintendo Staff member will take a photo of your cosplay (the “Entry”) at the Pokémon Launch event held at one of the two Nintendo kiosk locations listed below (the “Event”). There is a limit of one (1) Entry per person. Any attempt or suspected attempt to submit more than one (1) Entry per person, through any means, shall be deemed as tampering, and the Contest Sponsor reserves the right, at its sole discretion, to remove and delete any and all Entries you submit, without further notice. Nintendo Staff have the right to disqualify any potential participant who, in the staff’s sole discretion, is wearing a costume or otherwise acting in a manner that is crude, offensive or inappropriate for Nintendo’s brand. OFFICIAL RULES

Pokémon Cosplay Contest (the “Contest”) is sponsored by Nintendo of Canada Ltd., 2925 Virtual Way, Vancouver,

BC V5M 4X5, Canada (“Sponsor”).

Eligibility: Contest is open only to individuals who are legal residents of Canada (excluding Quebec) who are at

least 13 years of age at the time of entry (or over the age of majority in entrant's province of residence). Directors,

officers and employees of Sponsor, and any of its respective affiliate companies, subsidiaries, agents, professional

advisors, and advertising and promotional agencies, and immediate families of each, are not eligible to win any

prizes. Limit one entry per person.

Contest Period: The entry period for the Contest (“Entry Period”) begins on Friday, November 18, 2016 at 10:00

am and ends on Sunday, November 20, 2015 at 6:00 pm local time (the “Contest Entry Period”).

Contest Rules: A panel of judges comprised of representatives from Sponsor will review all eligible entries

received by Sponsor. On or about 11/21, the panel will select three (3) winning entries per Kiosk location that the

panel determines, in its sole discretion, to be the most apt, original, and interesting based on the three following

judging criteria (“Judging Criteria”):

(a) Spirit: how well the cosplay costume encompasses your enthusiasm for the selected Pokémon franchise

character

(b) Creativity: how well the cosplay costume demonstrates creativity

(c) Quality: the overall artistic quality of the cosplay costume

For each entry, the panel will assign points for each of the Judging Criteria. Each of the three Judging Criteria will

have the same maximum possible points that can be assigned by the panel, such that each of the Judging Criteria

will be weighted equally. The sum of the points for each entry will be the entry’s total score for the Contest. The

panel will select three (3) winning entries per Kiosk location based on the entries with the highest total score. In the

unlikely event of a tie, the winner will be deemed to be the entrant with the highest number of points in the

following judging criteria: Spirit: how well the cosplay costume encompasses your enthusiasm for the selected

character. The potential winners will be notified by phone on or about November 21, 2016. To claim the prize, the

potential winner must follow the instructions contained in the phone message and respond within two (2) days.

Prizes:

(a) One (1) Grand Prize is available to be won at each Kiosk location noted above during the Contest

Entry Period, consisting of one (1) New Nintendo 3DS XL system. Approximate Retail Value of

$239.99 CDN.

(b) One (1) First Prize is available to be won at each Kiosk location noted above during the Contest Entry

Period, consisting of one (1) Pokémon Sun or Pokémon Moon game. Approximate Retail value of

$49.99 CDN.

(c) One (1) Secondary Prize is available to be won at each Kiosk location noted above during the Contest

Entry Period, consisting of one (1) Pokémon 8’’ Plush doll. Approximate Retail Value 17.99 CDN.

Prize Conditions:

The following general conditions apply to the Prizes:

(a) Odds of winning a prize depend on number of eligible entries received. Prizes not claimed within

three (3) days after delivery of notification may be forfeited and awarded to an alternate winner.

No substitutions or exchanges (including for cash) of any prizes will be permitted, except that

Sponsor reserves the right to substitute a prize of equal or greater value for any prize. Prizes may

not be transferred to any other person. Limit one prize per household or address. All prizes are

awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including,

without limitation, any implied warranty of merchantability or fitness for a particular purpose).

ALL FEDERAL, STATE, PROVINCIAL AND LOCAL TAXES ASSOCIATED WITH THE

RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER.

(b) A Prize won by a person who entered the Contest while under the age of majority in his or her

province of residence (a "Minor") will be awarded to a parent or guardian on the Minor's behalf.

(c) Prizes must be accepted as awarded, and are not transferable or convertible to cash (no

substitutions except at Contest Sponsor’s option, in its sole and absolute discretion);

(d) Prizes can be picked up at the Nintendo Kiosk at Erin Mills Town Centre (Mississauga, ON)

provided upon winner confirmation of an official government issued ID. If the winner does not

respond within 10 days, Nintendo will proceed in contacting an alternate winner.

Sponsor’s License to Use Photo: By entering this Contest and submitting your photo, you hereby grant to Sponsor

a perpetual, irrevocable, royalty-free, worldwide, nonexclusive license to publish, reproduce, communicate to the

public by telecommunication, display, perform, distribute, adapt, edit, modify, translate, create derivative works

based upon, and otherwise use and sublicense your photo, or any portion thereof, in connection with the Contest and

for any other advertising or promotional purpose, and to incorporate the photo, in whole or in part, into other works

in any manner, form, media or technology now known or later developed. Sponsor will have no obligation to

publish or use or retain any photo you submit or to return any such photo (or other Contest entry materials) to you.

You agree that it is your sole responsibility to obtain all permissions and releases necessary for the grant of the

rights contained in this paragraph. You also agree to take, at Sponsor's expense, any further action (including,

without limitation, execution of affidavits, licenses, and other documents) reasonably requested by Sponsor to effect,

perfect, or confirm Sponsor's rights set forth above in these Official Rules, including this paragraph. You agree to

waive any applicable moral rights in and to your photo in favor of Sponsor. You will not be entitled to

compensation for any use by Sponsor, or its agents, licensees or assignees, of your photo.

Non-Infringing Entry Materials. You represent and warrant that (a) you have the right to grant the rights granted

in these Official Rules or, alternatively, you have obtained all necessary rights and permissions to use and submit

your photo in connection with the Contest and to provide all the rights specified in these Official Rules; and (b) your

photo and the use of your photo as contemplated in these Official Rules does not and will not violate,

misappropriate, or infringe upon any law or regulation or the rights of any third party, including without limitation

any copyright, trademark, or any rights of publicity or privacy, or any other intellectual property or other rights.

Entrant’s Personal Information: Information collected from each entrant is subject to the Nintendo privacy policy

applicable to the entrant. Please see the Nintendo of Canada Online Privacy Policy at

http://www.nintendo.com/corp/privacy_ca.jsp.

GENERAL CONDITIONS:

THE CONTEST SPONSOR RESERVES THE RIGHT IN ITS SOLE DISCRETION TO DISQUALIFY

ANY ENTRANT WHO IS FOUND TO BE TAMPERING WITH THE ENTRY PROCESS OR THE

OPERATION OF THE CONTEST, TO BE ACTING IN VIOLATION OF THESE CONTEST RULES, OR

TO BE ACTING IN A MANNER THAT, IN THE CONTEST SPONSOR’S SOLE DISCRETION, IS

DISRUPTIVE OR UNDERMINING TO THE LEGITIMATE OPERATION OF THE CONTEST, OR IS

ANNOYING, ABUSIVE, THREATENING OR HARASSING TO ANY OTHER PERSON, AND THE

CONTEST SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM

ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. ANY ATTEMPT BY AN

ENTRANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST

MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE

MADE, THE SPONSOR RESERVES THE RIGHT TO REPORT SUCH ACTION TO THE

APPROPRIATE AUTHORITIES FOR PROSECUTION AND/OR SEEK DAMAGES FROM ANY SUCH

PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

THE CONTEST SPONSOR WILL NOT BE LIABLE FOR: (A) ANY INCOMPLETE OR INACCURATE

INFORMATION, WHETHER CAUSED BY ANY EQUIPMENT OR COMMUNICATIONS ASSOCIATED

WITH OR UTILIZED IN THE CONTEST, OR BY ANY TECHNICAL OR HUMAN ERROR WHICH

MAY OCCUR IN THE HANDLING OF ENTRIES; (B) THE THEFT, LOSS, DESTRUCTION OR

UNAUTHORIZED ACCESS TO, OR ALTERATION OF, ENTRIES; (C) ANY FAILURE OF ANY E-

MAIL TO BE RECEIVED BY OR FROM THE CONTEST SPONSOR FOR ANY REASON INCLUDING

BUT NOT LIMITED TO TRAFFIC CONGESTION ON THE INTERNET OR AT ANY WEBSITE OR

COMBINATION THEREOF; D) ANY USE OF AN ENTRANT'S PERSONAL INFORMATION.

In the event of a dispute as to the identity of a Prize Winner based on an email address, the winning Entry

will be deemed to be made by the authorized account holder of the email address at time of entry.

“Authorized account holder” is the natural person who is assigned an email address by an internet service

provider, internet access provider, online service provider, or other organization responsible for assigning

email addresses for the domain associated with the email address in question.

This Contest is subject to all applicable federal, provincial and municipal laws and regulations, and is void

where prohibited. By entering the Contest, you agree to be bound by these Contest Rules and by the decisions

of Contest Sponsor, which shall, subject to section 9 where applicable, be final on all matters relating to this

Contest. All Entries become the property of the Contest Sponsor and none will be returned. The Contest

Sponsor reserves the right to withdraw, terminate or modify this contest or any portion of this contest, or

extend the deadline of this contest, at any time without prior notice. The Contest Sponsor assumes no

responsibility for lost, delayed, or misdirected Entries.
