TermsandConditions:

TheAdopterhasagreedtoadopttheabovementioneddogaccordingtothetermsandconditionsofthisAgreementasfollows:-

1. PointersinNeedshallremainatalltimesthelegalownerofthedoguntilitsdeath.TheAdoptershall be the custodian and registered keeper of the dog, and shall not transfer or assign any ofhis/her rights in the dog under this Agreement to any other person, organisation or body, orpurporttodoso-withoutthewrittenpermissionofPointersinNeed.Further,theAdopterSHALLNOTholdthemselvesoutasthedog’slegalownertoanyperson,organisationorbody,or(saveinthecaseofCondition17ofthisAgreement)doANYact inconsistentwithPointers inNeedbeingthelegalowner.Inparticular,thedogwillnotbesold,givenawayorotherwisereleasedintothecareofanyotherpersonexceptforshorttermpurposesduringholidays,illnessetc.

2. TheAdopterherebyconfirmsthattothebestoftheirknowledgeandbeliefnopersonresidingintheir household, orwhowill care for the dog, orwhowill have significant access to the dog, isdisqualifiedfromkeepinganimals,orhashadaDeprivationOrdermadeundertheAnimalWelfareAct 2006 or has an unspent conviction for ANY offences relating to animals, and that noproceedingsrelatingtoanyoftheabovearecurrentlyoutstanding.

3. The Adopter agrees to comply with all relevant legislation and laws concerning the welfare,control,responsibleownershipandprotectionofthedog,including(withoutlimitation)theAnimalWelfareAct2006(incl.theCodesofPracticeissuedwiththe2006Act)andtoensurethatANYONEwithtemporarycustodyorcareofthedogalsocomplieswithsame.Thewelfareneedsofthedogmeansprovidingforthedog’shealthandhappiness,ensuringthatthedogisproperlyhoused,fed,watered,socialised,exercised,groomedandreceivesappropriateveterinarycare,regularwormingandfleatreatment,andanyotherperiodiccareappropriatetothebreed.

4. VaccinationofthedogisatthediscretionoftheAdopter.5. TheAdopterwill need to register themicrochip inhis/herownname.Youcando thisby calling

PetLogon01296336579. Youwillneed toprovidePetLogwith theexistingmicorchipnumber.TherewillbeasmalladmininstrationchargeleviedbyPetLogforthechangewhichtheAdopterwillhavetopay.

6. Pointers inNeedmayterminatethisAgreementandrepossessthedogatanytimeifPointers inNeedbelieve(intheirsoleandabsolutediscretion)thatthedoghasbeenmistreatedorneglectedinanyway,oriftheAdopterhasbreachedthisAgreement.IftheAdopterisunableorunwillingatanytimetocontinuetheadoption,he/shewillnotifyPointersinNeedimmediatelyandreturntheaforementioneddogtousbypriormutualarrangement.

7. Aftersix(6)monthsfromthedateofsigningthisagreement,therewillbenoreimbursementoftheadoptiondonationshould theadoptionnotsucceed forany reason,unlessagreedbyPointers inNeed.

8. The Adopter will be responsible for the custody, care and control of the dog from the date ofsigningthisAgreement,aswellasALLactions,consequences,costsand liabilitiesrelatingtosuchcustody,careandcontrol.Thisincludes,withoutlimitation,arrangingandpayingforanyveterinarytreatmentwhichthedogmayrequire,unlessthereisaknownmedicalconditionwhichPointersinNeed have agreed in writing to pay veterinary fees for. Attention is specifically drawn to thepossibleliabilityoftheAdopterfordamageand/orinjurywhichmaybecausedtothirdpartiesortheirproperty. Inparticular, liabilitymayariseundertheAnimalsAct1971. Thepossibilityofanaction for nuisance against the Adopter as a result of the dog’s behaviour should also berecognised.

9. Pointers inNeedstronglyadvisestheAdoptertoarrangeappropriate insurancecoveragainsttherisksreferredtointhisAgreementabove-includingthecostsofveterinarytreatment.

10. TheAdopteragreesthattheyWILLNOTletthedogofftheleaduntiltheyhaveestablishedasolidcommand structure that the dog understands. THIS CONDITION APPLIES IRRESPECTIVE OFWHETHERORNOTYOUUSEANYFORMOFTRACKERCOLLAR.

11. The Adopter has been made aware of the safety advice concerning rehoming a dog, and inparticular, with reference to children living in, and visiting the house. The adopter has read,

understood and will abide by the instructions outlined to them by the Home Checker AND inaccordancewiththeinformationcontainedintheChildrenandDogssectionofthisdocument.

12. Unlessotherwise agreedwithPointers inNeed, theAdopter also agrees that should thedogbe‘entire’, that theywill take theresponsibility tohavehimorherneuteredorspayedat theirowncost,andattheearliestopportunitydependingonthedogsageandmedicalconditionandwiththeagreement of a registered veterinary surgeon. Furthermore, the Adopter agrees to provide toPointersinNeed(ondemand)verificationoftheprocedurefromtheVeterinaryPractice.

13. The Adopterwill immediately notifyPointers in Need if his/her contact addressesor telephonenumbersprovidedabovechange.

14. TheAdoptershallnotunderanycircumstancesusethedogorallowthedogtobeusedbyanother:inanyformofbreedingprogramme;forresearchofanykind;fordogfightingorinanywaywhichcouldbeconstruedasforthepurposeoffinancialgain–whetherdirectlyorindirectly.

15. TheAdopterwillallowarepresentativeofPointersinNeedtomakeregularvisitstotheAdopteratmutuallyagreeddatesandtimestocheckthedog’swelfareandwellbeing.

16. PointersinNeedhasdisclosedtotheAdopterallrelevantinformationwhichithasaboutthedog.This will include any pertinent information provided by the previous owner/fosterer (whereapplicable),andanyfurtherobservationsmadebytheteamatPointersinNeed.Fortheavoidanceof doubt, any information concerning the habits and past history of the dog is passed on byPointers inNeedtotheAdopter ingoodfaith. This informationhasbeenprovidedtoassistwiththe adoption process and successful adoption of the dog. It is NOT exhaustive, and Pointers inNeedcannotguaranteethatthis informationisaccurate,correctorcompletedespiteeveryeffortbeingmade.

17. SubjecttoCondition19,theAdopterindemnifiesandshallholdPointersinNeedharmlessfromallclaimsandagainstallliabilities,costs,expenses,damagesandlosses(includinganydirect,indirector consequential losses, loss of revenue, loss of reputation and all interest, penalties, regulatoryfines,legalcostsandotherreasonableprofessionalcostsandexpenses)sufferedorincurredbythePointersinNeedarisingoutoforinconnectionwith:

a. anybreachofthisAgreementbytheAdopter;and/orb. theAdopter’snegligenceorbreachofstatutoryduty.

18. Pointers in Need confirms that if a qualified veterinary surgeon advises that the dog requirestreatment, or that in the case of severe illness or injury, that the dogmust be put to sleep toprevent further suffering, the Adopter may give any necessary permissions to their veterinarysurgeononbehalfofPointers inNeed.TheAdoptermust informPointers inNeedshouldthisbethecase.

19. Intheeventof:a. anemergency;and/orb. thedogorAdopter(s)beinginvolvedinANYcriminalorcivilproceedings;and/orc. the Police, RSPCA, local council, or any other public authority or official conducts or

commencesANYformofinvestigationorenquiryconcerningthedogd. the Police, RSPCA, local council, or any other public authority or official conducts or

e. it is a condition of this Agreement that Pointers in Need are contacted IMMEDIATELYusingthefollowingemergencytelephonenumbers:

20. NothingintheseTermsandConditionsshallexcludeorlimitPointersinNeed’sliabilityfor:I. Fraud,orfraudulentmisrepresentation;II. deathorpersonalinjurycausedbyitsnegligence;III. anyotherliabilitytotheextentthatthesamemaynotbeexcludedorlimitedasamatter

oflaw.21. WithoutprejudicetoCondition20,PointersinNeed’smaximumaggregateliabilitytotheAdopter

underor in connectionwith thisAgreementwhether arising in contract, tort (including,withoutlimitation,negligence)restitutionorotherwise,shallinnoeventexceed:

a. TheamountofthedonationmadebytheAdopterinconsiderationofthisAgreement;orb. ThreeHundredandFiftyPounds(£350.00),

whicheveristhegreateramount.

22. SaveasexpresslyprovidedinCondition20,allconditions,warranties,representationsandterms,expressor implied (whetherby statute, common laworotherwise) in relation to thedogor thisAgreementareherebyexpresslyexcludedtothefullestextentpermittedatlaw.

23. This Agreement shall be governed by and interpreted according to English law, and the partiesherebyagreetosubmittotheexclusivejurisdictionofthecourtsofEnglandandWales.

24. Thisagreementisvalidfromthedateofsigninguntilthedog’sdeath.25. Finally,before you commit and sign this agreement; It is very important to give time to these

ChildrenandDogsPleaseread–importantinformation

Rescuedogsarebythenatureoftheircircumstancescarryingsomesortofemotionaltrauma, invaryingdegrees.Putinthemixpotentiallyaggravatingcircumstancessuchasanoisychild,overhotatmosphere,adog’snaturalinstincttoprotectitsfoodandtoys,orotherissues,suchashavingatoothacheorotherpain,andyouhavethepotentialforadogtoreactintheonlywayitknows;fightorflight.

Dogscannotintellectualiseorexplain,theycanonlyreactphysically.Buttheywilltrytotellyou.

Therearealwayswarningsigns.Someareobvious,othermoresubtle.Commonexamplesare;growlingorsnarling;baringteeth,raisedhackles,bulgingeyes,lickinglips.Oftenthedogwilltrytoremoveitselffromtheproximityofthecauseofitsstress.

Teachthechildthatthedogisarelativeofawildanimalwithbigteethandstrongjaws.

Teachthechildnottofearthedogbuttorespectit.

Teachthechildtonotantagonise,frightenorannoythedog.

Stayawayfromthedogwhenithasfood.

Separatethedogfromchildrenwhentheyareeating.Thisincludessnacks.

Andremembertoteachthechildtoletsleepingdogslie.

Wewillnotsendyouanymarketingmaterial,andwouldonlycontactyoupersonallyviaemail/phoneshouldwehaveaspecificneedtoinrelationtotheAdopted/Fostereddog.

Anynewsand/or informationwewouldneedtocommunicate toallofourAdopters/Fosterswouldbeeither throughourwebsiteorFaceBookpagesonly;neitherofwhichwouldweeverreleaseanypersonalinformationto.
