COMES NOW, City of Pocatello ("Pocatello"), seeking the above-captioned relief.

I . Pocatello' s position as an "interested party" in these proceedings was confirmed in the

August 8, 2012 Order Affirming Party Status and Notice of Status Conference. At the

time of the August 8, 2012 Order, Pocatello was represented by Beeman & Associates.

2. Undersigned counsel now represents the City of Pocatello in this matter and hereby

enters an appearance.

3. As noted in the August 8, 2012 Order, "interested" entities that desired to be treated as

fonnal parties for purposes of the record were required to file motions to intervene.

Pocatello did not file such a motion, and no longer wishes to participate in this matter.

4. Pocatello has conferred with Suez Water, the applicant in this matter. Suez Water does

not object to Pocatello's withdrawal.

WHEREFORE, Pocatello respectfully requests that the hearing officer withdraw

Pocatello as an "interested party" to these proceedings, and that the service list be adjusted to

reflect this withdrawal.
