MOVEMENT CONTROL ORDER 2.0 | UPDATES [1]

Further to JBC Circular No.82/20, the following updates relating to conduct of court matters

during the MCO 2.0 period are brought to members’ attention.

JOHOR BAHRU

1. Johor Bahru 1.1 Subordinate Courts [Criminal] The duty rotation schedule for the Criminal Sessions and Magistrate’s Court are attached

respectively as APPENDIX–9 and APPENDIX–10.

NORTH JOHOR

2. Muar 2.1 High Court 1 The list of matters affected and their rescheduled dates received from Deputy Registrar

Muar High Court, Puan Noor Shahidah binti Saharom is at APPENDIX–11.

3. Batu Pahat 3.1 Sessions Court

(i) The Sessions Court will operate only for the purposes of criminal matters involving fresh charges;

(ii) All other matters are postponed to a dated to be notified; (iii) Mentions for cases registered manually will be via email while those registered via e-filing will be by way of e-Review in the Case Management System [CMS];

(iv) Members are advised to check the CMS for case status. For cases registered manually, members may contact the interpreters for further information and

assistance.

3.2 Magistrates’ Courts (i) All civil and criminal matters set down for trial/hearing are postponed to a date after MCO 2.0; the rescheduled dates will be notified in due course by the courts;

(ii) Only fresh criminal charges and remand matters will proceed; (iii) Cases registered manually will be dealt with via email while those registered via e-filing will be by way of e-Review.

(ii) Case managements in the CMS will proceed per usual via e-Review;

(iii) Mentions for cases registered manually will be via email while those registered via e-filing will be by way of e-Review in the CMS.

Criminal Matters

(iv) criminal trials are vacated and court will reschedule the trial dates through email; (v) all criminal mentions are rescheduled per APPENDIX–13 and reproduced below:-

1. Berikutan dengan arahan Kerajaan untuk melaksanakan Perintah Kawalan Pergerakan

bermula 13 Januari 2021 sehingga 26 Januari 2021, semua kes-kes Sivil & Jenayah

MOVEMENT CONTROL ORDER 2.0

UPDATES ON OPERATION OF LAW FIRMS,

COURT AND CONVEYANCING MATTERS

On 11 Jan 2021, the Prime Minister announced the Movement Control Order (“MCO 2.0”)

from 13 Jan to 26 Jan 2021. Johor is among the states affected by MCO 2.0.

Members are accordingly informed of the following.

OPERATION OF LAW FIRMS

1. By the media statement of YB Dato’ Seri Mohamed Azmin Ali, Minister of International Trade and Industry, in particular “Lampiran 1, Category C, item 27” it is confirmed that

legal firms are allowed to operate during MCO 2.0 subject to compliance of the Standard

Operating Procedure and guidelines applicable to the legal sector. The Bar Council Circular

007/2021 is attached as APPENDIX – 1.

2. The “SOP AM PERINTAH KAWALAN PERGERAKAN (PKP)” as at 12/01/2021 from the Majlis Keselamatan Negara website is at APPENDIX–1A.

COURT MATTERS

3. The Office of Chief Registrar of the Federal Court of Malaysia has issued the directive

“Operasi Mahkamah Semasa Pelaksanaan Perintah Kawalan Pergerakan (PKP) Berkuat Kuasa Mulai 13 Hingga 26 Januari 2021”, pertaining to Court operations during the MCO

2.0. With the issuance of this directive, all previous directions relating to court are thereby

revoked. The directive is attached as APPENDIX-2.

APPENDIX-3 is the “Arahan Amalan Ketua Hakim Negara Bilangan 1 Tahun 2021”

referred in said directive.

4. JOHOR BAHRU 4.1 HIGH COURT

4.1.1 Deputy Registrar, Puan Azureen Sahira Binti Sauffee Afandi, confirmed the

directions during MC0 2.0 as follows:-

General Information

(i) no matters shall be conducted by physical attendance; (ii) all counters at the High Court are closed; (iii) the list of Judicial Officers with their contact details is at APPENDIX-4.





Civil Courts

(i) all matters involving the physical attendance the public will be rescheduled to a date to be notified. Members are required to check for the next dates via the e-filing

system;

(ii) cases scheduled online (ie. e-Review, email, Skype, Zoom etc.) will proceed as scheduled and those not requiring physical attendance of the public will be conducted

online.

Criminal Courts

(i) matters which cannot proceed online will be rescheduled to a date to be notified; (ii) case managements to be conducted online by consent of the parties.

4.1.2 Auction Proceedings

The letter dated 12/1/2021 from Tuan Mohd Farid Nazzrin bin Ahmad, Senior Assistant

Registrar High Court Johor Bahru captioned “PENANGGUHAN PERBICARAAN KES

LELONGAN AWAM (MANUAL) DI MAHKAMAH TINGGI JOHOR BAHRU (KOD

38”) is attached as APPENDIX-5.

Please note that the new official email address of Unit Pelaksanaan Mahkamah Tinggi

4.2 SUBORDINATE COURTS The information from Johor Bahru Subordinate Courts Senior Assistant Registrar, Tuan

Mohd Zulhilmi Bin Ibrahim is per below.

Civil Courts

(i) all courts are closed; (ii) cases which can be disposed by way of remote hearing will proceed online; (iii) Trials scheduled during the MCO 2.0 are vacated. The Court will liaise directly with members concerned concerning the further conduct of said matters;

(iv) cases with certificates of urgency will be heard by the Sessions Court Judge or Magistrate on duty per the schedules attached as APPENDIX–7 and APPENDIX-8

respectively.


Criminal Courts

(i) courts will operate according to a rotation schedule, which will be circulated once JBC receives it;

(ii) only proceedings concerning fresh charges and remands will proceed; (iii) cases set down for Trials and Mentions are postponed to after MCO 2.0.

5. MUAR 5.1 HIGH COURT

High Court Muar Deputy Registrar, Puan Noor Shahidah binti Saharom

informed that:-

5.1.1 Cases in High Court 1

(i) HC 1 is closed during the MCO 2.0; (ii) all matters are rescheduled. A circular will be issued upon receipt of the list of rescheduled matters from the Court.

5.1.2 Cases in High Court 2 (i) HC 2 is closed during the MCO 2.0; (ii) scheduled matters are converted to Case Management via email or e-Review. Members are advised to email Senior Assistant Registrar,

Puan Kartini Binti Kasran at [email protected]

5.2 SESSIONS COURT Puan Shahidah kindly checked with Sessions Court Judge, Tuan Amran who confirmed that

matters set down for trial before him are adjourned. The Court Interpreter will contact the

solicitors concerned for rescheduling.

CONVEYANCING MATTERS

6. Pejabat Tanah dan Galian, Johor notified JBC as follows:-

“Kaunter Urusniaga Dan Bukan Urusniaga Pentadbiran Tanah Johor akan dibuka

mengikut waktu pejabat tetapi hanya 3 kaunter Urusniaga sahaja yang beroperasi.

Bilangan pelanggan yang dibenarkan memasuki bangunan PTG hanya semaksimum

30 orang dalam satu-satu masa. SOP PKP adalah terpakai bagi semua pelanggan

dengan menguatkuasakan pematuhannya. Semua pihak yang berurusan dengan

PTG@PTD diingatkan agar mematuhi SOP yang ditetapkan. Kegagalan pematuhan

akan menyebabkan mereka tidak dibenarkan berurusan dengan pentadbiran ini.”

Secretariat from Monday to Friday at 8:30 a.m. to 5:30 p.m. As the use of these facilities is

MOVEMENT CONTROL ORDER 2.0

UPDATES ON OPERATION OF COURT MATTERS

MCO 2.0 has been extended in the State of Johor until 04/02/2021.

By notification dated 20/01/2021 issued by the Right Honourable Chief Justice of Malaysia,

directions were issued for the conduct of criminal matters, such directions taking effect from

27/01/2021 [ARAHAN MENGENAI PENGENDALIAN PROSIDING KES JENAYAH DI

MAHKAMAH SEMASA TEMPOH PERINTAH KAWALAN PERGERAKAN (PKP) –

APPENDIX-1].

Following this direction, the office of the Chief Registrar of the Federal Court issued the

attached TATACARA OPERASI STANDARD PENCEGAHAN WABAK COVID-19 DI

MAHKAMAH DI SELURUH MALAYSIA BAGI PENGGUNA MAHKAMAH [APPENDIX-

2], which supersedes the Standard Operating Procedure issued on 03/05/2020.

Members are accordingly informed of the following effective from 27th January 2021 until

further notice.

COURT MATTERS

1. JOHOR BAHRU 1.1 HIGH COURT Deputy Registrar, Puan Azureen Sahira Binti Sauffee Afandi, confirmed the directions

as follows:-

General Information

(i) all counters at the High Court are closed; (ii) however, the following counters at the High Court of Johor Bahru will be open

temporarily on 27th January 2021 from 9:00 a.m. to 12:00 p.m. only. To ensure

observance and compliance of the SOP in place, these counters’ business will be

by way of appointment;

(a) for submission and certification of true copies of documents in Codes 31 and 32 proceedings [Letters of Administration & Probate]; and

(b) for filing of Revocation of Power Attorney and Deed of Receipt Reassignment.





Civil Courts

(i) all matters involving the physical attendance of the public will be rescheduled to a date to be notified. Members are required the check for the next dates via the e-filing

system;

(ii) cases scheduled online (ie e-Review, email, Skype, Zoom etc) will proceed as scheduled and those not requiring physical attendance of the public will be conducted

online.

Criminal Courts

Criminal matters will proceed as scheduled. Case managements to be conducted online

by consent of the parties.

PERBICARAAN KES LELONGAN AWAM (MANUAL) DI MAHKAMAH TINGGI

JOHOR BAHRU (KOD 38”) is attached as APPENDIX-4.

1.2 SUBORDINATE COURTS The information from Johor Bahru Subordinate Courts Senior Assistant Registrar, Tuan

Mohd Zulhilmi Bin Ibrahim is per below.

Civil Courts (i) all courts are closed; (ii) cases which can be disposed by way of remote hearing will proceed online; (iii) Trials scheduled during the MCO 2.0 are vacated. The Court will liaise directly with members concerned concerning the further conduct of said matters;

(iv) cases with certificates of urgency will be heard by the Sessions Court Judge or Magistrate on duty per the schedules attached as APPENDIX–5 and APPENDIX-6

respectively.

2. MUAR 2.1 HIGH COURT High Court Muar Deputy Registrar, Puan Noor Shahidah binti Saharom informed that:-

General Information

(i) The service bureau counter at the High Court is open but only on an appointment basis.

(ii) The Commissioner for Oaths Counter is closed until further notice.

Civil Courts

(i) all matters involving the physical attendance of the public will be rescheduled to a date to be notified. Members are required the check for the next dates via the e-filing

3. Kluang Magistrate’s Court Civil Matters

(i) No open court matters will proceed during MCO 2.0 period. Trial/hearing dates for all civil matters are converted to Case Management dates and will be conducted

through email with respective parties to reschedule the trial/hearing dates. For matters

registered via e-filing, please check the CMS.

(ii) Case managements in the CMS will proceed per usual via e-Review;

(iii) Mentions for cases registered manually will be via email while those registered via e-filing will be by way of e-Review in the CMS;

(iv) In the event of urgency, subject to the agreement of the parties and as directed vide Arahan Amalan Ketua Hakim Negara Bilangan 1 Tahun 2021, the matter will

proceed by way of remote hearing.

Criminal Matters

All criminal matters and mentions will proceed in open court pursuant to Arahan

Amalan Ketua Hakim Negara Bilangan 1 Tahun 2021.

4. SEGAMAT SUBORDINATE COURTS

(i) Criminal matters will proceed as scheduled. Case managements to be conducted online by consent of the parties.

(ii) Trial/hearing dates for all civil matters are converted to Case Management dates. Parties will be furnished the Zoom link via email.

(iii) Case managements and Mentions will proceed per usual via Zoom at 9 a.m.

As announced in JBC Circular 46/20, Video Conference Facilities are available at the

Secretariat from Monday to Friday at 8:30 a.m. to 5:30 p.m. As the use of these facilities is

subject to availability, members are required to make prior reservation, with the Secretariat,

for the specific time and date.

TATACARA OPERASI STANDARD

PENCEGAHAN WABAK COVID-19 DI MAHKAMAH SELURUH

MALAYSIA BAGI PENGGUNA MAHKAMAH

1. PENDAHULUAN

Badan Kehakiman Malaysia sentiasa prihatin tentang kesihatan, keselamatan dan

kebajikan pengguna Mahkamah semasa penularan wabak Coronavirus 2019

(COVID-19). Selaras dengan itu, Pejabat Ketua Pendaftar Mahkamah

Persekutuan Malaysia (PKPMP) mengeluarkan Tatacara Operasi Standard

Pencegahan Wabak COVID-19 di Mahkamah Seluruh Malaysia (SOP) bagi

pengguna Mahkamah untuk memastikan proses pentadbiran keadilan berjalan

dalam keadaan selamat, teratur dan lancar serta akses kepada keadilan tidak

terjejas.

2. TARIKH KUAT KUASA

SOP ini mula berkuat kuasa pada 27 Januari 2021.

3. PEMAKAIAN

3.1 SOP ini terpakai bagi semua peringkat Mahkamah di seluruh Malaysia.

3.2 SOP ini menggantikan Tatacara Pengendalian Piawai Pencegahan

Wabak COVID-19 di Mahkamah Seluruh Malaysia Semasa Tempoh

Perintah Kawalan Pergerakan Bersyarat (PKPB) dan Pasca Perintah

Kawalan Pergerakan (PKP) yang dikeluarkan oleh PKPMP pada 3 Mei

2020.

4. TANGGUNGJAWAB PENGGUNA MAHKAMAH

Pengguna Mahkamah –

4.1 adalah DILARANG untuk hadir ke Mahkamah jika –

(a) disahkan positif COVID-19;

(b) suhu badan melebihi 37.5 darjah celsius;

(c) bergejala seperti demam, batuk, selsema atau sesak nafas;

(d) merupakan kontak rapat kepada kes positif COVID-19;

(e) telah dikategorikan sebagai Person Under Investigation (PUI)/

Person Under Surveillance (PUS); atau

(f) telah menjalani ujian calitan (swab test) tetapi belum mendapat

keputusan;

4.2 adalah dilarang untuk hadir ke Mahkamah jika tidak mempunyai sebarang

urusan;

4.3 hendaklah memastikan penjarakan fizikal antara satu sama lain semasa

berurusan di Mahkamah sentiasa dipatuhi;

4.4 hendaklah sentiasa memakai pelitup muka semasa berada di dalam premis

Mahkamah;

4.5 hendaklah mengimbas kod QR aplikasi MySejahtera sebelum memasuki

premis Mahkamah dan sebelum memasuki Mahkamah terbuka atau

sebelum mengunjungi mana-mana fasiliti Mahkamah yang mempamerkan

kod QR MySejahtera untuk diimbas. Pengguna Mahkamah yang tidak

mempunyai aplikasi MySejahtera hendaklah mencatatkan nama dan suhu

badan mereka dalam buku daftar yang disediakan;

4.6 hendaklah mematuhi penandaan jarak fizikal yang telah dibuat di

Mahkamah seperti di kantin, kaunter-kaunter Mahkamah, lif, Mahkamah

terbuka dan lain-lain;

4.7 hendaklah tidak berkumpul di kaunter-kaunter Mahkamah dan hanya

seorang sahaja pengguna Mahkamah dibenarkan untuk berurusan di

kaunter-kaunter Mahkamah pada satu-satu masa;

4.8 tidak dibenarkan untuk berjumpa dengan banduan/ Orang Kena Tuduh

(OKT) dalam reman di mana-mana tempat di dalam premis Mahkamah

kecuali di dalam Mahkamah terbuka. Walau bagaimanapun, tatacara ini

tidak terpakai kepada penjamin yang diarahkan untuk menandatangani bon

jamin;

4.9 hanya dibenarkan untuk memasuki Mahkamah terbuka apabila kes mereka

dipanggil dan keluar dari Mahkamah terbuka apabila kes selesai;

4.10 digalakkan untuk menggunakan aplikasi e-Jamin bagi urusan pembayaran

wang jamin; dan

4.11 digalakkan untuk menggunakan cash deposit machine (CDM) atau saluran

ePOS bagi urusan pembayaran denda.

5. TATACARA AM DI MAHKAMAH

5.1 Pintu Mahkamah terbuka akan mula dibuka pada jam 9.00 pagi atau pada

waktu-waktu lain yang ditetapkan oleh pihak Mahkamah.

5.2 Pihak-pihak hendaklah duduk di tempat yang telah ditetapkan dalam

Mahkamah terbuka dan mematuhi penandaan jarak fizikal yang telah

dibuat.

5.3 Hanya seorang Timbalan Pendakwa Raya/ Peguam Persekutuan/ peguam

dibenarkan untuk berada di Mahkamah terbuka melainkan jika mendapat

pengecualian daripada Mahkamah.

5.4 Hanya dua orang ahli keluarga/ kawan/ kenalan tertuduh dibenarkan masuk

ke Mahkamah terbuka.

5.5 Timbalan Pendakwa Raya/ Peguam Persekutuan/ peguam tidak

dibenarkan untuk menghampiri meja jurubahasa semasa perbicaraan.

5.6 Pihak-pihak hendaklah hadir mengikut tarikh dan masa berperingkat yang

telah ditetapkan oleh Mahkamah. Pihak-pihak tidak dibenarkan untuk

berada di dalam Mahkamah terbuka sehingga kes mereka dipanggil.

6. LIPUTAN MEDIA

Liputan media adalah tidak dibenarkan semasa apa-apa prosiding Mahkamah.

Namun, bagi kes-kes yang melibatkan kepentingan awam, Mahkamah boleh

mempertimbangkan untuk menyediakan bilik bagi siaran langsung (live feed)

dengan pematuhan terhadap jarak fizikal, pemakaian pelitup muka dan

penggunaan hand sanitizer, atau menyediakan kemudahan liputan media melalui

aplikasi zoom.

7. ARAHAN BERHUBUNG DENGAN WABAK COVID-19

Selain tatacara yang dinyatakan dalam SOP ini, pengguna Mahkamah hendaklah

mematuhi apa-apa arahan berhubung dengan wabak COVID-19 yang dikeluarkan

oleh MKN serta KKM dari semasa ke semasa apabila berurusan di Mahkamah.
