A. For the voluntary annexation of one (1) tract ofland totaling 3,500.07 acres, more or less, as described in the attached Exhibit "A", and known as Tract 1 (N.D. Hachar Tract), located northwest ofthe city, west of Travel Centers and Flying J Truck Stops and east of Millennium Park, along FM 1472 (Mines Road), as required by Section 43.063 ofthe Texas Local Government Code.

After reading the item and having no objections, the chairman opened the public hearing.

There was no public comment.

Cm. Garcia made a motion to close the public hearing and support the annexation.

1. Revise plat note #2 to read, "This replat does not attempt to alter, amend, or remove any restrictions or covenants or restrictions. No portion of the preceding plat was limited by deed restriction to residential use for not more than two (2) residential units per lot."

2. Provide a plat note to state, "Building setbacks shall be as shown on the fuce of the rep lat."

3. Provide any pertinent plat notes from the previously recorded plat.

James Bishop, representing members of the Home Owner's Association, spoke against the proposed item.

Conform to the SUP requirements for Townbomes as approved the City Council. 1. Provide a revised plat name in order to avoid plat name duplication. 2. Place signature blocks on the face of the plat in the following order: Owner w/notary, Lien

holder w/notary (If applicable), Engineer or record and/or Surveyor, City Engineer, the Planning & Zoning Commission Chairman, Planning Director and the Webb County Clerk as the last three.

3. Provide a plat note stating the purpose of the replat. 4. Revise plat note #7 to include Lot 53. Also clearly reference the un-inhabitable lots on the

face of the rep lat. 5. Delete plat note #3. 6. As Per Section 24.80.4(1) of the Laredo Land Development Code, provide a plat note stating,

"No more than one single family detached dwelling shall be located on an individual lot." 7. Confirm street name appropriateness with the Planning & Zoning Department prior to

purchase of signs. Also provide an additional street name for Lots 27-52.

Prior action: The Commission tabled a request for an R-3 district at the regular meeting of April16, 2014. BACKGROUND

Council District: III- The Honorable Alejandro "Alex" Perez, Jr.

Proposed use: Multi-family residential

Site: Two single-family residential structures

Surrounding land uses: The properties to the north are single-family residential. To the south are single-family residential, multi-family residential and vacant lots. To the east are single-family residential uses and vacant lots. To the west are single-family residential, vacant lots and multi-family residential.

Comprehensive Plan: The Future Land Use Map recognizes this area as Low Density Residential.

Transportation Plan: The Long Range Thoroughfare Plan does not identify Corpus Christi Street.

Letters sent to surrounding property owners: 23 InFavor: 0 Opposed: 0

STAFF COMMENTS

The Laredo Land Development Code (Section 24.63: Permitted Uses) permits apartments in zones R-2, R-3, B-1 and B-3. This property is currently zoned R-1. The applicant is applying

for a Conditional Use Permit. Section 24.94.5(A) (1): Conditional Use Permit Application Submittal Criteria states that "Applications for properties currently zoned, AG, R-S, R-1, R-IA, R-1 MH, or RSM may only seek conditional use status for those uses permitted by zones R-S, R -I, R­IA, R-IMH, RSM, R-2, R-3, R-0 or B-1 of higher intensity."

Staff supports the issuance of the proposed CUP at this location for the following reasons:

1. The proposed use is compatible with similar uses in the area.

P&Z COMMISSION RECOMMENDATION: The P & Z Commission, in a to vote , recommended

of the conditional use permit.

2. The property complies with the minimwn parking requirements with the proposed use. 3. The proposed use is compatible with the adjacent R-2 district to the south of the property.

IMPACT ANALYSIS:

Is this CUP contrary to the established land use pattern? No. The established land use pattern is mixed residential in nature.

Would this CUP create an isolated zoning district use unrelated to surrounding districts? No. The proposed use is compatible with existing R-2 districts adjacent to the south of the property.

WiD issuance of a CUP adversely influence living conditions in the neighborhood? No, the proposed use is compatible with existing uses in the surrounding neighborhood.

Are there substantial reasons why the property cannot be used in accord with existing zoning? Yes, the existing R-1 district only allows for single-family residential uses.

Should the Commission wish to recommend in favor of the request, staff suggests the following conditions:

1. The Conditional Use Permit shall be issued to the Sylvia M. Leal, and is nontransferable. 2. The Conditional Use Permit is restricted to the activities provided in the letter, Exhibit "A", which is

made part hereof for all purposes. 3. The Conditional Use Permit is restricted to the site plan, Exhibit "B", which is made part hereof for

all purposes. 4. Parking will be provided in compliance with the Laredo Land Development Code. 5. Landscaping will be provided in compliance with the Laredo Land Development Code. 6. Parking must comply with provided site plan and be limited to access off of Corpus Christi Street.

This is a formal request that I be granted a conditional use permit for address 2601 Corpus Christi. When I purchased the property, the structure was divided into 3

apartments. Later to find out that this property is in R1 zone and that I would not be able to rehabilitate the 3 units. I have requested a zone change and was told that perhaps I would be able to obtain a conditional use permit ifl meet all the

requirements, such as parking. I have submitted a site plan along with a floor plan to the department of planning and zoning and believe that requirements are met.

Again, I am formally requesting that I be granted a conditional use permit so that I may continue working on the project as a 3 apartment structure. I sincerely

It is intended for this zoning classification to exist primarily along principal arterial streets or the freeway and to impose site development regulations to ensure adequate access of all uses within this classification.

It is intended for this zoning classification to exist primarily along principal arterial streets or the freeway and to impose site development regulations to ensure adequate access of all uses within this classification.

Is this change contrary to the established land use pattern? Yes, the established land use pattern is undeveloped.

Would this change create an isolated zoning district unrelated to surrounding districts? Yes, the immediately surrounding districts only include B-3 and R-1 districts. However, there are sections of B-4 well to the north and well south of this site.

Comprehensive Plan: The Future Land Use Map recognizes this area as Light Commercial.

B-4 (Highway Commercial District): The purpose of the B-4 District (Highway Commercial District) is to provide for those businesses and services serving a regional area which are to be located primarily along principal (major) arterial streets or the freeway, as classified in the Transportation Plan of the City of Laredo. It is intended for this zoning classification to exist primarily along principal arterial streets or the freeway and to impose site development regulations to ensure adequate access of all uses within this classification.

Is this change contrary to the established land use pattern? Yes, the established land use pattern is undeveloped.

Would this change create an isolated zoning district unrelated to surrounding districts? Yes, the immediately surrounding districts only include B-3 and R-l districts. However, there are sections ofB-4 well to the north and well south of this site.

Will change adversely influence living conditions in the neighborhood? Yes, the proposed B-4 district may introduce more intense and incompatible uses to the area.

Site: The site is occupied by a vacant single family residence and a structure current daycare.

Surrounding land uses: The predominant uses surrounding this property are single family residential. Abutting the property, to the north are single family residences; to the east are single and multi-family structures, a vacant commercial building, and an ambulance service. South of the property are Exxon Gas Station and a meat market, Auto Masters and more single family residences. West of the property are Ryan Elementary School and more single family residences.

Comprehensive Plan: The Comprehensive Plan identifies the north side of the site as Light Commercial and the south side as Low Density Residential.

Transportation Plan: The Long Range Thoroughfare Plan identifies Clark Boulevard as a Modified Major Arterial and Arkansas Avenue as a Minor Arterial.

1. The C.U.P. shall be issned to Cesar and Maria Elena Almanza, and it is nontransferable. 2. The C.U.P. is restricted to the following activities: for a child day care center with the capacity for 28

children, 4 employees, and will be open from Monday through Sunday from 6:00 .am. through 9:00 p.m., and as further described in letter, Exhibit "A", which is made part hereof of all purposes.

3. The C.U.P. is restricted to the Site Plan, Exhibit "B", which is made part hereof for all purposes.

4. Strobe lights, flashing lights, and any other outdoor lighting designated to attract attention are prohibited.

5. Banners and window signs are prohibited. 6. Owner shall comply with all requirements for parking spaces, paving, exterior lighting, access and

I Maria Elena Almanza, I am requesting to change the Rl Zone to C.U.P. on the property located at 2720 Clark Blvd.

The purpose for this conditional pennit is to continue providing our child care services to the community. Our extended hours of operation are Monday through Sunday from 6:00am to 9:00pm.

The Center has capacity for 28 children and we need four employees during the morning and four in the afternoon.

Site: The site is occupied by Times Square Commercial building, which includes Building A and Building B.

Surrounding land uses: North of the site, across Del Mar Blvd., is Plantation Residential Subdivision. East of the property is Building B, which includes 26 miscellaneous commercial uses and Building A that includes Tacos Kissi. East of the site abutting the property is City Walk Commercial Building A, that includes, four different commercial uses, and Building B that includes Laredo Chi Academy Beauty School. East of the site is a vacant lot. South of the property is a vacant lot, Lago del Mar Apartments, Precious Treasures and Mundo Montesori. West of the property is Times Square Commercial Plaza, which includes other commercial Suites.

Comprehensive Plan: The Comprehensive Plan identifies this area as Light Commercial.

Transportation Plan: The Long Range Thoroughfare Plan identifies Del Mar Boulevard as a Modified Major Arterial. Rocio Drive is not identified on the Thoroughfare Plan.

Staff Comments (cont.)

Staff supports the issuance of the special use permit at this location. The proposed use is compatible with the surrounding zones in the area and is in conformance with the Comprehensive Plan's designation for the area as Light Commercial.

Staff suggests the following conditions:

I. The Special Use Permit is issued to Juan Carlos Ordaz and Ricardo and Flor Kissi, and is non­transferable.

2. The Special Use Permit is restricted to the site plan, Exhibit "A", which is made part hereof for all purposes.

3. The Special Use Permit is restricted to the following activities: for a restaurant serving alcohol on 7619 Rocio Drive Unit A-27, that will be open from Sunday through Thursday from 7:00a.m. To 12:00 a.m., and Friday and Saturday from 7:00a.m. through I :00 a.m. to include holidays and as further described in the letter, Exhibit "B", which is made part hereof for all purposes.

4. The establishment must make provisions to keep litter to a minimum, and to keep it from blowing onto adjacent streets and properties.

5. Signage shall be consistent with the City's Sign Ordinance and TABC rules or regulations. 6. Off-street parking shall be provided in accordance with the City of Laredo Land Development Code. 7. There shall be no ground vibrations created or sustained on the site which are perceptible without

instruments at any point on any property adjoining the subject property. 8. At all times the restaurant is open to the public for business, it shall continually maintain and serve

food from its full service menu. 9. The restaurant shall not exceed the "Occupant Load" as set forth in the Certificate of Occupancy with

Occupant Load. I 0. The restaurant shall, during all hours of operation, maintain, free from obstruction or impediment to

full instant use in the case of fire or other emergency, all exit accesses, exits or exit discharges. 11. The restaurant shall undergo an annual Fire Inspection. 12. All permits, licenses, certifications and inspections required by the codes and ordinances of the City

of Laredo shall be kept up to date and current including but not limited to Food Manager License (annual), Food Handler's Permit (annual), and Certificate of Occupancy with Occupant Load, Occupant Load being the approved capacity of a building or portion thereof.

13. Landscaping of property shall be provided in accordance with the City of Laredo Land Development Code.

14. Lighting of property shall be screened to avoid adverse impact on adjacent residential neighborhoods. 15. Owner shall provide a 7' high opaque fence along property lines which abut or adjoin any residential

zones/uses. 16. Owner shall comply with, Building, Health, Life and Safety, and all applicable codes and regulations

as required.

PROPOSED ACTION: APPROVE SUBJECT TO THE FOLLOWING COMMENTS: Master Plan:

I. Provide a revised master plan with a revision date of 06119114 to incorporate any approved comments prior to any subsequent submittals in accordance to Section 2-3.2(a)4 of the Subdivision Ordinance Handbook.

2. Provide and show phases numbers in bold dark lines. Also provide a lot and street layout to better determine possible issues with accessibility.

3. Conform to Section 24-69 of the Laredo Land Development Code regarding Flood Plain Management Standards.

4. Label the north/south street north of Shiloh Dr. as a major collector. Also extend Shiloh Dr. east to the edge of the master plan boundaries.

Dear Mr. B rattan

Howland Engineering and Surveying Company submitted a preliminary plat for the above reference project on May 20, 2014 on behalf of the developer. A Bus Road is shown on sheet 2 of 4 of the preliminary plat and is located east of Bob Bullock Loop and north of Del Mar Blvd. (also known as Killam Ranch Road), along the east property line of the Cuauhternoc Rodriguez Tract. The right-of-way for the Bus Road is 50 feet and the distance from Del Mar. to the end of the proposed cul-de-sac is 1450 ft. This is a request for a variance to the maximum dead-end street length requirements as per Section 3.2(J) of the Subdivision Ordinance.

The Ordinance states: "Dead-end streets, designed to be so permanently, shall not be longer than five hundred (500)feet or twenty-four dwelling units, ..... "

Although the distance exceeds the maximum cul-de-sac length of 500 ft. as stated on the ordinance, there are only two property owners abutting the proposed road. The purpose of this street is to provide a secondary means of ingress and egress to the proposed 20 acres school site. The master plan identifies the area east of the road as commercial and the area west of the road as undeveloped and outside the city limits. We hereby request a variance to the dead-end street length requirement.
