Section §163.3194, F.S. requires that “all land development regulations enacted or amended...to be consistent with the adopted comprehensive plan.”

LDR, Section 2.2.1 states that “Amendments to zoning on the Official Zoning District Map shall be consistent with the adopted Cape Coral Comprehensive Plan, including the Future Land Use Map and its accompanying text.”

STAFF RECOMMENDATION

For the reasons discussed within the analysis below, staff believes the proposed rezoning is consistent with the Comprehensive Plan, and as a result, staff recommends Approval of the proposed rezoning request. Background/Analysis:

The future use of this site is yet to be determined. However, the applicant has submitted a Future Land Use Map Amendment (FLUMA) request to Multi-Family Residential for the subject properties. The subject properties received a Single Family Residential classification in 2004, when centralized utilities were delivered to the area through the Southwest 2 Utility Expansion Area. No other FLUMA or rezoning amendment had been requested for the subject properties prior to the current requests received this year. The subject properties currently have the Residential Development (RD) zoning designation. This zoning designation permits single family residential uses by right, and permits a maximum residential density of 4.4 dwelling units per acre. Multi-Family residential uses would not be permitted given the future land use map classification of Single Family Residential; if that classification was to be amended, as is requested, then multi-family uses could be permitted on the subject property.

The proposed rezoning to Multi-Family Residential (R-3) would permit multi-family residential uses on the subject properties. These properties are located near an intersection of arterial and collector roadways, which is seen as an appropriate location of multi-family residential development. Comprehensive Plan As identified above, a FLUMA to Multi-Family Residential has been requested for the subject properties. The proposed rezoning would be consistent with the proposed future land use map classification. In analyzing the Comprehensive Plan, multiple policies are relevant in determining the propriety of the rezoning request. Policies 1.1 and 1.2 of the Housing Element, and Policy 8.5 of the Future Land Use Element relate to the rezoning request. Staff is in agreement with the applicant’s findings that the rezoning request is in accordance with the Comprehensive Plan. Land Use and Development Regulations -- Section 8.7 Amendments: Staff has reviewed this request in accordance with Section 8.7 Amendments, .3 Consistency with Comprehensive Plan and General Standards A., B. 1.-10. of the Land Use and Development Regulations and provides the following analysis. This section is used for future land use map amendments, comprehensive plan amendments, and for rezoning amendments.

1. The extent to which the value of the property is diminished by the proposed land use restriction or zoning of the property.

The rezoning of these properties from RD to the R-3 district would not diminish the land value because this proposed district permits a higher density of dwelling units.

2. The extent to which the removal of a proposed land use restriction or change depreciates the value of other properties in the area. The proposed zoning district is not anticipated to depreciate the value of other properties in the area. There are multiple properties in two directions (southeast, east) that have a multi-family residential future land use map classification.

3. The suitability of the property for the zoning purpose or land use restriction imposed on the property as zoned. The proposed zoning district would be consistent with the proposed land use classification of Multi-Family Residential, and is consistent with the guidance that is provided in the Land Use and Development Regulations. Staff is recommending approval of the proposed FLUMA to Multi-Family Residential. Should the FLUMA be denied by Council, however, then this rezoning would not be possible, and should be withdrawn.

4. The character of the neighborhood, existing uses, zoning of nearby and surrounding properties,

and compatibility of the proposed land use restriction or zoning.

The surrounding area has a mixed character of commercial, single family and multi-family residential uses. An emerging commercial node is being developed at the intersection of Skyline Boulevard and Mohawk Parkway. The subject property is located on a collector roadway, across the street from a Neighborhood Wal-Mart, adjacent to multi-family residential properties to the east. As a result, the proposed rezoning should not negatively affect the character or compatibility of the neighborhood.

5. The relative gain to the community as compared to the hardship, if any imposed, by the

proposed land use restrictions or from rezoning said property.

The purpose of this rezoning is to increase the City’s inventory of multi-residential properties, a housing type which is under-represented in the community.

6. The community need for the use proposed by the zoning or land use restriction.

The City of Cape Coral needs to increase the amount of multi-family residential lands in appropriate areas, in order to provide a mix of residential opportunities for residents within Cape Coral.

7. Length of time the property proposed to be rezoned has been vacant, as zoned, when

considered in the context of the City of Cape Coral Comprehensive Land Use Plan for the development of the proposed property and surrounding property. The subject properties are not developed. The property has been classified as Single Family since 2004. Should the proposed FLUMA to Multi-Family be adopted, the proposed rezoning will provide full consistency between the land use and zoning.

8. The extent to which the proposed land use restriction or zoning promotes the health, safety,

morals, or general welfare of this community.

Approval of this rezoning request will have negligible negative effect upon the health, general welfare, safety or morals of the community. Providing a zoning designation that is consistent with the future land use map classification should have a positive effect on the general welfare for the community.

9. The extent to which the proposed land use, land use restriction, or zoning will impact the level

of service standards for public facilities as specified in the Comprehensive Plan.

The impacts on infrastructure for residential development on this site will be negligible. There may be an increase of vehicular traffic due to the close proximity of the subject properties to

arterial and collector roadways. Facility capacity exists for both the transportation and utility infrastructure networks maintaining the level of service standards will remain unchanged as a result of this rezoning.

10. Whether the proposed land use restriction, removal of a restriction, or zoning is consistent with

the City of Cape Coral Comprehensive Land Use Plan. The proposed rezoning is compatible with the future land use classification proposed for the subject properties, and is in accordance with guidance standards for the placement of this zoning designation as identified within the Land Use and Development Regulations.

Public Notification This case will be publicly noticed as required by LUDR, Section 8.3.2.A as further described below. Publication: A legal ad will be prepared and sent to the News-Press announcing the intent of the petitioners to rezone the property described within this report. The ad will appear in the News-Press a minimum of 10 days prior to the public hearing scheduled before the Planning and Zoning Commission. Following the public hearing before the Commission, the ad announcing the final public hearing before the City Council will appear once in the News-Press. The ad will appear in the newspaper not less than 10 days prior to the date of the final public hearing before the City Council. Written notice: Property owners located within 500 feet from the property line of the land which the petitioners request to vacate will receive written notification of the scheduled public hearings. In addition, all property owners serviced by the alley proposed to be vacated with receive written notification. These letters will be mailed to the aforementioned parties a minimum of 10 days prior to the public hearing scheduled before the Planning and Zoning Commission. Posting of a Sign: A large sign identifying the case and providing salient information will be posted on the property, as another means of providing notice of the rezoning request. Recommendation:

Planning staff has reviewed this request in accordance with Section 8.7 Amendments, .3 Consistency with the Comprehensive Plan and General Standards A., B. 1.-10 of the Land Use and Development Regulations and the City’s Comprehensive Plan. Therefore, the Planning Division recommends approval.

AN ORDINANCE AMENDING THE CITY OF CAPE CORAL COMPREHENSIVE PLAN

BY AMENDING THE FUTURE LAND USE MAP FROM MULTI FAMILY RESIDENTIAL

(MF) TO COMMERCIAL/PROFESSIONAL (CP) LAND USE FOR PROPERTY DESCRIBEDAS LOTS 27-46, BLOCK 2162, UNIT 32, CAPE CORAL SUBDIVISION; PROPERTYLOCATED AT THE INTERSECTION OF KISMET PARKWAY AND ANDALUSIA

BOULEVARD; PROVIDING SEVERABILITY AND AN EFFECTIVE DATE.

WHEREAS, the City of Cape Coral on February 13,1989, adopted a Comprehensive Plan pursuantto the Comprehensive Planning Act; and

WHEREAS, as part of the Comprehensive Plan the City of Cape Coral adopted therewith a futureland use map designating land uses and proposed land uses throughout the City of Cape Coralconsistent with the Comprehensive Plan and Comprehensive Planning Act; and

WHEREAS, the City of Cape Coral City Council has considered the testimony, evidence, anddocumentation for the Land Use Amendment initiated by HARRY M. SECTION 3. Effective Date. The effective date of this small scale development amendment to theComprehensive Plan shall be thirty-one (31) days after the adoption of this ordinance. Alternatively,if the small scale development amendment adopted by this ordinance is challenged by an "affectedperson" within thirty (30) days after adoption, then the effectivedate of this amendment shall be thedate upon which either the state land planning agency or the Administration Commission issues a"final order" determining that this small scale development amendment is "in compliance" asprovided in Section 163.3187(5), Florida Statutes.
