Each Institutional Superintendent, 37 Private/Regional Warden, and Director of Offender Services will determine these areas. 38 39 Residential Stability Codes - These codes are utilized to flag resident status when inmates are 40 being considered for assignment to unfenced institutions and outside assignments. This code is 41 an indicator of potential escape risks and extensive criminal activity. It does not replace a 42 manual review of the institutional record. 22-01-01 (u) Forms

43 National Crime Information Center INCIC) - A document that provides and maintains accurate 44 and timely criminal information to include but not limited to prior, current and/or charges without 45 dispositions which must be considered for reclassification actions. An incomplete NCIC is one 46 where the disposition on a previous (and not the current offense/charge) is questionable in 47 terms of whether the charge is still pending. 48 49 PROCEDURES: 50 51 Administration of Correctional Agencies (Central Office): Written agency policy provides that 52 all inmates/juveniles/residents are classified into the most appropriate security and 53 program level. The policy covers the minimum: 54 55 • classification plans 56 • classification status reviews 57 • pre-parole progress reports 58 • special needs [2-C0-4B-01]. 59 60 General 61 62 Adu/t Correctional/nstitutions: Written policy, procedure, and practice provide for a written 63 inmate classification plan. The plan specifies the objectives of the classification syste", 64 and methods for achieving them, and it provides a monitoring and evaluation mechanism 65 to determine whether the objectives are being met. The plan is reviewed at least annually 66 and updated as needed [4-4295]. 67 68 Institution/Facility Classification Authority 69 70 The Institutional/Facility Authority for each classification action will be governed by the 71 Classification Flow Chart (Form 14). 72 73 At state institutions, the Director or Assistant Director of Offender Services (ADOS) will approve 74 all decisions regarding classification actions prior to making the clarification action final for the 75 following: 76 77 • inter-facility transfers 78 • custody changes 79 • trusty status 80 • sensitive placement 81 82 At private/regional facilities, the Director or Assistant Director of Offender Services (ADOS) will 83 approve all decisions regarding classification actions prior to making the clarification action final 84 for the following: 85 86 • inter-facility transfers 87 • custody changes 88 • trusty status 89 90 Wardens at private/regional facilities who house state offenders will be the approving authority 91 for Sensitive Placement job aSSignments within their institution pursuant to established MDOC 92 guidelines and criterion.

93 Court order return offenders (except civil court orders signed by a chancery court judge) must 94 process through CMCF Offender Services Department prior to transfer or return movement to 95 former housing, state institutions, private, regional or satellite facility. 96 97 If a court order offender (except civil court orders signed by a chancery court judge) returns to 98 Mississippi State Penitentiary (MSP) or South Mississippi Correctional Institution (SMCI), the 99 respective Offender Services department will arrange movement to Central Mississippi

100 Correctional Facility (CMCF). 101 102 Exceptions will be approved by the responsible ADOS with justification entered in the Offender 103 Trak Offender Log Record. 104 105 In cases of an emergency, approval must be obtained from the Director of Offender Services or 106 designee for an offender not to transfer to CMCF as a court order return. 107 108 Housing of Offenders 109 110 Immediate family members may be housed together in Community Work Centers, state III institutions, private, and regional facilities ONLY at the discretion of the Commissioner. 112 113 If bed space is not available, the offender will be retained until bed-space is available at the 114 designated facility or the Classification Hearing Officer makes reassignment. lIS 116 An offender with a past or present conviction for felony escape is prohibited from being housed 117 at a Regional Correctional Facility without the authorization of the Commissioner. 118 119 Classification Plan Objectives 120 121 Adult Correctional Institutions: Written policy, procedure, and practice provide for 122 identification of special needs inmates [4-4305]. 123 124 Adult Correctional Institutions: The classification system specifies the level of custody 125 required and provides for a regular review of each classification [4-4296]. 126 127 Adult Correctional Institutions: iThe classification plan provides for maximum involvement 128 of representation of relevant institutional programs and the inmate concerned in 129 classification reviews [4-4297]. 130 131 Adult Correctional Institutions: The institution or parent agency solicits and uses pre 132 institutional assessment information regarding the· mate's progress and adjustment [4-133 4298]. 134 135 Adult Correctional Institutions: iThe classification plan specifies that prior to a parole 136 hearing a progress report is made available to the paroling authority. The report 137 includes a current and complete history of the inmate's activities in the institution and a 138 proposed parole plan [4-4304].

National Crime Information Center (NCIC) 240 241 • A NCIC will be required on all reclassification actions. Once a NCIC is received on an 242 offender it is valid for one year thereafter. Violent criminal information on NCIC must 243 have a disposition. To obtain a disposition for criminal information: 244 245 1. 281 Adult Correctional Institutions: he classification plan specifies criteria and procedures fo~ 282 determining and changing an inmate's program status; the plan includes at least one 283 level of appeal [4-4301], 284 285 An offender may appeal the decision of the Classification Hearing Officer through the offender 286 grievance process. 287 288 Initial Classification 289 290 Adult Correctional Institutions: At initial classification, each inmate is assigned to a staff 291 member to ensure supervision and personal contact; a unit management team may 292 perform this function [4-4299]. 293 294 All newly committed offenders will be received at the Reception Center at the Central 295 Mississippi Correctional Facility (CMCF) for admission and orientation as set forth by policy and 296 procedure. The offender will be assigned to an Admission & Orientation Case Manager during 297 the reception and orientation process. 298 299 While in admission and orientation status. all offenders are automatically unclassified offenders 300 and may be housed in maximum-security units. Unclassified offenders housed in maximum-301 security units are not permitted outside their assigned unit unless they are in full restraint gear. 302 303 These offenders have not been classified by the Mississippi Department of Corrections and 304 cannot participate in work programs outside the secure perimeter of a correctional facility. 305 306 Offenders that have insufficient data to build a profile for initial classification will remain 307 unclassified until such time the appropriate information has been collected and evaluated by 308 staff for completion of initial assessment. 309 310 Upon completion of initial classification, offenders will be transferred to a designated facility as 311 soon as it is reasonably possible to begin their incarceration program. 312 313 Reclassification Actions 314 315 Adult Correctional Institutions: irhe written plan for inmate classification specifies that each 316 inmate's classification status is reviewed at least every 12 months [4-4300). 317 318 Adult Correctional Institutions: ritten policy, procedure, and practice require that unless 319 precluded for security or other substantial reasons, all inmates appear at their 320 classification hearing and are given notice 48 hours prior to the hearing; such notice may 321 be waived by the inmate in writing [4-4302]. 322 323 Adult Correctional Institutions: Written policy, procedure, and practice specify the 324 conditions under which an inmate can initiate a review of progress and program status 325 [4-4303], 326 327 The classification plan specifies that each offender's classification status will be reviewed at 328 least every 12 months to assess the appropriateness of the individual's classification plan 329 and/or program(s), and his needs as well as the institution's needs.

330 Request for reclassification will be initiated through the assigned Case Manager as follows: 331 332 • Request from Offenders 333 • Request from Staff 334 • Request from Non-Staff Members 335 336 Offender Statuses (Not Custody Levels) 337 338 Protective Custody 339 340 A form of separation from the general offender population where the offender has requested or 341 the administration concludes that the continued presence in general population would pose a 342 threat to life, property, self, staff, other offenders or the security and/or orderly running of the 343 facility. 344 345 Administrative Segregation 346 347 This is a form of separation from the general population, where the continued presence of 348 an inmate is believed to be a threat to the security and/or orderly running of the facility. 349 350 Death Row 351 352 An offender committed to the Mississippi Department of Corrections under the sentence of 353 death will be classified as a "Death Row" prisoner and housed in a unit deemed appropriate by 354 the Commissioner of Corrections. 355 356 Custody Levels 357 358 The Classification Hearing Officer will recommend custody levels based on objective criteria. 359 360 The following is a list of three (3) custody levels to which an offender may be assigned: 361 362 • Close 363 • Medium 364 • Minimum 365 366 Close Custody 367 368 This custody is the highest risk general population inmate and has one or more of the below risk 369 factors: 370 371 • risk of escape 372 • periodic demonstrated as a threat to staff/inmates 373 • recent or serious disciplinary record 374 375 This custody requires close supervision where the offender must be under positive security 376 control at all times.

377 Close Custody Supervision 378 379 Offenders assigned to Close custody in the general population will be confined to a security cell 380 or dormitory unit. Close custody offenders housed in the general population will be housed with 381 the same custody offenders. 382 383 Close custody offenders may be restricted for security reasons from some or all work/program 384 assignments, as well as from specific parts of the institution as deemed appropriate for security 385 reasons by the SuperintendentlWarden/designee of that institution. 386 387 For some Close custody offenders, movement inside the perimeter of the housing unit may be 388 unescorted, but it will be continuously observed by correctional staff. 389 390 The supervision for a Close custody offender inside the unit perimeter will include constant 391 supervision and observation by correctional staff. 392 393 An offender being escorted outside of the unit perimeter will be in full restraints. A minimum of 394 two correctional officers, one of whom will be armed, will escort the offender at all times. 395 396 Offenders who are assigned to authorized work details outside of the unit perimeter will not 397 require restraints. 398 399 All offenders assigned to Close custody will wear a uniform designated by the Commissioner of 400 Corrections. 401 402 Medium Custody 403 404 This is a medium security status where the offender has displayed a desire to be considered 405 responsible and presents a moderate risk. 406 407 This custody level offender is housed in a medium security correctional facility and must be 408 under direct/constant armed correctional supervision when engaging in activities outside the 409 perimeter of the correctional facility. 410 411 Offenders are permitted to move about the housing unit or security work area, but are to be 412 within direct observation of correctional staff. 413 414 Minimum Custody 415 416 This is a minimum custody, which affords the offenders a more relaxed atmosphere and an 417 extension of privileges. 418 419 This custody requires the ability to work satisfactorily with minimum supervision or security 420 control. 421 422 Minimum custody offenders will be placed in one of the following statuses: 423 424 • Community Minimum Status - This custody has the least security and supervision required 425 of an offender. Usually this type offender works in the community.

426 • Non-Community Minimum Status - This custody has the least security and supervision 427 required of an institutionalized offender. Usually this type custody is housed under minimum 428 security circumstances and may participate in activities on institutional grounds without 429 direct staff supervision. Off grounds, the offender must be supervised by trained 430 correctional staff. 431 432 Upgrade to Minimum Custody 433 434 The Classification Hearing Officer will take into consideration the following factors when 435 recommending upgrade to minimum custody: 436 437 Community Minimum Status Eligibility 438 439 • Sentences that are within sixteen (16) years of earliest release date may be considered for 440 CWC placement and must be receiving or eligible to receive 30/30 Trusty Earned Time. 441 442 • Those offenders who do not qualify for 30/30 trusty status must be within eight (8) years of 443 their earliest release date 444 445 • Offenders must be within twelve (12) months of earliest release date for placement 446 consideration in a Community Pre-Release Program (Reference SOP 27-02-01) 447 448 • Escapes from county jails or institutions which are over five (5) years old will be considered 449 on a case by case basis. 450 451 • Breach of trust and absconding supervision will be considered on a case by case basis 452 453 The classification hearing officer will closely investigate the circumstances surrounding escapes, 454 breach of trust, or absconding to determine if the offender is a potential escape risk. 455 456 Ineligible for Community Minimum Status 457 458 • Past or present sex offenders 459 460 • Violent offenders will not be considered for CWC placement, Mobile Work Crew, Joint 461 State/County Work Program or work crews outside the institution. Offenders with violent 462 offenses (No current or prior sex offense) may be considered for Community Pre-Release 463 Programs if otherwise eligible for the previous programs 464 465 • Sentence of death, habitual life, life with parole or life without parole 466 467 • Requirements for Medium or Close custody 468 469 • RVR for assault within the past twelve (12) months 470 471 • RVR of any type in the past three (3) months 472 473 • Escape from a county jail or institution within the last five (5) years

523 Sensitive Placement Work Assignments 524 525 Sensitive Placement is an offender's job assignment or work place which requires integrity, 526 responsibility or security precaution. These job assignments will be reviewed by each 527 institutional MDOC Superintendent or Private/Regional Facility Warden. Approving Authority is 528 determined by the Classification Flow Chart.
